WHEREAS, an application has heretofore been filed for a text amendment to
create a Special Use for Schools - Post Baccalaureate and the issuance of a
Special Use therefor; and
WHEREAS, pursuant to ordinance G- 422, the Village President and Board of
Trustees of the Village of Oak Brook have amended the Zoning Ordinance of the
Village of Oak Brook to incorporate the same as a Special Use in the ORA-1
zoning district; and
WHEREAS, the Plan Commission of the Village of Oak Brook has submitted
its report on the subject petition to the Zoning Board of Appeals and the
President and Board of Trustees and has recommended the approval of the
issuance a Special Use Permit subject to certain conditions; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals of the Village on November 1, 1988 pursuant to due and
appropriate legal notice; and
WHEREAS, the President and Board of Trustees have reviewed these
recommendations and concur with the recommendations and deem the passage of
this Ordinance to be in the best interest and in furtherance of the general
welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED By THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK. COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That a Special Use Permit pursuant to the provisions of
Section x(B)(2)(f) be and is hereby granted for the use of a Post
Baccalaureate School at property located at 2625 Butterfield Road, which
property is legally described as follows:
That part of Lot 1 in Butler Company - M-1 Inc. Assessment Plat No. 2 of
part of the North half of Section 28, Township 39 North, Range 11, East
of the Third Principal Meridian, DuPage County, Illinois, as per plat
thereof recorded July 8, 1964 as Document No. R64-24069 described as

WHEREAS, an application has been filed requesting an amendment to Section
X(B)(2) of the Zoning Ordinance of the Village of Oak Brook to create an
additional Special Use Category in the ORA-1 Office Research Assembly zoning
district; and

application and has recommended its approval; and

applicant could re-apply for continuation of the Special Use; and 3)
the Special Use Permit be limited to the proposed square footage within
the office building of not more than 7,000 square feet.

SUBJECT: RREEF Text Amendment - Special Use Regarding School
(2625 Butterfield Road)
This application is for a Text ndment and Special Use Permit within the
ORA-1 Zoning District which would allow Lewis University to conduct evening
and week-end extension college credit courses at the subject property The
Text Amendment, as originally proposed by the applicant, would add a
sub-category entitled "Schools Post Secondary" to the Special Use section of
the ORA-1 District. Both the Plan Commission and the Zoning Board of Appeals
felt that the title should be modified to indicate that courses offered would
be those following receipt of a Bachelors Degree. The Plan Commission
recommended a title of "School, Post Graduate" whereas the Zoning Board of
Appeals recommended "School, Post Baccalaureate" which more closely matches
the proposed use as presented by Lewis University.
Both the Plan Commission and the Zoning Board of Appeals recommended approval
of the requested Text Amendment and Special Use Permit subject to the
following conditions:
1. The Special Use Permit be limited to the Lewis University operation
as proposed for this site.
2. The Special Use Permit be limited to five years in duration, after
which time the applicant could re-apply for continuation of the
Special Use.

within the office building. The Plan Commission's recommendation was
for approximately 5,000 square feet and at the Zoning Board of
Appeals meeting, based on revised information from the applicant, the
Zoning Board limited the use to no more than 7,000 square feet.
Additional information concerning the proposed use is contained in a letter
dated October 25 from Lewis University which is in this file.

Dear President and Board of Trustees:
This application is for a text amendment and special use permit which would
allow Lewis University to conduct evening and weekend extension college credit
courses at the subject property. The proposed text amendment would add a
sub-category entitled "Schools, Post Secondary" to the Special Use section of
the ORA-1 uses.
A motion was made by Member Weber, seconded by Member Herman, to recommend a
text amendment for a "School, Post Baccalaureate" which more closely matches
the proposed use as presented by Lewis University.
This recommendation was approved on a roll call vote of six ayes, Acting
Chairman Crouch, Members Herman, Martinello, Sarwar, Shumate, and Weber; zero
nays; and one member absent, Chairman Savino.
A motion was made by Member Weber, seconded by Member Martinello, to recommend
approval of the requested Special Use Permit for a School, Post Baccalaureate,
at the subject property based on the following conditions:
1. The Special Use Permit be limited to the Lewis University operations as
proposed for this site.
2. The .term of the Special Use Permit be limited to five years after which
time the applicant could re-apply for an extension.
3. The amount of area utilized in the subject building be limited to 7,000
square feet.

