FLOOD PLAIN PURSUANT TO SECTION 10-34 OF THE CODE OF ORDINANCES OF THE

WHEREAS, the subject property was previously granted a Flood Plain
Special use pursuant to Ordinance 5-455 passed August 26, 1980; and
WHEREAS, the owners of certain property described herein have
petitioned the corporate authorities of the Village of Oak Brook, DuPage and Cook.
Counties, Illinois, for an amendment to said Ordinance 5-455; and
WHEREAS, a public hearing on such petition has been conducted by the
Zoning Board of Appeals on April 5, 1988, pursuant to due and appropriate legal
notice; and
WHEREAS, on March 21, 1988, the Plan Commission of the Village of Oak
Brook submitted its recommendation to the President and Board of Trustees; and
WHEREAS, the proposed use is consistent with the best use of the flood
plain, provided that the conditions set forth below are satisfied; and
WHEREAS, the proposed use satisfies the requirements of and is
consistent with each of the factors set forth in Section 10-34(c) of the Code of
Ordinances of the Village of Oak Brook; and
WHEREAS, the corporate authorities of the Village of Oak Brook deem the
passage of this Ordinance to be in the best interest and in furtherance of the
general welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section l: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: Pursuant to Section 10-34 of the Code of Ordinances of the
Village of Oak Brook, Illinois, the flood plain special use permit previously
granted in Ordinance S-455 is hereby amended to allow dredging and filling within
the Salt Creek flood plain on the property commonly known as N.E. q* 1drant of Oak
Brook Center, Oak Brook, Illinois, and legally described as follows:
Lot 5 in OAKBROOK TERRACE SUBDIVISION, a subdivision of part
of Section 23, Township 39 North, Range 11 East of the Third
Principal Meridian, according to the plat thereof recorded
10/24/60 as D1cument X984765 in DuPage County, Illinois.
Permanent Parcel No. 06-23-300-026.
Section 3: That the flood plain special use permit herein granted in
Section 2 of this Ordinance is expressly subject to the following conditiona-
l. Provision of an "As-built" to the Village following construction.
2. Certification to the Village that the applicant has obtained any
necessary approvals from other governmental entities in conjunction
with this project, including the Hinsdale Sanitary District,
Federal Emcrgency Management Agency, Illinois Division of Water
Resources and the Kane/DuPage Water Conservation Districv.
3. Completion of the proposed construction in substantial conformity
with the plans entitled 'Oak IIrook E192 III" re tired by

Section 4: That this Ordinance shall be in full force and effect from
and after its passage and approval as provided by law.
Section 5: All ordinances, rules and regulations of the Village of Oak
Brook which are in conflict with the provisions of this Ordinance are hereby -
repealed to the extent of such conflict but only as they apply to the property
hereinbefore described.
Section 6: If any section, subsection, sentence, clause or phrase of
this Ordinance is for any reason held to be invalid, such determination shall not
affect the validity of any remaining portion of this Ordinance.

NOW, THEREFORE, 4n consideration of the granting by the
Village of the Flood Plain Special use Permit and of the mutual
promises herein contained, it is hereby mutually agreed as follows::

1. Trustee hereby covenants and agrees on behalf of itself,
!.ts successors and assigns and future holders of title to the
Subject Property, to maintain the detention area, identified on
Exhibit A hereto as being within the northerly four hundred I� 1

feet (400 1 ) of the Subject Property. The duty to maintain as

aforesaid shall mean to keep area in a neat and presentable
condition including the removal of debris, driftwood, or ob-
structions, and compliance with all laws, ordinances and �I
regulations of governmental authority which are applicable to

