WHEREAS, Mc Donald's Corporation filed an application with the Village
Clerk of the Village of Oak Brook requesting a Special Use Permit under Section
10-34 of the Code of Ordinances of the Village of Oak Brook, relating to flood
plain and wetland regulations; and
WHEREAS, on March 11, 1986 the Corporate Authorities referred the
application to the Plan Commission and the Zoning Board of Appeals for public
hearings;- and
WHEREAS, after consideration of the application at its meeting on March
17, 1986, the Plan Commission recommended to the Village Board that the requested
special use permit be granted subject to certain conditions and restrictions; and
WHEREAS, at its meeting on May 6, 1986 pursuant to due and appropriate
legal notice, the Zoning Board of Appeals recommended to the Village Board that
the applicant's request for a flood plain special use permit be granted subject
to certain conditions and restrictions, as the temporary earth stockpile
satisfies the requirements of and is consistent with'each of the factors set
forth in Section 10-34(c) of the Code of Ordinances of the Village of Oak Brook
relating to minimum standards for use of flood plain property; and
WHEREAS, the Corporate Authorities of the Village of Oak Brook deem the
passage of this Ordinance to beiin the_best interest and in furtherance of the
general welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as (hough fully set forth herein.
Section 2: Pursuant to Section 10-34 of the Code of Ordinances of the
Village of Oak Brook, Illinois, a Flood Plain Special Use Permit is hereby
granted to allow temporary storage of an earth stockpile near the Oak Brook Road
(31st Street) bridge on the property legally,_described as follows:
Lots 1 and 2 in Butler GHQ Subdivision, being a Subdivision of
part of Section 26, Township 39 North, Range 11 East of the
Third Principal Meridian, according to the Plat thereof
recorded August 6, 1980 as Document R80-44966, in DuPage
County, Illinois. Permanent Parcel Nos. 06-26-401-008,
06-26-401-009, 06-26-401-010 and 06-26-400-014.
Section 3: That the Flood Plain Special Use Permit herein granted in
Section 2 of this Ordinance is expressly subject to the following conditions:
A. That the earth stockpile be removed not later than May 1,
1987.
B. That the applicant maintain the hay bales surrounding the
stockpile in order to prevent any washing of the dirt into
Salt Creek.
C. That the applicant use the stockpile to backfill the
foundation as each sublevel is completed.
D. That the applicant provide a performance bond expiring on
August 1, 1987 for removal of the stockpile.

E. That in the event that Mc Donald's Corporation or its
successors or assigns, fails to comply with the above
conditions, upon telephone notice in the case of an
emergency, or upon ten (10) days written notice, the ,
Village may enter onto the premises and take remedial
action to ensure that the public health and safety is not
imperiled by the stockpile. The cost of said remedial
action shall be paid in its entirety by Mc Donald's
Corporation, its successor and assigns.
Section 4: That this Ordinance shall be in full force and effect from
and after its passage and approval as provided by law.
Section 5: All ordinances, rules and regulations of the Village of Oak
Brook which are in conflict with the provisions of this Ordinance are hereby
repealed to the extent of such conflict but only as they apply to the property
hereinbefore described.
Section 6. If any section, subsection, sentence, clause or phrase of
this Ordinance is for any reason held to be invalid, such determination shall not
affect the validity of any remaining portion of this Ordinance.

Dear Mr. Boyce :
Following receipt of your letter of April 11, 1986 ,
McDonald' s has retained the firm of Lindley & Sons , Inc. to
prepare the requested permit application and to complete the
requested flood risk evaluation.
McDonald' s plans to use the earth in the subject
stockpile at the earliest possible moment for backfilling the
foundation walls now being constructed on the property adja-
cent to the stockpile. It is expected that this work can begin
in the early fall and be completed by November. However, there
is always the chance that there will be delays caused by weather
or strikes which are beyond the control of McDonald' s. But, in
any event, it is expected that the earth will be completely re-
moved from the stockpile prior to May 1, 1987.

Dear Mr. Gooder:
Temporary Earth Stockpile
The March 21, 1986, letter from the Village of Oak Brook ad-
dresses the temporary earth stockpile at the McDonald's Office
Complex within the floodway of Salt Creek. Because the stockpile
is considered fill in the floodway, which was not permitted by
the. Division, it is a violation of State Statutes, Chapter 19,
Section 70.
We are requesting that McDonald's Corporation apply for our per-
mit for the temporary fill. Because of the location of the
stockpile and the apparent lack of flood damageable structures in
the vicinity, the McDonald's Corporation may be able to demon-
strate that no significant flood risk exists. We will expect a
prompt application submittal, timetable for removal, and flood
risk evaluation.

WHEREAS, McDonald's Corporation, filed an application with the Village

WHEREAS, at its meeting on July 15, 1985 the Plan. Commission
recommended to the Village Board that the requested special use permit be
granted; and
WHEREAS, at its meeting on August 6, 1985 pursuant to due and
appropriate legal notice, the Zoning Board of Appeals recommended to the Village
Board that the applicant's request for a flood plain special use permit be
granted as the proposed work and construction satisfies the requirements of and
is consistent with each of the factors set forth in Section 10-34(c) of the Code
of Ordinances of the Village of Oak Brook relating to minimum standards for use
of flood plain property; and
WHEREAS, the Corporate Authorities of the Village of Oak Brook deem the
passage of this Ordinance to be in the best interest and in furtherance of the

C. McDonald's Improvement Plan - Phase 1-B (Jorie Boulevard):
On July 15, 1985, per memo from Chairman Marcy, the Plan Commission
recommended approval and on August 6, 1985, the Zoning Board of Appeals
similarly recommended approval, per memo from Chairman Savino dated August
9, 1985, of Phase 1-B of the development which calls for the construction
of a 260,000 square foot office building containing underground parking
for 600+ cars, Lodge Building #3 with a swimming pool, and a maintenance
building directly northwest of the Training Center. They further
recommended approval of amendment to the Development Plan regarding the
location of maintenance building within bubble "F", clarification of
structure height between. Phase 1-A and Phase 1-B, and approval of the
Flood Plain Special Use for the Phase 1-B reconstruction of service drive.

Dear President Cerne and Trustees :
McDonald' s Phase 1B Improvement contemplates the completion
of Phase 1 by construction of the following:
1. A major office building, 3 stories in height, with not
to exceed about 260 ,000 gross square feet. It will be
similar in design, construction and exterior materials
to the Lodge and Training Center and will be located in
Development Area/Bubble A where the Butler office buildings
and the other buildings formerly used for the Saddle Club,
horse arena and stables are now located. All of these
will be removed or demolished.
2. Beneath the office building and its adjacent landscaped
terraces , there will be a 3 level parking garage with
parking stalls for a least 780 cars.
3. The following additional buildings will be constructed
in Phase 1B within Bubble D:
(a) An additional wing on the Lodge (west of south bed-
room wing) containing about 75 rooms. This is re-
quired because of the increasing number of students
attending classes at the Training Center.
(b) A wing on the Lodge (west of its center) containing
a swimming pool and other health facilities .
4 . The following additional buildings may be built during
Phase 1B:
(a) A maintenance building northwest of the Training
Center to be located in Bubble F.

(b) An extension of the Training Center to the north
within Bubble C.
5. The service drive south, southeast and east of the proposed
office building will be rebuilt and widened to 24 feet in
order to handle the trucks coming to the loading docks at
the east end of the east wing of the building. This will
necessitate regrading and minor modifications of the flood
plain. (See McDonald' s Application for Special Use (Flood
Plain) ) .
6. Trees will be planted to meet the need for screening the
new office building from Oak Brook Road and from the Vil-
lage Commons. The existing oak forest will fully screen
the office building from Jorie Boulevard. No additional
plantings are necessary for the new wings on the Lodge since
they will be screened by the oak forest on the south and
west along Jorie Boulevard. Screening will be added as
required west and northwest of the maintenance building
and the northerly expansion of the Training Center. No
new structures are currently planned to be located between
or east of the Lodge and Training Center.
7. There will be no new roads , sewer or water mains . There
will only be entrance drives and service lines for utilities
all of which will be submitted for approval in the building
permit process.
/ In addition to approval of the proposed Improvement Plan for
Phase 1B, McDonald's requests that it be permitted by issuance of a
foundation permit to enable excavation and. construction of the subgrade
parking structure to begin prior to filing its final plans, specifi-
cations and working drawings for the above-grade office building. This
will make it possible to begin excavating in the late Fall of 1985 and
continue through the winter. Such permission was granted also for
Phase 1A.
At the Board meeting scheduled for Tuesday, McDonald' s will
have company officers present and also representatives of its archi-
tects , engineers and landscapers all of whom will be pleased to answer
questions and to make a brief presentation of the planned construction.
The Phase 1B Improvement Plan as presented meets the require-
ments of ORA3 provisions of the Zoning Ordinance (Sec. X(D) ) and the
requirements of the ORA3 improvement plan sections of the Subdivision
Regulations. With two minor exceptions (see McDonald 's Application
for Development Plan Amendments) it meets all the requirements of the
Development Plan approved May 31, 1978 , by Ordinance No. S-409 . It
is therefore respectfully. urged that, after reviewing and approving
McDonald' s request for a Special Use (Flood Plain) permit and amend-,
ments to the Development Plan, the Board of Trustees approve the pro-
posed Improvement Plan for Phase 1B. 11'

Dear President and Board of Trustees:
The Plan Commission, at its regular meeting of July 15, 1985, considered the
application of McDonald's Corporation for a Flood Plain Special Use Permit which
is required based on proposed relocation of an existing service drive adjacent to
Salt Creek.
The Plan Commission recommends to the President and Board of Trustees approval of
the requested Flood Plain Special Use Permit subject to a confirmation by the
Illinois Department of Transportation Division of Water Resources concerning the
actual boundary of the Salt Creek floodway.
This recommendation was made on a motion by Member Doyle, seconded by Member
Haglund and approved on a Roll Call Vote of five (5) ayes: Members Doyle, Haglund,
Sandstedt, Stachniak, Chairman Marcy; zero (0) nays; two (2) absent: Members
Antoniou, Beard.

