AN ORDINANCE GRANTING FRONT AND SIDE YARD VARIATIONS
FROM THE PROVISIONS OF THE
ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
(2425 22ND STREET)
WHEREAS, the subject property, pursuant to Ordinance 5-661, was granted
a special use for a clinic on January 24, 1989; and
WHEREAS, the subject property was granted a variation regarding the side
yard requiremerzs on the east side of the subject property pursuant to
Ordinance S-687 on April 10, 1990; and
WHEREAS, the property owners have sought additional variations from the
east side yard setback requirement and the front yard setback requirement so
as to validate the pre-existing structure located on the subject property
which encroaches into said required yards; and
WHEREAS, the subject property was previously granted a variation for the
front yard setback substantially in conformance with the variation requested
in the present application by the Zoning Board of Appeals of the Village of
Oak Brook on December 27, 1960;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section X(B) (5) (a) of the Zoning Ordinance of the Village of Oak Brook so as
to reduce the required front yard setback from 100' to between 38.48' and
42.31' all as depicted on the survey of the property entitled "Land Title
Survey" prepared by James R. Boyes, revised December 18, 1990, a copy of
which is attached hereto, labelled Exhibit "A" and hereby made a part hereof.
Section 3: That a variation is hereby granted from the provisions of
Section X(B) (5) (b) of the Zoning Ordinance of the Village of Oak Brook so as
to reduce the required side yard on the east side of the subject property
from 100' to 30.08' as depicted on the attached Exhibit "A".
Section 4: That this ordinance is applicable only to that property
located at 2425 22nd Street, which property is legally described on the
attached Exhibit "A".
Section 5: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.

SUBJECT: Jafari - Front and Side Yard Variations
2425 22nd Street
The existing building location as shown on the enclosed Site Plan shows a front
yard setback of 38' to 42' from 22nd Street and a side yard setback adjoining
Tower Drive of approximately 301 . In both instances, current ORA-1 setback
requirements call for a 100' setback from the front as well as a side yard
adjoining a street.
With respect to the front yard setback, the Village granted its first variation
in 1960 to this property to allow the structure as presently constructed adjacent
to 22nd Street. However, since that time, the 22nd Street right-of-way has
expanded and according to our Village Attorney, a variation is required in order
to bring the current structure into total compliance with the Village's Zoning
Ordinance.
With respect to the side yard variation, the building was constructed prior to
dedication of Tower Drive, and as such, a 100' side yard was not required.
The current structure, therefore, exists as "existing non-conforming" and would
only have to be relocated to a conforming location in the event the structure was
more than 50% destroyed. The current application is a requirement of the
building's lender, such that in the event the building were destroyed, there
would be no impediment to reconstruction .at the present location.
The Zoning Board of Appeals, at its February 5 meeting, on a vote of 5 to 0 with
1 absent, recommended approval of the two requested variations.

Dear Village President & Board of Trustees:
The Zoning Board of Appeals, at its meeting of Febrary 5, 1991, considered the
request of the applicant for front and side yard variations to reduce the front
yard setback from the 100' requirement to approximately 431 , and the side yard
setback adjoining Tower Road from the 100' requirement to approximately 301 .
A motion was made by Member Kenny, seconded by Member Crouch, to recommend
approval of the requested variations reducing the front yard setback from the
100' requirement to 38.5' and reducing the side yard adjoining Tower Drive
from 100' to approximately 301 . This recommendation is made based on specific
findings of fact indicating that the variations are simply confirming an existing
use, not an expansion of such use, and further that:
(1) The reasons for the requested variations are due to unique circumstances,
since they would be unable to rebuild the existing structure if it were
totally destroyed;
(2) Approval of the variations would not alter the essential character of the
neighborhood since the structure has existed at its present location
since 1960;
(3) The variations, if granted, would not be generally applicable to other
properties nor detrimental to surrounding property values;
(4) The purpose of these variations is not based exclusively upon a desire to
make more money out of the property; and
(5) The right-of-way takings are a hardship which was not created by any person
presently having an interest in the property.

