AN ORDINANCE GRANTING A FLOOD PLAIN SPECIAL USE PERMIT
PURSUANT TO SECTION 10-34 OF THE CODE OF ORDINANCES OF
THE VILLAGE OF OAK BROOK, ILLINOIS
(1425 Kensington Road)
WHEREAS, the owner of certain property described herein has petitioned
the corporate authorities of the Village of Oak Brook, DuPage and Cook
Counties, Illinois, for a Flood Plain Special Use Permit under Section 10-34
of the Code of Ordinances of the Village of Oak Brook, relating to flood plain
and wetland regulations; and
WHEREAS, a public hearing on such petition has been conducted by the
Zoning Board of Appeals of the Village on October 2, 1990, pursuant to due and
appropriate legal notice; and
WHEREAS, the Plan Commission of the Village of Oak Brook has submitted
its recommendation to the President and Board of Trustees; and
WHEREAS, both the Plan Commission and Zoning Board of Appeals have
recommended approval of the petition since the proposed use is consistent with
the best use of the flood plain; and
WHEREAS, the Village President and Board of Trustees have reviewed the
recommendations of the Plan Commission and Zoning Board of Appeals; and
WHEREAS, the proposed use satisfies the requirements of and is
consistent with each of the factors set forth in Section 10-34(c) of the Code
of Ordinances of the Village of Oak Brook; and
WHEREAS, the corporate authorities of the Village of Oak Brook deem the
passage of this ordinance to be in the best interest and in furtherance of the
general welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: Pursuant to Section 10-34 of the Code of Ordinances of the
Village of Oak Brook, Illinois, a Flood Plain Special Use Permit is hereby
granted to allow regrading of the Ginger Creek flood plain, said property
being legally described as:

Lot 2 of McDonald's Autumn Oaks Subdivision recorded as Document
No. R90-77300 on June 22, 1990, being a subdivision of part of
Section 26, Township 39 North, Range 11 East of the Third
Principal Meridian in DuPage County, Illinois. Permanent Index
No. 06-26-102-007.
Section 3: That this special use permit is granted subject to the
condition that said regrading on the subject property be completed in
accordance with the Building Code.
Section 4: That this special use permit is subject to the condition
that the property owner prepare and file an amendment to the drainage easement
required by Section 2(B) (9) of Article VII of Appendix B of the Oak Brook
Village Code, depicting the revised flood plain boundaries.
Section 5: That the special use permit herein granted in Section 2 of
this Ordinance be further expressly subject to the condition that said
regrading on the subject property be completed on or before February 11, 1996
in substantial conformity with the Grading Plan - Oak Brook Park District
Kensington Road Site drawn by Lindley & Sons, Inc. dated January 8, 1992, as
last revised January 31, 1992, incorporated herein by reference. If the
property owner fails to meet the conditions of this section, this special use
permit shall automatically terminate and be of no further force or effect.
Section 6: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.

SUBJECT: Oak Brook Park District - Use of Kensington Road Right-of-Way
As indicated in the attached March 5 letter from Jon Sommer, the Park
District, in conjunction with their redevelopment of the property east of
Route 83 and south of Kensington Road is requesting use of the unused Village
right-of-way west of the Kensington Road pavement.
Please contact Mr. Sommer and obtain additional information as well as prepare
a report for Village Board review if you feel this is appropriate. One course
of action would be to review this particular request in conjunction with the
overall redevelopment of the Park District property south of Kensington as you
recently discussed with Mike Hughes of Lindley & Sons.

Dear Steve:
This letter comes as a request to the Village of Oak Brook,
from the Oak Brook Park District, to utilize, for recreational land
development purposes, the unapproved portion of the Kensington Road
right-of-way. This right-of-way is adjacent and adjoining the Park
District's 14.25 acre park located along Kensington Road.
The District is currently in the process of planning the
development of this area for recreational game fields and courts
and would like to figure this unapproved portion into their overall
development plan.
We anticipate beginning our construction phase during this
Spring/Summer 1991 season and hope to be completed by late Fall,
1991.
It would certainly be appreciated by our Board if you and your
Board could address this request as soon as possible.

