ORDINANCE S- 702
AN ORDINANCE REZONING CERTAIN PARCELS
FROM R-1, SINGLE FAMILY DETACHED RESIDENCE DISTRICT,
TO R-2, SINGLE FAMILY DETACHED RESIDENCE DISTRICT
(3515, 3603 YORK ROAD)
WHEREAS, an application has been ailed requesting that the property
commonly known as 3515 and 3603 York Road, Oak Brook, Illinois, presently
zoned R-1, be rezoned to R-3; and
WHEREAS, at its meeting of December 18, 1989, the Plan Commission
recommended denial of the R-3 request and recommended approval of a rezoning
to R-2 to the Village Board that the requested rezoning be granted; and
WHEREAS, at its meeting of January 10, 1990, the Zoning Board of Appeals
was unable to make a recommendation on the requested rezoning; and
WHEREAS, the corporate authorities of the Village of Oak Brook have
considered the recommendation of the said Plan Commission and the
deliberations of the Zoning Board of Appeals concerning the rezoning; and
WHEREAS, the Village President and Board of Trustees deem it in the best
interest of the Village of Oak Brook that the property be rezoned to the R-2
Single-Family Detached Residence Zoning District as said zoning represents the
most appropriate zoning consistent with the highest and best use of the said
property;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That the hereinafter described property is hereby rezoned
from R-1 to R-2 Single-Family Detached Residence District, which property is
legally described as follows:
Lot 1 of Graue's Assessment Plat No. 1 (except the South 540.26
feet and except the North 237.9 feet thereof as measured along the
East line of Lot 1) being a part of the North 1/2 of the Southeast
1/4 of Section 36, Township 39 North, Range 11,
and now known as
Brush Hill Acres, being a subdivision of the South 480.94 feet of
the North 718.84 feet (as measured on the East line) in Graue's
Assessment Plat No. 1, in the West 1/2 of the Southeast 1/4 of
Section 36, Township 39 North, Range 11, East of the Third
Principal Meridian, reference being had to the record thereof on
February 11, 1944, as Document No. 458793, in DuPage County,
Illinois, Permanent Parcel Nos. 06-36-400-002, 06-36-400-003 and
06-36-400-004.

Section 3: That the Village Clerk is hereby directed to amend the
official map of zoning districts of the Village of Oak Brook in accordance
with the provisions of Section 2 of thisoOrdinance.
Section 4: That all ordinances in conflict with the provisions of this
Ordinance are hereby repealed to the extent of such conflict, but only as they
apply to the specific property hereinabove described.
Section 5: That this Ordinance shall be in full force and effect from
and after passage and approval as provided by law.
