AN ORDINANCE AUTHORIZING CONDEMNATION OF CERTAIN PROPERTY
WITHIN THE VILLAGE OF OAK BROOK, DU PAGE, ILLINOIS
WHEREAS, it is necessary to construct a water reservoir of four million
(4 million) gallons in order to better assure a constant supply of potable water
to the residents of the Village; and
WHEREAS, it is necessary that a site for.said water reservoir be
purchased by the Village of Oak Brook to accomplish this objective;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section l: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That it is necessary in order to preserve the public
health, safety and welfare that a water reservoir be constructed by the Village
of Oak Brook.
Section 3: That in order to construct said water reservoir it is
hereby determined that it is in the best interest of the Village of Oak Brook and
necessary that said Village acquire title to and possession of the following
described property for purposes of said water reservoir:
Lots 1 and 2 (except that part conveyed for Tollway purposes
and except the East 210 feet of Lot 2 and except the North 120
feet of the East 75 feet of Lot l) of Bullinger Estates, a
Subdivision in the South West 1/4 of Section 28, Township 39
North, Range 11, East of the Third Principal Meridian,
according to the Plat thereof recorded August 19, 1947 as
Document 527420, in DuPage County, Illinois.
Permanent Parcel Numbers: 06-28-300-003 and 06-28-300-004.
Section 4: That John H. Brechin, Attorney for the Village of Oak
Brook, be and is hereby authorized, empowered and directed to negotiate for and
on behalf of the Village of Oak Brook with the owners of said real property for
the purchase thereof by the Village of Oak Brook. Said attorney is authorized to
offer the full fair cash market value price for the purchase of said property
consistent with the fair cash market value thereof as determined by an appraisal
authorized by the corporate authorities.
Section 5: In the event said John H. Brechin, on behalf of the Village
of Oak Brook, is unable to agree with the owners of said property on the
compensation be paid therefor, then title to and possession of said real estate
specifically described in Section 3 of this Ordinance shall be acquired by the
Village of Oak Brook and John H. Brechin, as attorney for the Village of Oak
Brook, is hereby empowered, authorized and directed to institute proceedings in
any court of competent jurisdiction to acquire title to said real property in the
Village of Oak Brook in accordance with the eminent domain laws of the State of
Illinois.

SUBJECT: Village of Oak Brook - Reservoir B - Special Use and Yard
Variations
In conjunction with the planned construction of Reservoir B at 2710 Meyers
Road. the Village has made the following applications:
1. Special Use Permit which would allow construction of a pumping station
aid reservoir within this residential district.
2. Variations to the side yard requirements, reducing the northerly and
southerly side yards to approximately 19' instead of the 30' required
for non-residential structures.
Both the Plan Commission at its December 19th meeting, and the Zoning Board
of Appeals at its January 3rd meeting, recommended approval of the Special
Use Permit for these structures.
The yard variations received a positive recommendation at the Zoning Board's
February 7th hearing. Mrs. A. E. Bluhm, representing the Trust which owns
properties directly north and south of the reservoir site, was present at the
hearing and submitted into the record a January 11, 1989 letter to Mr. Paul
Weber and two letters addressed to the Village dated January 29 and February
6, 1988. In addition to staff and Harza Engineers responding to her concerns
at the hearing, it was agreed that our Village Engineer would walk the
reservoir site with Mrs. Bluhm prior to the Village Board's consideration of
this subject at its February 14th meeting. Dale is scheduled to meet with
Mrs. Bluhm late Friday, and as such, will provide a verbal report to the
Board at its February 14th meeting.

difference of 18' We feel no consideration was given to the natural
flow of water in regard to the next door properties.