Dear Jon,
This letter is written to follow up on our conversation of last week
and your letter of March 5, 1991 to Steve Berley.
It is unlikely that the unused Kensington Road right-of-way will be of
any immediate use to the Park District in their currently developing
plan for the following reasons:
1) It would have to be determined what likelihood there is that
this right-of-way will never be needed. Dale Durfey, the
Village. Engineer, has indicated that this may not be the
case.
2) If vacated, the property owner to the north has prior rights
to this property since they originally dedicated the entire
right-of-way.
3) The property is in a different zoning district. (ORA-1)
While none of the above are unsolvable problems, to deal with they
will take a period of time which won't work well with your planned
schedule.
I have discussed the setback requirements with Mike Hughes of Lindley
& Sons. Once you have drawn up your preliminary plan it will be
possible to review your needs with respect to the Village requirements
and advise you as to the best course of action. In any case the flood
plain special use procedure is still to be completed.

Oak Brook Park District Community- Center/Kensington Site
I have reviewed the revised plans received on January 17 , 1992 and offer
the following comments :
1 . The revised plans have removed all improvements related to
buildings and paving. The applicant is now only requesting the
ability to move dirt and install storm sewer . .
2 . The revised drawings have reconfigured the proposed flood plain
significantly different from what was anticipated with the previous
submittal . What this means is that , should some development take
place within the future. it will have to comply with the now
revised flood plain as opposed to the previous plan.
3 . The revised plan does not provide sufficient compensatory storage.
The Engineering Department has calculated an existing volume of
8 . 27 acre feet with a proposed volume of 8 . 05 acre feet , 0 . 22 acre
feet short .
4 . Some drafting revisions need to be made to the engineering plans .
5 . This plan calls for the releasing of the existing flood plain
easement and the approval of a revised flood plain easement . These
documents need to be submitted and reviewed.

SUBJECT: Oak Brook Park District Flood Plain Special Use -
January 28 , 1992 Agenda
In August of 1990, the Park District petitioned the Village for
several actions for their property located south of Kensington
Road, east of Route 83 , and abutting their property to the south.
This was in conjunction with their plans for a community center
and related facilities on this site. The requests were as fol--
laws:
1) Rezoning from R-4 to CR.
2) Amend the ordinance text to provide for community cen-
ters as a Special Use within a CR district.
3) Granting of a Special Use to allow for the proposed
community center.
4) Flood Plain Special Use to allow the needed land modifi-
cations to reconfigure the floodplain and thereby im-
prove the usability of the site.
Both the Plan Commission and zoning Board of Appeals have made
recommendations of approval for these requests.
Subsequent to the defeat of the Community Center referendum, the
Park District requested that all pending petitions be tabled.
The present situation is as follows:
1) the property was rezoned to CR
2) all other items are tabled

The Park District is now requesting to withdraw the Text Amend-
ment and Special Use regarding the Community Center.
However, they would like to proceed with the Flood Plain Special
Use to allow reconfiguration of the flood plain as these changes
are necessary regardless of whatever the future use of the
property is to be.
Staff , including Trustee Skinner and Attorney Martens ; have
reviewed this request and are in agreement that the Community
Center building and other improvements can be removed from the
site plan and we can still proceed with the Flood Plain Special
Use and that you may approve it if you so wish.
Dale Durfey has not at this time give final approval. The compe-
nasatory storage has to be increased approximately 3%.
Any approval should include a final engineering approval condi-
tion.
If it is your wish to approve the Flood Plain Special Use it
would be appropriate to authorize the attorney to draft the
necessary ordinance.

