S- /07.7o AN ORDINANCE GRANTING A VARIATION FRON TIM PROVISIONS 0'T Cl—M-jo_g f SECTION V(B)(2) OF TM ZWING ORDINAWX OP THE VILL" OF OAK BROM, ORDINANCE Cv-60, AS AMRIOMP RELATIVE TO YARDS ON TWOUGH LOTS (404 ASCOT LANE) WHEREAS, an application has been filed r -questing a variation from the provisions of Section V(E)(2) of the Oak Brock Zoning Ordinance, Ordinance G-60, as amended, to permit the construction of a 15-foot deep by 34-foot long deck to the rear of the existing residence, extending approximately 12 feet into the 40-foot Building Setback Area adjacent to Meyers Road; and WHEREAS, a public hearing on such application has been conducted by the I Zoning Board of Appeals of the Village of Oat: Brook on August 2, 1988 pursuant to due and apprcpriate legal notice; and WHEREAS, a recommendation has been made by said Zoning Board of Appeals that the variation requested be granted; and WHEREAS, the said Zoning Board of Appeals made explicit findings that the variation requested meets the applicable standards set forth in Section XIII(G)(4) of the said Oak Brook Zoning Ordinance; and WHEREAS, the President and Board of Trustees of the Village concur with the recommendations and findings made by the Zoning Board of Appeals; NOW, THEREFORE, BE IT ORDAINED By THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OFK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a variation is hereby granted from the provisions of Section V(E)(2) of the Zoning Ordinance of the Village of Oak Brook so as to permit construction of a deck, level with the structure's first floor, provided that said deck may not be enclosed or roofed, extending approximately 12 feet into the 40-foot Building Setback Area adjacent to Meyers Road in substantial conformity with the Plat of Survey submitted with the application, a copy of which Plat of Survey is attached hereto, labelled "Exhibit A", and hereby made a part here Section 3: That this Ordinance is limited and restricted to the property known as 404 Ascot Lane, Oak Brook, Illinois, which property is legally described as follows: Lot 34 in Saddle Brook Chase Resubdivision, being a resubdivision of Lots 32 through 36, both inclusive, in Saddle Brook Chase, being a subdivision of part of the North half of section 33, Township 39 North, Range 11 East of the Third Principal Meridian according to the plat thereof recorded September 2, 1980 as Document R80-51479 in DuPage County, Illinois. Permanent Parcel No. 06-33-106-010. Section 4: That this Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