We wonder why the whole tank could not be completely burridd to
avoid the tremendous changes in topography causing all the problems,
, impact and dangers to the adjacent properties and lives for now and
in the future. The existing residential environment has been changed
by your permit for non-residential use. This permit negates all the
values and amnemeties existing now —this means a great financial
loss to us* � We believe since you live in Oak Brook, you do realize
this yourself*
For all the above mentioned reasons, we believe we are entitled
and want td* be included in your planning for the alleviation of
the effects On us, being the adjacent residents to your Watertank
project.
1. Detailed plans of the projeot,euch as all construction dstails
such as Sanitary sewer. Water system, storm Water run off,
Utility easement around your lot must be shown to us.
2. What is the topography of the new access road being constructed
along the 1,5 A - where and how high this road is compared to our
property?
3. Storm water run off from improvements and drainage led to?
4. Where is the connection burried for the Sanitary sewer and
and water - how is this going to be led to� he buildings in
relationship to our lots and properties?
All these questions should be made known to us.
Presently, we have no standing water on any of our properties -
North the lot, or South of the project our home.
We have not heard of any impact study by the Village of Oak Brook
in regard to the proposed Watertank project and its effects.
As we know, none of the previous Watertank projects were constructed
In such close proximity to a residential area with so little space
in between.
We would like to ask you, Mr. Weber, and the rest of the members
of the Zoning Board of Appeal, how would you feel you have such
a monstrous non-residential thing sitting practically in front
of your doorsteps?
However, we assure you of the willingness to work where the rights
of all parties to the project can be preserved and health and
safety and property values can be provided for us.
I hope and expect to hear from you this time, expecially since
we had been given no consideration by the Village of Oak Brook
up to this date.
We submit this letter for your information and to be put on the
agenda of the next meeting of the Zoning committee for discussion
and consideration.

Gentlemen:
Thank you for your letter dated 2/288 and copy of appraisal
dated 12/9/87. .
However$ we find the appraisal mailed to us completely un-
acceptable and unrealistic.
There are several discrepancies in area description and des-
cription in general. We know the area well since we have
lived here since 1958. Our homes were used in the Chicago
Trubune to advertises a view of Oak Brook in _total, which .
led to the beginning subdivision of Ginger Creek# and the
existance of Oak Brook in general.
The Appraiser also mentions census figures from 1980 and his
appraisal reflects prices from 10 - 15 years ago.
lour 41409000.00 offer equals a price of $2.14 per sqft.
This certainly is unrealistic even for any residential site
here in Oak Brook.
Since Oak Brook prides itself to 'be such an;.. exclusive area
it would be a poor testimony if all surrounding areas as
Oak Brook Terrace and Downers Grove can command sqft prices
of $13.001 $17.00 and $25.00. See map of area enclosed
showing proximity to our property.
Our piece consists of 1.5 Ac. = to 65#340 sqft and not 63,840
wgft. as stated by your appraiser.

We also enclose an appraisal from an independent, certified
appraiser with actual prices paid for large and small home=
sites in the immediate area and Oak Brook in 1986 and 1987.
These prices- xill substantiate our asking price of '015-00
per sqft. which is very realistic in comparison to all .
factors entering in the general appraisal_UL this site.
Tour offered price 'of less than $15.00 per sqft puts us in -
a worse monetary position, compared to the monetary position
we are in now in regard to the value of 65,340 sqft in the
parcel on Meyers Road, Oak Brook.
A new acquisition or replacement of the same area,'of square-
footage in this town especially on Meyers Road would not be
possible with your monetary offer.
Since access to the open market for now and in the future
is taken from us in regard to our property, a replacement
of the same area, with the same square-footage will be
necessary for us. The same economical position as the prsents
with all future possibilities in regard to exchange of value
of our property for your project would be the basis of our
negotiation.

Gentlemen:
First I would like to summarize what has transpired so fare re-
garding the above mentioned property.
I received two (2) letters from the Village of Oak Brook dated
11/23/87 and 1/5/88. I received the first letters which was mailed
to the. Trusts after the Village Board Meeting dated 12/8/87 agreeing-
to condemn the—aiova mentioned property, without our knowledge. ' The
first letter to us never identified the above property: it mentioned
2 Acres and a house. (No legal description etc.) After my requests,
the second letter from the Village of Oak Brook finally identified
the property, I received this letter after January 5s 1988.
On January 22s 1988 I received a Newsletter from the Oak Brook Civic
Association by mails stating that condemnation of the above property
was already voted on 3-2s and to table the matter to Executive session.
I was unable to find out when the Executive session was or its outcome.
In fall when the Village of Oak Brook drilled holes on our property: -
we inquired what the purpose of this was. We were told that they
only want to find out how much radon was in the ground.

Then in December 1987: a construction truck was placed in front of
the above mentioned property; we again inquired what the meaning of
this .act-ion was. We were told this was for the widening of Meyers- Road.
We feel all these actions where very ambiguous and a complete denial
of the basic rights of a property owner.