Dear Steve:
This letter will hopefully culminate the many communications,
written and verbal, over the past many months as the Oak Brook Park
District requests that its Kensington Road site Floodplain Special
Use application, previously approved by the Village of Oak Brook
Plan Commission and Zoning Board of Appeals, but tabled November
13 , 1990, by the Village Board, be acted upon and approved by the
Board of Trustees at its regularly scheduled meeting to be held
January 28, 1992. Also, enlight of the Park Board not going ahead
with their Community Center project, at this time, we would request
the withdrawal of the Text Amendment and Special Use regarding the
Community Center.
The Park District requests final action on its plan and
application to modify the 100-year flood boundary within the
Kensington Road site. As per your letter request, dated December
10, 1991, a meeting with Thomas Hawk and Dale Durfey of your staff,
along with our Engineer and myself was held on December 12 , 1991.
It was mutually agreed that the most appropriate course of action
would be that all references. to buildings and parking lots should
be deleted from the plan since only the re-grading of the site is

Dear Mr. Hawk:
The intentions of the Oak Brook Park District and the McDonald's Corporation, with regard to
their properties on the south side of Kensington Road between Jorie Boulevard and Route 83,
were discussed at our meeting of December 12, 1991, held at the Oak Brook Village Hall. Present
at the meeting were a representative of McDonald's Corporation, representatives of the Oak
Brook Park District, and yourself, Dale Durfey, and Erik Louckes of Donohue and Associates
representing the Village of Oak Brook. The interrelationship between the Oak Brook Park
District's request to reactivate its tabled request for a Floodplain Special Use and the McDonald's
Corporation's request for a Floodplain Special Use on its property immediately to the east of the
Park District site was discussed. it was explained that the Oak Brook Park District is requesting
that the Village Board of Trustees act on the tabled recommendations of the Village Plan
Commission and Zoning Board of Appeals to grant a Floodplain Special Use to the Park District
for re-grading of its Kensington Road site, and that this request is neither precipitated nor
dependent upon any action by the McDonald's Corporation.
It was agreed that the work proposed by the McDonald's Corporation contemplates the proposed
re-grading of a very small portion of the Park District site which will require authorization of the
Park District Board, but, again, has no bearing on the proposed Park District re-grading.
Since the Park District no longer intends to move forward with the construction of a Community
Center on this property, it was agreed by all parties in attendance at the December 12, 1991,
meeting that, for the sake of clarity, all reference to buildings and parking lots should be removed
from the plan such that only re-grading of the site consistent with the requirements of the Village
of Oak Brook would be illustrated.
Subsequent to that meeting, I solicited the concurrence of Dale Durfey to lower and adjust the
grades outside the proposed flood boundary to achieve an earthwork balance. This adjustment in
grading is necessary to offset the loss of fill which would have been generated from the excavation
of basement areas within the previously proposed Community Center. Dale Durfey agreed to this
adjustment and indicated he would not consider it to be a material change in the plan, so long as

Springfield has held up the transfer of the $5 million for this

WHEREAS, an application has been filed by the Oak Brook Park District
requesting the rezoning of property located at 1425 Kensington Road from R-4
to C/R; and
WHEREAS, the Plan Commission on September 17, 1990 and the Zoning Board
of Appeals on October 2, 1990 recommended approval of the requested rezoning;
and
WHEREAS, the Village President and Board of Trustees have reviewed the

As per our recent telephone conversation, please be advised
that the Park District's proposed development of a Community Center
on the 14 .25 acres Kensington Road property has been dropped at
this time.
The previously tabled Ordinance to rezone this property from
R-4 to C/R District would be in order for approval by the Village
Board at this time.
As you are aware, the Park District had recently received
FEMA'S letter of approval regarding the regrading of the Kensington
Road site to modify the existing flood limits as per the proposed
Community Center plan. The. Park District's current thinking on
regrading certain portions of. this property would be in the
direction of developing a flat surface to accommodate community
sports game fields. We have not had sufficient time to develop
same at this point, but when that time comes, we will again return
to the Village for their guidance.

of August 31, 1990 from Acting Chairman Doyle.