Gentlemen and Ladies of the Board,
Our purpose in appearing before you this evening is to request a clarification
and if necessary, a variation for the front and side yards for the property
identified as 2425 22nd Street in Oak Brook.
To be specific, it is a requirement of our lendor that in the event that
our building experiences a major destructive loss that requires major
reconstruction, that we have the ability to rebuild the building in accordance
to its exact size, specifications and configuration without limitations by
current set hack requirements.
The ability to do this is essential to the success of our business plan
and to provide the scope and depth of the Medical Services we have planned
and presented to the Community and Physicians and Tenants.
Prior to appearing tonight, I did some research into our property with
the Village staff to understand the situation. I reviewed all the appropriate
Village plats dating back to August 1962.
The current foot print of the building puts our building in the status
of "legal Existing-Non Conforming" in the terms of front yard and side yard
requirements.

With regard to the front yard, I offer the following facts:
A. The current set back requirements ar-e 100' .
B. Currently the building Is physically set at ►'�`-
C. On December 27, 1960, the building was granted a variation
that allowed a 60' set back. We have the distinction of having
been granted the very first variation. A copy is attached.
D. However, at a later,.date ,' the; state widened 22nd street and
as a result, reduced the set back to 43' .
E. Considering that this event was out of the control of either
the owner or the village, we ire requesting recognition of
the 1960 variance and, a variance to recognize a 43'
setback to allow our building to become complaint with
node as well as to meet our lendors requirements.
With regard to the side yard:
A. When the building was originally built in 1960, Tower Drive
did not exist as a formal road. As a result the building
was constructed to conform to "Interior Side Yard" requirements.
B. Tower Drive was built and dedicated in 1962 and as a result,
the building did not conform to "Side Yard Abuting a Street"
requirements. Consequently, considering that the building was
already in existence, the existing 30' set back also puts
us into the category of "Legal Existing-Non-Conforming.

C. The canopy currently extends well into the set back.
However we have recieved the necessary variance to allow
this. (which is specific to the canopy and not th location of
the building,.) A copy of which is attached.

WHEREAS, the subject property, pursuant to Ordinance S-661,; was previously
granted a special use for a clinic on January 24, 1989; and
WHEREAS, an application has been filed requesting a variation from the
provisions of Section V(G)(3) (h)(1) of the Zoning Ordinance of the Village of
Oak Brook to permit the construction of a canopy extending east from the
existing building approximately 28 feet, 2 feet from the Tower Drive right-
of-way on the property hereinafter described; and
WHEREAS, a public hearing on such application has been conducted by the

to due and appropriate legal notice; and

Lance Kupisch, attorney, George Olsen and Jalal Mizani, architect, presented
their petition for front and side yard variations which would allow
reconstruction of the building at its present location since the structure is
presently an existing non-conformity with respect to the front and side yard.
It was noted that the Village, in 1960, granted a front yard variation to
allow the structure as presently constructed; however, since that time, the
22nd Street right-of-way has expanded and Tower Drive was constructed,
creating .the two existing non-conformities.
A motion was made by Member Kenny, seconded by Member Crouch, to recommend
approval of the requested variations reducing the front yard setback from the
100' requirement to 38.5' and reducing the side yard adjoining Tower Drive
setback from 100' to approximately 301 . This recommendation is made based on

IV. ILLINOIS STATE TOLL HIGHWAY AUTHORITY, ZONING - WEST OF MEYERS ROAD
NORTH AND SOUTH OF I-88
Jim Smith and Mal Erickson, attorneys, made the presentation for the Tollway
which is a request for zoning of former oasis properties located west of
Meyers Road, the north half to the ORA-2 District and the south half to the
R-3 District. The Tollway indicated that they are only requesting a zoning of
the property so that they are then able to sell the property to a developer.
They have no intention of developing the property themselves. A resident of
18W772 Chateaux North in the unincorporated area directly south of the
proposed R-3 tollway property indicated support for the R-3 development, but
opposition to the ORA-2 on the north side of the tollway, instead preferring
an ORA-1 development which would allow office buildings of a lower height.
A motion was made by Member Crouch, seconded by Member Kenny, to recommend
approval of the requested zoning of the north parcel to the ORA-2 District
based on findings of fact that the requested zoning would serve as a buffer to
higher intensive developments to the west, no substantial negative impact on
surrounding properties, no decrease in property values in the area, and that
the property in question appears suitable for an ORA-2 development. This
recommendation is made subject to a condition that the Village have future
subdivision and site plan approval authority including a determination as to
proposed access prior to any development on the site.