but not limited to, the conditions set forth in ordinance S-643

of the Village, its officers, agents, employees, contractors

SUBJECT: Cooperfund - Front Yard Variation
(611 Enterprise Drive)
Cooperfund, Inc. , as owners of the property at 611 Enterprise Drive, are proposing
construction of a 20-foot addition in front of the existing building.
611 Enterprise (Lot 11) is one of 18 properties fronting on Enterprise Drive. This
area was annexed to the Village of Oak Brook between 1958 and 1961 and according to
the 1959 Zoning Ordinance, this area was zoned M Manufacturing requiring a 100-foot
front yard. These properties were originally subdivided in 1965 and are referred
to as the Central Industrial Plaza Subdivision approved by the Village in 1965•
The Subdivision Plat only required a 40-foot setback from Enterprise Drive and not
the 100-foot setback required by the Zoning Ordinance. There are no Village
records indicating a granting of variations to all of the properties in conjunction
with the approval of this Subdivision Plat. Therefore since that time, development
of these properties has been required to meet the 100-foot zoning setback unless a
separate variation was granted. Immediately following subdivision approval in
1965, the 1966 Zoning Ordinance classified this area as ORA-1, also with a 100-foot
front yard requirement. The attached map of the Central Industrial Plaza
Subdivision has noted on each of the lots the particular front yard setback in
those cases where variations were granted from the 100-foot setback. Six of these
properties received a variation permitting a 40-foot setback. Three received a 50-
foot setback. One received a 55-foot setback. Lot 11 (the subject property)
received a 60-foot setback and one property received a 70-foot setback.
The current application came about as a result of Cooperfund's desire to construct
a 20-foot addition which would reduce the setback from 60-foot to 40-foot. The
initial building permit application filed by Cooperfund stated that a variation had
previously been granted for the property permitting a 40-foot setback which, in
fact, was not the case. Upon discovering the discrepancy involved, the Building
Department stopped any further work on the addition. Presently, only two footing
extensions have been dug and no concrete has been poured.

NOTICE IS HEREBY GIVEN that a public hearing before the Zoning Board of Appeals
of the Village of Oak Brook, DuPage and Cook Counties, Illinois, will be held on

SUBJECT: Cooperfund - Front Yard Variation
(611 Enterprise Drive)
Cooperfund, Inc. , as owners of the property at 611 Enterprise Drive, are proposing
construction of a twenty (20') foot addition in front of the existing building.
611 Enterprise Drive (Lot 11) is one (1) of eighteen (18) properties fronting on
Enterprise Drive. This area was annexed to the Village of Oak Brook between 1958
and 1961 and the zoning requirement since that time has been consistently
for a 100 foot front yard. This area was originally subdivided in 1965 as the
Central Industrial Plaza Subdivision. The confusing item in this application is
the fact that the subdivision plat only required a 40 foot setback from Enterprise
Drive and not the 100 foot setback required by the Zoning Ordinance. No Village
records indicate the granting of variations to all of the properties in conjunction
with the approval of this plat. Since that time,'development of each of the properties
has been required to meet the 100 foot setback unless a separate variation was
granted. Based on our review of the Village's zoning files and information submitted
by the applicant at the zoning hearing, of the eighteen (18) properties within the
subdivision, fifteen (15) have received some type of setback variation. Eight (8)
properties have received variations for a 40 foot setback, three (3) for a 50 foot,
one (1) for a 55 foot, one (1) for 60 feet (the subject property) , one (1) for a
70 foot and one (1) for 78 feet. The variations and dates granted are indicated on
the revised Page 11 of the folder.
The Zoning Board of Appeals at its June 7, 1988 hearing unanimously recommended
approval of the requested variation which would reduce the front yard from 60 feet
to 40 feet. In the event the Village Board concurs with this recommendation, the
necessary ordinance approving same should be prepared by the Village Attorney.

In reference to the consideration of a variance at 611 Enterprise
Drive, presented to the village by Mr. W. T. Barthel of Wood Dale,
I have the following thoughts.
I am the managing general partner of a newly formed group which has
recently purchased 616 Enterprise Drive. We object to Mr. Barthel' s
proposed variation without specific reference to his architectural
plans and/or schemes for the following reasons:
-Recent flooding and flood control in the area is
negatively served by creating additions and
specifically additions which move 60% into a
required front yard setback.
-Enterprise Drive has long been established as a very
special, small corporation user environment that is
not well served by interrupting the tree lines and
building lines currently in place.
-The requested variation would have an extremely
detrimental impact on the attractive wooded
scenario which surrounds many of the properties
on Enterprise Drive and there is no positive
impact to the neighboring areas and/or the
environment through the issuance of this variance.
We, as always, respect the judgement of the Village of Oak Brook
and will wholeheartedly support any decision you make. These
however are thoughts on the current issue.