This letter is to clarify any questions which may result from my
previous correspondence concerning the filling of the Floodplain.
The width of the proposed Service Driveway is 24 feet.
Additionally, the 1.40 acre feet of Floodplain encroachment
associated with this proposed drive was computed based upon the
roadway width of 24 feet.

MEMORANDUM IN SUPPORT
OF
REQUEST FOR SPECIAL USE FLOOD PLAIN
As required by Subsection (c) of Section 10-34 of the Oak Brook
Code, McDonald' s Corporation urges that favorable findings be made
as to the 11 factors specified in Subsection (c) for the following
reasons :
Factor #1. There will be no danger to life and property due
to increased flood heights or velocities caused
by the development because onsite developmental
and compensating flood storage has been and will
be provided: the release rate will not exceed the
maximum rate permitted by the Hinsdale Sanitary
District and the existing flood stages of Salt
Creek will remain unchanged.
Factor #2. There will be no danger that materials may be
swept onto other lands , or cross-stream, up-stream
or downstream, to the injury of others because re-
quired flood storage will be provided and there
will be no storage of materials that could be
floated or moved by flood waters. The velocity
of such waters in the direction of stream flow
will be zero.
Factor #3. Water supply to the proposed buildings will be pro-
vided by connection to existing water. mains6 ' Sanitary
service to the proposed buildings will be provided
by correction to the existing sanitary sewer. Both
water and sanitary mains are located along Ronald
Lane.
Factor #4 . All habitable areas of the project are out of the
flood plain. The east entrance to .the loading
docks and the underground parking garage will be
flood-proofed by the service drive and adjacent
ground levels.
Factor #5. Not applicable .

Factor #6. None.
Factor V. Area is zoned to permit the proposed office
buildings.
Factor #8. The proposed use will. become an integral part of
the comprehensive plan and flood plain management
program for the office campus .
Factor #9. The service drive will be no lower than the 100
year flood elevation so that emergency as well as
ordinary vehicles will have access even in time
of the 100 year flood.
Factor #10. With regard to expected heights, velocity, dura-
tion,. rate of rise and sediment transport of flood
water expected at the site, the applicant states
as follows:
(a) Flood heights - see information on
Sheet FPG-4 .
(b) Velocity - there will be no change
in stream velocity and there will be
zero velocity in direction of stream
flow of flood waters onsite west of
floodway line .
(c) Duration - since existing storm water
storage will not be diminished there
will be no change in duration except
in the possible detention portions of
the site which are to be designed for
the storage of flood water in a 100
year flood.
(d) Rate of rise - this is dependent upon
the waterway opening which will remain
unchanged.
(e) Sediment transport - the development
of the site will not provide any addi-
tional transportable sediment since all
areas planned for development will be
paved with an all-weather hard surface
or covered with well-established turf
or non-erodable, soil stabilizing material.
Factor #11. No additional factors.

- DEVELOPMENT PLAN AMENDMENT
David M. Gooder, attorney for the applicant, noted that the McDonald's Corporation
is preparing plans for its next phase of development of the McDonald"s Office
Campus to be known as Phase 1-B. The primary construction proposed for this phase
will be the first major office building on the site ranging in size from
200,000-260,000 square feet of floor area. He noted that in conjunction with the
Village's approval of this Improvement Plan, they have made application to modify
the Development Plan, and Plat, approved by the Village in 1978, as well as a Flood
Plain. Special Use Permit which will permit modification of the service drive
adjacent to Salt Creek.
Chairman. Marcy noted the approximate time schedule attached to Ordinance 5-409,
which approved the McDonald's Development Plan.
Mr. Gooder noted that the schedule contained in Ordinance 5-409 was only
approximate based on a preliminary time table for development.
Joe Anturovich, architect for the development, noted that this Phase 1-B Office
Building would take approximately 30 months for construction with the additional
time being for construction of three below-grade levels of parking. He further
noted that as a part of Phase 1-A, McDonald's chose to construct all land
improvements, utilities, roadways, and storm water detention facilities based on
full development of the property. He further noted that the proposed office
building will be approximately three stories and only project 42 feet above the
highest point within. bubble A. It was noted that one of the Development Plan
amendments requested relates to the severe slope within. bubble A and a modified
office building layout from that originally proposed in 1978. He also made the
following comments with respect to Phase 1-B:
1. A proposed walkway will correct the existing lodge building and proposed office
building, running over Ronald Lane, with a 14-foot clear height under the
walkway.
2. An addition to the lodge facility comprising 75 rooms and enclosed pool are
proposed for Phase 1-B.
3. The proposed maintenance building as part of this phase will be a ore-story
grounds maintenance building within. bubble F.
In response to Chairman, Marcy, Mr. Artunovich stated that phases 2, 3 and 4,
comprised entirely of office building construction., will be additional wings added
on to the current proposed building.
In response to Member Haglund, Mr. Antunovich stated that the design of the
underground parking decks is very difficult due to the high water table and that
the entire underground construction will be made watertight. He also noted that
this underground parking will extend approximately 35 feet below ground.

David Gooder and Joe Artunovich noted that the various items contained it Dale
Durfey's memo of July 11, 1985 will be taken care of, although they are making
certain, requests as follows:
The first request is to be able to delay submittal of a detailed grading plan
around the office building until application is made for a building permit.
In addition, they are requesting permission to plant some minor landscaping on
Village Commons property to serve as additional screening of the development.
Member Doyle stated his concern with respect to the close spacing of such large
diameter trees.
Mr. Arturovich stated that McDonald's and Brickman. Landscape Company have had
success with such plantings in the past.
Mr. Gooder noted that the requested flood plain special use permit will permit
construction of an enlarged service drive to the East of the office building which
will service the loading berths behind the building. The proposal is to wider, this
driveway to 24 feet in width, taking it, for the most part, above the 100-year
flood plain.. He further noted that there will be no modification to the floodway
of Salt Creek and only minor modifications to the flood fringe.
Member Stachriak arrived at this point of the meeting.
Mr. Gooder noted that in conjunction with Phase 1-A, 5.9 acre feet of additional
storm detention was created. This proposed roadway modification will fill 1.4 acre
feet of that surplus detention..
Mr. Gooder stated the applicant's willingness to comply with the review items
contained in Dale Durfey's memo of July 11, 1985 concerning the flood plain special
use.
Mr. Gooder further submitted a memorandum in support of the requested flood, plain
special use addressing the eleven factors contained in Section. 10-34 of the Village
Code concerning flood plain. modifications.
Mr. Gooder noted that there were two specific modifications requested to the
development plan and plat which was approved pursuant to Ordinance S-409 passed by
the Village in 1978.
The first modification concerns construction of the proposed ore-story maintenance
building and that it was determined that it would be best to relocate bubble F
approximately 75 feet to the South. It was noted that the proposed building will
only project approximately 6 feet above current ground level, since the majority of
the building will be dug into the hill.

Mr. Antunovich stated that the exterior of the building will be constructed of
Lannon store, as viewed from Jorie Boulevard.
Mr. Gooder stated that the second requested modification, is to strike the sentence
in paragraph 2 of the Development Plan which presently prohibits any building
within. Phase 1 to exceed four stories or 48 feet in height whichever is less.
Mr. Gooder noted that the other height requirement contained in the Development
Plan is under item #8 which states that no office building shall exceed five
stories or 60 feet in height or elevation. 719.0 feet. He noted that the average
height figured against the natural ground level for the office building is
approximately 53 feet. If, however, the westerly portion of the proposed building
were considered by itself, that portion of the building would meet the 48—foot
height limitation..
Chairman. Marcy commented that the Development Plan was primarily concerned with
keeping all buildings below tree height, and that the proposed 1—B development
appears to meet that concern..
A motion was made by Member Sandstedt, seconded by Member Stachniak to approve the
two requested development plan amendments based on the assumption that the proposed
office building will not exceed 53 feet in height and that the modified bubble F
will remain the same size but only be moved in a southerly direction based on
testimony that this modification will have no impact on any original trees located
on the site.