The existing building location is shown on the ipnclosed Site Plan. As you may
recall, the Village approved a side yard variation along Tower Drive for the
entrance canopy which extends to within 1.5' of the Tower Drive right-of-way.
The current application relates to the fact that the existing building as
located does not comply with the ORA-1 front and side yard adjoining a street
setback requirement of 100' . In the event the structure was more than 50%
destroyed, current regulations would require compliance with the 100'
requirements and would not allow relocating the structure to within 30' of
Tower Drive and 43' of 22nd Street. As indicated in the applicant's
December 19 letter, the current application is a requirement of their lender
which would permit reconstruction of the building at its current location.

SUBJECT: Oak Brook Medical & Surgical Centre
Section XII, B, (1) through (8) refers to "Authority to Continue
Nonconforming Building Structures and Uses. " References are made in
all Sections to the "Use" not being permitted in the district. The
Oak Brook Medical & Surgical Centre is a Permitted Use. However,
since it is BULK that we are concerned with, only the following
sections seem to somewhat apply:
Section (2) (b) A nonconforming building or structure which is
nonconforming only as to BULK, may be added to or enlarged provided
such additions or enlargements conforms to all regulations of the
district in which it is located.
This Section does not answer the concerns of the applicant.
Section (7) (a) (3) - In Office-Research-Assembly Districts:
No lawfully established principal and accessory nonconforming
building or structure and a lawful nonconforming USE thereof shall
be subject to the amortization provisions of this ordinance.
This Section appears to place a caviat of having to be a nonconforming
building (does this mean BULK?) and a lawful nonconforming USE and
therefore it appears to be exempt from the amortization provisions
below.
Section (7) (b) Amortization Provisions: All nonconforming
buildings, structures and uses as set forth in (3) above that were
nonconforming prior to and remain nonconforming by subsequent
amendments thereto shall be removed, or converted, and therefore
devoted to USES permitted.
Again, this Section refers primarily to USE and does not appear to
apply to this particular situation.
The applicant in seeking relief from the front and side yard
requirements (BULK) and this seems to be a reasonable procedure to
legalize the location of the building.

SUBJECT: Oak Brook Medical & Surgical Centre
Section XII, B, (1) through (8) refers to "Authority to Continue
Nonconforming Building Structures and Uses. " References are made in
all Sections to the "Use" not being permitted in the district. The
Oak Brook Medical & Surgical Centre is a Permitted Use. However,
since it is BULK that we are concerned with, only the following
sections seem to somewhat apply:
Section (2) (b) A nonconforming building or structure which is
nonconforming only as to BULK, may be added to or enlarged provided
such additions or enlargements conforms to all regulations of the
district in which it is located.
This Section does not answer the concerns of the applicant.
Section (7) (a) (3) - In Office-Research-Assembly Districts:
No lawfully established principal and accessory nonconforming
building or structure and a lawful nonconforming USE thereof shall
be subject to the amortization provisions of this ordinance.
This Section appears to place a caviat of having to be a nonconforming
building (does this mean BULK?) and a lawful nonconforming USE and
therefore it appears to be exempt from the amortization provisions
below.
Section (7) (b) Amortization Provisions: All nonconforming
buildings, structures and uses as set forth in (3) above that were
nonconforming prior to and remain nonconforming by subsequent
amendments thereto shall be removed, or converted, and therefore
devoted to USES permitted.
Again, this Section refers primarily to USE and does not appear to
apply to this particular situation.
The applicant in seeking relief from the front and side yard
requirements (BULK) and this seems to be a reasonable procedure to
legalize the location of the building.

Dear Bruce:
We are requesting an opportunity to meet before the appropriate Board of the
Village of Oak Brook to present our request for an ordinance variance.
For the purpose of meeting the requirements of our lendor, they are requiring
that the owner, in the event that a fire or disaster that destroys a major
percentage of the building, have the ability to reconstruct the building to
its current configuration, size and specifications and consequently not be
restricted to the current set back ordinances due to the reason that our
building is currently classified as "Existing/Non-Conforming".
This issue is of major concern to our lender as it effects our ability to
carry out our business plan as originally developed and consequently impacts
our immediate and long term financial position.
In speaking previously to Mary Ann Lakosil regarding existing ordinances that
might apply to our specific need, it is my understanding that there is current-
ly nothing that directly relates to our situation, even though there are exist-
ing ordinances that may vaguely be applied. As our lendor requires explicit
direction, Mary Ann has suggested that we present our case before the Village
Board and request an ordinance variance that allows us to rebuild to our cur-
rent building plans and specifications.

February 5, 1991. Should you have any additional questings, please do not