Dear President and Board of Trustees:
The Zoning Board of Appeals, at its Regular Meeting of June 7, 1988, considered the
application of Mr. W. T. Barthel, owner's contractor, for a 20-foot addition to the
front of an existing structure which will add approximately 1,000 square feet of
office space.
After careful consideration, the Zoning Board of Appeals recommended approval of
the requested front yard variation reducing the front yard from 60 feet to 40 feet
based on the following findings of fact:
1) The property owner would be denied a reasonable return if the strict
requirements of the Zoning Ordinance were followed.
2) The property is unique due to its somewhat irregular shape.
3) The requested variation would not generally be applicable to other properties
within the zoning classification.
4) Approval of the requested variation would not alter the character of the area.
5) The current hardship is not created by any current owner of the property.
This recommendation was made on a motion by Member Weber, seconded by Member
Martinello, and approved on a Roll Call Vote of six (6) ayes: Members Crouch,
Martinello, Sarwar, Shumate, Weber, Chairman Savino; zero (0) nays; one (1) absent:
Member Herman.

Statement of Cooperfund, Inc . ( "Cooperfund" ) in support of
Request for front yard Variation at 611 Enterprise Drive,
Oakbrook
Description of Work
Cooperfund, Inc . purchased the subject one story, twelve
thousand square foot building at 611 Enterprise Drive in
Oakbrook, Illinois in 1970 to house its corporate offices .
Cooperfund, Inc . is the parent corporation of the Weight
Watchers Company.
The Company has found it necessary to expand its offices at
the location and thus proposes the construction of a 1000
square foot addition ( less than 8% of current building area)
of the same architectural character to the front of the
existing building.
Compliance with standards
The proposed addition meets local zoning standards for grant-
ing the requested front yard variation in the following
ways :
1 . The building as constructed does not allow Cooperfund to
obtain a reasonable return on the building. Cooperfund
would like to add executive personnel to its company.
The company will be much more efficient if its offices
are expanded and located at the building where the
company' s operations take place ( 611 Enterprise Drive) .
2 . The necessity for the variation is the product of unique
circumstances . The building is located on lot 11 - an
irregularly shaped parcel - of the Central Industrial
Plaza Subdivision in such a manner that to locate the
additional office space elsewhere in the building will
interfere with required parking and loading.

3 . The requested variation will not alter the essential
character of the locality. Since 1965 , the Village of
Oakbrook has granted numerous variations in the Central
Industrial Plaza Subdivision, eight of which are identi-
cal to the front yard variation sought by Cooperfund
( that is a 40 foot front yard) . Furthermore, the
minimal addition will be architecturally consistent with
the existing building. The many large trees on the
subject property will continue to buffer the building
addition from neighboring properties and the public
right-of-way. No new traffic will be generated by this
addition.
Other Considerations in Determining
Hardship
1 . The manner in which the subject building is sited on
this irregularly shaped lot makes it impossible to
locate the addition elsewhere without reducing, or
interfering with, parking and loading required by the
Village Zoning Ordinance .
2 . The condition upon which the application is based is not
applicable to other property within the same zoning
classification. The physical limitations on adding to
the building ( see 1 above) and the need to add the
necessary office space are not present generally in the
district.
3 . This front yard variation will not be detrimental to the
public welfare or injurious to neighboring properties .
In fact, many neighboring property owners have sought
and received the same, and in some cases greater, front
yard variations. As stated above, the many large trees
provide an excellent natural buffer from the street and
neighboring properties .
4 . The proposed variation will not impair an adequate
supply of light and air to adjacent properties or other-
wise affect neighboring property values . The proposed
addition will not move the building closer to any abut-
ting property. The building addition in the front yard
projects the building line 20 feet, which is a minimal
amount; moreover, no height is being added to the build-
ing. Finally, the addition will be architecturally
consistent with the existing structure.
5 . The proposed variation does not stem from a desire to
make more money. The addition will cost the Cooperfund
Corporation a substantial amount of money and will
simply allow the company to add needed office space.

