S- 699 AN ORDINANCE GRANTING A FLOOD PLAIN SPECIAL USE PERMIT PURSUANT TO SECTION 10-34 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS (811 Kerry Lane) WHEREAS, the owner of certain property described herein has petitioned the corporate authorities of the Village of Oak Brook, DuPage and Cook Counties, Illinois, for a Flood Plain Special Use Permit under Section 10-34 of the Code of Ordinances of the Village of Oak Brook, relating to flood plain and wetland regulations; and WHEREAS, the Plan Commission. on May 21, 1990 recommended denial of the flood plain special use permit for reasons that the grading plan could create bank erosion during flood periods, home access during heavy rains could be impaired and precise future flood heights are unknown; and WHEREAS, a public hearing on such petition has been conducted by the Zoning Board of Appeals of the Village on June 5, 1990, pursuant to due and appropriate legal notice; and WHEREAS, the Zoning Board of Appeals on June 5, 1990, recommended approval of said request; and WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of the Plan Commission and Zoning Board of Appeals; and WHEREAS, the proposed use satisfies the requirements of and is consistent with each of the factors set forth in Section 10-34(c) of the Code of Ordinances of the Village of Oak Brook; and WHEREAS, the corporate authorities of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: Pursuant to Sect''-on 10-34 of the Code of Ordinances of the Village of Oak Brook, Illinois, a Flood Plain Special Use Permit is hereby granted to allow the construction of a single-family residence, which property Ordinance S- 699 Granting a Flood Plain Special Use 811 Merry Lane Page 2 C is legally described as: Lot 20 in "Merry Lane Subdivision", being a subdivision of part of the East half of Section 23, Township 39 North, Range 11, East of the Third Principal Meridian according to the plat thereof recorded December 15, 1964, as Document R-64-46971, in DuPage County, Illinois. Permanent Parcel No. 06-23-209-012. Section 3: That this ordinance is subject to the condition that all improvements constructed on the subject property be constructed in accordance with the Building Code and in accordance with the requirements for flood resistent construction as set forth in Section 2102.0 of the BOCA National Building Code. Durfey, Village Engineer SUBJECT: Brush Hi11 Acres, Knoppers, Schroeder Flood Plain Applications The Village Board, at its July 24 meeting, directed preparation of ordinances approving the Special Use Permits to be reviewed by the Board at its August 14 meeting. This direction was conditioned upon your department putting together specific information addressing the subject of permitting basements in flood plain area. The Village Board responded favorably to your memo regarding Knoppers where it suggests that there might not be a significant engineering difference between properties which wiZl be totally surrounded by flood waters as opposed to properties which �ight have only one side of their property abutting a flood. The Village Board appears to be leaning toward allowing basements in both cases; however, they would like you to review this subject either individually or in conjunction with consulting engineers if you see that additional step is necessary. Lexi stated at the meeting that Donohue & Associates had verbally indicated that they saw no difficulty with flood- proofing residential basements under either scenario. The Board also wants you ta determine if special construction techniques would be warranted for construction of basements, and if so, you should provide a listing of such additional rec�sirements for review at the Auqust 14 meeting. I would strongly recon�end that you meet with the applicants' engineers including Lindley & Son and Eddy & Company as well as Bob Nielsen, to get their input and other corc¢nents they might have in this regard. The Village Board also directed John to prepare the necessary documents to approve the flood plain applications contingent on your being able to adequately review the aboue-mentioned flood plain issues. Theoretically, if all of the above takes place on a timely basis, all three applicants could receive final approval at the August 14 meeting. The applicant was told to either (1} receive approval fro�a IDOT as to his praposed modification to Salt Creek; or (2) chanqe the nlans such that no change be made to the banks of Salt Creek. As indicated in Dale's July 11 memo, revised plans received Ju1y 3 no longer modify the existing Salt Creek bank. SUBJECT: Flood Plain Special Use Lot 20 - Merry Lane 811 Merry Lane I have reviewed the revised site plan for the above stated subject, which I received on July 3, 1990 and note that the existing Salt Creek bank is now being kept in its natural state rather than being cut in to as depicted on the earlier plan. I also note that the building pad is somewhat smaller than previously presented and that up to two (2') feet of fill is being placed within the floodway at the flooday line. Compensatory storage is being required which compensates for all fill within the floodway and flood fringe. Because compensatory storage is being provided, I do not have a technical problem with the small amount of fill near the floodway line. As before, the applicant must apply for and receive a permit from IDOT since work is being contemplated within the regulatory floodway. Since part of the proposed work is within the Salt Creek rloodway, I recommend that any Village approval be specifically conditioned upon the applicant anplying for and receiving an IDOT Permit with such conditions stated within any ordinance passed by the Village. While an IDOT Permit is required even without the Village specifically stating so, the general public may not be aware of it and anyone reading the Flood Plain Special Use Ordinance may not be aware of it. The house pad is located in the flood fringe and will be raised to 3 feet above the high water level. Regrading will also take place to the rear of the house which is located within the floodway. The Plan Commission, at its May 21 , 1990 meeting, on a vote of 7-0 recommended denial of this request based on the following findings of fact: 1 ) The proposed Grading Plan could perhaps create additional bank erosion during flood periods. 