ORDINANCE NO. S- 616
AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTION VII(D)(3) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
ORDINANCE G-60 AS AMENDED RELATIVE TO THE LOT AREA
(3016 35TH STREET)
WHEREAS, an application has. been filed requesting a variation from
the provisions of Section VII(D)(3) of the Oak Brook Zoning Ordinance, Ordinance
G-60 an amended, to permit a reduction in the required lot area for a lot in the
R-2 zoning district from one (1 ) acre to .44 acres; and
WHEREAS, a public hearing on the said application has been conducted
by the Zoning Board of Appeals of the Village of Oak Brook on October 6, 1987
pursuant to due and appropriate legal notice; and
WHEREAS, a recommendation was made by said Zoning Board of Appeals
that the variation requested be granted; and
k WHEREAS, said Zoning Board of Appeals made explicit findings in its
report dated October 9, 1987 that the variation requested meets the applicable
. standards set forth in Section XIII(G)(4) of the said Oak Brook Zoning; ordinance;
and
WHEREAS, the President and Board of Trustees concur with the
recommendations and finding made by the Zoning Board of Appeals deeming the
granting of the variation to be appropriate, subject to certain conditions
stated herein;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as
follows:
Section 1 : That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section VII(D)(3) of the Zoning Ordinance of the Village of Oak Brook so as to
permit a reduction in the required lot area of a lot in the R-2 Zoning District
from one (1 ) acre to .44 acres for the property described in Section A hereof.
l Section 3: That the variation granted pursuant to Section 1 hereof
is made explicitly subject to the following conditions:
A. That the owner and all necessary parties submit to the Village an Assessment
Plat in conformance with the provisions of Article XI-A of the Subdivision
Regulations of the Village in form and substance acceptable to the Village.
B. That within one (1 ) year from the date of this Ordinance, the existing
structures on the subject property be demolished and removed in their
entirety from the subject property and actual physical construction commenced
of a single family residence structure.
Section 4: This Ordinance is limited and restricted to the property
known as 3016 35th Street, Oak Brook, Illinois which properly is legally
described as follows:
The East 75 feet of the South 290.4 feet (except the North
10 feet of the South 146 feet of the West 10 feet thereof)
of the following: The South 30 acres of the Southwest
Quarter of the Northwest Quarter of Section 33, Township 39
North, Range 11 East of the Third Principal Meridian,
(except the West 660 feet thereof and except the East 374.75
feet thereof) in Du Page County, Illinois.

Section 5: That this Ordinance shall be in full force and
effect from and after its passage and approval pursuant to law.