- DEVELOPMENT PLAN AMENDMENT
David M. Gooder, attorney for the applicant, noted that the McDonald's Corporation
is preparing plans for its next phase of development of the McDonald's Office
Campus to be known. as Phase 1-B. The primary construction proposed for this phase
will be the first major office building on the site ranging in size from
200,000-260,000 square feet of floor area. He noted that in conjunction with the
Village's approval of this Improvement Plan, they have made application to modify
the Development Plan. and Plat, approved by the Village in 1978, as well as a Flood
Plain Special Use Permit which will permit modification of the service drive
adjacent to Salt Creek.
Chairman Marcy noted the approximate time schedule attached to Ordinance S-409,
which approved the McDonald's Development Plan,.
Mr. Gooder noted that the schedule contained in Ordinance 5-409 was only
approximate based on a preliminary time table for development.
Joe Antunovich, architect for the development, noted that this Phase 1-B Office
Building would take approximately 30 months for construction with the additional
time being for construction of three below-grade levels of parking. He further
noted that as a part of Phase 1-A, McDonald's chose to construct all lard
improvements, utilities, roadways, and storm water detention facilities based on
full development of the property. He further noted that the proposed office
building will be approximately three stories and only project 42 feet above the
highest point within. bubble A. It was noted that one of the Development Plan
amendments requested relates to the severe slope within. bubble A and a modified
office building layout from that originally proposed in 1978. He also made the
following comments with respect to Phase 1-B:
1. A proposed walkway will correct the existing lodge building and proposed office
building, running over Ronald Lane, with a 14-foot clear height under the
walkway.
2. An addition to the lodge facility comprising 75 rooms and enclosed pool are
proposed for Phase 1-B.
3. The proposed maintenance building as part of this phase will be a ore-story
grounds maintenance building within bubble F.
In response to Chairman. Marcy, Mr. Antunovich stated that phases 2, 3 and 4,
comprised entirely of office building construction, will be additional wings added
on to the current proposed building.
In response to Member Haglund, Mr. Antunovich stated that the design of the
underground parking decks is very difficult due to the high water table and that
the entire underground construction will be made watertight. He also noted that
this underground parking will extend approximately 35 feet below ground.

David Gooder and Joe Antunovich noted that the various items contained in Dale
Durfey's memo of July 11, 1985 will be taker, care of, although they are making
certain requests as follows:
The first request is to be able to delay submittal of a detailed grading plan
around the office building until application is made for a building permit.
In. addition, they are requesting permission to plant some minor landscaping on
Village Commons property to serve as additional screening of the development.
Member Doyle stated his concern with respect to the close spacing of such large
diameter trees.
Mr. Anturovich stated that McDonald's and Brickman Landscape Company have had
success with such plantings in the past.
Mr. Gooder noted that the requested flood plain special use permit will permit
construction of an enlarged service drive to the East of the office building which
will service the loading berths behind the building. The proposal is to widen this
driveway to 24 feet in width, taking it, for the most part, above the 100-year
flood plain. He further noted that there will be no modification to the floodway
of Salt Creek and only minor modifications to the flood fringe.
Member Stachriak arrived at this point of the meeting.
Mr. Gooder noted that in conjunction with Phase 1—A, 5.9 acre feet of additional
storm detention was created. This proposed roadway modification will fill 1.4 acre
feet of that surplus detention..
Mr. Gooder stated the applicant's willingness to comply with the review items
contained in Dale Durfey's memo of July 11, 1985 concerning the flood plain special
use.
Mr. Gooder further submitted a memorandum in support of the requested flood plain
special use addressing the eleven factors contained in Section 10-34 of the Village
Code concerning flood plain. modifications.
Mr. Gooder noted that there were two specific modifications requested to the
development plan and plat which was approved pursuant to Ordinance S-409 passed by
the Village in 1978.
The first modification concerns construction, of the proposed one—story maintenance
building and that it was determined that it would be best to relocate bubble F
approximately 75 feet to the South. It was noted that the proposed building will
only project approximately 6 feet above current ground level, since the majority of
the building will be dug into the hill.

Mr. Antunovich stated that the exterior of the building will be constructed of
Lannon stone, as viewed from Jorie Boulevard.
Mr. Gooder stated that the second requested modification is to strike the sentence
in paragraph 2 of the Development Plan which presently prohibits any building
within. Phase 1 to exceed four stories or 48 feet in height whichever is less.
Mr. Gooder noted that the other height requirement contained in the Development
Plan is under item #8 which states that no office building shall exceed five
stories or 60 feet in height or elevation, 719.0 feet. He noted that the average
height figured against the natural ground level for the office building is
approximately 53 feet. If, however, the westerly portion of the proposed building
were considered by itself, that portion of the building would meet the 48-foot
height limitation.
Chairman Marcy commented that the Development Plan was primarily concerned with
keeping all buildings below tree height, and that the proposed 1-B development
appears to meet that concern.
A motion was made by Member Sandstedt, seconded by Member Stachniak to approve the
two requested development plan amendments based on the assumption, that the proposed
office building will not exceed 53 feet in height and that the modified bubble F
will remain the same size but only be moved in a southerly direction based on
testimony that this modification will have no impact on any original trees located

SUBJECT: McDonald's Phase 1-B - Flood Plain Special Use
As a part of the Phase 1-A improvement, McDonald's constructed a service drive
along the eastern edge of the property adjacent to Salt Creek. Phase 1-B, as
presently proposed, calls for a rebuilding of this service drive including
certain flood plain filling operations to raise the service drive above the
100-year flood plain.
The revised flood plain grading is shown on Sheet FPG-4 dated June 14, 1985. As
noted on the plan, the floodway or moving portion of a flood will not be impacted
by the roadway improvement, only the flood fringe will be affected. As indicated
by the applicant, excess storm water storage provided as a part of Phase 1-A will
more than compensate for the additional filling for the service drive.

Flood Plain Special Use
I have reviewed the drawing FPG-4,. revised 7/8/85, received on July 8, 1985 along
with the file documentation and offer the following comments:
1. A letter needs to be received from IDOT confirming the location of the
floodway line and further confirming IDOT's permission for McDonald's
to fill-in this portion of the flood plain.
2. The service road is being proposed as being widened to twenty-four (24')
feet on the drawing which, I am told by the applicant's attorney, is the
correct width as opposed to the twenty-two (22') foot dimension as stated
within John D. Hollywood's letter of June 14, 1985.
3. The applicant's engineer has calculated the "As-built" Phase lA flood plain
storage provided to be 107.92 acre feet which is 5.91 acre feet in excess
of the 102.01 acre feet of storage required. Mr. Hollywood has calculated
that 1.40 acre feet of flood plain will be filled-in with the reconstruction
of the service drive which will leave 4.51 acre feet of storage access.
4. The proposed reconstruction of the service drive is to take place outside
of the floodway line as calculated by the applicant's engineer. I have
also located the floodway line to coincide with that location as depicted
on Sheet FPG-4.

Flood Plain Special Use Permit
Dear Mr. Antonovich:
The following information is presented as an evaluation of the flood
storage characteristics of the McDonald's Headquarters site, in
support of the Phase IB design as it applies to flood storage along
Salt Creek.
The Phase IA Improvement Plan as proposed in April, 1981, provided
for a surplus of 5.47 acre feet of flood storage. This surplus
represented the maximum amount of filling that could occur in future
devlopment phases without increasing the future flood hazard
potential.
Based upon the actual as-built grading drawings for the Phase IA
improvements, the present (1985) 100-year flood storage potential
was determined by the attached calculations. This analysis showed
the actual excess flood storage available to be 5.91 acre feet.
The following summarizes the Phase IA 100 year flood storage (As
built 1985):

It is presently proposed, as part of the Phase IB work, to fill a
portion of the 100-year flood plain adjacent to Salt Creek. This
filling is shown on the accompanying plan entitled "Phase IB, Flood
Plain Grading Plan, Sheet No. FPG-4". The proposed work consists of
raising the service driveway above the flood plain and widening it
to a width of 22' to accommodate vehicular access to an easterly
service entrance of the building. All of the proposed filling would
occur outside of the Floodway line of Salt Creek as delineated on
the plan.
The attached calculations of the flood plain fill required for this
driveway improvement indicate that 1.32 acre feet of flood fringe
would be filled. Based upon the existing available excess storage.
It is our opinion that this proposal will not increase the flood
hazard potential of this section of Salt Creek.

organized under the laws of the State of Illinois, having its principal offices in Chicago,
Illinois as Surety, are held and firmly bound unto The Village of Oak Brook Illinois, an
Illinois municipal corporation, in the sum of One Hundred Thousand and no/100 Dollars
($100,000.00) lawful money of the United States, for which payment well and truly be
made, we bind ourselves, our heirs, executors, administrators, successors and assigns,
jointly and severally, firmly by these presents.
WHEREAS, the above bounden Principal has obtained a special use permit under
Ordinance No. S-584 of the Code of Ordinances of the Village of Oak Brook which permit
authorizes the above Principal to maintain a temporary stockpile of dirt in the flood
plain of Salt Creek as depicted on the proposed Flood Plain Grading Plan dated March 11,
1986.
NOW, THEREFORE, THE CONDITION OF THIS OBLIGATION IS SUCH, that if the
above Principal shall comply with the terms and conditions of Section 3 of the
Ordinance, namely:
A. That the earth stockpile be removed not later than May 1, 1987;
B. That the applicant maintain the hay bales surrounding the stock-
pile in order to prevent any washing of the dirt into Salt Creek;
C. That the applicant use the stockpile to backfill the foundation as
each sublevel is completed;
D. That the applicant provide a performance bond expiring on August
It 1987 for removal of the stockpile;
E. That in the event that McDonald's Corporation or its successors or
assigns, fails to comply with the above conditions, upon telephone
notice in the case of an emergency, or upon ten (10) days written
notice, the Village may enter onto the premises and take remedial
action to ensure that the public health and safety is not imperiled
by P the stockpile. The cost of said remedial action shall be paid in
its entirety by McDonald's Corporation, its successor and assigns;
then this obligation shall be null and void, otherwise to remain in full force
and eff ect.

