S- 637 AN 0RDIXANM GRANTING VARIATIONS MM IM PFMISIOIAA 01► A 16-30)-VA, SIXTION XII(B)(2)(b) AID SEMON VII(D)t8)(e) OF THE ZOKING ORDIMMM OF TR VILLAO OE OU NW= RBLATM TO R IRRD REAR YAWS (16 Robins Boow3 Rg9S WHEREAS, an application has been filed requesting variations from the provisions of Section XII(Bt(2)(b) and Section VII(D)(8)(c) of the Zoning Ordinance of the Village of teak Brook to permit the construction of an addition encroaching approximately 11 feet into the 60 foot required rear yard on the property hereinafter described; and WHEREAS, a public hearing on such application has been conducted by the Zoning .Board of Appeals of the Village of Oak Brook on May 3, 1988 pursuant to due and appropriate legal notice; and WHEREAS, a recommendation has been wade by said Zoning Board of Appeals that the variations requested be granted and made explicit findings that the variations requested meet the applicable standards set forth in Section XIII(G)(4) of the said Oak Brook Zoning Ordinance; and WHEREAS, the Village President and Board of Trustees concur with the reco.:mendations and findings made by the Zoning Board of Appeals subject to the condition enumerated herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD} OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Se-tion 2: That the variations are hereby granted from the provisions of Section XII(B)(2)(b) and Section VII(D)(8)(c) of the Zoning Ordinance of the Village of Oak Brook so as to permit construction of an addition encroaching approximately 11 feet into the 60 foot required rear yard, provided that the addition is constructed in substantial conformity with the site plan prepared by Werner Wehmeyer and dated March 11, 1988, a copy of said site plan is attached hereto, labelled '%Zc bit A" and hereby made a part hereof. Section 3: That this Ordinance is limited and restricted to property commonly known as 16 Robin Hood Ranch, Oak Brook, Illinois, which property is legally described as: Lot 12 (except the southerly 20' thereof, measured on a perpendicular drawn to the southerly line of said Lot 12) in Robin Hood Ranch Subdivision, being a subdivision of part of the West 1/2 of Section 36, Township 39 North Range 11, east of the Third Principal Meridian, according to the plat thereof recorded June 15, 1953 as Document No. 685421, in DuPage County, IL. Permanent Parcel No. 06-36-303-012. Section 4: That the variations granted herein are specifically subject to the condition that the applicant for the variations and any other necessary parties submit to the Village a proposed plat of resubdivision of Lots 11 and 12 in Robin Hood Ranch Subdivision and any other required documentation so as to formalize the prior sale of the southerly 20 feet of Lot 12 to the owner of Lot 11. Section 5: That this Ordinance shall be in full force and effect from and after its passage and approval pursuant to law.