Application has been made for various hearings related to the proposed

Permit; 2) Rezoning from R-4 to CH; and 3) Text Amendment and Special
Use Regarding the Community Center.
The particular fees normally charged for the above applications would
be $675, Special Use in Flood Plain; $650, Rezoning; $650, Text
Amendment; $400, Zoning Special Use Permit. As provided by Section
2-226 of the Village Code, the Park District, as a governmental unit,
has requested that the fees be waived.

Dear Mr. Sommer:
The Village Board, at its October 23, 1990 meeting, directed the Village
Attorney to prepare an ordinance to rezone the property from R-4 to the C/R
District. This ordinance will be presented to the Board at its next meeting
on November 13, 1990 for approval.
The other two applications concerning flood plain special use and text
amendment and special use for the Community Center were tabled to the
November 13 Board meeting for further discussion.
As discussed at the October 23 Board meeting, the Village Board chose to take
no action in favor of or opposed to the proposed development, not wishing to .
favor either side of the issue prior to the referendum on this subject.

Both the Plan Commission, at its meeting of September 12, 1990, and the
Zoning Board of Appeals, at its meeting of October 2, 1990, recommended
approval of these applications subject to the Park District actually
constructing the improvements as presented.
,Trustee Winters moved, seconded by Trustee Rush to direct the Village
Attorney to prepare the necessary ordinance for rezoning the proposed
Community Center. Voice Vote: all ayes, no nays. Motion carried.

It was the consensus of the Village Board that current zoning
regulations for through lots remain the same, and to request
recommendations from the Plan Commission and Zoning Board of Appeals
regarding accessory structures in rear yards of interior lots.
D. Oak Brook Park District 10-K Run and Fun Run:
Trustee Bushy moved, seconded by Trustee Winters to approve the Park
District's 10-K races which will be held on Sunday, April 28, 1991 at
8:00 a.m. , pursuant to the following conditions:
1) The Oak Brook Park District notify all the commercial tenants on
Jorie Boulevard, Kensington and Kensington Court of the race and
the closing of Jorie Boulevard between 0745 - 1000 hours.
2) The Oak Brook Park District supply an adequate amount of traffic
cones and barricades for traffic control and be responsible for
installing and removing them.
3) The Oak Brook Park District use Oak Brook Police Officers to direct
traffic.
4) The Oak Brook Park District make arrangements with the commercial
tenants on Kensington and Kensington Court for a centralized
parking and staging area.

I previously told you that I had calculated the existing versus proposed volumes of
the flood plain on your drawing dated 7/24/90. My existing volume above elevation
662 was 8.94 acre feet and my proposed number was 8.53 acre feet. Since that time,
I have had Rich Vaiciulis of my office do a more detailed planimeter take-off
(I cut the site in half and Rich cut it to thirds) with Rich's existing volume
equally 8.57 acre feet above 662 and the proposed volume being 8.29 acre feet.
I am willing to accept Rich's numbers since they should be more accurate than mine
since they were taken on a smaller area of planimetering. In any event, it is
apparent that your drawing is 0.28 acre feet short of compensating at a 100% level.
Please revise your drawing and resubmit accordingly.

The Oak Brook Park District, in conjunction with its proposed community center
on the 10-acre parcel located south of Kensington Road adjacent to Route 83,

A further description of these applications is contained on page 22 of the
folder (September 12 memo to the Plan Commission) .
Both the Plan Commission and Zoning Board recommended approval of these
various applications subject to the Park District actually constructing the
improvements as presented. In general, it was determined by both Boards that
the proposed flood plain modifications are compatible with the Ginger Creek
flood plain, rezoning of the property to the Conservation/Recreation District
is consistent with the intent and purpose of the Village's creation of this
district (other park district properties are already under this zoning
category) , and the text amendment and special use permit for community center
uses is the appropriate means by which this construction should be authorized.
The next step in the process would be to direct the Village Attorney to
prepare appropriate ordinances approving the above-mentioned relief for
approval at the Board's November 13 meeting.

area, nor will it negatively affect property values.
2. The area proposed to be rezoned is suitable for the various uses
contained in the C/R District.
3. The. rezoning will promote the general welfare of the community.