American Motorists Insurance Company, hereby agrees upon any default by
Principal to be responsible for all costs of removal of said stockpile to the extent of the

Request for Special Use Permit
for Temporary Earth Stockpile
Dear Al:
This letter will bring you up to date on developments
since your meeting of April 1, at which the matter was continued
for one month to afford McDonald' s an opportunity to respond to
the telephone call to me from Roger Lockwood of the Illinois
Division of Water Resources ("IDOWR") during which he stated that
it was his preliminary opinion that McDonald' s should obtain a
State permit for the temporary stockpile. As I informed the
Zoning Board at the meeting, the need for a State permit came
as a surprise since both McDonald' s engineers and I had been
told by Gary Jerit of IDOWR that such a permit was not required
for a temporary stockpile. Apparcntly Mr. Lockwood overruled
Mr. Jerit.
Be that as it may, immediately after your meeting
McDonald' s retained Lindley & Sons to prepare the necessary
application and damage evaluation. However, Lindley did not have
the necessary topographic information as to the east side of Salt
Creek opposite the stockpile. To obtain this data McDonald' s
promptly retained Bollinger, Lach & Biancalana to do the neces-
sary field survey and preparation of a topographic plan.
While the engineering work was proceeding I received
the attached letter dated April 11, 1986 , from David Boyce of
IDOWR confirming the need for a State permit and his preliminary
opinion that there should be no difficulty in obtaining one.

On Thursday, April 24 , I obtained a preliminary topo-
graphic plan from Bollinger, Lach & Biancalana which I delivered
that afternoon to Lindley who assured me also that there were
no dangers created by the stockpile and that a State permit should
be obtainable without difficulty. Mr. Lindley also assured me
that the permit application and damage evaluation report should
be in my hands by May lst or 2nd at which time copies will be
delivered to the Village.
Let me add a word or two of necessary background infor-
mation to explain how this matter began since it is important to
understand that initially neither McDonald' s, its architects,
engineers, general contractor nor its excavator realized that a
special permit from either the Village or the State was required
for a temporary stockpile of earth intended to be used to back
fill adjacent foundation walls. McDonald' s wishes to assure you
that it believed that it was proceeding properly and in full com-
pliance with all legal requirements.
However, as soon as McDonald' s was informed by the
Village staff that a Village special use permit was required, it
took the following steps :
( ) Prepared an application to the Village for a special
use permit.
(2) Agreed in writing to remove the stockpile if a Village
permit should not be approved.
(3) Filed a bond in the amount of $100 , 000 to cover the
cost of removal.
(4) Reconfirmed by telephone with Gary Jerit of IDOWR
that no State permit was required.
Copies of the State application and the damage evalu-
ation report will be in your hands before Tuesday, May 6. I will
call you on .Monday, May 5, to determine whether the matter will
be formally .and fully considered on May. 6 or will go over another
month while we await action by IDOWR and also the U. S. Corps of
Engineers and the Illinois Environmental Protection Agency as
IDOWR requires.

AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR CERTAIN
FILLING WITHIN THE FLOOD PLAIN PURSUANT TO SECTION 10-34
OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK
(McDonald's Corporation)
WHEREAS, Mc Donald's Corporation filed an application with the Village
Clerk of the Village of Oak Brook requesting a Special Use Permit under Section
10-34 of the Code of Ordinances of the Village of Oak Brook, relating to flood
plain and wetland regulations; and
WHEREAS, on March 11, 1986 the Corporate Authorities referred the
application to the Plan Commission and the Zoning Board of Appeals for public
hearings; and
WHEREAS, after consideration of the application at its meeting on March
17, 1986, the Plan Commission recommended to the Village Board that the requested
special use permit be granted subject to certain conditions and restrictions; and
WHEREAS, at its meeting on May 6, 1986 pursuant to due and appropriate
legal notice, the Zoning Board of Appeals recommended to the Village Board that
the applicant's request for a flood plain special use permit be granted subject
to certain conditions and restrictions, as the temporary earth stockpile
satisfies the requirements of and is consistent with each of the factors set
forth in Section 10-34(c) of the Code of Ordinances of the Village of Oak Brook
relating to minimum standards for use of flood plain property; and
WHEREAS, the Corporate Authorities of the Village of Oak Brook deem the
passage of this Ordinance to be in the best interest and in furtherance of the
general welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1_ That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: Pursuant to Section 10-34 of the Code of Ordinances of the
Village of Oak Brook, Illinois, a Flood Plain Special Use Permit is hereby
granted to allow temporary storage of an earth stockpile near the Oak Brook Road
(31st Street) bridge on the property legally,described as follows:
Lots 1 and 2 in Butler GHQ Subdivision, being a Subdivision of
part of Section 26, Township 39 North, Range 11 East of the
Third Principal Meridian, according to the Plat thereof
recorded August 6, 1980 as Document R80-44966, in DuPage
County, Illinois. Permanent Parcel Nos. 06-26-401-008,
06-26-401-009, 06-26-401-010 and 06-26-400-014.
Section 3: That the Flood Plain Special Use Permit herein granted in
Section 2 of this Ordinance is expressly subject to the following conditions:
A. That the earth stockpile be removed not later than May 1,
1987.
B. That the applicant maintain the hay bales surrounding the
stockpile in order to prevent any washing of the dirt into
Salt Creek.
C. That the applicant use the stockpile to backfill the
foundation as each sublevel is completed.
D. That the applicant provide a performance bond expiring on
August 1, 1987 for removal of the stockpile.

E. That in the event that Mc Donald's Corporation or its
successors or assigns, fails to comply with the above
conditions, upon telephone notice in the case of an

action to ensure that the public health and safety is not
imperiled by the stockpile. The cost of said remedial
action shall be paid in its entirety by Mc Donald's
Corporation, its successor and assigns.
Section 4: That this Ordinance shall be in full force and effect from
and after its passage and approval as provided by law.
Section 5: All ordinances, rules and regulations of the Village of Oak
Brook which are in conflict with the provisions of this Ordinance are hereby
repealed to the extent of such conflict but only as they apply to the property
hereinbefore described.
Section 6: If any section, subsection, sentence, clause or phrase of
this Ordinance any reason held to be invalid, such determination shall not
affect the validity of any remaining portion of this Ordinance.

The Zoning Board of Appeals, at its regular meeting of May 6, 1986, considered the
application of McDonald's Corporation for a Flood Plain Special Use Permit for the
temporary location of a dirt stockpile within the Salt Creek floodplain.
The Zoning Board of Appeals recommends to the President and Board of Trustees
approval of this Flood Plain Special Use Permit for a temporary stockpile within
the Salt Creek floodplain based on testimony indicating compliance with the eleven
factors contained in Section 10-34 of the Village's Flood Plain Regulations. This
recommendation is made based on the following conditions:
1) Total removal of the stockpile area no later than May 1, 1987.
2) Maintenance of the hay bales surrounding the stockpile in order to prevent any
washing of the dirt into Salt Creek.
3) Backfilling of the basement construction concurrent with the construction
activities.
4) Amendment of the bond previously submitted to have an expiration date of May 1,
1987.
This recommendation was made on a motion by Member Crouch, seconded by Member O'Brien
and approved on a Roll Call Vote of six (6) ayes: Members Crouch, Martinello, O'Brien,
Shumate, Weber, Chairman Savino; zero (0) nays; one (1) absent: Member Bartecki.

