AN OP.DTNANCE REGARDING VARIATIONS FROM THE PROVISIONS
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK,ORDINANCE G-60,
AS AMENDED RELATIVE TO ENTRANCE DRIVE WIDTH AND PARKING
REQUIREMENTS IN n-2 DISTINCT

WHEREAS, on October 23, 1987, The John Buck Company filed an application
with the Village Clerk of the Village of Oak Brook requesting, among other
things, that, with regard to certain property in the area of 16th Street and
Castle Drive, a variation be granted from the provisions of Section
XI(E)(4)(a) of the Zoning Ordinance of the Village of Oak Brook, Ordinance
G-60, as amended, to permit an entrance driveway up to 80 feet in width as
measured at the lot line adjoining 16th Street and said application was
amended on December 9, 1987, to request the granting, with regard to said
property, of a variation from the provisions of Section XI(E)12 of said
Ordinance G-60, as amended, to permit the determination of the required
minimum number of parking spaces for developments on the Ernie. Pyle property
by the provisions of Section XI(E)(12) excluding the provisions of subsection
(e) thereof., rather than by the provisions of subsection (e) as is normally
required for B-2 Regional Shopping Center Districts; and

WHEREAS, pursuant tc the statutory legal notice, the Zoning Board of
Appeals at it:, .eeting of -?nuary 5, 1988, unanimously recommended to the
Village Board that both o,. -he requested variations be granted and made
certain findings of fact in aupport thereof as set forth in the Chairman of
the Zoning Board's letter to the President and Board of Trustees dated January
8, 1988, which the Village Board hereby concurs with; and
WHEREAS, the President and Board of Trustees deem it in the best interest
of the Village of Oak Brook that the two variations be granted with regard to
the below described property.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That the following variations from the provisions of the
7onirg Ordinance of the Village of Oak Brook, Ordinance G-60, as amended, are

hereby granted:
(a) A variation from the provisions of Section XI(E)(4)(a) to
permit a single entrance driveway from 16th Street up to
80 feet in width as measured at the lot line adjoining
16th Street provided that it be aligned with the existing
entrance driveway to the Oakbrook Center now located on
the south side of 16th Street.
(h) A variation from the provisions of Section XI(E)(12) to
permit: the determination of the required minimum number
of parking spaces for developments on the Ernie Pyle
property by the provisions of Section XI(E)(12) excluding
the provisions of subsection (e) thereof, rather than by
the prov.i.slons of subsection (e) as is normally required
ror. B-2 Regional Shopping Center Districts.

Section 3: That this Ordinance is limited and restricted to the
property legally described as follows:
Lots 5 through 20 in Block 1, Lots 1 through 30 in Block 2, of Town
Development Company's Elmhurst Countryside Unit Number 2 situated in part of
the Northwest Quarter of Section 23, Township 39 North, Range 11 East of the
Third Principal Meridian in DuPage County, Illinois.
Permanent Parcel Nos.:
06-23-102-004 through 06-23-102-019; 06-23-103-002 through
06-23-103-007; 06-23-103-009 through 06-23-103-012; .06-23-103-015 through
06-23-103-032; 06-23-103-034 and 06-23-103-036.
Section 4: That this ordinance is subject to the conditions that the
John Buck Company or its nominee take title to the property North of 16th
Street, East of Illinois Route 83, and West of the Oak Brook Club Subdivision,
(also known as the Buck/Ernie Pyle Resubdivision) on or before December 31,
1988 and provide the Village with written proof thereof and that the record
owners of the Buck-Ernie Pyle Resubdivision execute and deliver to the Village
a covenant in form and substance acceptable to the Village as approved by the
Village Attorney agreeing to the conditions set forth in Resolution R-,06 of
the Village of Oak Brook.