The Plan Commission, at its meeting of September 17, 1990, considered the
applicant's request for approval of a flood plain special use permit, rezoning
the property from R-4 to C/R and text amendment and special use for a community
center.
A motion was made by Member Sandstedt, seconded by Member Krafthefer, to
recommend approval of the requested flood plain special use permit for regrading
within the Ginger Creek flood plain subject to the following conditions:
1. Approval of the plans by the Village Engineer, FEMA and any other
appropriate governmental bodies.
2. Relocation of the flood plain easement previously granted to the Village
to cover the revised flood plain.
This motion was approved on a roll call vote of four ayes, Members Haglund,
Krafthefer, Sandstedt and Skinner; zero nays, and three members absent,

As indicated in the enclosed information, the Park District is proposing
construction of a community center on the 10-acre parcel of property recently
purchased from McDonald's Corporation. The property is located at the
southeast corner of Kensington Road and Route 83 and backs up on Ginger Creek.
In conjunction with this proposed development, the following types of Village
relief are required:
I
1. Flood Plain Special Use Permit - As indicated on the plans prepared by
Lindley & Sons, the existing flood plain line is proposed to be relocated
in order to provide adequate buildable area for the structure and parking
areas. A memo from Dale in the file provides further engineering detail
on this subject.
2. Rezone From R-4 to C/R - The Village in 1984 created the Conservation/
Reservation District (C/R) 4hose purpose was to encourage the development
of land for open space, recreational activities and/or preserve natural
resources. As indicated on the enclosed section from the Zoning Ordinance,
the permitted uses are primarily open space uses consistent with the
purpose of the district. Uses which involve buildings and other major
structures are required to receive a special use permit prior to construc-
tion. Areas presently zoned C/R within the Village include the Fullersburg
Forest Preserve, Oak Brook Sports Core, Central Park and York Park.
Consistent with the Village's previous rezoning of Central Park to the
C/R District, it would seem appropriate to, at this time, include the
community center property within this district.
3. Text Amendment and Special Use Regarding Community Center - As
recommended by our Village Attorney, it would be appropriate to create a
new special use category encompassing, in general terms, the intended
activities proposed for the community center. Using some of the
narrative contained in the Park District's literature, the new special
use category might be as follows:

general public.
This current request is both to create the new special use category as
well as issue a special,.use permit to the Park District for construction
of the proposed center on this site. As with other special use permits,
the Village should review the particular special use standards contained
on page 973 (copy attached) . Since the proposed uses will be operated by
a public agency, all. three of the standards should be reviewed by the
Village in this regard.

I have reviewed the site plan received on September 4 , 1990, the engineer ' s
flood plain calculations received on September 12 , 1990, and the booklet
concerning a request for conditional letter of map revision received on
September 12 , 1990 and offer the following comments :
1 . I understand the purpose of the applicant is to rearrange the
existing flood plain on this site so as to render the site more
usable for development as a community center . The applicant is
thus proposing to rearrange the flood plain to place it nearer
the stream banks .

4 . The site plan has been reviewed only in regards to the flood

application items . However , I do note that there may be a
problem with the three (3) proposed driveways . Because of this ,
my staff will be preliminarily reviewing this in order to note
any glaring deficiencies.
5 . The exhibits within the booklet do not accurately depict the
recently received letter of map revision which was approved by
FEMA when the McDonald' s Autumn Oaks Subdivision was approved.
This is a minor issue but I do note it for information. The
applicant is free to look at our repository and make any
necessary copies .