The normal procedures to 9equire any property must be preceded .by
1. Legal description and formal intent to purchase the property.
P. Legally identifying the person empowered to deal for the
Village of- Oak Brook.
3. Presenting the plans and purpose of purchase and their
consequences to next door properties, including environ-
mental studies guaranteeing the safety of their plans.
4. Notification of adjoining property owners by mail by the
Village of Oak Brook's intent, to buy the property for
special use and land modification.
5. No monetary offer was ever given in writing or otherwise
until I received the letter from the Village of Oak Brook
on .1/25/88 while I was out of town until 1/28 /88.
-111 these actions on the part of the Village of Oak Brook gave' us
no chance at all to Iresent our side, especially, since we ourselves
.had plans for developing the above mentioned property intthe future.
Sooner or later we would have purchased the property 2710 Meyers Rd.
when it would have come on the market.
This is a forced sale and the Village of Oak Brook certainly forces
us to 'sell under duress. Under such conditions, the Law says we
must not be worse off financially and economically as if the property
would not have been taken. The Law says "The seller is entitled
to have the property valued at is highest and most Profitable use,
even if the property is not currently being used in such a manner."
This forced sale does not only take away the possibility of sub
dividing the above mentioned property to 4.5 lots per acre, it
also greatly affects our next door property, which is our home,
with all the detrimental impact like:
1. Effect of a 15 foot mount with water pressure of 4 million
gallons.
2. Loss of property value of our next door property with our
home.
3. Loss of the normal watershed and its subsequent consequences.
4. Loss of privacy, due to the fact that the street becomes a.
utility street with its inherent problems, like traffic and
transients. Since our property to the west boarders on '
_ Non-Oak Brook property we have no proper Police protection.
5• Loss of possibility ofdeveloping the three contiguous
properties as planned into beautiful choice homesites. ..
6. Nowhere in Oak Brook will we be able to obtain the same
contiguous square footages for the price the Village of
Oak Brook is offering to us.

In order to compensate for all these hardships we counter---
propose a price of $15.00 per sgft. so we will not be worse
off than before. The price of $15.00 is based on actual
average sales prices in this area.
In ending this letter, we want to stress that we are willing
to work with the Village of Oak Brook in their "eat for
serving the community and surrounding areas.

This recommendation was approved on a roll call vote of seven ayes, Members

2. A great majority of the house, which was constructed prior to 1960 and
annexation to the Village, is located within the 60' rear yard. -- ---
3. The proposed addition will not set a precedent since a number of
properties within the Robin Hood Ranch area are constructed within the
yards .and therefore, the proposed construction would not be out of
character.
A motion was made by Member Herman, seconded by Member Crouch, to recommend
approval of the requested rear yard variation which would allow construction
of an addition encroaching approximately 30' into the required 60' rear yard
based on the following findings of fact:
1. The proposed variation would not alter the essential character of the
locale.
2. The variation is not being requested with the desire to make more money
out of the property.
3. The variation, if granted, will not impair an adequate supply of light
and air to adjacent properties.
4. The variation, if approved, will allow the property owner to enhance the
neighborhood.

Village Engineer, Dale Durfey, in conjunction with Harza Consulting Engineers,
responded to concerns expressed by the Zoning Board at the previous hearing
noting the preliminary Landscape Plan, drainage patterns and necessity of
constructing a circular tank as opposed to an oval or rectangular design due
to cost as well as safety concerns.
Mrs. A. E. B1uhm, manager of Western National Bank, Trust No. 3434, submitted
copies of correspondence with the Village indicating her various concerns with
the proposed construction. Mrs. Bluhm stated that she represented the trust
which owns the property directly north and south of the reservoir site and was
concerned with the possible drainage impact and other issues concerning this
construction.

Special Use Permit & Yard Variations
The Zoning Board of Appeals, at its January 3rd hearing, recommended approval
of the requested Special Use Permit for the reservoir and pumping station.
The only remaining item to be acted on by the Zoning Board is the question of
the northerly and southerly side yard variations which reduce these side
yards to approximately 19 feet instead of the 30-foot side yard requirement
for non-residential uses. The Zoning Board, at its January 3rd meeting,
tabled this subject for reasons indicated in the minutes.
These items have since been reviewed by the Village Board at its January 10th
meeting, and all issues are summarized in Dale's January 31st memo.

