WHEREAS, on August 10, 1971 the Corporate Authorities of the Village of
Oak Brook passed Ordinance No. S-237, which approved a special use for the
property hereinafter described for construction of a church sanctuary and
steeple; and
WHEREAS, on October 28, 1975 and October 25, 1983, the Corporate
Authorities of the Village of Oak Brook passed Ordinance Nos. S-346 and S-511
respectively, which amended the aforementioned special use by permitting
additional parking; and
WHEREAS, the owners of said property have applied to the Village for an
amendment to said special use to permit construction of two additions to the
,Church, additional parking spaces and various roadway and grading modifications;
and
WHEREAS, the Plan Commission on February 17, 1986 recommended approval
of the requested amendments to the special use; and
WHEREAS, a public hearing thereon was conducted by the Zoning Board of
Appeals of the Village of Oak Brook on March 4, 1986 and April 1, 1986, pursuant
to due and appropriate legal notice; and
WHEREAS, a recommendation has been made by both the said Zoning Board
of Appeals and Plan Commission that the amendment to special use be granted; and
WHEREAS, the President and Board of Trustees concur with the
recommendations of the Zoning Board of Appeals and Plan Commission and deem the
passage of this Ordinance to be in the best interest and in furtherance of the
general welfare of the Village of Oak Brook, subject to the conditions .and
restrictions set forth below;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows.
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: The the special use granted pursuant to Ordinances Nos.
S-237, S-346 and S-511 be and are hereby further amended to permit the
construction :of two additions to the Church, 136 additional parking spaces and
various roadway and grading modifications hereinafter described.
Section That the amendment to the special use permit herein granted
pursuant to Section 2 of this Ordinance is expressly subject to compliance with
the following:
A. That construction of the additions to the Church be in accordance
with the plans prepared by C. Edward Ware Associates, Inc. ,
Architects, Sheets S-7 and S-8, dated as last revised March 24,
1986, a copy of which is attached hereto as Exhibit A.
B. That construction of the 136 additional parking spaces, landscaping
and roadway and grading modifications be in accordance with the
Site Development Landscape Plan prepared by C. Edward Ware
Associates, Inc. , Architects, Sheet SD-1, dated as last revised
March 24, 1986, a copy of which is attached hereto as Exhibit B,
and in accordance with the plan entitled "Parking Lot Entry and
Detention Improvement - Christ Church of Oak Brook", Job No. 85-184
dated December 18, 1985 and prepared by Edmund M. Burke &
Associates, Ltd. , Consulting Engineers, a copy of which is attached
hereto as Exhibit C.

C. That the owner of the property provide additional plantings along
Oak Brook Road to screen the existing parking lot.

Section 4: That this Ordinance is limited to property located at 501
Oak Brook Road and 3202 York Road, Oak Brook, Illinois, which property is legally
described on Exhibit I, which is attached hereto and hereby made a part hereof.

Section 5: That except as amended hereby the special use granted
pursuant to Ordinances S-237, S-346 and 5-511 be and the same is hereby ratified
and confirmed in all respects.

and after its passage and approval pursuant to law.

Dear President and Board of Trustees:
At the Zoning Board of Appeals meeting of April 1, 1986, Christ Church presented
plans for their proposed building additions which do not encroach in the 100-foot
setback area adjacent to York Road. Consequently, the Church has withdrawn its
request for a Variation to the 100-foot setback requirement.
Turning to the Church's request for an amendment to the Special Use Permit, much
of our discussion centered on the additional parking requested by the Church.
After much discussion, a motion was made by Member Bartecki that the Zoning Board
recommend that the request for an amendment to the Special Use Permit, which
includes additional parking, be denied, because no additional parking is needed
and would injure surrounding property values. The motion died for a lack of a
second.
A motion was made by Member Crouch, seconded by Member Martinello to recommend
to the President and Board of Trustees that the applicant's proposed amendment to
the Special Use Permit be granted because it would not alter the essential character
of the neighborhood, provided that the applicant provides plantings along Oak Brook
Road and the 40-foot setback area on the East and South sides of the proposed parking
area and provided further that the applicant grant a bike path easement along York
Road, if so requested by the Village.
This motion was approved on a Roll Call Vote of four (4) ayes: Members Crouch,
Martinello, Shumate and Chairman Savino; one (1) nay: Member Bartecki; two (2)
absent: Members O'Brien, Weber.