As a follow up to the Oak Brook Plan Cx=nission meeting held on 10-17-88, it
was requested that Lewis University provide to the Village of Oak Brook the
intended usage of property being leased at 2625 Butterfield Broad frac 142F-'
Mid America Fund 1. As a means of introducticn, lowis University was
founded in 1932 and is spanscred by the Christian Brothers. 71* University,
which is named after the noted Chicago philanthropist and industrialist,
Frank 7. Lewis, is aocredited by the North Central Association of Colleges

Zhe University has been in the Oak Brook area for about ten years offering
classes primarily at the Oak Brook Marriott. Dine to sustained growth in our
program, we now find it adventageous to obtain larger facilities and thus
are entering into a lease agrWa*nt on the 2625 Butte field Read property.
The facility will be used primarily for the MBA program, and other graduate
program, as well as other contemporary educational offerings. For eam ple,
e.%emtive seminars, colloquiums, symposiums, and vmzferea�oes would also be
rs.ld at this location as the University oontimms to provide such services
to the area business and professional oamunity. In the past, we have held
such events at the Oak Brook Marriott, McDonald's Corporate Btrational
Center, The [hake Hotel and Mayslake. The University will use this facility
to consolidate these programs at one educational location.
Faculty for the NIDA program at Oak Stook are mainly corporate executives,
marry of whom are living and/or working in Oak Brook and the

practicing professionals and 25% practicing academicians, their ages

The students in the Oak Brook MBA program tend to be mid-level corporate
massagers and working professionals, ranging from 25 to 50 years of age, the
average age being apiar ximatsly 30.. Most are upwardly mdbi.le.. educationally
conscious men and woman with signifiow-t family and oomm rdty obligations.
Many are west suhn-bas residents ar4/or euployees of firm located in Oak
Brook.
The amount of space to be leased by T.ewis will apprnocimate 6100 square feet.

IV RREEF - TEXT AMENDMENT AND SPECIAL USE FOR SCHOOL, 2625 BUTTERFIELD RD.
The Secretary noted the required Legal Notice published in the Oak Brook
Doings October 12 and notice to surrounding property owners dated October 5.
Kelly Bufton, attorney, Rosemary Hammer-Smith, RREEF representative, Wally
Pascale, Dean, College of Business, and Mary Gee, realtor, made the following
comments in support of the application.
1. Although the Plan Commission recommended the text read "School, Post
Graduate", and this would meet Lewis University's needs, they feel the
special use should be entitled "School, Post Secondary".
2. The proposed square footage has been increased to approximately 6100
square feet with a ten-year lease.

3. The building is appropriate for this type of use since it has 24-hour
manned security and more than adequate parking.
David Gooder indicated the need for this type of text amendment since there
was a clear need for MBA programs in this area.

RREEF - TEXT AMENDMENT AND SPECIAL USE - RE: SCHOOL
Kelly Bufton, attorney, and Rosemary Hemmer-Smith, property manager, made the
following comments in support of the application:
(1) Although the Village's B-2 and B-3 districts presently allow some type
of school as a permitted use, the current application creates a special
use category for post secondary school within the ORA-1 district.

(2) The proposed school use in this district is complimentary to the office
environment within an ORA-1 district.
(3) The building at 2625 Butterfield is located in the middle of an ORA-1
zoning district and would be inappropriate for rezoning to B-2 or B-3.
(4) The building presently comprises 200,000 gross square feet of building
area on a 10-acre site. Parking presently includes five spaces per
1,000 square feet, and therefore, no problem will exist for
accommodating the proposed school use.
(5) Lewis University proposes to utilize up to 5,000 square feet of building
area.
(6) Mr. Wally Paschal, Dean of Lewis University, stated that approximately
175 graduate students study at the Oak Brook campus.
(7) Active school programs are conducted approximately 35 weeks per year on
Monday through Thursday evenings, 6:30 to 9:30 p.m.
(8) The average class size of 16, based on four proposed classrooms, will
result in approximately 60 students at any one time.
A motion was made by Member Doyle, seconded by Member Haglund, to recommend
approval of the requested text amendment creating a new special use category
entitled "School-Post Graduate" which will allow predominantly post-graduate
courses with other types of classes and/or seminars permitted as incidental
to the principal use as a post-graduate school.

VI. VILLAGE OF OAK BROOK TEXT AMENDMENT REGARDING GATES
Village Attorney Brechin described the proposed text amendments, indicating
that the intent was to clarify the height limitation of 42" which covers
driveway and other gates whether or not they are attached to a fence, as well
as various other design standards proposed by the Zoning Board.
A motion was made by Member Sandstedt, seconded by Member Haglund, to
recommend approval of the requested text amendment with the following
modification to the proposed draft as stated in Exhibit A to the application.
Section 4(4) Location of Gates
Gates shall be located a minimum distance of 30 feet from the edge of
pavement of the adjacent roadway to allow adequate room for automobile
and truck access to the property.
