ORDINANCE GRANTING A FLOOD PLAIN SPECIAL USE PERMIT
PURSUANT TO SECTION 10-34 OF THE CODE OF ORDINANCES OF THE VILLAGE OF
OAK BROOK TO ALLOW CONSTRUCTION OF BRIDGES IN THE FLOOD PLAIN
(BUTLER NATIONAL GOLF CLUB 2616 YORK ROAD)
WHEREAS, the owners of the property described herein have petitioned
the corporate authorities of the Village of Oak Brook, DuPage and Cook Counties,
Illinois for a flood plain special use permit under Section 10-34 of the Code of
Ordinances of the Village of Oak Brook to allow the construction of three bridges
in the flood plain area; and
WHEREAS, a public hearing on said petition has been conducted by the
Zoning Board of Appeals of the Village of Oak Brook on October 6, 1987 pursuant
to due and appropriate legal notice; and
WHEREAS, on September 21 , 1987 the Plan Commission of the Village of
Oak Brook submitted its recommendation to the President and Board of Trustees
recommending the granting of the relief requested; and
WHEREAS, the proposed use satisfies the requirements and is
consistent with each of the factors set forth in Section 10-34(c) of the Code of
Ordinances of the Village of Oak Brook; and
WHEREAS, the corporate authorities of the Village of Oak Brook deems
the passage of this ordinance in the best interests of the general welfare of the
Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1 : That the provisions of the preamble hereinabove set
forth are hereby adopted as though fully set forth herein.
Section 2: That pursuant to Section 10-34 of the Code of Ordinances
of the Village of Oak Brook a flood plains special use permit is hereby granted
to allow the following work to be done on the property described in Section 3
hereof:
A) Construction of a new steel pedestrian bridge across Salt Creek
between the seventh green and eighth tee;
,B) Widening and stabilization of an existing pedestrian
bridge across the secondary channel near the first
green;
C) Construction of a low flow culvert crossing first
fairway to the area between the eighth and second tees;
and
D) The provision of compensatory storage in the secondary
channel near the first green;
all as depicted on the site plan entitled "Site Improvement Plan Butler National
Golf Club Creek and Channel Crossings" prepared by Lindley and Sons, Inc. and
dated 8-13-87, a copy of which is attached hereto, labeled Exhibit A, and hereby
made a part hereof.
Section 3: That the flood plain special use granted pursuant to this
Ordinance is limited and restricted to the property commonly known as the Butler
National Club located at 2616 York Road, Oak Brook, Illinois, which property is
legally described as follows:
Lot 1 in Butler National Golf Course Assessment Plat
No. 1 of parts of Sections 25 and 26, Township 39
North, Range 11 East of the Third Principal Meridian
which Plat was recorded on March 23, 1979, as
Document No. R79-23378 in DuPage County, Illinois.