SUBJECT: Christ Church Resubdivision - Final Plat
I have reviewed the revised final plat received on March 19, 1986 and offer the
following comments:
A. MAJOR ISSUES
1. The Village Board must decide whether they will require a dedication of York
Road within the southerly portion of the subject subdivision. Until that
happens, the plat cannot be finalized.
2. Consideration should be given to requiring the applicant to grant a ten (10')
foot bicycle easement along the easterly lot line.
The DuPage County Division of Transportation has informed us that the improve-
ments to the intersection of 31st/York could move the existing ditch line on
York Road westerly toward the right-of-way line. If this should happen, it
would then be difficult to construct the bike trail strictly within the right-
of-way. Therefore, it appears appropriate that the applicant grant the ten
(101) foot wide bicycle easement so that the bicycle trail can be constructed
in the most feasible location.
3. Consideration should be given to having the applicant construct the bike trail.
This would be in keeping with the most recent subdivision submittal of the
McDonald's Spring Road Resubdivision #1 in which the Village required that
the applicant construct a sidewalk as the only public improvement.
B. MINOR ITEMS
1. Several minor drafting items remain to be revised on the plat.
2. The boundary survey information on the plat does not correlate with two (2)
surveys previously submitted by the applicant with his application. Although
we discussed these discrepancies with Rev. DeKruyter and Ed Ware on
March 10, 1986, their surveyor has not contacted me regarding the discrepan-
cies.

The Plan Commission, at its regular meeting of March 17, 1986, considered the
Application of Christ Church for a Resubdivision Plat which would consolidate
their existing property at 501 Oak Brook Road with the Novacek property at
3202 York Road, which has recently been purchased by the Church.
The Plan Commission recommends to the President and Board of Trustees approval
of the Subdivision Plat as presently drawn which includes a 50 foot dedication
of York Road adjacent to the Novacek parcel, subject to the following conditions:
1) Addition of a 10 foot wide bicycle path easement along the easterly
lot line adjacent to York Road.
2) The bicycle path along the easterly lot line be constructed in con-
junction with the Church's development of the property.
3) Conformance with all other review items as required by the Village
Engineer.
This recommendation was made on a motion by Member Beard, seconded by Member
Antoniou and approved on a roll call vote of six (6) ayes, Members Antoniou,
Beard, Doyle, Haglund, Stachniak, Chairman Marcy, zero (0) nays, one (1) absent,
Member Sandstedt.

VI CHRIST CHURCH RESUBDIVISION — FINAL PLAT
No one was present representing the Church in this application.
Commission members proceeded to discuss the review items contained in Dale Durfey's
March 13th memo. There was general agreement that the Church should dedicate York
Road right-of-way adjacent to the Novacek parcel and should grant a bicycle path
easement along the West side of York Road.
Member Doyle indicated that the Church should be required to build the bicycle path
in exchange for its expanded development into a residential area, and for the fact
that the bicycle path construction would constitute only a small part of their
overall development cost.
In answer to Commission questioning, Staff noted that the requirement to construct
bicycle paths is generally made in lieu of the Subdivision requirement for
sidewalks.
The Chairman noted that there were no members of the audience expressing support
for or opposition to the proposed application.
A motion was made by Member Beard, seconded by Member Antoniou to recommend to the
President and Board of Trustees approval of the Subdivision Plat as presently drawn
which includes a 50-foot dedication of York Road adjacent to the Novacek parcel
subject to the following conditions:

The Zoning Board of Appeals, at its March 4th meeting, at the applicant's request,
continued the above applications to its April 1st meeting. As you may recall, the
original Development Plans showed the location of two building additions located
partially within the 100-foot setback from York Road.
The Church has submitted revised Development Plans, including Sheets SD-1, S-7
and S-8 all revised March 24, 1986, indicating conformance with the 100-foot
setback. As such, the current Plans no longer require a Yard Variation and
simply require the Village's approval of the development as proposed as a
modification to their existing Special Use Permit for operation of a church
within this residentially zoned district.

