AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTION V(G)(3)(h)(1)
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
RELATIVE TO SIDE 7MRD REQUIRENENTS

WHEREAS, the subject property, pursuant to Ordinance S-661, was previously
granted a special use for a clinic on January 24, 1989; and
WHEREAS, an application has been filed requesting a variation from the
provisions of Section V(G)(3)(h)(1) of the Zoning Ordinance of the,Village of
Oak Brook to permit the construction of a canopy extending east from the
existing building approximately 28 feet,. 2 feet from the Tower Drive right-
of-way on the property hereinafter described; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals of the Village of Oak Brook on March 6, 1990 pursuant
to due and appropriate legal notice; and
WHEREAS, a recommendation has been made by said Zoning Board of Appeals
that the variation requested be granted and made explicit findings that the
variation requested meets the applicable standards set forth in Section
XIII(G)(4) of the said Oak Brook Zoning Ordinance; and
WHEREAS, the Village President and Board of Trustees concur with the
recommendations and findings made by the Zoning Board of Appeals;
NOW, THEREFORE, BE IT ORDAINED By THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section V(G)(3)(h)(1) of the Zoning Ordinance of the Village of Oak Brook so
as to permit construction of a canopy extending east from. the existing building
approximately 28 feet, 2 feet from the Tower Drive right-of-way, on the
condition that the canopy is constructed in substantial conformity with the
site plan previously approved and incorporated into the provisions of Ordinance
S-661.
Section 3: That this Ordinance is limited and restricted to property
commonly known as 2425 22nd Street, Oak Brook, Illinois, which property is
legally described as:
Parcel 1: Lot 1 in Butler Co. M-1, Inc. Assessment Plat No. 6, in
Section 28, Township 39 North, Range 11, East of the Third Principal
Meridian, according to the plat thereof recorded July 20, 1964 as
Document R64-25649, in DuPage County, Illinois.

Parcel 2: Lot 1 in Rapistan Assessment Plat of part of the Northeast 1/4
of Section 28, Township 39 North, Range 11, East of the Third Principal
Meridian, according to the plat thereof recorded May 4, 1961 as Document
R61-5593, in DuPage County, Illinois.
Parcel 3: That part of the Northeast 1/4 of Section 28, Township 39
North, Range 11, East of the Third Principal Meridian, described as
follows: Beginning at the Southwest corner of Lot 1 of Butler Co. M-1
Inc. Assessment Plat No, 6; thence South on the extension of the West
line of said lot to its intersection with the South line of Northern
Illinois Gas Company right of way; thence Easterly along said South line,
also being the North line of the East-West Tollway to the point of
intersection with an extension Southerly of the East line of Lot 1 of
Butler Co. M-1 Inc. Assessment Plat No. 6; thence North on said extension
of the East lot line to the Southeast corner of said lot; thence Westerly
along the South line of said lot, also being the North line of Northern
Illinois Gas Company right of way to the point of beginning, all in York
Township, in DuPage County, Illinois. Permanent Parcel Nos.
06-28-202-005 and 06-28-202.-008.
Section 4: That this Ordinance shall be in full force and effect from
and after passage and approval as provided by law.