SUBJECT: Village of Oak Brook-Reservoir B & Pumping Station
Yard Variations
RECOMMENDATION: That the Zoning Board of Appeals grant the requested side yard
variations based upon the hardship resulting from the need to
construct a round reservoir versus an oval or rectangular reservoir
which would cost substantially more and be less reliable over time
than the round reservoir.
At its meeting of January 3, 1989, the Zoning Board of Appeals reviewed the Village's
request for side yard variations for the proposed Reservoir B and raised comments and
concerns concerning the round configuration in order to diminish or eliminate the
requested side yard variations. Regarding these comments and concerns, I note the
following:
1. Landscape Plan
The Zoning Board was concerned that a formal landscaping plan was not submitted
with the application. A formal plan was not submitted since the zoning ordinance
does not mention the requirement of submitting a landscaping plan. The packet
did include a design sketch which allowed the Zoning Board to be familiar with
the landscaping concept as approved by the Village Board, that being a terracing
effect on the north and south sides of the proposed reservoir on which landscape
screening material would be planted in order to mitigate the appearance of the
terraced landscaping walls. The design sketches submitted are typical of design
sketches for this type of project prior to the drafting of final construction
drawings. The design engineer, Harza Environmental Services, Inc. , (HES) is
completing the final landscaping plans, a copy of which is attached for your
information.
2. Round Configuration Versus Oval or Rectangular
The Village Board previously discussed the design concept of the configuration
of the reservoir with the engineer, and concluded that a round configuration was
the most cost effective and reliable. The Village Board also directed that the
tank should be totally buried if feasible. Based upon that direction, HES
proceeded with final design which resulted in the need for the current side
yard variations.

The attached memo dated January 10, 1989 to the President and Board of Trustees
from Stephen Berley and myself addresses that many issues raised by the Zoning
Board concerning cost figures associated with different concepts, increasing
the height to eliminate the required yard variations, and other items. To
summarize, the oval design would increase construction costs $800,000 to
$1,500,000, th&*rectangular design would increase costs $180,000 to $300,000,
and the higher circular design would increase costs $145,000 to $285,000. Based
upon all information submitted, the Village Board chose not to direct HES to
produce alternative site plans showing the rectangular or different circular
tank designs along with the access road on the site, but did direct that HES
continue on the design process with the current decision of designing and con-
structing a circular tank.
3. Drainage
The existing drainage on the site is in a westerly to easterly and northeasterly
direction. This concept will not be changed with construction of the reservoir.
Swales will be constructed around the north and south edges of the tank so that
storm water runoff will continue to flow west to east. A small portion of the
rear of the site will flow northwesterly onto the access road, but then flow
northeasterly down to the low point which will then be carried northerly toward
the Tollway as presently exists.
In summary, hardship does exist for the granting of the requested side yard variations
based upon the need of constructing a circular tank. Other configurations involve the
additional expenditure of significant public funds, exhibit significantly reduced
aesthetic impacts on the surrounding area, and are less reliable over time. The round
design provides the best long term value at the least cost the Village's water customers.

4. Public Works & Library: Trustee Imrie - Library Board conducted a
public opinion poll related to upgrading the Library to 10,000
square feet.
5. Sports Core: Trustee Maher - No report.
6. Zonino_& Planning: Trustee Winters - Recommendation by the Zoning
Board of AVeals that a Special Use Permit be granted for the
proposed reservoir located at 2710 Meyers Road. The variation
requests,,were tabled for further information on location and
design.

VI. NEW BUSINESS:
A. Discussion of Traffic Signal at 35th Street and Meyers Road:
Since the County will not participate in the cost for installation of
a traffic signal at the subject location, discussion ensued as to
whether or not to budget for this project.
Trustee Bushy moved, seconded by Trustee Maher. . .
That staff advise DuPage County of its desire to assume financial
responsibility for the installation of a traffic signal at the subject
location.

B. Request for Purchase Order - Voice Recorder/Reporducer - Police
Department:
Current recorder/reproducer unit became inoperative and beyond repair.
Trustee Rush moved, seconded by Trustee Bartecki. . .
To approve a purchase order for a new magnasync voice recorder/
reproducer Model #2RP20 from Magnasync/Moviola Corporation in the
total amount of $12,200.00 and waive the bidding requirements due to
the purchase being under the State of Illinois contract.

C. Heritage Oaks Unit 2 - Preliminary Plat:
On December 19, 1988, the Plan Commission recommended approval of this

out in conjunction with the final plat. Proposed subdivision is
located directly southwest of the existing Heritage Oaks Subdivision
west of Meyers Road and north of 35th Street, resubdividing an
approximate 17-acre parcel into 11 residential lots.