2) Access to the house might be impaired during heavy rains. 3) Due to the incomplete nature of the dredging projects along Salt Creek and construction of berms in Elmhurst, the precise future flood heights are unknown, thus �reating a concern for the new construction as well as existing houses in the area. Village Engineer Durfey's memo of May 31, 1990 addressed the three concerns expressed by the Plan Commission. SUBJECT: Flood Plain Special Use Lot 20 - Merry Lane 811 Merry Lane As per your request, in our meeting of June 19, 1990, this memo will provide you with further information regarding the above stated subject. The first issue relates to the compensatory storage as detailed on the drawing. At the various elevations above the normal water level of Salt Creek, the proposed volumes are greater than the existing volumes. This means that the compensatory storage is approximately 11,000 cubic feet greater than existing flood storage and further that the co�pensatory storage is greater at the lower and more frequent storm events which provides greater protection for the area in these more frequent events. This particular design characteristic does not meet the suggested IDOT Flood Plain Ordin- ance criteria that compensatory stroage shall be hydraulically equivalent to the existing condition; flood plain storage lost below the existing 10-year flood elevation shall be replaced below the proposed 10-year flood elevation and flood plain storage lost above the existing. l0-year flood elevation shall be replaced above the proposed 10-year flood elevation. However, in the case of a single lot, the volumes in question are relatively minor and, since this section of Salt Creek is particularly susceptible to the lower flooding events, this additional storage volume at the lower elevations would help in the more frequent events. In my perusal of the Model Flood Plain Ordinance espoused by IDOT, it is my understanding that this proposal meets the requirements of that model ordinance with the exception5 as noted above and as follows: The Model Ordinance states that residential basements below the flood plain elevation are not permitted. This is similar to current FEMA regulations and current Village regulations, since the Village had to comply with FEMA require- ments to remain in good standing for the National Flood Insurance Program. What happens, however, if the Village decides that it would allow a basement on this lot provided certain conditions are met, is that the lot would be filled to an elevation above the flood plain and then a Letter of Map Revision would be requested of FEMA to remove the filled area from the flood plain maps. Once the maps have been revised, the filled area is no longer in the flood plain, is no longer under the flood plain regulations, and a basement can be constructed. a9 BYuce F. Kapff June 20, 1990 '� ^ Page 2 The Zoning Board of Appeals, in their deliberation of this matter, suggested that a basement would be appropriate so long as the area was filled properly and certain floodproofing measures constructed in addition to the conventional house construction techniques. These floodproofing items should include that a registered professional engineer certify that the building is floodproofed below the flood protection eleva- tion and that the structure and attendant utility facilities are water-tight and capable of resisting the effects of the 100-year flood. The building design should take into account flood velocities, duration, rate of rise, hydrostatic and hydro- dynamic forces, the effects of buoyancy, and impacts from debris or ice. Flood proofing measures should be operable without human intervention and without an outside source of electricity. Since part of the proposed work is within the Salt Creek floodway, I recommend that any Village approval be specifically conditioned upon the applicant applying for and receiving an IDOT permit with such condition stated within any ordinance passed by_-the Village. While an IDOT permit is required even without the Village specifically stating so, the general public may not be aware of it and anyone reading the Flood Plain Special Use Ordinance may not be aware of it. Finally, the Village must decide whether or not it would allow a basement for a � proposed house on this site. Current Village and FEMA regulations prohibit the construction of a basement within a flood plain area. In the past, flood plain areas have been filled so that the ground is then revised to be above the flood plain elevation and the Village and the applicant have co-sponsored a Letter of Map Revision application to FEMA to revise the flood maps to remove the filled portion from the flood plain. These LOMR's have been approved by FEMA and homes with basements have subsequently been constructed. However, these instances have been in areas where street vehicular access has been available. In this particular case, Merry Lane may be flooded to such an extent that vehicular access may be precluded. This also relates to the potential of flood damage on the section of a home that is below the flood elevation. If a home is built on a slab above the flood elevation, flood damage cannot occur; however, if a basement is constructed below the flood elevation, there is a potential that damage may occur, even though floodproofing measures are constructed. In this particular case where the home will be an island totally