The Secretary noted that the required Legal Notice was published in the Suburban
Life GRAPHIC on February 15, 1986 and that surrounding property owners were
notified of this hearing on February 12, 1986.
The following persons were present representing this application: George Howell,
Jeff Jensen, Don Basta, Ed Ware, architect; Gene Elliott, architect; John Reemer,
engineer.
Mr. Howell gave a brief history of the Christ Church development noting that the
proposed additions will help the Church meet the increased need for additional
counselling and pre-school areas as well as an expanded Fellowship Hall. He noted
that the Church presently has 4500 members and that 90 percent of the people
utilizing the counselling and pre-school areas are non-members. The proposed
addition will add 27,000 square feet of floor area resulting in a total of 100,000
square feet.
Edward Ware, architect for both the original development as well as subsequent
additions, noted that the proposed additions would best be located as proposed due
to the relationship between existing and proposed uses inside the building. He
also noted that the proposed drive-up entrance to the new additions will provide
access as both a drop-off point for children to the pre-school area, handicapped
access to a new elevator, as well as deliveries to the kitchen area.
Mr. Howell stated that the two additions will encroach into the required 100-foot
setback from York Road , one resulting in a 58-foot yard and the other resulting in
a 70-foot yard. He noted that the additions, as designed, are made to conform
architecturally as well as functionally with the existing building. He stated that
the hardship involved with the requested variation relates to the functional needs
of the Church's interior and that to locate the additions elsewhere would cause
substantial hardship on the workings of the Church. He stated that this request is
unique since the property is a one-of-kind property and, therefore, would not set a
precedent. He also noted that at the time the original Church was built, although
there was a 110-foot setback from the center line of Oak Brook Road, the required
setback from York Road was only 50 feet, and that the 100-foot setback was added to
the Zoning Ordinance at a later time. Referring to an aerial view of York Road,
Mr. Howell noted that 15 of 20 existing buildings are non-conforming, since they
lie within the 100-foot setback.
Reverend DeKruyter arrived at this point of the meeting and gave a brief history of
the Church's development as well as current needs. He noted that the proposed
additions are needed to serve a currently overcrowded condition in the classrooms,
counselling areas and Fellowship Hall.
Chairman Savino inquired as to whether the additions could be located on the West
side of the Church, and still not affect the parking area.

Mr. Ware stated that a small parking lot to the West would be affected, which
presently serves as an access point for handicapped individuals, choir members and
Church members. He also noted that since a pre—school presently exists on the East
side of the structure, to place the proposed pre—school addition on the West would
require a duplication of playground areas, washroom and other items required by the
State for pre—schools. He further noted that the proximity of a required
playground adjacent to the existing detention basin would provide a substantial
safety problem. Mr. Ware further noted that the plans call for substantial
landscape screening of the proposed parking area, which has been set back 40 feet
from adjacent residential properties. He further noted that only two points of the
proposed addition lie within the 100—foot setback, and that the requested
encroachment is not for the entire width of the addition.
In response to Chairman Savino, Mr. Ware stated that the proposed additions could
not be slid further West, as such would cause certain structural construction
problems, alter any roof continuity with the existing building, and block the view
from existing windows.
In response to Member Bartecki , Village Engineer Dale Durfey stated that the
proposed York Road widening at the intersection would add one lane and, therefore,
6 feet of pavement on either side of the existing roadway.
Member Crouch stated his concern that the addition with the greater encroachment is
located closer to the intersection.
Member Martinello suggested that the current play area adjacent to the pre—school
located near York Road is a safety hazard.
Reverend DeKruyter stated that the play area presently exists in that location,
based on State requirements, which call for a play area to be directly adjacent to
pre—school rooms.
In response to Member Bartecki , Reverend DeKruyter stated that the parking area is
always filled during the 9:30 service and sometimes during the 11 A.M. service.
Member Weber suggested that perhaps the Church has reached the site's capacity and
that perhaps in its attempts to serve all comers, including non—Church members, the
Church has perhaps become too successful. He suggested that if the Village were to
allow this type of variation, then they would be required to do so when other
properties came to the Village requesting similar variations.
The Reverend suggested that a church is a different type of operation than a
commercial operation, since there is no monetary gain from the proposed
construction.

