AN ORDINANCE GRANTING A SPECIAL USE PERMIT AND YARD VARIATIONS
FOR A PUMPING STATION & RESERVOIR
FOR CERTAIN PROPERTY IN THE R-2 SINGLE FAMILY DETACHED RESIDENCE DISTRICT
(2706 & 2710 MEYERS ROAD, OAK BROOK, ILLINOIS)
WHEREAS, an application has been filed requesting a Special Use Permit
and Side Yard Variations for a Pumping Station and Reservoir to be constructed
as provided in Section VII(C)(2)(f)(7) and VII(D)(8)(b) of the Zoning
Ordinance of the Village of Oak Brook; and
WHEREAS, a public hearing on said application has been held by the Plan
Commission on December 19, 1988 and its report submitted to the Zoning Board
of Appeals and to the President and Board of Trustees; and
WHEREAS, a public hearing on said application has been held by the Zoning
Board of Appeals of the Village of Oak Brook on January 3, 1989 and February
7, 1989 pursuant to due and appropriate legal notice; and
WHEREAS, a recommendation has been made by the Zoning Board of Appeals
that the requested Special Use Permit and Variation be granted subject to
certain conditions; and
WHEREAS, the President and Board of Trustees deem the passage of this
ordinance to be in the best interest and in furtherance of the general welfare
of the Village of Oak Brook subject to certain conditions.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That pursuant to Section VII(C)(2)(f)(7) of the Zoning
Ordinance of the Village of Oak Brook, a Special Use is granted to property
located at 2710 Meyers Road for use as a pumping station and reservoir.
Section 3: That Side Yard Variations from Section VII(D)(8)(b) of the
Zoning Ordinance are granted to reduce the side yards each to approximately 19
feet instead of the 30-foot required.
Section 4: That this Ordinance is limited and restricted to the property
commonly known as 2706 and 2710 Meyers Road, Oak Brook, Illinois, which
property is legally described as follows:
That part of Lot 2 in Bullinger Estates, a subdivision in the Southwest
1/4 of Section 28, Township 39 North, Range 11, East of the Third
Principal Meridian, according to the plat thereof recorded August 19,
1947 as Document No. 527420, described as follows: Commencing at the
Southeast corner of said Lot 2 and running westerly along the South line
thereof a distance of 218.55 feet to the Southeast corner of property
conveyed to the Village of Oak Brook in Warranty Deed recorded April 15,
1988 as Document R88-036988; thence Northeasterly along the Easterly line
of said property conveyed in Document R88-36988, being a non-tangent
curve whose center lies Easterly and has a radius of 1898.81 feet, a
distance of 203.91 feet to a point on the North line of said Lot 2, said
point being 227.40 feet, as measured along the North line thereof,
Westerly of the Northeast corner of said Lot 2; thence Easterly along the
said North line of said Lot 2, 227.40 feet to the Northeast corner
thereof; thence Southerly along the Easterly line of said Lot 2 t the
point of beginning, in DuPage County, Illinois.

apart of a tract of land described in Warranty Deed to The Illinois
State Toll Highway Commission recorded September 26, 1958 as
Document 896379, said part being more particularly described as
follows: Beginning at the Southwest corner of said Lot 2; thence on
an assumed bearing of North 08 Degrees, 46 Minutes, 16 Seconds West
along the West Line of said Lot 2, also being along the Westerly
Line of said tract of land described in Warranty Deed recorded as
Document 896379, a distance of 128.12 feet; thence North 65 Degrees,
57 Minutes, 30 Seconds East, 26.02 feet; thence North 53 Degrees, 35
Minutes, 16 Seconds East, 110.22 feet to a point on the North Line
of said Lot 2, also being along the Northerly Line of said tract of
land described in Warranty Deed recorded as Document 896379; thence
North 84 Degrees, 14 Minutes, 48 Seconds East, along said North
Line, a distance of 97.08 feet to the most Easterly corner of said
tract of land described in Warranty Deed recorded as Document
896379; thence South 41 Degrees, 44 Minutes, 42 Seconds West along
the Southeasterly Line of said tract of land described in Warranty
Deed recorded as Document 896379, a distance of 284.65 feet (283.94
feet record) to the point of beginning. The above described Parcel
contains 0.3878 acres, '16,891 square feet, more or less. Permanent
Parcel No. 06-28-300-035.
Section 5: That this Ordinance shall be in full force and effect from
and after passage and approval as provided by law.
