AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTION VII(D) (8) (b) OF THE ZONING ORDINANCE
OF THE VILLAGE OF OAK BROOK, ORDINANCE G-60, AS AMENDED,
RELATIVE TO REQUIRED YARDS
(4 Pine Hill Lane)
WHEREAS, an application has been filed requesting a variation from the
provisions of Section VII (D) (8) (b) of the Oak Brook Zoning Ordinance, Ordinance
G-60, as amended, to permit the construction of an attached garage and roan
addition which would encroach into the 18-foot Required Side Yard, resulting in a
10'7" Side Yard; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals of the Village of Oak Brook on September 2, 1986 and
October 7, 1986 pursuant to due and appropriate legal notice; and
WHEREAS, a recanmendation has been made by said Zoning Board of Appeals
that the variation requested be granted; and
WHEREAS, the said Zoning Board of Appeals made explicit findings in its
report dated October 9, 1986 that the variation requested meets the applicable
standards set forth in Section XIII (G) (4) of the said Oak Brook Zoning Ordinance;
and
WHEREAS, the President and Board of Trustees of the Village concur with
the recommendations and findings made by the Zoning Board of Appeals;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted fran the provisions of
Section VII (D) (8) (b) of the Zoning Ordinance of the Village of Oak Brook so as to
permit construction of an attached garage and roan addition encroaching into the
18-foot Required Side Yard, resulting in a 1017" Side Yard, provided that said
attached garage and roan addition is constructed in substantial conformity with
the Plans consisting of Sheets Al and A2 drawn by Chris Pete Karidis and dated
July 7, 1986 and stamped Received by the Village of Oak Brook on September 30,
1986, a copy of which Plans is attached hereto as Exhibit A and incorporated
herein by reference.
Section 3: That this Ordinance is limited and restricted to the
property commonly known as 4 Pine Hill Lane, Oak Brook, Illinois, which property
is legally described as follows:
The East 90.0 feet of the West 180.0 feet of the East Half of
the North Half of Lot 6 in "Seidcheck's Subdivision" in the
Northeast Quarter of Section 2, Township 39 North, Range 11,
East of the Third Principal Meridian, according to the Plat
thereof recorded July 26, 1916 as Document 126018, in DuPage
County, Illinois.

Section 4: That this Ordinance shall be in full force and effect from

Harger Road curb modifications and traffic restrictions; and on October
7, 1986, the Zoning Board of Appeals recanmended approval of the
modified plan.

Association to establish a drive-in bank facility subject to the
condition that if traffic problems develop with respect to the design,

same.

1. Final Plat:
Preliminary plat, identified as Pierce Subdivision, a 12-lot
subdivision, approved at the Regular Meeting of May 22, 1984. On
September 15, 1986, the Plan Commission recamnended approval of the
Final Plat of Gateway Subdivision, consisting of 11 lots instead of 12
lots, subject to conditions outlined in letter from Chairman Marcy
dated September 18, 1986.

The Zoning Board of Appeals, at its meeting of September 2, 1986 at the applicant's
request, tabled this subject in order to allow time to rethink the original design
with respect to the required side yard. The original application was for a 13-foot
encroachment into thelS-foot Required Side Yard.
The applicant, by letter of September 29, 1986 and plans received September 30, 1986,
has revised the application to be for a 7'5" encroachment into the 18-foot side yard
which would leave a 10'7" separation between the proposed garage addition to the
westerly side lot line. They have also submitted, as evidence, copies of ordinances
granting side yard variations previously granted by the Village for properties which
are principally within the R-2 Zoning District, as is their property.

Gentlemen : ADMINISTRATION
We appreciate your allowing us to table our original
proposal for a two-car garage/mud room addition to our home
at the September 2nd meeting of the Zoning Board of Appeals.
We have earnestly tried to cut back on our original
request for a side yard variance and still remain light and
airy in keeping with the character of Oak Brook.
We have been residing here since 1971 and have a par-
ticular hardship in that we need a garage large enough to
accommodate two full-size American cars .
The unique circumstances are that the R-2 requirement
is one acre and 150 feet lot width, but we only have .68 acres
and a 901lot width to work with, as this home was built in
1964, previously to being annexed into the village of Oak Brook.
We have scaled down our plans and are now requesting
a variance to build a 20' 8" garage/mud room addition. This
would require a 7' 5" side yard variance and would still leave
10' 7" from our westerly side lot line. The adjoining lot
contains a dwelling with attached garage adjacent to our side
yard. This adjacent dwelling is also 30' from our lot line
which would still allow over 40' of open space between our
two homes.
It has become exceedingly more difficult and creating
more hardships for us to live without a garage . As it was
pointed out at the last meeting, we have a 140' driveway with
an uphill incline, and it would be an undue hardship to place
it to the rear due to the slope of the land continuing uphill
in a steeper grade, and it would be a herculean task to deal
with an additional 100-plus feet of driveway. Also, placing
the garage to the rear would eliminate natural light and ven-
tilation to our kitchen, powderroom and living room.
We ask that you consider the following when reviewing