Member Weber stated that his concern was based on the intensity of use for a given
property, which does not take into consideration whether the property is utilized
by a commercial venture as opposed to one which is non-profit in nature.
The Reverend inqured as to whether the Zoning Board was saying that the Church
would be unable to expand its ministry.
Chairman Savino stated that expansion on any given property can't go on
indefinitely.
In response to Member Bartecki , Mr. Ware stated that if the parking lot were
redesigned to conform to the Village's new office parking space dimensions, they
would only gain 13 additional spaces, but since the property is non-office in use,
to utilize such new standards would require an additional variation.
The Chairman noted that there were no members of the audience expressing support
for or opposition to the proposed Variation.
Mr. Howell requested that this item be continued to the April 1, 1986 Zoning Board
hearing in order to allow time for the Church to review possible alternatives to
the current proposal.
A motion was made by Member Weber, seconded by Member Bartecki to table this
subject to the April 1, 1986 Regular Meeting of the Zoning Board of Appeals as
requested by the applicant.

A long time source of worry has been the constant
threat of the widening of York Road, and with the
pedestrian-bicycle path about to be completed on the

elimination of the prns?nt church entrance on York
Road, so close to the busy Oak Brook Road/York inter-
section, appears undesirable.

SUBJECT: Christ Church - Special Use and Yard Variation
(501 Oak Brook Road)
Christ Church of Oak Brook has proposed construction of two building additions and
additional surface parking adjacent to the existing Church. Since a church is a
permitted special use within a residential district, any modifications to the
property require review and approval by the Village.
As can be seen on the Site Plan, a new parking area is proposed directly South of
the existing Church extending onto what is now occupied by the Novaceks, who
presently reside at 3202 York Road. The Church is in the process of purchasing the
Novacek parcel and based on this plan, will construct surface parking within the
rear two-thirds of the Novacek parcel. Plans are for the Novaceks to have a life
estate permitting them to continue their residence on the property. One of the
plans also shows future plans to construct additional surface parking to within
100 feet of York Road once the Novaceks leave the property, although such is not
proposed at this point in time.
The Church is also planning on constructing two building additions to the East of
the existing Church as shown on both the Site Plans and the proposed Floor Plans.
These additions extend up to 43 feet into the required 100-foot setback adjacent
to York Road. In this regard, the Church has also applied for a setback variation.
Directly East of these additions is a new roadway/turnaround area which will provide
additional access to the Church.
The Zoning Board, in its review of the requested setback variation, should determine
that the proposal meets the standards of the Zoning Ordinance as contained in
Section XIII(G) , pages 966-969. The specific standards relative to the granting of
a Special Use Permit are contained in Section XIII(J) , pages 971-973.
The Plan Commission, at its meeting of February 17, 1986, recommended approval of
the requested Special Use Permit as noted by Chairman Marcy's letter contained in
the Special Use file.

The Plan Commission, at its regular meeting of February 17, 1986, considered the
application of Christ Church of Oak Brook for an amendment to their Special Use
Permit which would permit construction of two building additions and surface
parking areas.
The Plan Commission recommends to the President and Board of Trustees approval
of the amendment to their Special Use Permit based on the plans as presented and
subject to approval by the Village of the required setback variation and approval
by Village Staff of all necessary building plans.
This recommendation was made on a motion by Member Beard, seconded by Member Haglund
and approved on a Roll Call Vote of five (5) ayes: Members Beard, Haglund, Sandstedt,
Stachniak, Chairmam Marcy; one (1) nay: Member Doyle; one (1) absent: Member
Antoniou.
Following the motion, Plan Commission members indicated that their recommended approval
of the current parking plan in no way implies approval of the area noted as "future
parking, 97 spaces" as shown on one of the Site Plans.

