ORDINANCE NO. S-675 AN ORDINANCE GRANTING VARIATIONS REGARDING GROUND SIGNS AND SETBACK REQUIREMENTS 710 OAK BROOK ROAD Whereas, an application has been filed requesting variations from the provisions of Section VI-A(10), and by reference, Section X(B)(6) of the Oak Brook Zoning ordinance, Ordinance G-60, as amended; and WHEREAS, a public hearing on such application has been conducted by the Zoning Board of Appeals of the Village of Oak Brook on May 2, 1989 pursuant to due and appropriate legal notice; and WHEREAS, the said Zoning Board of Appeals recommended that the variation allowing one additional ground sign be granted; and WHEREAS, the said Zoning Board of Appeals recommended that the requested setback from ten feet to three feet from the lot line should be denied; and WHEREAS, the President and Board of Trustees have reviewed these recommenda- tions and are of the opinion that both of the requested variations should be granted; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a variation is hereby granted from the provisions of Section X(B)(6)(f) of the Zoning Ordinance so as to allow the erection of one additional ground sign on the property described in Section 4. The sign location shall be adjacent to the Oak Brook Road entrance to the Sports Core Open Fields. Section 3: That a variation is hereby granted from the provisions of Section X(B)(6)(f) of the Zoning Ordinance so as to allow the sign to be located three feet from the lot line instead of the ten-foot required setback. Section 4: That this Ordinance is limited and restricted to the property located at 710 Oak Brook Road, Oak Brook, Illinois, which property is legally described as follows: Lot 1 of the Sports Core Subdivision, being a subdivision of part of Sec- tions 25 and 26, Township 39 North, Range 11, East of the Third Principal Meridian, Township of York, DuPage County, Illinois. Permanent Parcel #06-25-300-017. Section 5: That this ordinance shall be in full force and effect from and after its passage and approval as provided by law. PASSED THIS 13th day of June 1989. Kapff, Assistant to Village Manager SUBJECT: Village of Oak Brook - Polo Club Sign Variation 710 Oak Brook Road The Village Board, at its March 28 meeting, directed staff to prepare an application for a sign variation which would permit a "Bath & Tennis-type" sign at the Oak Brook Road entrance to Polo Field No. 3. The first variation required is from the provisions of Section VI-A(10) and by reference, Section X(B)(6) which states that "one ground sign shall be permitted for each building on a lot except that on a corner or through lot, a sign maatbe May erected along each street frontage. The Zoning Board of Appeals variation 2 hearing, on a vote of five to one, recommended approval allowing one additional ground sign on the Oak Brook Road frontage. Subsequent to the Board's March 28 meeting, after a detailed site plan had been developed, it was determined that an additional variation riationgwould bline as required to allow locating the proposed sign along the shown on the enclosed map. This particular variation is from the same provisions as noted above which states in part, "a ground sign may. . .be not closer than ten feet from any lot line." on the existing fence line would be located approximately The proposed sign three feet from the lot line and therefore, the variation requested is to permit this location instead of the ten-foot setback required. The Zoning Board, at its May 2 hearing, unanimously recommended denial of this variation since it was felt that moving the sign back to a conforming setback would not be a particular hardship and would still serve the intended purpose of to ify- ing the public of the entrance location. The applicant place the sign at a conforming location would require removal of substantial vegetation which presently screens the bike path and Field #3 from Oak Brook Road and the bike path would also need to be relocated. In the event the Village Board chose to approve these variations, only a simple majority of the Board would be required concerning the first Variation a I- A✓ l6' . 1 ' Ground Sign - 2 - May 16, 1989 whereas a favorable vote of two-thirds of the Trustees would be required concerning the second variation. A motion was made by Member Herman, seconded by Member Martinello, to recommend approval of the variation which would permit construction of one additional ground sign on the 31st Street frontage based on the following findings of fact: 1. The Sports Core property is unique due to its large size and relatively minor impact of having a second ground sign along this frontage. 2. Approval of the variation would not alter the essential character of the area. 3. This variation, if approved, would not be detrimental to the neighborhood. This recommendation was approved on a roll call vote of five ayes, Members Herman, Martinello, Sarwar, White and Chairman Savino; one nay, Member Shumate; and one member absent, Member Crouch. A motion was made by Member Shumate, seconded by Member White, to recommend denial of the requested setback variation which would permit locating the sign approximately three feet from the right-of-way instead of the ten-foot requirement based on the following findings of fact: �I - /3 • 1 11 • Ground Sign - 2 - May 10, 1989 1. VILLAGE OF OAK BROOK - POLO CLUB SIGN VARIATION - 710 OAK BROOK ROAD The Secretary noted the required Legal Notice published in the Oak Brook Doings April 14, 1989 and notice to surrounding property owners dated April 14, 1989. Chuck McAdams, Sports Core Manager, was present and made the following comments in support of the request: 1. In 1988, the Polo Club originally constructed a sign at this entrance on Village property without Village approval. The sign was subsequently removed and Village staff was directed to design a sign similar in style to the Bath & Tennis sign. 2. It was determined that the sign as located would require two variations including a variation to permit an additional ground sign along 31st Street and also to reduce the ten-foot required setback to approximately 3 feet. 3. The Village felt it would be best to have a Village-sponsored permanent sign at the location since it would be more esthetic than the temporary Polo Club signs and also would indicate Village ownership of the polo fields. 4. The specific hardship involved with these requests includes the necessity of having a sign directing the public to this entrance, the need to make the sign visible to traffic on 31st Street for safety purposes, as well as a desire to not relocate the bike path and cut substantial landscaping in the event the sign had to be moved back further from the road. Zoning Board members indicated support for an additional sign at this entrance, but could find no particular hardship which would justify granting the sign setback variation. A motion was made by Member Herman, seconded by Member Martinello, to recommend approval of the variation which would permit construction of one additional ground sign on the 31st Street frontage based on the following findings of fact: 1. The Sports Core property is unique due to its large size and relatively minor impact of having a second ground sign along this frontage. 