S- 599 e L AN ORDINANCE GRANTING A SPECIAL USE FOR DRIVE-IN BANKING FACILITY (Ben Franklin Savings and Loan - 1200 Harger Road) WHEREAS, the owners of the property at 1200 Harger Road have applied to the Village for a special use to permit construction of a drive-in banking facility; and WHEREAS, the Plan Commission on September 15, 1986 recommended approval of the requested special use subject to certain conditions and restrictions; and WHEREAS, a public hearing thereon was conducted by the Zoning Board of Appeals of the Village of Oak Brook on October 7, 1986 pursuant to due and appropriate legal notice; and WHEREAS, the Zoning Board of Appeals recanmended approval of the requested variation subject to certain conditions and restrictions; and WHEREAS, the President and Board of Trustees concur with the recanmendations of the Zoning Board of Appeals and Plan Commission and deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook, subject to the conditions and restrictions set forth below; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTESS OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a special use is granted to permit the construction of a drive-in banking facility at the property cammonly known as 1200 Harger Road and legally described as: That part of Lot 9 in Oak Brook Terrace, a Subdivision of part of Section 23, Township 39 North, Range 11 East of the Third Principal Meridian, according to the Plat thereof recorded October 24, 1960, as Document No. 984765, described as follows: Beginning at a point on the East line of said Lot 9, 678.15 feet North of the Southeast corner thereof; thence West along a line parallel to the South line of said Lot 9, 448.02 feet to the angle corner in the West line of said Lot 9, which is 1,971.64 feet South of the Northwest corner of said Lot 9; thence North along the Wost line of said Lot 9, 971.99 feet to the Southerly line of the 80 foot strip described as the Easement Property in the instrument dated July 16, 1962 and recorded in the Recorder's Office of DuPage County, Illinois, on September 28, 1962, as Document No. R62-34593; thence Easterly along the Southerly line of said Easement Property to the East line of said Lot 9; thence South along said East line of Lot 9 to the place of beginning, excepting therefrom the Easterly 10 feet taken for additional Spring Road in DuPage County, Illinois. The construction of the drive-in banking facility be in `- accordance with the Site Plan prepared by Joseph J. Kobylecky, A.I.A. , P.C. , dated August 18, 1986, provided that the "drop-off" lane is constructed in accordance with the Plan prepared by Barton-Aschman Associates, dated October 2, 1986. Kapff, Assistant to Village Manager SUBJECT: Ben Franklin Savings and Loan - Drive-In Bank - Special Use (1200 Harger Road) Ben Franklin Savings and Loan has made application for construction of a drive-in bank facility which will be located to the North of their existing bank at 1200 Harger Road. The original plans submitted were prepared by Joseph Kobylecky, dated August 18, 1986, and were reviewed by the Plan Commission at their meeting of September 15, 1986. The Plan Commission recommended approval of those preliminary plans subject to the following conditions: 1) Modification of the existing curb at the intersection of Harger Road and the existing roadway to the West of the building in order to create an easier turning movement. " 2) Restriction of the drive-in bank exit to right turn only traffic by such means as narrowing the exit and modifying the curb line such that exiting traffic would have a difficult time making a left turn. 3) Elimination of the proposed relocated drop off area. In response to the Plan Commission's concerns, the applicant submitted a revised drawing prepared by Barton Ashman Associates, dated October 2, 1986. This revised plan meets the first two conditions noted by the Plan Commission and calls for a redesigned drop off area which would separate the drop off area from Harger Road by means of a 4-foot wide island. The applicant's traffic consultant felt that the physical separation of this area from the Harger Road pavement would provide a safer configuration. The Zoning Board of Appeals, at its October 7th meeting, agreed with the applicant and, therefore, recommended approval of this modified plan subject to the condition that if traffic problems developed with respect to this design, the bank would be required to either relocate or remove the drop off area. This condition was agreed to by the applicant at the Zoning Board hearing. Although the preliminary plans, prepared by Joseph Kobylecky dated August 18, 1986, were initially presented by the applicant to the Plan Commission, a revised layout, prepared by Barton Ashman Associates dated October 2, 1986, was presented at the hearing. The substantive change was the redesign of the proposed parcel truck drop off area located