Various representatives from the Church were present representing this application.
Mr. Elliott, of Edward Ware & Associates, Architects, gave a brief history of the
property noting that it presently contains 18+ acres and there are proposed
construction of two building additions, surface parking and landscaping for the
purpose of screening. With respect to the setback Variation, Mr. Elliott stated
that they had failed to realize the need for a 100-foot Setback adjacent to York
Road. He noted the proposed setback encroachment along York Road and that such was
required based on the interior floor plan of both the existing and proposed
buildings. He further noted that the Novacek property at 3202 York Road, which is
proposed to be partially utilized for surface parking, will remain as a life estate
residence for the Novaceks, and that at such time as the Novaceks leave the
property, future plans are to construct an additional 100 parking spaces replacing
the residence.
In response to Chairman Marcy, Mr. Elliott stated that the reduced setback adjacent
to the additions would not have any detrimental effect upon the neighborhood, since
a number of other existing residences are presently located closer to the right of
way.
In response to Member Stachniak, the Church representatives noted that the Church
requires the additional parking whether or not the building additions are
constructed based on the fact that the parking lot is presently filled to capacity
at the 9:30 Sunday service.
In response to Member Haglund, Mr. Elliott stated that additional storm water
detention will be provided in the existing southerly detention lake with tiered
railroad ties and an enlargement of the bottom of the existing lake.
In response to Member Doyle, Mr. Elliott stated that in conjunction with the
additional parking on the Novacek lot, some filling will be required in order to
meet the grade of the existing parking lot, that numerous storm water inlets will
pick up the additional storm water from the parking lot, and that landscaped berms
and curbing around the parking area will prevent storm water from washing onto
other properties.
Member Doyle suggested that the proposed cul-de-sac turnaround at the easterly edge
of the new additions would be a traffic hazard, since cars utilizing this
turnaround could back up toward York Road causing a hazard for other vehicles
entering the site.
Church representatives noted that the proposed turnaround area was created to
provide an additional entrance to the Church as well as provide an easy entrance
for children utilizing the new wing, handicapped inaividuals, since an elevator
will be provided near that entrance, and for small delivery trucks.
Edward Ware noted that future plans call for relocation of this new driveway
further South onto the Novacek property ,thus providing more vehicle storage room
for the drop-off area.

Member Sandstedt noted that the existing entrance off of 31st Street has less
stacking room than the proposed entrance, and that the proposed is, therefore, a
better design. He also suggested that construction of a berm adjacent to the
turnaround would prevent headlights from the circle causing confusion for traffic
on York Road.
Member Doyle expressed his concern with the proposed encroachment of a parking area
further into a residential neighborhood.
Church representatives noted that proposed landscaping includes a solid bank of
existing trees which will be relocated to screen the new driveway and proposed
parking area from view from the East and South.
A motion was made by Member Beard, seconded by Member Haglund to recommend to the
President and Board of Trustees approval of the requested amendment to their
Special Use Permit which would permit construction of two additions and additional
surface parking based on the plans as presented subject to approval of the required
setback Variation and approval of all building plans by Village departments.

SUBJECT: Christ Church - Special Use
(501 Oak Brook Road)
Christ Church of Oak Brook is proposing construction of additional surface parking
and two additions to the existing church. Since this property is located within
a Residential District, it originally received a Special Use Permit for construction
of a church pursuant to Ordinance S-237 approved August 10, 1971. Since special use
permits are generally tied to a specific level of development, each time the Church
chooses to construct any additional structures on the property, it requires approval
of a modified Special Use Permit approving such structures. It should be noted that
the additional parking area to the South of the Church will be ,constructed on the
back two-thirds of the property at 3202 York Road. This lot is presently occupied
by a single-family residence, and it is my understanding that the Church is pro-
posing a purchase of this lot to allow construction of the parking as proposed.
The existing residence will remain as a life residence for the current property
owner. In this regard, the Church is also preparing a Subdivision Plat which will
join 3202 York Road to the existing Church property.
The two additions to the Church presently show up to a 43-foot encroachment into the
100-foot required setback along York Road. The Church's application for a Setback
Variation will be heard by the Zoning Board of Appeals in March. I also refer you
to Dale's February 13th memo concerning his review of the engineering items relative
to this application.
The Plan Commission, in its review of special use applications, is required to utilize
the provisions of Section XIII(J) of the Zoning Ordinance, copy attached. This section
notes certain review criteria to be utilized by the Plan Commission as well as certain
conditions which could be recommended associated with the proposed Special Use Permit.
In the way of history, up until this date, the Church has received the following types

