ORDINANCE NO. S- 627
AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS
OF SECTION X(B)(3) RELATIVE TO FLOOR AREA RATIO ON A LOT ZONED ONA-1
(1000 Commerce Drive - AT&T)
WHEREAS, an application has been filed requesting a variation from the
provisions of Section X(B)(3) of the Zoning Ordinance of the Village of Oak Brook,
Ordinance G-60 as amended; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals of the said Village on December 1, 1987, pursuant to due
and appropriate legal notice; and
WHEREAS, the said Zoning Board of Appeals has recommended the granting of
;sz,id variation subject to conditions; and
WHEREAS, the Village President and Board of Trustees concur with the
findings of fact and recommendation of the said Zoning Board of Appeals as set
forth in the minutes of their December 1, 1987 meeting subject to certain further
conditions set forth herein;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That a variation is granted from the provisions of Section
X(B)(3) of the Zoning Ordinance of the Village of Oak Brook so as to allow
construction of arm addition to an existing nonconforming building resulting in a
Floor Area Ratio (FAR) of 0.8 on the property described in Section 2 hereof..
Section 3: That the variation granted pursuant to this ordinance is
limited and restricted to property located at 1000 Commerce Drive, Oak Brook,
Illinois which property is legally described as:
Lot 3 in Oak Brook Development Company's Commerce Plaza
Subdivision, unit Three, of part of Lot 1 and all of Lot 2
in Butler Company K-1 Incorporated, Assessment Plat No. 1
Of parts of Sections 23 and 24, Township 39 North, Range
11, East of the Third Principal Meridian, according to the
Plat of said Oak Brook Development Company's Commerce Plaza
Subdivision, Unit Three recorded April 8, 1969, as Document
R69-14514, in DuPage County, Illinois, Permanent Parcel No.
06-23-404-020. + 07.3
Section 4: This Ordinance and the variation herein granted are
expressly subject to the following conditions:
(A) That the variation granted hereunder shall be in effect only for so
long as the principal use of the property described in Section 3 hereof is utilized
as a telephone exchange building.
(B) That the record owners of the subject property execute a written
agreement in form and surstaace acceptable to the Village as approved by its
Village Attorney to demo.-'sh a portion of the improvements on the property so that
the Floor Area Ratio (FAR) of the property not exceed 0.54. Such demolition shall
occur if and when the principal use of the building is changed from that of a
telephone exchange building within 30 days of such change in use.

Section 5: This ordinance shall be in full force and effect from and