adjacent to Harger Road. The redesign calls for a 4-foot wide island to separate the drop off area from Harger Road. The Zoning Board of Appeals recommends to the President and Board of Trustees approval of the requested Special Use Permit based on the revised plans submitted at the meeting showing a drop off area separated from Harger Road by a 4-foot island subject to the condition that if a traffic problem develops with respect to the proposed drop off area, the applicant would be required to review the situation with the Village Engineer and either remove or relocate the drop off area to a better location. This recommendation was made on a motion by Member O'Brien, seconded by Member Martinello and approved on a Roll Call Vote of seven (7) ayes: Members Bartecki, Crouch, Martinello, O'Brien, Shumate, Weber, Chairman Savino; zero (0) nays. Savino, Chairman Zoning Board of Appeals BFK/APS/jr ZONING BOARD OF APPEALS Minutes -4- October 7, 1986 V BEN FRANKLIN SAVINGS AND LOAN - DRIVE-IN BANK - SPECIAL USE (1200 Harger Road) The Secretary noted that the required Legal Notice was published in the Oak Brook DOING on September 18, 1986 and that surrounding property owners were notified of this hearing on September 4, 1986. The following persons were present representing this application: Russell Custer, Attorney; Laura Adams, bank representative; Joseph Kobylecky, architect; Gerald Solsman, traffic consultant with Barton/Aschman Associates. Mr. Kobylecky reviewed the proposed construction and noted that a revised plan had recently been prepared incorporating the Plan Commission's recommendations, except for elimination of the drop-off area along Harger Raod. Member Weber stated that the existing drop-off area is not good and, therefore, is concerned with any redesign of such an amenity. Mr. Solsman stated that the new drop-off area is separated from Harger Road by a 4- foot wide island which is safer that the current construction which has the drop- off area directly connected with the Harger Road pavement. Mr. Ray Stanis, Vice President of UIDC Management which operates the Shopping Center, stated his desire to retain access from a drop-off area to the lower level of the building. In response to Member Shumate, Mr. Solsman noted that the proposed drive-in bank area is larger than that provided by the Oak Brook Bank on Commerce Drive. Ms. Adams noted that the facility would be open on a 24-hour basis for a cash station, and that on Saturdays, the entire facility would be open from 8:00 A.M. to 2:00 P.M. Mr. Kobylecky stated that the facility would contain normal parking lot lighting for this type of facility. In response to Chairman Savino, Mr. Solsman stated that the heaviest use of the facility would be around Saturday at noon, at which time the capacity of this design would be 65 vehicles per hour. Member Weber inquired as to the overall impact of the facility on surrounding traffic patterns. Mr. Solsman stated that some users of the new facility are current users of the bank lobby and, therefore would not be adding traffic to the area. He also noted that the traffic signal cycle at Spring and Harger Roads is a 2-minute cycle and, therefore, at peak times for the drive-in bank, a maximum of two cars exiting from the drive-in bank would be added to the cycle at that intersection. He also noted that the bank would tend to be busy at times when there would be little or no office traffic in the area. In response to Member Shumate, Mr. Stanis noted that UIDC is responsible for all plowing and maintenance of both Harger Road as well as the various proposed improvements. Village Engineer Durfey noted a potential conflict point with traffic exiting the drop-off area with that from the driveway directly East of the building. He stated that although there is a potential for accidents, that does not mean accidents will happen, and that one course of action would be to allow them to build the proposed development with a 4-foot island and, if it doesn't work, the owner has agreed to change the design. Mr. Solsman noted that although there is a potential for conflicting traffic at that point, conflict points are a very cannon occurrence in a shopping center and drivers would be more atuned to such activity. The Chairman noted.no members of the audience expressing support for or opposition to the proposed Special Use Permit. Member O'Brien expressed his opinion that the Village should cooperate with its commercial residents in staying competitive so long as the proposed improvements do not create a public safety problem. A motion was made by Member O'Brien, seconded by Member Martinello to recommend to the Village President and Board of Trustees approval of the requested Special Use Permit for construction of a drive-in bank facility based on the revised Plans submitted at the meeting showing a drop-off area separated from Harger Road by a 4- foot island subject to