any proposed amendment in accordance with applica-
ble Illinois Statutes, or may refer it back to the Boards
for further consideration.
(5) Re-Applications: Any person, firm, or corporation
having been denied an amendment to the Zoning
Ordinance respecting a specific parcel of property may
not re-apply for a like amendment on said real
property until the period of one (1) year has elapsed
since the denial of the application for amendment by
the President and Board of Trustees. (Ord. No. G-137,

(J) Special Uses.
(1) Purpose: The development and execution of the zoning
ordinance is based upon the division of the Village
into districts, within any one of which the use of land
and buildings and the bulk and location of buildings
or structures, as related to the land, are essentially
uniform. It is recognized, however, that there are
special uses which, because of their unique character,
cannot be properly permitted in particular districts
without consideration, in each case, of the impact of
those uses upon neighboring lands and upon public
need for the particular use or the particular location.
Such special uses fall into two categories:
(a) Uses operated by public agency or publicly-regu-
lated utilities, or uses traditionally affected with a
public interest.
(b) Uses entirely private in character, but of such a
nature that the operation may give rise to unique
problems with respect to their impact upon
neighboring property or public facilities such as,
but not limited to, single-family attached and
semi-detached dwellings, horizontal condomini-
ums and other residential developments. (Ord. No.
G-66, 12-19-66)

Sec. XIII OAK BROOK CODE
(2) Authority. Special uses shall be authorized or denied
by the Village Board in accordance with the Statutes
of the State of Illinois applicable to amendments of
this ordinance, and the regulations and conditions set
forth in this ordinance for special uses.
No application for a special use shall be acted upon by
the Village Board until after:
(a) A written report is prepared and forwarded to the
Board of Appeals and the Village Board by the
Plan Commission in a manner prescribed herein
for amendments to this ordinance; and
(b) A public hearing has been held by the Zoning
Board of Appeals, after due notice by publication
as provided by the applicable Statutes of the State
of Illinois for amendments and upon a report of
the Plan Commission to the Board of Trustees, if
such a report is made.
(3) Initiation: An application for a special use may be
made by any person, firm or corporation or by any
office, department, board, bureau or commission
requesting or intended to request a zoning certificate.
(4) Processing. An application for a special use, in such
form and accompanied by such information as shall
be established from time to time by the Plan
Commission, shall be filed with the Village Clerk and
thereafter processed in the manner prescribed thereto-
fore for applications and amendments. Special use
applications may be processed simultaneously with
requests for amendment of this ordinance. (Ord. No.
6-66, 12-19-66)
(5) Decisions: The Village Board, upon report of the
Zoning Board of Appeals and the Plan Commission,
and without further hearing, may authorize or deny
an application for a special use in accordance with the
Statutes of the State of Illinois applicable to amend-
ments, or may refer it back to the Board of Appeals
and the Plan Commission for further consideration.