Mr. David Gooder, attorney, and Joseph Antunovich, architect, were present
representing this application.
Mr. Gooder noted that since the Zoning Board's continuance of this subject in
April, Mc Donald's had filed an application for a permit with the Illinois Division
of Water Resources for the temporary loction of a stockpile within the Salt Creek
floodplain. Mc Donald's had also added to, as well as reinforced, the hay bales
surrounding the stockpile to prevent further erosion. Mr. Gooder submitted Exhibit
A being the May 6, 1986 letter from Lindley & Sons concerning the potential impact
of the stockpile on Salt Creek. Following discussion among Zoning Board members,
Mr. Gooder indicated a willingness to proceed with the application at this hearing
without Bill Lindley and agreed with the Village Attorney that the Village does not
need to wait for issuance of a State permit prior to taking action. Mr. Gooder
noted that in conjunction with the McDonald Phase 1—A, development of the property,
there was provided compensatory storage sufficient for the total future development
of the property. He noted that based on a full development of the property, there
would still be 4.5 acre feet excess of storage on site and that the stockpile area
would not use up that entire excess. He, therefore, noted that the only question
before the Village is the impact of the stockpile on the Salt Creek floodway and
that Mr. Lindley's May 6th letter indicates that there would be no increased flood
hazard by the temporary stockpile. Mr. Gooder further noted that Mc Donald's
believed it was acting correctly by placing the stockpile as it exists based on the
fact that an original plan sheet attached to the foundation permit issued by the
Village noted the stockpile location, although such plan sheet never received an
approved stamp by the Village.
In response to Member O'Brien, Dale Durfey noted that there would be no negative
flood impact on downstream properties.
In response to Member Weber, Mr. Gooder stated that none of the stockpile will
remain for longer than a year from this date, since it will be used entirely to
backfill the office building presently under construction. He noted that in the
general area of the stockpile, there are no structures within the flood plain,
since the two river houses just North of 31st Street on the Sports Core are not
within the floodplain area. He further noted that as Mr. Lindley's letter
indicates, the stockpile will result in an increase in flood height of .08 feet or
approximately .96 inches and that 1/10 of a foot or 1.2 inches is the maximum rise
in flood height permitted by the State.
Joe- Antunovich noted that Salt Creek and Ginger Creek, which come together directly
North of the stockpile, reach flood stage at different times and, therefore, flood
waters from Salt Creek tend to back up into the lake on Mc Donald's property thus
providing more flood storage than originally calculated. He further noted that the
4.5 acre feet of excess storage assumed the property at a fully built stage which
is not presently the case.
In response to Zoning Board members, Mr. Gooder stated that assuming good weather,
this pile should be gone no later than October of this year and in no case will
remain any longer than May 1 , 1987.

In response to Zoning Board members, Mr. Gooder responded satisfactorily to the
eleven factors contained on page 635 of the Village Code indicating that the impact
of the stockpile on the Salt Creek floodplain would not be hazardous to the Village
or surrounding properties.
In response to Member O'Brien, Mr. Gooder stated that the bond would be modified to
have a May 1, 1987 expiration date.
Mr. Antunovich stated that although they will make every attempt to backfill the
basement area prior to starting work above the foundation. However, in the event
weather slows the backfill operation, they would begin construction above grade.
The Chairman noted that there were no members of the audience expressing support
for or opposition to the application.
In response to Chairman Savino, Dale Durfey indicated that in the event the hay
bales were washed away, some dirt would be washed downstream, although it would not
be a major problem.
A motion was made by Member Crouch, seconded by Member O'Brien to recommend to the
President and Board of Trustees approval of the requested Flood Plain Special Use
Permit for the temporary stockpile within the Salt Creek floodplain to remain no
longer than May 1, 1987 based on testimony indicating compliance with the eleven
factors contained in Section 10-34 of the Village's Flood Plain Regulations.
This recommendation is made based on the following conditions:

Dear Mr . Gooder:
As requested, I have completed a backwater analysis of the 100
year and 50 year flood flows for Salt Creek immediately upstream
of the 31st Street bridge in Oak Brook, Illinois. This area of
the creek is adjacent to the McDonald's Corporate Headquarters
which is still under construction. As part of this construction,
work along the banks of Salt Creek is required. In addition, the
general contractor found it advantageous to use the flood fringe
in this area to temporarily store a quantity of topsoil for future
use in re-establishing vegetation. Concern about the effect of
this stockpile on the flood stage of Salt Creek has prompted this
investigation.
The predevelopment topography was included as part of the original
plans for this project and was utilized along with supplementary
data on the area east of the creek prepared by Bollinger, Lach and
Biancalana, Inc. With these topographic data a series of eight
cross sections was determined, both existing (predevelopment) and
proposed as it exists today with the stockpile in place, and have
been used to plot this information. Copies of this information
are enclosed for your reference.
Using a standard step backwater analysis and the flood flow infor-
mation contained in the Flood Insurance Study for Oak Brook, a
comparison of the flood stage in this reach of Salt Creek was
accomplished. This study indicates that the existence of the
stockpile and other earthwork which will remain a permanent part
of the McDonald's project will increase the 100 year flood stage a
maximum of 0.08 foot and the 50 year flood stage 0.06 foot. This
increase is less than that allowed by the regulations of the
Illinois Department of Transportation/Division of Water Resources
which is 0.10 foot.

The increased flood hazard that is being created by the temporary
stockpile will not represent any increase in the flood plain to
the existing residence east of the creek and north of 31st Street
and, since there are no structures in the flood hazard area
between 31st Street and 22nd Street, no additional flood risk will
be altered by the existence of the temporary stock pile at the
McDonald's construction site.
I trust this report is sufficient for your needs in this matter.
A permit application to the various regulatory agencies is being
prepared and will be sent as soon as all applicable exhibits are
ready.

Dear Al:
This letter will bring you up to date on developments
since your meeting of April 1, at which the matter was continued
for one month to afford McDonald' s an opportunity to respond to
the telephone call to me from Roger Lockwood of the Illinois
Division of Water Resources ("tDOWR") during which he stated that
it was his preliminary opinion that McDonald' s should obtain a
State permit for the temporary stockpile. As I informed the
Zoning Board at the meeting, the need for a State permit came
as a surprise since both McDonald' s engineers and I had been
told by Gary Jerit of IDOWR that such a permit was not required
for a temporary stockpile. Apparently Mr. Lockwood overruled
Mr. Jerit.
Be that as it may, immediately after your meeting
McDonald' s retained Lindley & Sons to prepare the necessary
application and damage evaluation. However, Lindley did not have
the necessary topographic information as to the east side of Salt
Creek opposite the stockpile. To obtain this data McDonald' s
promptly retained Bollinger, Lach & Biancalana to do the neces-
sary field survey and preparation of a topographic plan.
While the engineering work was proceeding I received
the attached letter dated April 11, 1986 , from David Boyce of
IDOWR confirming the need for a State permit and his preliminary
opinion that there should be no difficulty in obtaining one.
Attached also is a copy of my reply to Mr. Boyce dated April 13 ,
19 86 .

On Thursday, April 24 , I obtained a preliminary topo-
graphic plan from Bollinger, Lach & Biancalana which I delivered
that afternoon to Lindley who assured me also that there were
no dangers created by the stockpile and that .a State permit should
be obtainable without difficulty. Mr. Lindley also assured me
that the permit application and damage evaluation report should
be in my hands by May 1st or 2nd at which time copies will be
delivered to the Village.
Let me add a word. or two of necessary background infor-
mation to explain how this matter -began since it is important to
understand that initially neither McDonald' s , its architects ,
engineers, general contractor nor its excavator realized that a

be formally .and fully considered on May. 6 or will go over another
month while we await action. by IDOWR and also the U. S. Corps of
Engineers and the Illinois Environmental Protection Agency as
IDOWR requires.

Temporary Earth Stockpile
The March 21, 1986, letter from the Village of Oak Brook ad-
dresses the temporary earth stockpile at the McDonald's Office
Complex within the floodway of Salt Creek. Because the stockpile
is considered fill in the floodway, which was not permitted by
the Division, it is a violation of State Statutes, Chapter 19,
Section 70.
We are requesting that McDonald's Corporation apply for our per-
mit for the temporary fill. Because of the location of the
stockpile and the apparent lack of flood damageable structures in
the vicinity, the McDonald's Corporation may be able to demon-
strate that no significant flood risk exists. We will expect a
prompt application submittal, timetable for removal, and flood
risk evaluation.

Dear Mr. Boycc :
Following receipt of your letter of April 11, 1986 ,
McDonald' s has retained the -firm of Lindley & Sons , Inc. to
prepare the requested .permit application and to complete the
requested flood risk evaluation.
McDonald' s plans to use the earth- in the subject
stockpile at the earliest possible moment for- backfilling the
foundation walls now being constructed on the. property adja-
cent to the stockpile. It is expected that this work can begin
in the early fall and be completed by November. However, there
is always the chance that there will -be delays caused by weather
or strikes which are beyond the control of McDonald' s . But, in
any event, it is expected that the earth will be completely re-
moved from the stockpile prior to May 1, 1987.

Flood Plain Special Use
In addition to the comments within my March 13, 1986 memo, I have contacted
Roger Lockwood of the Illinois Department of Transportation, Division of Water
Resources (IDWR) and inquired of him where the State stood on allowing the
temporary placement of this stockpile within the floodway and flood fringe.
On March 21st, I sent him a copy of sheet FPG-4 .for his review and comment.
This morning I called Roger and inquired about IDWR's review. Roger replied
that a letter would be forthcoming within the next week or so but that pre-
liminary analysis showed that a permit would be required from IDWR, the State
probably would grant the permit if the applicant could show that the stockpile
causes no additional flood damage than already exists within the floodplain,
'and that Roger has contacted the applicant's attorney, David Gooder, concerning
the need for a permit application.