our request to the applicable standards :
1. Our plight is unique because of lot size and existing
pre-annexation.
2. The variation will not alter the essential character of
the area. There would still be a minimum of 40 .feet-plus
of open space from dwelling to dwelling.
3. The practical difficulty and hardship of living without
a garage is getting greater with cold winters and hot
summers as we are , unfortunately, getting older and not
younger.
4. The steep rise in the topography from the end of our present
driveway towards the rear of the lot brings a particular
hardship, more than a mere inconvenience, in attempting to
drive a vehicle in the winter with snow and ice on this
additional incline (not mentioning the additional amount
of snow to be removed).
5. We do not feel that our petition for variation would be
applicable generally to other properties in our locale, as
our lot, and the adjoining neighbor to the west, are the
only two lots with this unique lot size , and our adjacent
neighbor and all neighbors already have garages.
6. The granting of the variation will not be detrimental to
the public welfare or injurious to other property in the
neighborhood. Our architect assures us that the addition
will have the front brick similar to the present home and
the roof line will have the same angle, keeping the struc-
ture looking like it was originally built rather than an
obvious add-on.
7. The variation will not impair an adequate supply of light
and air to adjacent property, and it will not diminish the
valuation of their properties. We will be housing two
cars, where they will be out of sight instead of lined
up on the driveway.
We have also attached, for your perusal, copies of various

Appeals of the Village of Oak Brook on July 5, 1977; and
WHEREAS, the said Zoning Board of Appeals, after said public
hearing, has recommended that the requested variation be granted; and

deem the passage of this Ordinance to be in the best interest and in furtherance

VI LAMPROS - SIDE YARD VARIATION (4 Pine Hill)
The Acting Secretary noted that the required Legal Notice was published on August
7, 1986 in the Oak Brook DOINGS.
After receiving the oath, Mr. Chris Karidis stated that he was representing Mr. and
Mrs. Lampros in this matter. Originally the property at 4 Pine Hill was located in
unincorporated DuPage County, but was annexed into the Village of Oak Brook in
1968, about the time that Mr. and Mrs. Lampros purchased the property.
The property is zoned R-2 and as such is non-conforming in that it has only a width
of 90 feet where the R-2 requirement is 150 feet. The property presently has a 31
foot side yard on the west. The house has no garage and Mr. and Mrs. Lampros -
desire to construct a two-car garage on the west, leaving a 5 foot side yard where
an 18 foot side yard is required by the R-2 district requirements. Mr. Karidis
noted that there is a significant slope fr an the rear property line to the front
property line. The neighbor to the ub st is 30 feet from the Lampros property line.
Moreover, the neighbor to the Est has a twn-car garage which is facing West. Thus
in Mr. Karidis' judgment, the Lampros' construction of the proposed garage would
not interfere with the view by this neighbor. Mr. and Mrs. Lampros will match the
masonry and shingles on the proposed garage addition to those elements in the
existing house.
In response to Chainnan Savino's inquiry regarding the overhang shown in the
architect's drawing, Mr. Karidis stated that the overhang had been eliminated to
minimize the encroachment into the required side yard.
Chairman Savino then inquired whether the applicant had considered building a one-
car garage which would canply with the required 18 foot side yard setback. Mr.
Karidis stated that this had been considered, but that it did not meet the needs of
his clients.
Member Weber stated his concern that the applicant was asking for a Variation which
would allow virtually a 75% encroachment into the required side yard. He then
inquired whether the applicant had considered constructing a garage into the rear
of the principal building. Mr. Karidis replied that such construction would block
the views fram the rear of the house and would act as a dam for the stormwater run
off. Moreover, constructing the garage in the rear would require an extensive
lengthening of the already long driveway and thereby add to the additional expense
and inconvenience of his clients.
Member Weber stated his concern with the precedent which would be set by allowing a
75% encroachment into the required side yard.
Chairman Savino stated that a Variation of this magnitude was unprecedented, but
that if the garage was constructed in the rear yard, Mr. and Mrs. Lampros would
lose much of their air, space, and light.
In response to Chairman Savino's inquiry regarding the way in which the Lampros had
lived without a garage for the past seventeen years, Mrs. Lampros stated that now
that the children had been educated, the family wished to spend the necessary funds