APPENDIX A—ZONING Sec, XIII
No special use shall be authorized by the Village
Board unless the special use:
(a) Is of the type described in Section XIII J-1 (a) is
deemed necessary for the public convenience at
that location. (Ord. No. G-66, 12-19-66);
(b) Is so designed, located and proposed to be
operated that the public health, safety and welfare
will be protected; and
(c) Would not cause substantial injury to the value of
other property in the neighborhood in which it is
located.
(6) Conditions: The Plan Commission and Zoning Board
of Appeals may recommend, and the Village Board
may provide, such conditions and restrictions upon
the construction, location and operation of a special
use, including, but not limited to, provisions for
off-street paridng and loading as may be deemed
necessary to promote the general objectives of this
ordinance and to minimize the injury to the value of
the property in the neighborhood.
(K) Fees.
Fees for any relief under this ordinance shall be as
otherwise established by separate ordinance. (Ord. No.
G-132, 5-25-71; Ord. No. G-289, § 2, 3-24-81)
(L) Violation, Penalty and Enforcement.
(1) Any person, firm or corporation who violates,
disobeys, omits, neglects, refuses to comply with or
who resists enforcement of any of the provisions of
this ordinance shall, upon conviction, be fined not less
than $25.00 nor more than $500.00 for each offense.
Each day that a violation is permitted to exist shall
constitute a separate offense.
(2) The Building Inspector is hereby designated and
authorized to enforce this ordinance. However, it shall
also be the duty of all officers, citizens and employees
of the Village, particularly of all members of the police

SUBJECT: Christ Church - Special Use
I have reviewed documents recently received on the subject and offer the following
comments:
1. The applicant's engineer has calculated that 6.38 acre feet of detention
is required for the site including the presently proposed additional
development. The proposed storage capacity of the detention facilities
will equal 6.43 acre feet; therefore, they do meet the detention require-
ment.
2. Sheet 1 of 1:
A. The benchmark from which the elevation data came from remains to be
added to the sheet.
B. One (1) storm sewer manhole rim lies below the projected high-water
level of the detention facility; therefore, this rim must be raised.
C. Several parking stalls are less than the minimum 9' x 18' size. In
this regard, the aisle adjacent to these stalls must also be reviewed
when this item is cleared up.
D. The plan stops the curb at the York Road right-of-way rather than
extending the curb to meet the edge of the York Road pavement. This
item needs to be changed.
D. The sheet proposes a fifteen (15") inch culvert for drainage but there
appears to be a flat spot within the southerly ditch line on York Road
of about forty (40') feet which needs to be revised.
3. Sheet SD-1:
A. The north arrow is incorrectly configured.
B. Several parking spaces are denoted as "C" but this notation is not
defined within any legend.
C. The elevation information needs to be revised to be U.S.G.S. datum.
D. The forty-two (42') foot width of the driveway onto York Road needs
to be revised to be a maximum of thirty (30') feet.
E. The twelve (12') foot aisle dimension southerly of the proposed cul-
de-sac needs to be twenty-four (24') feet wide for two-way access.

Dear Mr. Durfee:
As instructed by Mr. Edward Ware, the architect, we have made certain
revisions to the engineering plan for the additional parking lot and
detention for the Christ Church of Oak Brook project.
We are including for your review two-- copies of the calculations for
the detention. Using the total tributary acreage and additional
impervious area added we have revised the lower detention basin to
provide 4.69 Ac/Ft while the upper basin remains unchanged at
1.74 Ac/Ft. The computed Ac/Ft required is 6.38, provided is 6.43.
The plan has been revised to include new dimensions and minimum stall
and aisle widths for the parking lot plus adding a small turnaround
in the front of the east new building addition. We have also revised
the parking lot data, indicating number of stalls being added and
total parking after expansion. We have further provided refined
elevation -for the final grading of the parking lot. The revision
to the lower detention is self-explanatory indicating a decrease in
the shelves between the cross tie retaining wall to increase the
surface area of the lower basin. We are enclosing 18 plans for your use.

Christ Church has made application for an amendment to their existing Special Use
Permit, a Subdivision Plat, as well as a Yard Variation all related to certain
proposed modifications to their property.
Their requested waiver of all associated fees would be permitted pursuant to
Section 2-226 of the Village Code, copy attached. It is, therefore, recommended
that the Village Board consider waiving the special use fee of $400.00, the final
plat fee of $100.00 and the variation fee of $300.00 as requested.