At the January 3, 1989 Zoning Board of Appeals meeting, the Zoning Board
tabled the Village 's application for side yard variations pending receipt
of the following information:
1 . Alternative site plans showing an oval tank shape and other alter-
nates which would allow reduction in the variation .
2 . Cost figures associated with a round and oval tank structure.
3. Any potential drainage impact created by the proposed structures .
4 . Revised site plan relocating the driveway onto the subject property
going around the oval tank .

Yesterda y morning,, Floyd Wilson and Bruce Kapff met with Steve and Dale to
discuss this subject . This morning, Steve and Trustee Winters discussed
the matter with Leonard Holt of Harza Environmental Services, Inc . (HES) .
The following information was reviewed:
1 . HES does not know of any oval tank built within the United States .
They further estimate that an oval tank would cost at least
$800,000 and maybe as much as $1 .5 million more than a circular
tank . This would be due to the very high quality assurances
necessary to assure the proper construction of this unique config-
uration .
2. A rectangular tank could be accommodated in the rear portion of the
lot with rough dimensions of approximately 225 ' long x 120 ' wide
x 20 ' high. This would allow the tank to be 30 ' from the south
lot line and qS ' from the north lot line, eliminating the side
Ward variations and allowing the access road to be placed on the
site.
3. A rectangular tank is roughly 15: to 2S: more expensive than a
circular tank . Assuming a circular tank costs $l .q million, the
rectangular tank would cost an additional $210,000 to $350, 000.
q. If the design was changed to go from circular to rectangular, it
would add approximately one Cl) additional month to the design time
at a cost of between $30, 000 to $'i0, 000 .
The current design is approximately 85: complete with 2-3 weeks
needed to finish . If we left HES finish and then revise the design
concept, the wasted design time between now and finishing would
amount to about $5, 000 .
S. Concerning cost savings in going from circular to rectangular, the
following would be eliminated:
A . $20, 000 - Shorter access road .
B . $1S, 000 - Simpler drainage design.
C . $60,000 - Construction sheeting not required.

tanks and therefore the quality control is much better on circular
tanks than on rectangular tanks which are built by more general
type concrete and steel contractors. Hundreds of circular tanks
have been built through the years by these specialized circular
tank contractors but general type concrete and steel contractors

have built perhaps only a few rectangular tanks per company .
7. Rectangular tanks require additional concrete and steel and
additional inspection to insure compliance with construction
drawings . HES estimates that this additional inspection would cost
approximately $3S, 000 Ca tentative circular tank inspection
contract would cost approximately $14S, 000) .
S . A rectangular tank is not as watertight as a circular tank .
However, if additional inspection is done to insure plan
compliance, it would initially place bath tanks on an even basis .
Over time, weathering and stresses would develop cracks and work
the ,points which could lead to leakage problems .
9 . An alternate design of a circular tank within the zoning setbacks
would increase the tank depth from approximately 30 ' to 44 ' . With
the current design having approximately 1S ' of tank above existing
ground, this alternate would place about 29 ' above existing ground
and perhaps make it impossible to slope up or terrace the tank .
This would then leave the top of the tank exposed . This
alternative would also increase the construction cost between
$210,000 - $3SO, 000 and the engineering design cost by $15, 000 -
$20, 000 .
10 . HES recommends a circular tank for the following reasons:
A. It saves money in construction .
B . It is more watertight .
C. It has a higher quality assurance .
11 . Since the current time schedule is to have final design plans done
by the end of January 1989, the finalized circular tank site plan
and landscaping plans would be available for the February 7th
Zoning Board meeting .
To summarize the costs, please note the following:
1 . The oval design would increase construction costs $800,000 -
$1 ,500,000 .
2. The rectangular design would increase costs $180, 000 - $330,000 net.
3 . The higher circular design would increase costs $lgS,000 - $28S, 000
net .
It now appears that the following decisions need to be made by the Village
Board:
1 . Decide whether it wishes to proceed on the current decision of
designing and constructing a circular tank or possibly changing

to appear before the Zoning Board in February.