The Plan Commission, at its regular meeting of March 17, 1986, considered the
Application of McDonald's Corporation for a Flood Plain Special Use Permit
which would allow the continued location of an existing dirt stockpile within
the Salt Creek flood plain. This stockpile was created as a result of massive
excavations required for the Phase I-B Office Building.
The Plan Commission recommends to the President and Board of Trustees approval
of this request based on the condition that the stockpile area be removed no
later than May 1, 1987.
This recommendation was made on a motion by Member Haglund, seconded by Member
Doyle, approved on a roll call vote of six (6) ayes, Members Antoniou, Beard,
Doyle, Haglund, Stachniak, Chairman Marcy, zero (0) nays, one (1) absent, Member
Sandstedt.

As per our telephone conversation of this afternoon, enclosed please find one (1)
copy of Sheet FPG-4 last revised 2-14-86 which was recently submitted by the
McDonald's Corporation in furtherance of their application to temporarily
maintain the existing stockpile which they erroneously constructed partially
within the floodway and partially within the flood plain of Salt Creek. We
also have a letter on file from their attorne y that states ". . .this dirt will
be the first to be used and it should be totally used within twelve months from
the date of the permit, i.e. by no later than May 1, 1987, and quite likely,
six months earlier than that."
The applicant in the case is David M. Gooder, Attorney for McDonald's Corporation,
1100 Jorie Boulevard, Suite 153, Oak Brook, Illinois.
Please let me have, as soon as possible, your written response concerning the
State's position regarding this issue.

V MCDONALD'S — FLOOD PLAIN SPECIAL USE — PHASE I—B STOCKPILE
Ken Pardue, campus director, David Gooder, attorney, and Joe Antunovich, engineer,
were present representing this application.
Mr. Gooder noted that the Village had approved the Phase I—B Building Plans which
noted the proposed stockpile location adjacent to Salt Creek. He noted that Staff
first made their objections known once the pile had been created. He stated that
it is Mc Donald's intent to utilize all of the stockpile area adjacent to Salt Creek
for backfilling purposes in conjunction with the office building construction, and
that such activities should take place ideally within six months but no later than
one year from now. Mr. Gooder stated that Mc Donald's was unaware of any problem
with the temporary nature of the stockpile, since previous stockpiles had been
permitted, including stockpiling of dirt in conjunction with the watermain
construction adjacent to 31st Street. He further noted that although a substantial
portion of the stockpile is within the floodway, this particular encroachment does
not severely limit the flood carrying capacity of the Creek, since the Creek is
already constricted by the 31st Street overpass. He also noted that there is more
than adequate compensatory storage on the site including surplus storage left over
from the Phase 1—A construction, as well as the large...hole presently being dug for
the office building. Mr. Gooder noted that Mc Donald's has committed itself to
remove this stockpile no later than May 1, 1987 and has presented the Village with
a bond indicating their intent to do so.
In response to Member Stachniak, Joe Antunovich stated that the stockpile contains
approximately 23,700 cubic yards of dirt, of which 3.5 acre feet is fill up to the
floodplain elevation. When subtracted from the excess compensatory storage of 4.51
acre feet, there is still an approximate 1.01 acre feet of excess storage after
compensating for the stockpile area.

Mr. Gooder stated that they had contacted the Illinois Division of Water Resources
on this subject and had been advised that no special permit would be required for
this temporary fill activity.
In response to Member Beard, Mr. Antunovich noted that any potential flooding of
the property would not erode the stockpile area due to existing hay bales around
the bottom of the stockpile required for sedimentation control.
The Chairman noted that there were no members of the audience expressing support
for or opposition to the proposed application.
In response to the eleven factors contained in Section 10-34 of the Village Code,
Mr. Gooder and Mr. Antunovich indicated that there would be no negative impacts
created by this stockpile.
A motion was made by Member Haglund, seconded by Member Doyle to recommend to the
President and Board of Trustees approval of the requested Flood Plain Special Use
Permit based on the condition that the stockpile area be removed no later than May
1, 1987.

SUBJECT: McDonald's - Flood Plain Special Use
Phase I-B Stockpile
McDonald's Corporation, as a part of their Phase I-B office building construction,
has, over the last number of months, placed large quantities of dirt in a stockpile
area directly adjacent to Salt Creek. The enclosed Flood Plain Grading Plan Sheet
FPG-4 notes at the southeast corner of the property the stockpile area in question
located both in the flood fringe and floodway of Salt Creek. This stockpile was
created by McDonald's without benefit of specific permission by the Village and
was not permitted in conjunction with any of the other applications heard by the
Village over the past number of years. It is McDonald's contention that since a
stockpile area is a necessary part of construction, it's location within the flood
plain, on a temporary basis, did not require specific approval by the Village.
However, Staff is unable to find any statement within the Village's Flood Plain
Ordinance which would allow a temporary encroachment into the flood plain and,
therefore, McDonald's was required to apply for a Flood Plain Special Use Permit
allowing the continued location of this stockpile as it presently exists. We
have also received a letter from David Gooder, dated February 28, 1986, indicating
that this stockpile area will be removed no later than May 1, 1987.
The Plan Commission, in its review of this subject, is required to utilize the
standards contained in Section 10-34, copy attached.

(3) Processing: An application for a special use, in such
form and accompanied by such information as shall
be established from time to time by the Village of Oak
Brook, shall be filed with the village clerk and
thereafter processed in the manner prescribed thereto-
fore for applications for amendments.
(4) Decisions: The village board, upon report of the
zoning-board of appeals and the plan=coftirn�ssionPand
without further hearing, may authorize or deny an
application for a special use in accordance with the
statutes of the State of Illinois applicable to amend-
ments, or may refer it back to the zoning board of
appeals and the plan commission for further consider-
ation. No special use shall be authorized by the village
board unless the special use:
(i) Is so designed, located and proposed to be
operated that the public health, safety and welfare
will be protected; and
(ii) Would not cause substantial injury to the value of
other property in the neighborhood in which it is
located.
----P (5) Conditions: The plan commission and zoning board of
appeals may recommend, and the village board may
provide, such conditions and restrictions upon the
construction, location and operation of a special use,
as may be deemed necessary to promote the general
objectives of this article and to minimize the danger
of flood damage resulting therefrom.
(b) Procedure To Be Followed by the Plan Commission in
Making Recommendations Concerning Special Use Permits:
Upon receiving an application for a special use permit, the
plan commission shall, prior to making a recommendation
thereon:
(1) Require the applicants to furnish three (3) copies of
such of the following information, prepared by a
professional engineer or land surveyor, registered as
such in the State of Illinois, as is deemed necessary by

the plan commission for determining the suitability of
the particular site for the proposed use:
(i) Plans drawn to a readable scale showing location,
nature, dimensions and elevation of the lot,
existing or proposed structures, fill, storage of
materials, floodproofing measures, and the rela-
tionship of the above to the location of the
channel, floodway and the flood protection eleva-
tion.
(ii) Typical valley cross-section(s) drawn to a scale of
one (1) inch to one hundred (100) feet and a
vertical scale of one (1) inch to ten (10) feet
showing the channel of the stream, elevation of
land areas adjoining each side of the channel,
cross-sectional areas to be occupied by the
proposed development, and high water elevation. '
Cross-section intervals shall not exceed one i
hundred (100) feet.
(iii) Plans (surface view) showing elevations or con-
tours of the ground; pertinent structure, fill or
storage elevations; size, location and spatial
arrangement of all proposed and existing struc-
tures on the site; location and elevations of
streets, water supply, sanitary facilities; soil
types; and other pertinent information. Contours
shall be shown at one-foot intervals.
(iv) Photographs showing existing land uses and
vegetation upstream and downstream.
(v) A profile showing the slope of the bottom of the
channel or the flow line of the stream.
(vi) Specifications for filling, grading, dredging, chan-
nel improvements, storage of materials, water
supply and sanitary facilities.
(2) Transmit one copy of the information described in
subsection (b)(1) to the village engineer for technical
assistance, where necessary, in evaluating the pro-
posed project in relation to flood heights and

velocities; the seriousness of flood damage to the use;
the adequacy of the plans for protection; and other
technical matters.
(3) Based upon the technical evaluation of the village
engineer, determine the specific flood hazard at the
site and evaluate the suitability of the proposed use in
relation to the flood hazard.
' (c) Factors Upon Which the Recommendations of the
Zonin g Board o f Appeals eals and the Plan Commission Shall
Be Based: In making recommendations upon applications
for special use permits, the zoning board of appeals and the
plan commission shall consider all relevant factors specified
in other sections of this article includin g but not limited to
the following:
(1) The danger to life and property due to increased flood
heights or velocities caused by encroachments;
(2) The danger that materials may be swept onto other #
lands, or cross-stream, upstream or downstream to the
injury of others;
(3) The proposed water supply and sanitation systems
and the ability of these systems to prevent disease,
contamination and unsanitary conditions;
(4) The susceptibility of the proposed facility and its
contents to flood damage and the effect of such
damage on the individual owners;
(5) The importance of the services provided by the
proposed facility to the community.
(6) The requirements of the facility for a waterfront
location;
(7) The compatibility of the proposed use with existing
development and development anticipated in the
foreseeable future;
(8) The relationship of the proposed use to the compre-
hensive plan and floodplain management program for
the area;