2. HELIPORT RECOMMENDATION Zoning Board members established the following consensus that the Village Board should consider: 1. Establishing a central site which could be utilized by all persons desiring a heliport. 2. Modifying the Zoning Ordinance in order to establish a cap on the number of heliports permitted in the Village. 3. Establishing specific limits for heliport use within the ordinance as to particular weather conditions or other conditions which might be unsafe for such travel. VII. Kapff, Assistant to Village Manager SUBJECT: Village of Oak Brook - Polo Club Sign Variation 710 Oak Brook Road The Village of Oak Brook has made application for two sign variations which would permit construction of a permanent sign at the entrance to Field No. 3 off of Oak Brook Road. This sign would be similar in style to the entrance sign at the Bath & Tennis Club and would provide a better means of identifying the entrance to Field No. 3 which is the primary field used for polo events. The Sports Core property is located within the Conservation/Recreation district which, by reference, utilizes the provisions of the Village's ORA-1 sign regulations contained in Section X(B)(6) , copy attached. I The specific variations requested are as follows: 1. Subsection F of the regulations permits up to one ground sign on each street frontage, on a corner or through lot. Presently, the sign at the Bath & Tennis entrance is the one permitted ground sign along the 31st Street frontage of the Sports Core. The Polo Club has in the past utilized temporary signs, but it was felt that in order to make the entrance more appealing, a permanent sign should perhaps be located at that entrance, and thus, the necessity for a variation. 2. Subsection F of the regulations also requires a ground sign to be at least ten feet from any lot line. As indicated on the map enclosed in the folder, the proposed sign location, which would be on the existing fence line, is approximately three feet behind the 31st Street lot line, instead of the ten-foot requirement. A variation is requested to permit this three-foot sign setback in order to allow greater visibility of the proposed sign and to avoid the necessity to remove more trees and bushes if the sign had to be moved further back. In addition, the proposed location would place the sign out of the way of any other obstructions in the area. Moving the sign back to the ten-foot setback would place it within the existing bike path and also create visibility problems due to existing foliage as well as due to the light standard between the sign and the street. 9 i Ground Sign April 24, 1989 Sports Core Manager Chuck McAdams will be in attendance at the Zoning Board hearing to answer further questions in this regard. The Board may reverse or affirm, wholly or partly, or may modify the order, requirement or decision or determina- tion as in its opinion ought to be made on the premises and to that end has all the powers of the official from whom the appeal is taken. (4) Decisions: All decisions, after hearing of the Zoning Board of Appeals on appeals from an administrative order,7requirement, decision, or determination of the Building Inspector or other authorized official of the Village of Oak Brook, shall, in all instances, be final administrative determinations and shall be subject to judicial review only in accordance with applicable Statutes of the State of Illinois. (G) Variations. (1) Authority: The Board of Trustees shall decide all applications for variations of the provisions of this ordinance after a public hearing held before the Zoning Board of Appeals on such notice as shall be required by the Illinois Statutes. The Zoning Board of Appeals shall hold public hearings upon all applica- tions for variations and shall report its recommenda- tions to the Board of Trustees as to whether a requested variation would be in harmony with its gen- eral purpose and intent, and shall recommend a varia- tion only where it shall have made a finding of fact specifying the reason or reasons for recommending the variations. Such findings shall be based upon the stand- ards prescribed in Section XIII G4 of this ordinance. No variation shall be granted by the Board of Trustees without such findings of fact. In the case of a variation where the Zoning Board of Appeals fails to recommend the variation,n,it can only be adopted by an ordinance with the favorable vote of two-thirds of the Trustees. (2) Initiation: An application for a variation shall be in triplicate and may be made by any governmental 966 I b APPENDIX A—ZONING Sec.XIH office, department, board, bureau or commission, or by any person, firm or corporation having a freehold interest, a possessory interest entitled to exclusive possession, a contractual interest which may become a freehold interest, or any exclusive possessory interest applicable to the land or land and improvements described in the application for a variation. (3) Processing. An application fora variation shall be filed with the Village Clerk who shall forward one copy of such application to the Zoning Board of Appeals for processing in accordance with applicable Statutes of the State of Illinois and one copy to the Board of Trustees. (4) Standards: (a) The Zoning Board of Appeals shall not recom- mend a variation of the provisions of this ordinance as authorized in this section unless it shall have made findings of fact based upon the ( evidence presented to it on the following specific issues that: (1) The property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regula- tions governing the district in which it is located. (2) The plight of the owner is due to unique circumstances. (3) The variation, if granted, will not alter the essential character of the locality. (b) For the purpose of supplementing the above standards, the Zoning Board of Appeals, in making the determination whether there are practical difficulties or particular hardships, shall also take into consideration the extent to which the following facts, favorable to the applicant, have been established by the evidence that: 967 • Sec.XIII OAK BROOK CODE (1) The particular physical surroundings, shape, or topographical conditions of the specific property involved would bring a particular hardship upon the owner as distinguished from a mere inconvenience if the strict letter of the regulation were to be carried out. (2) The condition upon which the petition for variation is based would not be applicable generally to the other property within the same zoning classification. (3) The granting of the variation will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is lo- cated. (4) The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the danger of fire, or otherwise endanger the public safety or substantially diminish or impair property values within the neighborhood. (5) That the purpose of the variation is not based exclusively upon a desire to make more money out of the property. (6) That the alleged difficulty or hardship has not been created by any person presently having an interest in the property.