The Secretary noted the required Legal Notice published in the Oak Brook
Doings December 7, 1988 and notice to surrounding property owners dated
December 7, 1988. Dale Durfey, Village Engineer, described the proposed
location for Reservoir B at the rear of 2710 Meyers Road noting that a
reservoir and pumping station are listed "Special Uses" within a residential
district. He also pointed out the need for a northerly and southerly side
yard variation reducing the 30-foot non-residential side yard requirement to
approximately 19 feet.
Zoning Board members expressed concern for the precedent nature of approving
yard variations where perhaps a different design might not need any

variations. A suggestion was made to construct the tank in an oval shape
which would also allow location of the access driveway on the subject
property, cutting its length in half.
A motion was made by Member Weber, seconded by Member Shumate, to recommend

pumping station on the subject property.

allow construction of a 4-million gallon reservoir and pumping station to be
located on Village property at 2710 Meyers Road. This property was recently
purchased by the Village for this purpose and is located within a residential
zoning district. Section VII(D)(2), and by reference Section VII(C)(2)(f)(7)
states that pumping stations and reservoirs are special uses within
residential districts.
The Village has made an attempt to design the reservoir and pumping stations
such that they blend in with the surrounding residential properties. As
such, the reservoir is to be located toward the back of the subject property
and partially below ground. The top of the reservoir will be covered with
grass and the sides will either be landscaped up to the top of the reservoir
with grass at a 3-to-1 slope, or on the north and south sides which are
closer to the adjoining lot lines, the areas will be landscaped with a
terraced landscaped treatment as indicated in plans contained in the file.
The pumping station will be located directly west of the reservoir and
constructed primarily below ground.
The Zoning Board of Appeals should utilize the provisions of Section XIII(J)
in reviewing and making its recommendations on this subject. The Plan
Commission, at its December 19, 1988 meeting, unanimously recommended
approval of the requested Special Use Permit for these two structures.
In addition to the Special Use Permit, construction of the reservoir requires
approval of side yard variations reducing the northerly and southerly side
yards to approximately 19 feet instead of the 30-foot side yard requirement
for non-residential uses. Residential districts contain different height and
side yard requirements depending on whether the use is residential or
non-residential in character. Residential uses may have a height of 30 feet
and a side yard of 18 feet whereas non-residential uses, which are 30 feet in
height, are required to have a 30-foot side yard. The reservoir will be
approximately 16 feet in height, much less than the 30 foot permitted for a
30-foot side yard, and also will be fully landscaped from view. The

Village's specific hardship in requesting these side yard variations is due
to the need -to construct a round reservoir due to its inherent structural
strength instead of a square or rectangular reservoir which would better fit
within the yard requirements. The Village also could have made the reservoir
taller, thereby meeting the yard requirements although this would have made
the overall structure much more visible to the surrounding properties.

the appeal within reasonable time. The Board may
reverse or affirm, wholly or.partly, or may modify
the order, requirement or decision or determina-
tion as in its opinion ought tq be made on the
premises and to that end has all the powers of the
official from whom the appeal is taken.
(4) Decisions: All decisions, after hearing of the Zoning
Board of Appeals on appeals from an administrative
order, requirement, decision, or determination of the
Building Inspector or other authorized official of the
Village of Oak Brook, shall, in all instances, be final
administrative determinations and shall be subject to
judicial review only in accordance with applicable
Statutes of the State of Illinois.
(G) Variations.
(1) Authority. The Board of Trustees shall decide all
applications for variations of the provisions of this
ordinance after a public hearing held before the
Zoning Board of Appeals on such notice as shall be
required by the Illinois Statutes. The Zoning Board of
Appeals shall hold public hearings upon all applica-
tions for variations and shall report its recommenda-
tions to the Board of Trustees as to whether a
requested variation would be in harmony with its gen-
eral purpose and intent, and shall recommend a varia-
tion only where it shall have made a finding of fact
specifying the reason or reasons for recommending the
variations. Such findings shall be based upon the stand-
ards prescribed in Section XIII G4 of this ordinance.
No variation shall be granted by the Board of Trustees
without such findings of fact. In the case of a
variation where the Zoning Board of Appeals fails to
recommend the variation, it can only be adopted by an
ordinance with the favorable vote of two-thirds of the
Trustees.
(2) Initiation: An application for a variation shall be in
triplicate and may be made by any governmental

office, department, board, bureau or commission, or by
any person, firm or corporation having a freehold
interest, a possessory interest entitled to exclusive
possession, a contractual interest which may become a
freehold interest, or any exclusive possessory interest
applicable to the land or land and improvements
described in the application for a variation.
(3) Processing. An application for a variation shall be
filed with the Village Clerk who shall forward one
copy of such application to the Zoning Board of
Appeals for processing in accordance with applicable
Statutes of the State of Illinois and one copy to the
Board of Trustees.
(4) Standards:
(a) The Zoning Board of Appeals shall not recom-
mend a variation of the provisions of this
ordinance as authorized in this section unless it
shall have made findings of fact based upon the
evidence presented to it on the following specific
issues that:
(1) The property in question cannot yield a
reasonable return if permitted to be used only
under the conditions allowed by the regula-
tions governing the district in which it is
located.
(2) The plight of the owner is due to unique
circumstances.
(3) The variation, if granted, will not alter the
essential character of the locality.
(b) For the purpose of supplementing the above
standards, the Zoning Board of Appeals, in
making the determination whether there are
practical difficulties or particular hardships, shall
also take into consideration the extent to which
the following facts, favorable to the applicant,
have been established by the evidence that:

(1) The particular physical surroundings, shape,
or topographical conditions of the specific
property involved would bring a particular
hardship upon the owner as distinguished
from a mere inconvenience if the strict letter
of the regulation were to be carried out.
(2) The condition upon which the petition for
variation is based would not be applicable
generally to the other property within the
same zoning classification.
(3) The granting of the variation will not be
detrimental to the public welfare or injurious
to other property or improvements in the
neighborhood in which the property is lo-
cated.
(4) The proposed variation will not impair an
adequate supply of light and air to adjacent
property, or substantially increase the danger
of fire, or otherwise endanger the public safety
or substantially diminish or impair property
values within the neighborhood.
(5) That the purpose of the variation is not based
exclusively upon a desire to make more money
out of the property.
(6) That the alleged difficulty or hardship has
not been created by any person presently
having an interest in the property.
(c) The Zoning Board of Appeals may recommend
and the Board of Trustees may require such
conditions and restrictions upon the premises
benefited by a variation as may be necessary to
comply with the standards set forth in this section
to reduce or minimize the injurious effect of such
variation upon other property in the neighbor-
hood, and to implement the general purpose and
intent of this ordinance.
(5) Unauthorized Variations: The variation procedure
shall in no case be used to accomplish a result which

could otherwise be achieved by a rezoning of the
property involved, such as, but not limited to,
establishment or expansion of a use not permitted in a
residence district; authorizing the construction of
residences in other than residence districts; nor
authorizing other than single-family""detached res-
idences in the R1, R2, R3 and R4 Districts.
(6) Re-applications: Any person, firm, or corporation
having been denied a variation to the Zoning
Ordinance respecting a specific parcel of property may
not re-apply for alike variation on said real property
until the period one (1) year has elapsed since the
denial of the application for variation by the
President and Board of Trustees. (Ord. No. G137,

(H) Plan Commission.
Jurisdiction.
The Plan Commission of the Village, which has been duly
established with functions as prescribed by the Illinois
Statutes, is the Plan Commission referred to in this
ordinance, and shall have the following duties under this
ordinance:
(1) Receive from the Village Clerk copies of applications
for proposed amendments and thereafter may submit
its recommendations thereon to the Zoning Board of
Appeals and Board of Trustees.
(2) Receive from the Building Inspector copies of applica-
tions for proposed Special Uses and thereafter submit
its recommendations thereon to the Building Inspector
and Board of Trustees.
(3) Act on all other matters which are referred to it as
required by the provisions of this ordinance.
(4) Review, from time to time, the provisions of this
ordinance and to make reports of its recommendations
with respect to proposed amendments to the Board of
Trustees.

The Secretary noted the required legal notice was published in the Suburban
Life Graphic on December 3, 1988. Village Engineer Durfey explained that the
modifications are basically housekeeping in nature, bringing our regulations
up to current state statute requirements and other minor changes.

approval of the requested amendments to the subdivision regulations.

Village Engineer Durfey noted the proposed location and construction of the
reservoir and pumping station on Village-owned property at 2710 Meyers Road.
In response to Commission concerns, Dale explained that a rupture of the tank
would be very unlikely although any water which might leak from the tank
would drain toward the east and northeast toward the large ditches adjacent
to the East-West Tollway and therefore not flood neighboring residential
properties. He also noted that screening will be constructed to the north
and south of the reservoir and that 2/3 of the reservoir will be placed
underground since that is more aesthetic than an above ground structure.
A motion was made by Member Beard, seconded by Member Doyle, to recommend
approval of the requested Special Use Permit for construction of Reservoir B
and a pumping station.

