AN ORDINANCE GRANTING A VARIATION FROM
THE PROVISIONS OF SECTION VII(E) (8) (b)
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
RELATIVE TO SIDE YARD REQUIREMENTS
(66 Greenleaf Drive)
WHEREAS, an application has been filed requesting a variation from the
provisions of Section VII(E) (8) (b) of the Zoning Ordinance of the Village of Oak
Brook to reduce the required easterly side yard from 12' to 9.9' to allow for
construction of an addition to an existing two-car garage; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals on March 5, 1991 pursuant to due and appropriate legal
notice; and
WHEREAS, a recommendation was made by the Zoning Board of Appeals to deny
the variation requested; and
WHEREAS, the corporate authorities have reviewed the recommendation and
findings made by the Zoning Board of Appeals and deem the granting of the
variation requested to be appropriate and in the best interests of the public
healthy, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section VII(E) (8) (b) of the Zoning Ordinance of the Village of Oak Brook so as
to permit construction of an addition reducing the required easterly side yard
from 12' to 9.9' provided that the addition is constructed in substantial
conformance with the Site Plan (and not exceed 6.07' x 23.61 ) dated as
received January 18, 1991, a copy of which is attached hereto, labelled
Exhibit "A" and hereby made a part hereof.
Section 3: That this ordinance is limited and restricted to property
commonly known as 66 Greenleaf, Oak Brook, IL 60521, which property is
legally described as:
Lot 50 in Timber Trails Estates Unit 1, being a subdivision of
part of the Northeast Quarter of Section 23, Township 39 North,
Range 11, East of the Third Principal Meridian, according to

Dear Village Board Members:
Enclosed please find additional information and site diagrams, which
we believe will assist to illustrate the reasons for approval of our
variation request.
Our application for a 10 foot sideyard variation is primarily for the
construction of a side wall off the existing front wing wall that was constructed
when the home was originally built in 1963. The wall to be constructed would
in no way impede any further than the existing structure, which has become
non-conforming since annexation to the Village. Also, Timber Trails sideyard
setbacks are predominatly at 10 feet, since the County required 50 feet front/
rear and 10 feet sideyard. Timber Trail R-3 requirements are still required to
conform to the 50ft. front/rear and now Village R-3 requirements of 12 ft.
sideyard setbacks. This has created difficultly with further restrictions
than normal Village R-3 requirements.
Any alternative solution will either diminish the property value in
question or the adjacent property value, in conjunction with a variety
or other negative ramifications. (See Alternative Solution folder)
Also, after review of our variation request in relation to what the
Zoning Board of Appeals found to be precedent setting, similar approved
requests are enclosed. Our request proportionately, is less intrusive.

Our denial was based on the following;
2. That there were alternative solutions which were acceptable and within
the framework of the Zoning Ordinance. "
That no real or unique hardship had been proven in that there are other
ways of accomplishing that same objective without varing the ordinance. "
Attached please find diagrams of what the Zoning Board of Appeals considered
to be viable solutions. We believe for the following reasons that they are not;
1. Can not yeild a reasonable return if permitted to be used only under
the regulations allowed.
2. This would alter the essential character of the locality.
3. This would be injurious to subject and adjacent property.
4. This would cause owner financial hardship to construct, and obvious
hardship to the adjacent neighbor and surrounding properties that
view the proposed construction.
5. If addition were constructed in total zoning conformity the results
would be unpleasant from an architectural standpoint.

residents a free recycling bin. Voice Vote: all ayes, no nays. Motion

B. Recommendation - Hahn - Side Yard Variation (66 Greenleaf Drive) :
Trustee Winters moved, seconded by Trustee Bartecki to grant the
applicants their requested continuance. Voice Vote: all ayes, no nays.

C. Change Orders #11 and #12 - Reservoir B (2710 Meyers Road) :
Trustee Rush moved, seconded by Trustee Bartecki to approve Change Order
No. 11 which increases the contract amount by $19,900.00 with no

to conduct two Customer Focus sessions with area businesses to identify
needs and plan strategies for Bring It Home Campaign; funding of $3,360
for printing of hotel flyers in conjunction with Tour Illinois
advertising; and funding of $6,000 to DuPage Convention and Visitors
Bureau to host a motor coach familiarization in May. Roll Call Vote:

SUBJECT: Hahn - Side Yard Variation - 66 Green Leaf Drive
This property is located in the Timber Trails Subdivision on the north side
of Green Leaf Drive, just west of Woodland Drive. The petitioner is requesting
a variation to reduce the east side yard from the 12 ft. required to approx-
imately 9.9 feet. This will permit the construction of a garage addition to
allow the housing of a third car. The exising'side wall of the garage is
approximately 16 feet from the lot line. Also, there is an existing legal
non-conforming architectural wing wall projecting into the east required
side yard. This wing wall is the same height and width as the proposed
garage addition.
The Zoning Board of Appeals, at their regular meeting of March 5, 1991, moved
to recommend denial of this request by a vote of 3 to 2.
The petitioners, Mr. and Mrs. George Hahn, have asked the Village to delay
consideration by the Board of Trustees for 60 days to allow them time to gather
additional data and/or information to support their request. A copy of
their letter is attached.
It would be appropriate to grant their request for this time extension. It is
my understanding that this is consistent with what we have done in the past.

Dear Mr. President and Board of Trustees:
The Zoning Board of Appeals, at its regular meeting of March 5, 1991, heard
the above request to reduce the required east side yard to approximately
9.9 feet instead of the required 12 foot side yard to permit the construction
of a garage addition to house a third car.
Member Shumate, seconded by Member Kenny, moved to recommend approval. This
motion failed as Members Crouch, Herman, and Savino voted against it.
Member Crouch, seconded by Member Herman, moved to recommend denial based on
the following findings:
1. that no real or unique hardship had been proven in that there are
other ways of accomplishing the same objective without varying
the ordinance,
2. that a variation based on the proposed factual information would
constitute an unacceptable precedent.

our particular situation. Pursuant to that conversation, we are
requesting a postponement of our variation application being presented
and heard by the Village Board of Trustees.
The necessity of this delay is resultant of the time required to
gather additional data and information to adequately present the
uniqueness of our application. After our conversation and learning the
Zoning Board of Appeals perspective, we would require sixty ( 60) days
to secure sufficient information to define the provisions set forth
under the ordinances allowed for a variation approval.

SUBJECT: Hahn Side Yard Variation Request
This property is located on the north side of Green Leaf Drive,
approximately 100 feet west of Woodland Drive. It is in the Timber
Trails Subdivision and is zoned R-3 Single Family Detached Residence
District. The required side yard in an R-3 District is 12 feet.
The petitioner is requesting a variation to allow an encroachment of
approximately 2. 1 feet into the east side yard to permit construction
of an addition to the existing 2 car attached garage to make it a
3 car garage.
In reviewing this application use the standards contained in Section XIII (G)
pp. 967-968 (copy attached) .

Village of Oak Brook Zoning Ordinance
(Section XIII (G) (4) pages 967 and 968
(4) Standards:
(a) The Zoning Board of Appeals shall not recommend a variation of the
provisions of this ordinance as authorized in this section unless it
shall have made findings of fact based upon the evidence presented to
it on the following specific issues that:
(1) The property in question cannot yield a reasonable return if
permitted to be used only under the conditions allowed by the
regulations governing the district in which it is located.
(2) The plight of the owner is due to unique circumstances.
(3) The variation, if granted, will not alter the essential character
of the locality.
(b) For the purpose of supplementing the above standards, the Zoning Board
of Appeals, in making the determination whether there are practical
difficulties or particular hardships, shall also take into consideration
the extent to which the following facts, favorable to the applicant,
have been established by the evidence that:
(1) The particular physical surroundings, shape or topographical
conditions of .the specific property involved would bring a
particular hardship upon the owner as distinguished from a mere
inconvenience if the strict letter of the regulation were to be
carried out.
(2) The condition upon which the petition for variation is based would
not be applicable generally to the other property within the same
zoning classification.
(3) The granting of the variation will not be detrimental to the public
welfare or injurious to other property or improvements in the
neighborhood in which the property is located.
(4) The proposed variation will not impair an adequate supply of light
and air to adjacent property, or substantially increase the danger
of fire, or otherwise endanger the public safety or substantially
diminish or impair property values within the neighborhood.
(5) That the purpose of the variation is not based exclusively upon a
desire to make more money out of the property.
(6) That the alleged difficulty or hardship has not been created by any
person presently having an interest in the property.
(c) The Zoning Board of Appeals may recommend and the Board of Trustees may
require such conditions and restrictions upon the premises benefited by
a variation as may be necessary to comply with the standards set forth
in this section to reduce or minimize the injurious effect of such
variation upon other property in the neighborhood, and to implement the
general purpose and intent of this ordinance.