6 . Cooperfund has not caused the hardship which neces-
sitates this variation. The building size was adequate
when purchased in 1970 . However, due to increased
demand for the services of the company, additional
office space is required.

The Secretary noted that the required Legal Notice was published in the Oak Brook
DOINGS on May 18, 1988 and surrounding property owners were notified of this
hearing on May 25, 1988.
Gary Chico, attorney, and Mr. Barthel, contractor, were present representing this
application and made the following comments:
1) The proposed construction is for a 20-foot addition to the front of the
existing structure which will add approximately 1,000 square feet of office
space.
2) The only place to locate the addition is to the front due to the small depth of
the lot and existing parking areas elsewhere.
3) The current property owner is not the original property owner.
4) The proposed addition will not generate any traffic difficulties.
5) Three exhibits were presented noting the location of the proposed 20' x 50'
addition, pictures of the subject site, and a marked-up copy of the Central
Industrial Plaza Subdivision Plat indicating that 14 properties have in the
past received setback variations with the majority being for a 40-foot setback
from the right-of-way.
A motion was made by Member Weber, seconded by Member Martinello, to recommend
approval of the requested front yard variation reducing the front yard from 60 feet
to 40 feet based on the following findings of fact:
1) The property owner would be denied a reasonable return if the strict
requirements of the Zoning Ordinance were followed.
2) The property is unique due to its somewhat irregular shape.
3) The requested variation would not generally be applicable to other properties
within the zoning classification.
4) Approval of the requested variation would not alter the character of the area.
5) The current hardship is not created by any current owner of the property.

WHEREAS, the subject property previously was granted a variation
reducing the required front yard to 60 feet pursuant to Ordinance S-118; and
WHEREAS, an application has been filed requesting a variation from the
provisions of Section X(B)(5) to permit construction of an addition further
reducing the setback from 60 feet to 40 feet; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals of the Village of Oak Brook on June 7, 1988 pursuant to
due and appropriate legal notice; and
WHEREAS, a recommendation has been made by said Zoning Board of Appeals
that the variation requested be granted; and
WHEREAS, the Village President and Board of Trustees concur with the
recommendation made by the Zoning Board of Appeals;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section X(B 5 so as to permit construction of a 20' x 50' addition to be
constructed at the northwesterly corner of the building in the front yard with a
40-foot setback to be limited to the area of the proposed addition and not for
the entire width of the front yard. The location and size of the proposed
addition shall conform to materials submitted to the Village as a part of the
hearing process.
Section 3: That this Ordinance is limited and restricted to property
commonly known as 611 Enterprise Drive, Oak Brook, Illinois, which property is
legally described as:

MONTH, WITH ZONING BOARD PUBLIC HEARING TO FOLLOW.
A Variation is a zoning adjustment which permits minor changes of district require-
ments where individual properties are both harshly and uniquely burdened by the
strict application of the law. The power to vary is restricted and the degree of
Variation is limited to the minimum change necessary to overcome the inequality
inherent in the property,
1. A Variation recognizes that the same district requirements do not affect all
properties equally; it was invented to permit minor changes to allow hardship prop-
erties to enjoy equal opportunities with properties similarly zoned. You must
prove that your land is affected by special circumstances or unusual conditions.
These must result in uncommon hardship and unequal treatment under the strict ap-
plication of the Zoning Ordinance. Where hardship conditions extend to other prop-
erties a Variation cannot be granted. The remedy for general hardship is a change
of the map or the text of the Zoning Ordinance.
2. You must prove that the combination of the Zoning Ordinance and the uncommon
conditions of your property prevents you from making any reasonable use of your
land as permitted by your present zoning district. Since zoning regulates land and
not people, the following conditions cannot be considered pertinent to the applica-
tion for a Variation: (1) Proof that a Variation would increase the financial re-
turn from the land, (2) Personal hardship, (3) Self-imposed hardship. In the last
case, the recognition of conditions created after the enactment of the Zoning,Ordi-
nance would encourage and condone violation of the law.
3. No Variation may be granted which would adversely affect surrounding property
or the general neighborhood. All Variations must be in harmony with the intent and
purposes of the Zoning Ordinance.