(J) Special Uses.
(1) Purpose: The development and execution of the zoning
ordinance is based upon the division of the Village
into districts, within any one of which the use of land
and buildings and the bulk and location of buildings
C or structures, as related to the land, are essentially
uniform. It is recognized, however, that there are
special uses which, because of their unique character,
cannot be properly permitted in particular districts
without consideration, in each case, of the impact of
those uses upon neighboring lands and upon public
+� need for the particular use or the particular location.
Such special uses fall into two categories:
(a) Uses operated by public agency or publicly-regu-
lated utilities, or uses traditionally affected with a
public interest.
(b) Uses entirely private in character, but of such a
nature that the operation may give rise to unique
problems with respect to their impact upon
neighboring property or public facilities such as,
but not limited to, single-family attached and
semi-detached dwellings, horizontal condomini-
ums and other residential developments. (Ord. No.
G-66, 12-19-66)

(2) Authority: Special uses shall be authorized or denied
by the Village Board in accordance with the Statutes
of the State of Illinois applicable to amendments of
this ordinance, and the regulations and conditions set
forth in this ordinance for special uses.
No application for a special use shall be acted upon by
the Village Board until after:
(a) A written report is prepared and forwarded to the
Board of Appeals and the Village Board by the
Plan Commission in a manner prescribed herein
for amendments to this ordinance; and
(b) A public hearing has been held by the Zoning
Board of Appeals, after due notice by publication
as provided by the applicable Statutes of the State
of Illinois for amendments and upon a report of
the Plan Commission to the Board of Trustees, if
such a report is made.
(3) Initiation: An application for a special use may be
made by any person, firm or corporation or by any
office, department, board, bureau or commission _
requesting or intended to request a zoning certificate.
(4) Processing. An application for a special use, in such
form and accompanied by such information as shall
be established from time to time by the Plan
Commission, shall be filed with the Village C)"rk and
thereafter processed in the manner prescribed thereto-
fore for applications and amendments. Special use
applications may be processed simultaneously with
requests for amendment of this ordinance. (Ord. No.

(b) Is so designed, located and proposed to be
operated that the public health, safety and welfare
will be protected; and
(c) Would not cause substantial injury to the value of
other property in the neighborhood in which it is
located.
(6) Conditions: The Plan Commission and Zoning Board
of Appeals may recommend, and the Village Board
may provide, such conditions and restrictions upon
the construction, location and operation of a special
use, including, but not limited to, provisions for
off-street parldng and loading as may be deemed
necessary to promote the general objectives of this
rordinance and to minimize the injury to the value of
the property in the neighborhood.
(A) Fees.
Fees for any relief under this ordinance shall be as
otherwise established by separate ordinance. (Ord. No.
G-132, 5-25-71; Ord. No. G-289, § 2, 3-24-81)
(L) Violation, Penalty and Enforcement.
(1) Any person, firm or corporation who violates,
disobeys, omits, neglects, refuses to comply with or
who resists enforcement of any of the provisions of
this ordinance shall, upon conviction, be fined not less
_ than $25.00 nor more than $500.00 for each offense.
- Each day that a violation is permitted to e3ist shall
constitute a separate offense.
(2) The Building Inspector is hereby designated and
authorized to enforce this ordinance. However, it shall
also be the duty of all officers, citizens and employees
of the Village, particularly of all members of the police

This morning I discussed with Bruce Kapff the subject of the Village applying for
a Special Use for our proposed Reservoir B along Meyers Road within a residential
district. The current zoning on the site is R2. Bruce has informed me that a
reservoir within this district requires a Special Use as stipulated within the
Zoning. Ordinance.
We will be gathering and generating the necessary zoning application within the

A Variation is a zoning adjustment which permits minor changes of district require-
ments u,here individual properties are both. harshly and uniquely burdened by the
strict application of Ole law. The power to vary is restricted and the degree 'of
Variation is limited to the minimum change necessary to overcome the inequality

1. A Variation recognizes that: the same district requirements do not a£i•ec:t al.1

prove that your land is affected by special circumstances or unusual. conditions.

2. You must prove that the combination of the Zoning Ordinance and the 1mcommon
conditions of your prope=rty prevents you from making any reasonable use of ycur
land as permitted by your present zoning district. Since zoning regulates lard and
not people, Die following; conditions cannot be considered pertinent to the applica-
tion for a Variation: (1) Proof that a Variation urould increa,.e the financial re-
tuxn from the M—id, (2) Personal hardship, (3) Self-imposed hardship. In the last
case, the r0copnition of conditions created after the enactment of the Zoni1i4 Ordi-
nance Would on ourage and condone violation of the law.
3. No Variation may be granted which would adversely affect surrounding property
or the ge'neral' nei.ghborhood. All Variations must be in harmony with the intent and
ptiiiposes of the Zoning Ordinance.