surrounded by water, the Village needs to make the policy decision of whether or not it feels comfortable co-sponsoring a LOMR request and allowing a basement if a LOMR is granted by FEMA or if, in the alternative, the public health, safety and welfare is better served by not allowing a basement. If a basement is allowed, the Village should give consideration to requiring that the applicant construct suitable flood- proofing devices and construction techniques as discussed above to minimize any potential damage. I met with the applicant's engineer, Michael Aughes, on Tuesday, April 3, 1990 and reviewed with him all of my coimnents on the originally submitted plan. From that meeting, a revised drawing was received on April 5, 1990 with a revision date of April 4, 1990. The following comments relate to the revised plan. 2. The IDOT/DWR floodway limit is incorrectly drawn on the plan. In reviewing the location of the floodway line from both the IDOT and FEMA floodway maps, it is apparent that a significant discrepancy exists within the FEMA maps. For this reason, it is most appropriate to utilize the IDOT floodway maps since they are based on a picture of the area which scales fairly accurately. Based upon the IDOT maps, the floodway line needs to be redrawn. 3. The note on the drawing enclosed in a box which states "Note: lowest opening and all window wells to be waterproofed to elevation 662.4" needs to be removed from the drawing since it implies that a basement is allowed on this lot. FEMA regulations as well as current Village Code will not allow a residential basement within the floodplain. 4. The flood storage volumes have been checked and have been found to be acceptable. 5. I have sent letters to both IDOT and FEMA and have requested their comments on this application. IDOT's comments are especially i�portant since the application proposes to do work within the Salt Creek floodway. (ii) Typical valley cross-section(s) drawn to a scale of one (1) inch to one hundred (100) feet and a vertical scale of one (1) inch to ten (10) feet showing the channel of the stream, elevation of land areas adjoining each side of the channel, cross-sectional areas to be occupied by the proposed development, and high water elevation. Cross-section intervals shall not exceed one hundred (100) feet. (ui) Plans (surface view) showing elevations or con- tours of the ground; pertinent structure, fill or storage elevations; size, location and spatial arrangement of all proposed and existing struc- tures on the site; location and elevations of ' streets, water supply, sanitary facilities; soil types; and other pertinent information. Contours shall be shown at one-foot intervals. (iv) Photographs showing existing land uses and vegetation upstream and downstream. (v) A profile showing the slope of the bottam of the channel or the flow line of the stream. (c) Factors Upon Which the Recommendations of the Zoning Board of Appeals and the Plan Commission Shull Be Based: In malflng recommendations upon applications for special use permits, the zoning board of appeals and the plan commission shall consider all relevant factors specified in other sections of this article, including but not limited to the following: (1) The danger to life and property due to increased flood heights or velocities caused by encroachments; (2) The danger that materials may be swept onto other lands, or cross-stream, upstream or downstream to the injury of others; (3) The proposed water supply and sanitation systems and the ability of these systems to prevent disease, contamination and unsanitary conditions; (4) The susceptibility of the proposed facility and its contents to flood damage and the effect of such damage on the individual owners; (5) The importance of the services provided by the proposed facility to the community. (d) Conditions Attached to Special Use Permits: Upon consideration of the zoning board of appeals and the plan commission recommendations, the factors listed above, and the purpose of this article, the .president and board of trustees may by orclinance grant, deny or attach such conditions to the granting of special use permits as they deem necessary to further the purposes of this article. Among such conditions, without limitation because of specific enumeration, may be included: (1) Modification of waste disposal and water-supply facilities; (2) Limitations on periods of use and operation; � (3) Imposition on operational controls, deposit of surety bonds and deed restrictions; (4) Requirements for construction of channel modifica- tions, dikes, levees and other protective measures; and (5) Floodproofing measures designed to be consistent with the flood protection elevation for the particular area, flood velocities, durations, rate of rise, hydrostatic and hydrodynamic forces, and other factors associated with the 100-year flood. (a) [President and Board of Trustees May Grant:] Variations to the provisions of this article may be granted by the president and board of trustees upon reeommendation by the zoning board of appeals. (b) A uthority: The board of trustees shall decide all applica- tions for variations of the provisions of this division after a public hearing held before the zoning board of appeals on such notice as shall be required by the Illinois Statutes for zoning variations. The zoning boazd of appeals shall hold public hearing upon all applications for variations and shall report its recommendations to the board of trustees as to whether a requested variation would be in harmony with its general purpose and intent, and shall recommend a variation only where it shall have made a finding of fact specifying the reason or reasons for recommending the variation. Such findings shall be based upon the standazds prescribed in subsection(e)below. No variation shall be granted by the board of trustees without such findings of fact.