the condition that if a traffic problem develops with respect to the proposed drop-off area, the applicant would be required to review the situation with the Village Engineer with the intent of either removing it or moving it to a better location. We wish to indi- cate our support of this request because we feel that. the addition of this facility will enable Ben Franklin to remain competitive in its field. We have reviewed plans that they have .submitted and have re-worked the entrance and exiting traffic pattern in conjunction with our traffic consultants, Barton- Aschman Associates. We are convinced that traffic will not be adversely affected on Harger Road as a result of this proposed change. We were very concerned with this question inasmuch as the bulk of the traffic entering or exiting this area is either inbound or outbound shopping center traffic. We also have noted a substantial decline in Harger Road traffic since opening the Commerce Road exten- sion concurrent with the expansion of Oakbrook Center a few years ago. We have yet to be. presented with elevations on the actual facilities.-and canopy but hope to be reviewing these matters in the near future. In any event, we feel that the proposed addition would provide a needed service to the patrons of Ben Franklin Savings & Loan and would, in fact, ease the pressure of some of the short-term parking that exists at the present time in the vicinity of the Oakbrook North Building. It was brought out in testimony that this facility will include 3 remote banking units with adequate stacking room for up to 21 vehicles. BEN FRANKLIN SAVINGS AND LOAN - DRIVE-IN BANK —SPECIAL USE (1200 Harger Road) The following persons were present representing this application: Russell Custer, attorney; Laura Adams, bank representative; Joseph Kobylecky, architect; and a traffic consultant from Barton/Asctman Associates. Mr. Kobyl ecky made the following comments concerning the site: 1) The Ben Franklin Savings and Loan occupies the first floor of an existing 8- story building located at 1200 Harger Road which is an entrance roadway connecting Spring Road and the Oakbrook Shopping Center. 2) This building's main parking area is located to the South of the building. 3) An open area of approximately 60 feet in depth exists between the North edge of the building and Harger Road. 4) The proposed drive-in bank will provide approximately a 14 car stacking area servicing 3 remote banking units. 5) The banking units will be covered by a 22-foot by 42-foot overhead canopy located approximately 12 feet off of the building and ending 6 feet from the Harger Road curb line. 6) The proposed exit fran the drive-in bank area will be right turn only. 7) The grassed area remaining between the drive-in bank and Harger Road will remain low in order to provide adequate sight distance for motorists using the site. 8) The existing drop-off area for small parcel vans is proposed to be moved easterly from its current location so that it will now be located between the proposed drive-in bank exit and an existing driveway located East of the building. 9) The North side of the building is presently overgrown with large trees and creates a visibility problem for motorists. In response to Member Sandstedt, the representative fran Barton/Aschman stated that at 5:00 P.M., Harger Road exhibits an approximate 4-5 car backup at the signal light at Spring Road and that the amount of traffic exiting the drive-in bank would have a minimal impact. He also stated that design standards for such a facility require stacking for six cars per remote banking unit requiring, in this case, 18 stacking where there has been provision for 21 on the proposed plans. He also would recommend no restriction to exiting traffic to right turn only, since the signal at Spring and Harger Roads already creates adequate gaps in Harger Road traffic. This property presently gains access off of an 80-foot wide private access easement which provides access for shopping center traffic to Spring -Road. As such, this access easement is not a public road but is simply a private driveway providing access to the shopping center. I have enclosed a copy of Dale's August 25th memo and noted the resolution of certain questions he raised concerning this application. The only open issue from Dale's memo concerns the possible traffic congestion caused by this drive-in facility with respect to other existing access points in the immediate vicinity. We are convinced that traffic will not be adversely affected on Harger Road as a result of this proposed change. We were very concerned with this question inasmuch as the bulk of the traffic entering or exiting this area is either inbound or outbound shopping center traffic. We also have noted a substantial decline in Harger Road traffic since opening the Commerce Road exten- sion concurrent with the expansion of Oakbrook Center a few years ago.