(9) The safety of access to the property in times of flood
for ordinary and emergency vehicles;
(10) The expected heights, velocity, duration, rate of rise
and sediment transport of the floodwaters expected at
the site; and
i
(11) Such other factors which are relevant to the purposes
of this article.
(d) Conditions Attached to Special Use Permits: Upon
consideration of the zoning board of appeals and the plan
commission recommendations, the factors listed above, and `
the purpose of this article, the president and board of 1
trustees may by ordinance grant, deny or attach such
conditions to the granting of special use permits as they
deem necessary to further the purposes of this article.
Among such conditions, without limitation because of
specific enumeration, may be included:
(1) Modification of waste disposal and water-supply
facilities; i
(2) Limitations on periods of use and operation;
(3) Imposition on operational controls, deposit of surety w
bonds and deed restrictions;
(4) Requirements for construction of channel modifica-
tions, dikes, levees and other protective measures; and
(5) Floodproofing measures designed to be consistent with
the flood protection elevation for the particular area,
flood velocities, durations, rate of rise, hydrostatic and
hydrodynamic forces, and other factors associated
with the 100-year flood. In this event, the president
and board of trustees shall require that the applicant
submit a plan or document certified by a registered
structural engineer that the floodproofing measures
are consistent with the flood protection elevation and
associated flood factors for the particular area and
shall be provided in accordance with the standards for
completely floodproofed structures contained within
the United States Army Corps of Engineers publica-

tion, "Flood-Proofing Regulations," June, 1972, GPO:
1973 0-005-026 edition, or any subsequent edition
thereof. (Ord. No. G-217, § 2, 9-27-77; Ord. No. G-364, § 2,
9-10-85)
Sec. 10-35. Variations.
(a) [President and Board of Trustees May Grant.)
Variations to the provisions of this article may be granted
by the president and board of trustees upon recommendation
by the zoning board of appeals.
(b) Authority. The board of trustees shall decide all applica-
tions for variations of the provisions of this division after a public
hearing held before the zoning board of appeals on such notice as
shall be required by the Illinois Statutes for zoning variations.
The zoning board of appeals shall hold public hearing upon all
applications for variations and shall report its recommendations
to the board of trustees as to whether a requested variation
would be in harmony with its general purpose and intent, and
shall recommend a variation only where it shall have made a
finding of fact specifying the reason or reasons for recommending
the variation. Such findings shall be based upon the standards
prescribed in subsection(e)below. No variation shall be granted
by the board of trustees without such findings of fact. The con-
curring vote of four (4) members of the zoning board of appeals
shall be necessary to recommend in favor of the requested varia-
tion. In the case of a variation where the zoning board of appeals
fails to recommend the variation, it can only be adopted by an
ordinance with the favorable vote of two-thirds of the trustees.
(c) Initiation: An application for a variation shall be in
triplicate and may be made by any governmental office,
department, board, bureau or commission, or by any person,
firm or corporation having a freehold interest, a possessory
interest entitled to exclusive possession, a contractual
interest which may become a freehold interest, or any
exclusive possessory interest applicable to the land or land
and improvements described in the application for a
variation.
(d) Processing: An application for a variation shall be
filed with the village clerk who shall forward one copy of

Flood Plain Special Use
I have reviewed the previously submitted document and offer the following comments:
1. The existing stockpile falls primarily within the Salt Creek Floodway and
secondarily within the Salt Creek Flood Fringe.
2. The 100 year high-water elevation for this location along Salt Creek is
655.5.
3. Section 10-20(a) within our Flood Plain Code states "On lots containing
floodways. . .fill, encroachments and new construction and substantial
improvements of existing structures shall be prohibited, except such
as are specifically permitted in floodways. . .".
Section 10-20(b) states "On lots containing floodway fringes. . .construction,
filling or use of those low lying lands shall be prohibited except such
as specifically permitted in floodway fringes. . .".
Section 10-31(a) states "In floodways only those uses will be permitted
which will not: (1) affect the rate of flow or quantity of floodwaters
flowing into, over or off of the subject; (2) affect the available
detention area of the flood plain; or (3) result in an increase in the
risk of blockages forming in a floodway during a flood".
Section 10-31(b) states "The following uses. . .are found to have a low
flood damage potential and are specifically permitted if they will not
obstruct flood flows, provided that no structure, fill or storage of
materials or equipment is required. . .".
4. Regarding the flood fringe portion of their application, their calculations
state that the site presently has excess compensatory storage available
to allow filling within the flood fringe.
5. Regarding filling within the floodway, compensatory storage is generally
not discussed since floodways are usually kept open to allow for the

floodwaters. Also, the filling of a floodway could increase flood
heights and cause increased damages.
6. Although Mr. Hollywood's letter to Joe Antunovich dated February 14,
1986 states that they have received permission from the Illinois

in the IDWR office who informed me that he is unaware of the subject
stockpile. He told me that he would be investigating with the other
engineers in the IDWR office and then get back to.me with more findings.
In any event, I believe it would be wise to receive written documentation
from IDWR, supplied by the applicant, regarding this request.

This will confirm a telephone conversation I had yesterday with Len Felke of
the Gerhardt F. Meyne Company. I informed him that I had recently been made
aware of fill that had been placed in the flood plain north of 31st Street,
west of Salt Creek and that this encroachment into the flood plain was not
permitted.
I discussed this item with other members of the Village staff at our staff
meeting of this afternoon. The staff's conclusion was that I direct this
letter to you informing you, in writing, that the fill placed in the flood plain
is against Village regulation and must be removed. It appears that the affected
fill area is partly floodway and partly flood fringe.
Please review this matter immediately and let me know your intentions.

In answer to your letter dated January 29, 1986, we must sincerely
apologize for this oversight regarding the temporary stockpile being placed
partially in the floodway. The stockpile will be there only temporarily and
will be removed after the foundations reach the point where they can be
backfilled.
After receiving your letter we have reviewed the flood retention
requirements that are on record with the Village of Oak Brook. We have an
excess of 4.51 acre/feet, which you corroborate in your July 11 , 1985, memo
to Bruce ap copy a ached). In the afo ementioned_stockpi.Led area we
are occuevi�,na_o dly 3�5 acre/feet, as stated in the Bollinger, Lach &
Biancalana, Inc. letter dated February 3, 1986 (copy attached).
Under normal construction practices, backfill is obviously placed as
close to its final location as possible for economic reasons. Even with the
backfill location mentioned here, we will still need to stockpile
approximately 20,000 cubic yards additional backfill on the Kensington
property because of space restrictions at the site.
Again, our motive was not to violate t1peTlillag� ordinances.
Fortunately, with our 4.51 acre/feet of ac-Tess, we have enough excess flood
storage to cover this oversight and we would request your indulgence to
allow us to keep the stockpile in its present temporary location. It will
be removed at the earliest possible moment when the building foundation
allows.

Flood Plain Special Use
I have reviewed the drawing FPG-4, revised 7/8/85, received on July 8, 1985 along
with the file documentation and offer the following comments:
1. A letter needs to be received from IDOT confirming the location of the
floodway line and further confirming IDOT's permission for McDonald's
to fill-in this portion of the flood plain.
2. The service road is being proposed as being widened to twenty-four (24')
feet on the drawing which, I am told by the-applicant's attorney, is the
Correct width as opposea to the twenty-two (22') foot dimension as stated
within John D. Hollywood's letter of June 14, 1985.
3. The applicant's engineer has calculated the "As-built" Phase lA flood plain
storage provided to be 107.92 acre feet which is 5.91 acre feet in excess
of the 102.01 acre feet of storage required. Mr. Hollywood has calculated
that 1.40 acre feet of flood plain will be filled-in with the reconstructio
of the service drive which will leave 4.51 acre feet of storage. acce".
4. The proposed reconstruction of the service drive is to take place outside
of the floodway line as calculated by the applicant's engineer. I have
also located the floodway line to coincide with that location as depicted
on Sheet FPG=4.

Dear Ken:
This will confirm a telephone conversation I had yesterday with Len Felke of
the Gerhardt F. Meyne Company. I informed him that I had recently been made
aware of fill that had been placed in the flood plain north of 31st Street,
west of Salt Creek and that this encroachment into the flood plain was not
permitted.
I discussed this item with other members of the Village staff at our staff
meeting of this afternoon. The staff's conclusion was that I direct this
letter to you informing you, in writing, that the fill placed in the flood plain
is against Village regulation and must be removed. It appears that the affected
fill area is partly floodway and partly flood fringe.
Please review this matter immediately and let me know your intentions.

