AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF SECTION XI(E)(4)(d)
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ORDINANCE G-60, AS AMENDED,
RELATIVE TO SPACING BETWEEN SEPARATE DRIVEWAY ENTRANCES ON A LOT
(Commerce Plaza - 2001, 2015 and 2021 Spring Road)
WHEREAS, an application has been filed requesting a variation from the
provisions of Section XI(E)(4)(d) of the Zoning of Ordinance of the Village of
Oak Brook, Ordinance G-60, as amended; and
WHEREAS, a public hearing on said application was conducted by the
Zoning Board of Appeals of the Village of Oak Brook on August 4, 1987 pursuant to
due and appropriate legal notice; and
WHEREAS, a recommendation has been made by said Zoning Board of Appeals
that the requested variation be granted; and
WHEREAS, said Zoning Board of Appeals made explicit findings that the
Variation requested meets the applicable standards set forth in
Section XIII(G)(4) of the said Zoning Ordinance of the Village of Oak Brook; and
WHEREAS, the President and Board of Trustees of the Village of Oak
Brook concur with the recommendation and findings made by the said Zoning Board
of Appeals;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section XI(E)(4)(d) of the Zoning Ordinance of the Village of Oak Brook so as to
allow the construction of two driveway entrances 289.75 feet apart along Commerce
Drive on the property known as 2001, 2015 and 2021 Spring Road, Oak Brook,
Illinois, which property is legally described in Section 3 hereof.
Section 3: That this Ordinance is limited and restricted to the
property located at 2001, 2015 and 2021 Spring Road, Oak Brook, Illinois which
property is legally described as:
Lot 3 in Oak Brook Development Company's Commerce Plaza
Subdivision Unit One, being a Subdivision of part of Lot 2 and
all of Lot 3 in Oak Brook Investment Company Assessment Plat
No. 4 and part of Lot 1 and all of Lot 3 in Butler Company-M-
1, Inc. Assessment Plat No. 1, all in the Southeast 1/4 of
Section 23, Township 39 North, Range 11 East of the Third
Principal Meridian, in DuPage County, Illinois.
Permanent Parcel Numbers 06-23-404-025, 06-23-404-026 and
06-23-404-027.
Section 4: That the variation granted herein is specifically subject
to the condition that the driveways to be constructed pursuant to the terms of
this Ordinance be constructed in conformance with all ordinances of the Village
of Oak Brook and at the locations specified in the Site Plan entitled "Commerce
Plaza Redevelopment Phase 1" prepared.'by Jack Train Associates, Inc. dated as
received July 16, 1987, a copy of which is attached hereto, labelled Exhibit 1,
and hereby made a part hereof.
Section 5: That this Ordinance shall be full force and effect from and
after its passage and approval pursuant to law.