to provide for a two-car garage. In her judgment, a one-car garage was not in
keeping with the character of Oak Brook; moreover, no neighbors had objected to
their proposal.
Chairman Savino noted that the home was built before the Oak Brook Zoning Ordinance
took effect in this annexed area, and that therefore some hardship was no doubt
present. However, the applicant's request for a 5 foot side yard was a request for
more than a slight variation. Perhaps the applicants could scale back their
request to provide for a smaller encroachment into the required side yard.
Several members noted that the minimum width for a two-car garage was 20 to 21 -
feet.
Chairman Savino noted that it appeared to be the consensus of the Board that the
applicants were requesting a greater encroachment into the required side yard than
the Board was willing to grant. He suggested that perhaps the applicants wished to
confer with Mr. Karidis, their architect, to determine if another configuration for
the garage could be found which would be less intrusive into the required side
yard.
Mr. .Karidis requested that the Board table this matter for thirty days to allow him
and his clients to confer about a smaller encroachment.
It was moved by Member Rbber, seconded by Member Msrtinello, that this matter be
tabled to the Board's next regular meeting.
VOICE VOTE: All in favor MOTION CARRIED...
In response to the Chairman's call for any old business, Member Shumate noted that
the Village's regulations provide that a swimming pool must have a fence around it.
Moreover, these regulations provide that a solid wooden fence six feet in height is
permissible. In Mr. Shumate's judgment, such a fence can be very unsightly.
The Chairman noted that in general the Zoning Board advised the Village Board only
when asked. Trustee Philip stated that if the Village Board was of a mind, the
matter might be referred back to the Zoning Board for its review.
VII ADJOURNMENT
A motion was made by Member Vbber, seconded by Member Crouch to adjourn this
Regular Meeting of the Zoning Board of Appeals.

the appeal within reasonable time. The Board may
reverse or affirm, wholly or.partly, or may modify
the order, requirement or decision or determina-
tion as in its opinion ought to be made on the
premises and to that end has all the powers of the
official from whom the appeal is taken.
(4) Decisions: All decisions, after hearing of the Zoning
- - Board of Appeals on appeals from an administrative
order, requirement, decision, or determination of the
Building Inspector or other authorized official of the
Village of Oak Brook, shall, in all instances, be final
administrative determinations and shall be subject to
judicial review only in accordance with applicable
Statutes of the State of Illinois.
(G) Variations.
(1) Authority: The Board of Trustees shall decide all
applications for variations of the provisions of this
ordinance after a public hearing held before the .
Zoning Board of Appeals on such notice as shall be ,
required by the Illinois Statutes. The Zoning Board of
Appeals shall hold public hearings upon all applica-
tions for variations and shall report its recommenda-
tions to the Board of Trustees as to whether a
requested variation would be in harmony with its gen-.
eral purpose and intent, and shall recommend a varia-
tion only where it shall have made a finding of fact
specifying the reason or reasons for recommending the
variations.Such findings shall be based upon the stand-
ards prescribed in Section XIII G4 of this ordinance.
No variation shall be granted by the Board of Trustees
without such findings of fact. In the case of a
variation where the Zoning Board of Appeals fails to
recommend the variation, it can only be adopted by an
ordinance with the favorable vote of two-thirds of the
Trustees.
(2) Initiation: An application for a variation shall be in
triplicate and may be made by any governmental

` office, department, board, bureau or commission, or by
any person, firm or corporation having a freehold
interest, a possessory interest entitled to exclusive
possession, a contractual interest which may become a
freehold interest, or any exclusive possessory interest
applicable to the land or land and improvements
described in the application for a variation.
(3) Processing: An application for a variation shall be
filed with the Village Clerk who shall forward one
copy of such application to the Zoning Board of
Appeals for processing in accordance with applicable
_ Statutes of the State of Illinois and one copy to the
Board of Trustees.
(4) Standards:
(a) The Zoning Board of Appeals shall not recom-
mend a variation of the provisions of this
ordinance as authorized in this section unless it
shall have made findings of fact based upon the
evidence presented to it on the following specific
-, issues that:
(1) The property in .question cannot yield a
reasonable return if permitted to be used only
under the conditions allowed by the regula-
tions governing the district in which it is
located.
(2) The plight of the owner is due to unique
circumstances.
(3) The variation, if granted, will not alter the
essential character of the locality.
(b) For the purpose of supplementing the above
standards, the Zoning Board of Appeals, in
making the determination whether there are
practical difficulties or particular hardships, shall
also take into consideration the extent to which
the following facts, favorable to the applicant,
have been established by the evidence that:

(1) The particular physical surroundings, shape,
or topographical conditions of the specific
J property involved would bring a particular
hardship upon the owner as distinguished
I from a mere inconvenience if the strict letter
j of the regulation were to be carried out.
(2) The condition upon which the petition for
variation is based would not be applicable
- generally to the other property within the
same zoning classification.
(3) The granting of the variation will not be
- _ detrimental to the public welfare or injurious
to other property or improvements in the
_ neighborhood in which the property is lo-
cated.
(4) The proposed variation will not impair an
adequate supply of light and air to adjacent
property, or substantially increase the danger
of fire, or otherwise endanger the public safety
or substantially diminish or impair property
values within the neighborhood
(5) That the purpose of the variation is not based
exclusively upon a desire to make more money
out of the property.
(6) That the alleged difficulty or hardship has
not been created by any person presently
having an interest in the property.
(c) The Zoning Board of Appeals may recommend
and the Board of Trustees may require such
conditions and restrictions upon the premises
benefited by a variation as may be necessary to
comply with the standards set forth in this section
to reduce or minimize the injurious effect of such
variation upon other property in the neighbor-
hood, and to implement the general purpose and
intent of this ordinance.
(5) Unauthorized Variations. The variation procedure
shall in no case be used to accomplish a result which

could otherwise be achieved by a rezoning of the
property involved, such as, but not limited to,
establishment or expansion of a use not permitted in a

residences in other than residence districts; nor
authorizing other than single-family detached res-
idences in the R1, R2, R3 and R4 Districts.
(6) Re-applications: Any person, firm, or corporation
having been denied a variation to the Zoning
Ordinance respecting a specific parcel of property may
not re-apply for a like variation on said real property
until the period one (1) year has elapsed since the
denial of the application for variation by the

Jurisdiction.
The Plan Commission of the Village, which has been duly
established with functions as prescribed by the Illinois
Statutes, is the Plan Commission referred to in this

ordinance: .
(1) Receive from the Village Clerk copies of applications
for proposed amendments and thereafter may submit
its recommendations thereon to the Zoning Board of
Appeals and Board of Trustees.
(2) Receive from the Building Inspector copies of applica-
tions for proposed Special Uses and thereafter submit
its recommendations thereon to the Building Inspector
and Board of Trustees.
(3) Act on all other matters which are referred to it as

to you for a zoning variance of the Lampros residence at
4 Pine Hill Lane showing an overhang on the west wall of
the expansion are in error. I am taking this method to
inform you by letter that there will be no overhang on
the west wall. The roof line will be flush with the wall.
In addition, our variance request is for 5 feet from the
western most edge of the foundation to our lot line. Our
plans show that the lot line is under 5 feet. Please be
advised that this was an error. The variance requested

ACTION REQUESTED.
Our home at 4 Pine Hill Lane was built by the previous owner
without a garage in then unincorporated DuPage County and, there-
fore, was not built to Oak Brook zoning regulations. We have lived
without a garage since purchasing the home in 1971. It has been an
extreme hardship for us and we are requesting at this time for a
zoning variance . We are asking to build an attached 2-gar garage
(26 feet wide) with a room addition behind the garage to be used
as a utility room. We now have 31.08 feet from our home to the
west boundary line and the home west of us is 29.66 feet from the
end of our lot line . This addition cannot extend further than the
North wall of our home as the land behind us (North) slopes to the
south and any extension will act as a dam from water run-off.
To build a garage in another location on the lot could only be
a detached garage to the North. The land is sloped and runs uphill
and would require a minimum of 100-feet extension to the current
driveway which currently abuts the west lot line. This would give
us over 230 feet of a sloping driveway and would create an even
greater hardship.
Our lot width is only 90 feet and the zoning in an R-2
district requires 150 feet, therefore, we cannot meet the yard
requirements.

A Variation is a zoning adjustment which permits minor changes of district require-
ments where individual properties are both harshly and uniquely burdened by the
strict application of the law. The power to vary is restricted and the degree of
Variation is limited to the minimum change necessary to overcome the inequality
inherent in the property.
1. A Variation recognizes that the same district requirements do not affect all
properties equally; it was invented to permit minor changes to allow hardship prop-
erties to enjoy equal opportunities with properties similarly zoned. You must
prove that your land is affected by special circumstances or unusual conditions.
These must result in uncommon hardship and unequal treatment under the strict ap-
plication of the Zoning Ordinance. Where hardship conditions extend to other prop-
erties a Variation cannot be granted. The remedy for general hardship is a change
of the map or the text of the Zoning Ordinance.
2. You must prove that the combination of the Zoning Ordinance and the uncommon
conditions of your property prevents you from making any reasonable use of your
land as permitted by your present zoning district. Since zoning regulates land and
not people, the following conditions cannot be considered pertinent to the applica-
tion for a Variation: (1) Proof that a Variation would increase the financial re-
turn from the land, (2) Personal hardship, (3) Self-imposed hardship. In the last
case, the recognition of conditions created after the enactment of the Zoning Ordi-
nance would encourage and condone violation of the law.
3. No Variation may be granted which would adversely affect surrounding property
or the general neighborhood. All Variations must be in harmony with the intent and
purposes of the Zoning Ordinance.