VI Mc DONALD'S - FLOOD PLAIN SPECIAL USE - PHASE 1-B STOCKPILE
Mr. David Gooder, attorney for the applicant, requested that the Zoning Board of
Appeals continue Mc Donald's Flood Plain Special Use request to the next Regular
Meeting of May 6, 1986.
Mr. Gooder noted Village Engineer Durfey's letter to the Illinois Department of
Transportation (IDOT) requesting clarification of whether IDOT would require a
permit to store the stockpile in the floodplain. Mr. Gooder further noted that
Jerri Garrett, of IDOT, stated to him that no permit was required; however, Roger
Lockwood, Mr. Garrett's supervisor, stated that a permit would be required due to
the length of time that Mc Donald's anticipated the stockpile will be in place. Mr.
Gooder stated that he was waiting for a letter from Mr. Lockwood regarding IDOT's
position and upon receipt of the letter, McDonald's would proceed expeditiously to
obtain the permit from the State.
A motion was made by Member Crouch, seconded by Member Martinello that Mc Donald's
request for a Flood Plain Special Use for the Phase 1-B Stockpile be continued to
the Zoning Board's May 6, 1986 meeting.
VOICE VOTE: All in favor. MOTION CARRIED. ..
Chairman Saviro requested that Mc Donald's check the bales of hay to be sure that
they were properly maintained.

for Temporary Earth Stockpile
Dear Al:
This letter will bring you up to date on developments
since your meeting of April 1, at which the matter was continued
for one month to afford McDonald' s an opportunity to respond to
the telephone call to me from Roger Lockwood of the Illinois
Division of Water Resources ("IDOWR") during which he stated that
it was his preliminary opinion that McDonald' s should obtain a
State permit for the temporary stockpile. As I informed the
Zoning Board at the meeting, the need for a State permit came
as a surprise since both McDonald' s engineers and I had been
told by Gary Jerit of IDOWR that such a permit was not required
for a temporary stockpile. Apparently Mr. Lockwood overruled
Mr. Jerit.
Be that as it may, immediately after your meeting
McDonald' s retained Lindley & Sons to prepare the necessary
application and damage evaluation. However, Lindley did not have
the necessary topographic information as to the east side of Salt
Creek opposite the stockpile . To obtain this data McDonald' s
promptly retained Bollinger, Lach & Biancalana to do the neces-
sary field survey and preparation of a topographic plan.
While the engineering work was proceeding I received
the attached letter dated April 11, 1986 , from David Boyce of
IDOWR confirming the need for a State permit and his preliminary
opinion that there should be no difficulty in obtaining one.
Attached also is a copy of my reply to Mr. Boyce dated April 18 ,
1986 .

On Thursday, April 24 , I obtained a preliminary topo-
graphic plan from Bollinger, Lach & Biancalana which I delivered
that afternoon to Lindley who assured me also that there were
no dangers created by the stockpile and that a State permit should
be obtainable without difficulty. Mr. Lindley also assured me
that the permit application and damage evaluation report should
be in my hands by May lst or 2nd at which time copies will be
delivered to the Village.
Let me add a word. or two of necessary background infor-
mation to explain how this matter began since it is important to
understand that initially neither McDonald' s , its architects ,
engineers, general contractor nor its excavator realized that a
special permit from either the Village -or the State was required
for a temporary stockpile of earth intended to be used to back
fill adjacent foundation walls. McDonald' s wishes to assure you
that it believed that it was proceeding properly and in full com-
pliance with all legal requirements .
However, as soon as McDonald' s was informed by the
Village staff that a Village special use permit was required, it
took the following steps :
(1) Prepared an application to the Village for a special
use permit.
(2) Agreed in writing to remove the stockpile if a Village
permit should not be approved.
(3) Filed a bond in the amount of $100 , 000. to cover the
cost of removal.
(4) Reconfirmed by telephone with Gary Jerit of IDOWR
that no State permit was required.
Copies of the State application and the damage evalu-
ation report will be in your hands before Tuesday, May 6 . I will
call you on .Monday, May S , to determine whether the matter will
be formally .and fully considered on May. 6 or will go over another
month while we await action. by IDOWR and also the U. S. Corps of
Engineers and the Illinois Environmental Protection Agency as
IDOWR requires.

Temporary Earth Stockpile
The March 21, 1986, letter from the Village of Oak Brook ad-
dresses the temporary earth stockpile at the McDonald's Office
Complex within the floodway of Salt Creek. Because the stockpile
is considered fill in the floodway, which was not permitted by
the Division, it is a violation of State Statutes, Chapter 19,
Section 70.
We are requesting that McDonald's Corporation apply for our per-
mit for the temporary fill. Because of the location of the
stockpile and the apparent lack of flood damageable structures in
the vicinity, the McDonald's Corporation may be able to demon-
strate that no significant flood risk exists. We will expect a
prompt application submittal, timetable for removal, and flood
risk evaluation.

Following receipt of your letter of April 11, 1986 ,
McDonald' s has retained the -firm of Lindley & Sons , Inc. to
prepare the requested .permit application and to complete the
requested flood risk evaluation.
McDonald' s plans to use the earth- in the subject
stockpile at the earliest possible moment for-.backfilling the
foundation walls now being constructed on the property adja-
cent to the stockpile. It is expected that this work can begin
in the early fall and be completed by November. However, there
is always the chance that there will -be delays caused by weather
or strikes which are beyond the control of McDonald' s . But, in
any event, it is expected that the earth will be completely re-
moved from the stockpile prior to May 1, 1987.

A Variation is a zoning adjustment which permits minor changes of district require-

2. 1ou must prove that the combination of the Zoning Ordinance and the uncommon
conditions of your property prevents you from making any reasonable use of your
land as permitted by your present zoning district. Since zoning regulates land and
not people, ,the' following•conditions cannot be considered-pertinent to the applica-
tion for a Variation: (1) Proof that a Variation would increase the financial re-
turn from the land, (2) Personal hardship, (3) Self-imposed hardship. In the last
case, the recognition of conditions created after the enactment of the Zoning Ordi
nance would cncourage' and condone violation of the law. ,
3. No Variation may be granted which would adversely affect surrounding property
or .the general neighborhood. All Variations must be in harmony with the intent and
purposes of the Zoning Ordinance.

We have carefully surveyed the existing stockpile of material being stored
in the southeast corner of the McDonald's site near Salt Creek. This
information has been documented on Drawing FPG-4, dated 02/14/86.
We have calculated the total volume of the stockpile to be 23,700 cubic
yards in place, and have determined that the stockpile containes 3.5
acre/feet below elevation 655.5.

Total Storage Provided 107.92 acre ft.
Full Development Storage Required 102.01 acre ft.
Service Drive Infringement 1.40 acre ft.
Total Excess Storage Provided 4.51 acre ft.
Based upon calculations prepared by Bollinger Lach, and Biancalana,
Inc., the amount of temporary fill in the Salt Creek flood plain
below the flood elevation 655.5 is 3.5 acre ft. With the stockpile
in place, the McDonald's Corporation is providing 1.01 acre ft. of
excess flood storage in the floodplain area. However, at this time,
we have not evaluated the hydraulic effect which this stockpiled
material would have upon the floodway.
We have reviewed the subject of temporary stockpile of materials
within the floodway with the Illinois Division of Water Resources
and are informed that they consider it to be incidental to
construction work and no permit is required from them.

ORDINANCE NO. S-603
AN ORDINANCE AMENDING AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR CERTAIN
FILLING WITHIN THE FLOOD PLAIN PURSUANT TO SECTION 10-34
OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAR BROOK
(McDonald's Corporation)
WIMEAS, Mc Donald's Corporation filed an application with the Village
Clerk of the Village of Oak Brook requesting a Special Use Permit under Section
10-34 of the Code of Ordinances of the Village of Oak Brook, relating to flood
plain and wetland reg-,-: ations; and
WILREAS, the Corporate Authorities passed Ordinance 5-584 which granted
a Flood Plain Special Use Permit subject to certain conditions and restrictions,
including the condition that the earth stockpile on the Subject Property be
remove: not later than May 1, 1987; and
WHEREAS, McDonald's Corporation has requested that the May 1, 1987
deadline be extended to July 1, 1987; and
WiEREAS, the Corporate Authorities of the Village of Oak Brook deem the
passage of this Ordinance to be in the best interest and in furtherance of the
general welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF TEL VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follow:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein..
Section 2: That Section 3 of Ordinance S-584 is amended to read as
folk's:
A. That the earth stockpile be removed not later than
July 1, 1987.
B. That the applicant maintain the hay bales surrounding
the stockpile in order to prevent any washing of the
dirt into Salt Creek.
C. That the applicant use the stockpile to backfill the
foundation as each sublevel is completed.
D. That the applicant provide a performance bond expiring
on August 1, 1987 for removal of the stockpile.
E. That in the event that McDonald's Corporation or its
successors or assigns, fails to comply with the above
conditions, upon telephone notice in the case of an
emergency, or upon ten (10) days written notice, the
Village may enter onto the premises and take remedial
action to ensure that the public health and safety is
not imperiled by the stockpile. The cost of said
remedial action shall be paid in its entirety by
McDonald's Corporation, it successor and assigns.
Section 3: That this Ordinance shall be in full force and effect from
and after its passage and approval as provided by law.
Section 4: all ordinances, rules and regulations of the Village of Oak
Brock rich are in conflict with the provisions of this Ordinance are hereby
repealed to the extent of such conflict but only as they apply to the property
hereinbefore described.
