AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTION VII(D)(8)(c)
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
RELATIVE TO REAR YARD REQUIRE14NTS
(25 Glendale Avenue) a.
WHEREAS, an application has been filed requesting a variation from the
provisions of Section VII(D)(8)(c) of the Zoning Ordinance of the Village of
Oak Brook to permit the construction of an addition encroaching approximately
34 feet into the required 60-foot rear yard on the property hereinafter
described; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals of the Village of Oak Brook on September 5, 1989
pursuant to due and appropriate legal notice; and
WHEREAS, a recommendation has been made by said Zoning Board of Appeals
that the variation requested be granted and made explicit findings that the
variation requested meets the applicable standards set forth in Section
XIII(G)(4) of the said Oak Brook Zoning Ordinance; and
WHEREAS, the Village President and Board of Trustees concur with the
recommendations and findings made by the Zoning Board of Appeals;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section l: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section VII(D)(8)(c) of the Zoning Ordinance of the Village of Oak Brook so as
to permit construction of an addition encroaching approximately 34 feet into
the required 60-foot rear yard, provided that the addition is constructed in
substantial conformity with the Plat of Survey dated as received July 21,
1989, a copy of which is attached hereto, labelled "Exhibit A", and hereby
made a part hereof.
Section 3: That this Ordinance is limited and restricted to property
commonly known as 25 Glendale Avenue, Oak Brook, Illinois, which property is
legally described as:
The East 37.5 feet of Lot 11 and Lots 9 and 10 in Block 4 in Glendale
Subdivision, a Subdivision of part of the East half of the Southwest
Quarter of Section 36, Township 39 North, Range 11, East of the Third
Principal Meridian, and part of the East half of the Northwest Quarter of
Section 1, Township 38 North, Range 11, East of the Third Principal
Meridian, and a Resubdivision of Lots 1, 2, 3 and 4 in Block 2 of the
Ordinance No. S- 679

recorded September 8, *1926 as Document 220961, in DuPage County,
Illinois.

Section 4: That this Ordinance shall be in full force and effect from
and after passage and approval as provided by law.