Said fees shall be for the periodic inspection of the
improvements which are to be within public
rights-of-way or easements and not covered by
other inspection departments of the village.
(5) Resubmissions.Upon resubmission of any final plat which
has not been recorded because of noncompliance with
the provisions of Section 6 of Article VI of the Subdivi-
sion Regulations, the fees enumerated under subsections
(2), (3) and (4) hereof shall be paid, notwithstanding

—� Sec. 2-226. Waiver of Fees.
Any governmental unit or any charitable organization as
defined in "an act to regulate solicitation and collection of
funds for charitable purposes, providing for violations
thereof and making an appropriation therefor", Chapter 23
Illinois Revised Statutes 1979, Sections 5101, et sequitur,
may request waiver of any fees established in this article.
Upon such request the president and board of trustees may,
in its discretion, waive any such fees imposed pursuant to

Sec. 2-227. Other fees.
The fees established herein shall be in addition to any
other fees or charges otherwise established by ordinances of

A Variation is a zoning adjustment which permits minor changes of district require-
ments where individual properties are both harshly and uniquely burdened by the
strict application of the law. The power to vary is restricted and the degree of
Variation is limited to the minimum change necessary to overcome the inequality
inherent in the property.
1. A Variation recognizes that the same district requirements do not affect all
properties equally; it was invented to permit minor changes to allow hardship prop-
erties to enjoy equal opportunities with properties similarly zoned. You must
prove that your land is affected by special circumstances or unusual conditions.
These must result in uncommon hardship and unequal treatment under the strict ap-
plication of the Zoning Ordinance. Where hardship conditions extend to other prop-
erties a Variation cannot be granted. The remedy for general hardship is a change
of the map or the text of the Zoning Ordinance.
2. You must prove that the combination of the Zoning Ordinance and the uncommon
conditions of your property prevents you from making any reasonable use of your
land as permitted by your present zoning district. Since zoning regulates land and
not people, the following conditions cannot be considered pertinent to the applica-
tion for a Variation: (1) Proof that a Variation would increase the financial re-
turn from the land, (2) Personal hardship, (3) Self-imposed hardship. In the last
case, the recognition of conditions created after the enactment of the Zoning Ordi-
nance would encourage and condone violation of the law.
3. No Variation may be granted which would adversely affect surrounding property
or the general neighborhood. All Variations must be in harmony with the intent and
purposes of the Zoning Ordinance.

PUBLIC HEARING HELD ON THE FIRST TUESDAY OF EACH MONTH.
AMENDMENT OR
SPECIAL USE: MUST BE RECEIVED PRIOR TO THE 15TH OF THE MONTH FOR PLAN
COMMISSION HEARING ON THE THIRD MONDAY OF THE FOLLOWING
MONTH, WITH ZONING BOARD PUBLIC HEARING TO FOLLOW.
A Variation is a zoning adjustment which permits minor changes of district require-
ments where individual properties are both harshly and uniquely burdened by the
strict application of the law. The power to vary is restricted and the degree of
Variation is limited to the minimum change necessary to overcome the inequality
inherent in the property.
1. A Variation recognizes that the same district requirements do not affect all
properties equally; it was invented to permit minor changes to allow hardship prop-
erties to enjoy equal opportunities with properties similarly zoned. You must
prove that your land is affected by special circumstances or unusual conditions.
These must result in uncommon hardship and unequal treatment under the strict ap-
plication of the Zoning Ordinance. Where hardship conditions extend to other prop-
erties a Variation cannot be granted. The remedy for general hardship is a change
of the map or the text of the Zoning Ordinance.
2. You must prove that the combination of the Zoning Ordinance and the uncommon
conditions of your property prevents you from making any reasonable use of your
land as permitted by your present zoning district. Since zoning regulates land and
not people, the following conditions cannot be considered pertinent to the applica-
tion for a Variation: (1) Proof that a Variation would increase the financial re-
turn from the land, (2) Personal hardship, (3) Self-imposed hardship. In the last
case, the recognition of conditions created after the enactment of the Zoning Ordi-
nance would encourage and condone violation of the law.
3. No Variation may be granted which would adversely affect surrounding property
or the general neighborhood. All Variations must be in harmony with the intent and
purposes of the Zoning Ordinance.
