S-622 )ofl,(N N CaRAM 41 AN OIiDINANCL GRANTING VAILIiiTION& FRO![ TIiB PROVISIONS OF BF4'PION XI(E U4 W AND SECTION XI 8 3 REGARDING DRIVMY SPACIII3 AND PARKING AISLX 1[I17Tlx srau- S-42M (Northwest Garner of 16th Street and Route 83Z c4mai1ME®W1 e— WHEREAS, an application has been filed requesting variations from the provisions of Section XI(E)(4)(d) of the zoning ordinance of the Village of Oak Brook to permit the spacing of two entrance driveways on the south lot line to be reduced to not less than 100 feet from the required 150 feet, and a variation from the requirements of Section XI(E)(3) to permit a reduction in the service drive/parking aisle on the west and north sides of the subject of property from 27 feet to 24 feet, and a variation from the p . ft no sq t total Section VIII(c)(5)(f) to permit construction of up to 1,420 sq. signage on the lot; and WHEREAS, the Village of Oak Brook has determined that with respect to total signage on the lot, that portion of the building facing the easterly Route 83 lot line shall be utilized in determining the Gross Surface Area of such signs, and the applicant has withdrawn the application for said variation; and WHEREAS, a public hearing on said application was conducted by the Zoning Board of Appeals of the Village of Oak Brook on January 5, 1988, pursuant to due and appropriate legal notice; and WHEREAS, the Zoning Board of Appeals has recommended that the requested variations for driveway separation and aisle width be granted; and WHEREAS, the said Zoning Board of Appeals made explicit findings that the above mentioned variations meet the applicable standards set forth in Section XIII(G)(4) of the said Zoning ordinance of the Village of Oak Brook; and WHEREAS, the President and Board of Trustees of the Village of Oak Brook concur with the recommendations and findings made by the said Zoning Board of Appeals regarding said variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF PY.E VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a variation is hereby granted from the provisions of Section XI(E)(4)(d) of the Zoning Ordinance of the Village of Oak Brook to permit the spacing of two entrance driveways from the required 40% of the length of the south lot line (150 feet) to be reduced to not less than 100 feet. Section 3: That a variation is hereby granted from the provisions of Section XI(E)(3) of the Zoning ordinance of the Village of Oak Brook to permit a reduction of the service drive/parking aisle on the west and north sides of the subject property from 27 feet to 24 feet. Section 4: That this ordinance is limited and restricted to property located at the northwest corner of 16th Street and Route 83, which property is legally described as follows: Lot 1 of Vantage Properties Resubdivssion recorded October 29, 1987 as Document No. R87-156766, being a resubdivision of Lots 13 through 17 and 19 through 28 and parts of Lot 18 in Block 1 in Town Development Company's Elmhurst Countryside unit number one, being a subdivision of part of the northeast 1/4 of Section 22, Township 39 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded June 22, 1945 as Document No. 479816, in Du Page County, Illinois. The foregoing property is also described as follows: Commencing at the Southeast corner of the Northeast 1/4 of Section 22, Township 39 North, Range 11, East of the Third Principal ordinance No. 8- 629 Granting Variations From Provi- siona of Section XI(E)(4)(d) and Section XI(E)(3) Regarding Space and Parking Aisle width (Northwest Corner of 16th Street and Route 83) i Page Two Meridian; thence west along the swath line of said Northeast 1/4 16.4 feet; thence North 20-08'-20" east along the west right of way of Route 83 40.03 feet to a point on the North line of 16th Street as recorded per Town Development Company's E1,.aurst Countryside Unit No. One per Document No. 479816; thence west along the North line of said 16th Street 41.50 feet to the point of beginning; thence continuing west along the North line of said 16th Street 375.95 feet to the East line of Monterey Avenue as recorded per said Town Development Company's Elmhurst Countryside Unit No. One; thence North O East along the east line of said Monterey Avenue 580.00 feet to the North line of Lot 28 of said Town Development Company's Elmhurst Countryside Unit one; thence North 890-58'-19" East along the North line of said Lot 28 185.00 feet; thence South 00 East along the East line of said Lot 28 70.00 feet; thence North 890-58'-19" East along the North line of Lot 13 of said Town Development Company's Elmhurst Countryside Unit No. one 251.51 feet to the west right of way line of said Route 83; thence South 20-08'-20" west along the West right of way of said Route 83 404.15 feet; thence SouthwesterAy the following four courses to the point of beginning 1). South 18 -38' West 33.92 feet 2). South 350-49' west 35.00 feet 3). South 240-39' West 27.50 feet 4). South 70-20' west 21.00 feet, all in Do Page County, Illinois. Permanent Parcel Nos. 06-22-205-003 through 008, 06-22-205-018 through 024, and 06-22-205-027. Section 5: That the variations granted herein are specifically subject to the conditions that the driveways and parking aisles to be constructed pursuant to the terms of this ordinance be constructed in conformance with all Ordinances of the Village of Oak Brook, and that the said parking aisles be constructed at the locations specified in the site plan entitled "Oak Brook Commons, Oak Brook, Illinois" prepared by Green, Hiltscher, Shapiro, Ltd., Architects, as revised December 4, 1987, and that the driveways be constructed at the locations shown on the plan prepared by Metro Transportation Group dated February 5, 1988 entitled "Access System Scenario i2". A copy of said plans are attached hereto labeled as Exhibits A and B and are hereby made a part hereof. Section 6: That this ordinance shall be in full force and effect from and after its passage and approval pursuant to law. PASSED THIS 8th day of March , 1988. Ayes: Trustees Bushy, Imrie. Maher.
