AN ORDINANCE REZONING PROPERTYAS
R-2, SINGLE-FAMILY RESIDENCE DISTRICT
(3415 and 3505 York Road)
WHEREAS, an application has been filed requesting the rezoning of property
located at 3415 and 3505 York Road from R-1 to R-3; and
WHEREAS, the Plan Commission on May 15, 1989 recommended approval of the
requested rezoning; and
WHEREAS, the Zoning Board of Appeals on June 6,1989 recommended denial
of the rezoning for reasons that it would change the character of the neighbor-
hood; and
WHEREAS, the Village President and Board of Trustees have reviewed the
recommendations of the Plan Commission and Zoning Board of Appeals and deem
the rezoning of the property to R-2, Single-Family Residence District to be
consistent with the Comprehensive Plan and is in the most appropriate zoning
of the property consistent with its highest and best use; and
WHEREAS, the applicant has amended his prior submittal of a preliminary
plat to conform to the R-2 standards; and
WHEREAS, all required hearings were held pursuant to due and appropriate
legal notice;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That property located on the east side of York Road known as
3415 and 3505 York Road be and is hereby rezoned from R-1, Single-Family
Residence District to R-2, Single-Family Residence District. Said property is
legally described as follows:
That part of the South 5.0 chains of the Southwest Quarter of
the Northeast Quarter of Section 36, Township 39 North, Range
11, East of the Third Principal Meridian, lying East of the
Elmhurst Fullersburg Road, in DuPage County, Illinois
and
Lots 1 and 2 of Nunziati's Resubdivision of the North 387.9 feet
(except the South 150.0 feet thereof) (measured on the East line
of Lot 1 of Graue's Assessment Plat No. 1) being part of the
North one half of the Southeast Quarter of Section 36, Township
39 North, Range 11, East of the Third Principal Meridian,
reference being had to the record thereof, on February 11, 1944,
as Document No. 458793, in DuPage County, Illinois. Permanent
Parcel Nos. 06-36-202-014 and 06-36-404-015 and 06-36-404-016.
Section 3: That the Village Clerk is hereby authorized and directed to
amend the Official Zoning Map of the Village consistent with the provisions of
this Ordinance.
