ORDINANCE APPROVING WATER PURCHASE AND SALE CONTRACT,
DATED AS OF JUNE 11, 1986, BY AND BETWEEN
THE VILLAGE OF OAK BROOK, ILLINOIS, THE DU PAGE WATER COMMISSION,
AND OTHER CHARTER CUSTOMERS
WHEREAS, the Village of Oak Brook, Illinois (the "Municipality") is an
Illinois municipality empowered under Divisions 124 and 135 of Article II of the
Illinois Municipal Code, as amended, to enter into a long term contract for
supply of water with a water commission; and
WHEREAS, the DuPage Water Commission, Counties of Du Page, Cook and
Will, Illinois (the "Commission") has'adopted an ordinance entitled "ORDINANCE
approving Water Purchase and Sale Contract, dated as of June 11, 1986 by and
between the Du Page Water Commission, and Charter Customers" and pursuant thereto
has offered to enter into a Water Purchase and Sale Contract, dated as of June
11, 1986 (the "Contract") by and between the Municipality and other proposed
Charter Customers as set forth therein; and
WHEREAS, it is necessary and advisable to approve the Contract.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD TRUSTEES
OF THE VILLAGE OF OAK BROOK, ILLINOIS as follows:
Section 1: The Contract in the form attached to this Ordinance and by
this reference incorporated herein and made a part hereof, and each and every
term thereof, is hereby approved.
Section 2: The Village President is hereby authorized to execute and
the Villag-e 7rerT o attest the Contract and to file an executed counterpart
thereof with the Clerk of the Commission as soon as possible but in no event
later than September 1, 1986.
Section 3: Subject to appropriate changes or additions as may be
called for'T ads and circumstances, the officers of the Village, including the
Village President, Village Manager, Village Clerk and Village Attorney are hereby
authorized and directed pursuant to Section 19 of the Contract to execute those
certificates and opinions enumerated in said section, and such other opinions or
certificates as may be necessary or advisable upon request of the Commission.
Section, 4: From and after the execution and delivery of the Contract
hereby approv , the proper officials, agents and employees of the Village are
hereby authorized, empowered and directed to do all such acts and things to
execute all such documents as may be necessary to further the purposes and intent
of this Ordinance, including the preambles hereto.
Section 5: All acts of the officials of the Village which are in
conformity whit the purposes and intent of this Ordinance and in furtherance of
the Contract be and the sane are hereby in all respects approved and confirmed.
Section 6: The provisions of this Ordinance are hereby declared to be
separable, and it any section, phrase or provision shall for any reason be
declared to be invalid , such declaration shall not affect the validity of the
remainder of the sections, phrases or provisions.
Section 7: All ordinances, resolutions, orders, or parts thereof, in
conflict with the provisions of this Ordinance are, to the extent of such
conflcit, hereby superseded.
Section 8: A full, true and canplete copy of this Ordinance and
Contract shall e published within ten (10) days after passage and approval in
pamphlet form by authority of the Corporate Authorities.

Section 9: This Ordinance shall be in full force and effect upon its
passage, approval and publication as provided by law.