APPENDIX A—ZONING sec.XIII
No special use shall be authorized by the Village
Board unless the special use:
(a) Is of the type described in Section XIII J-1 (a) is
deemed necessary for the public convenience at
that location. (Ord. No. G-66, 12-19-66);
(b) Is so designed, located and proposed to be
operated that the public health, safety and welfare
will be protected; and
(c) Would not cause substantial injury to the value of
other property in the neighborhood in which it is
located.
(6) Conditions: The Plan Commission and Zoning Board
of Appeals may recommend, and the Village Board
may provide, such conditions and restrictions upon
the construction, location and operation of a special
use, including, but not limited to, provisions for
off-street parlang and loading as may be deemed
necessary to promote the general objectives of this
ordinance and to minimize the injury to the value of
the property in the neighborhood.
(1) Fees.
Fees for any relief under this ordinance shall be as
otherwise established by separate ordinance. (Ord. No.
G-132, 5-25-71; Ord. No. G-289, § 2, 3-24-81)
(L) Violation, Penalty and Enforcement.
(1) Any person, firm or corporation who violates,
disobeys, omits, neglects, refuses to comply with or
who resists enforcement of any of the provisions of
this ordinance shall, upon conviction, be fined not less
than $25.00 nor more than $500.00 for each offense.
Each day that a violation is permitted to east shall
constitute a separate offense.
(2) The Building Inspector is hereby designated and
authorized to enforce this ordinance. However, it shall
also be the duty of all officers, citizens and employees
of the Village, particularly of all members of the police

Sea•10-33. Occupation and use of wetlands.
(a) [Generally:] In wetlands only those uses will be
permitted which will not affect adversely the quantity or
quality of the public water supply, drainage, storm water
runoff or detention, or the health and safety of the village
and its environs.
(b) Permitted Uses: The uses listed in section 10-31(b) and
any other uses permitted by the applicable provisions of the
Oak Brook Zoning Ordinance which, in the opinion of the
building commissioner, will not adversely affect the public
water supply or the public health and sanitation.
(c) Special Uses: Uses not listed above which are
permitted or special uses under the Oak Brook Zoning
Ordinance for the subject property may be allowed upon
issuance of a special use permit as set forth below. (Ord. No.
G-217, § 2, 9-27-77)
I/ Sec. 10-34. Special use permits.
(a) Required Any use listed in this article as requiring a spe-
cial use permit may be allowed only upon application to and
issuance of a special use permit by the village.
(1) Authority: Special uses shall be authorized or denied by
the village board in accordance with the statutes of the
State of Illinois applicable to amendments of a zoning or-
dinance, and the regulations and conditions set forth in
this division for special uses. No application for a special
use shall be acted upon by the village board until after.
(i) A written report is prepared and forwarded to the
zoning board of appeals and the village board by the
plan commission in the manner prescribed in the zon-
ing ordinance for amendments to said ordinance;and

(ii) A public hearing has been held by the zoning board of
appeals,after due notice by publication as provided by
the applicable statutes of the State of Illinois for amend-
ments to a zoning ordinance and upon a report of the
plan commission to the board of trustees, if such a

The concurring vote of four (4) members of the plan com-
mission and/or the zoning board of appeals shall be neces-
sary to recommend in favor of any application which is
brought before the respective hearing body pursuant to
this article.
(2) Initiation: An application for a special use may be
made by any person, firm or corporation or by any
office, department, board, bureau or commission
requesting or intended to request a zoning certificate
for property within a floodplain, as defined in this
article.

(3) Processing: An application for a special use, in such
form and accompanied by such information as shall
be established from time to time by the Village of Oak
Brook, shall be filed with the village clerk and
thereafter processed in the manner prescribed thereto-
fore for applications for amendments.
(4) Decisions: The village board, upon report of the
zoning board of appeals and the plan commission, and
without further hearing, may authorize or deny an
application for a special use in accordance with the
statutes of the State of Illinois applicable to amend-
ments, or may refer it back to the zoning board of
appeals and the plan commission for further consider-
ation. No special use shall be authorized by the village
board unless the special use:
(i) Is so designed, located and proposed to be
operated that the public health, safety and welfare
will be protected; and
(ii) Would not cause substantial injury to the value of
other property in the neighborhood in which it is
located.
(5) Conditions: The plan commission and zoning board of
appeals may recommend, and the village board may
provide, such conditions and restrictions upon the
construction, location and operation of a special use,
as may be deemed necessary to promote the general
objectives of this article and to minimize the danger
of flood damage resulting therefrom.
(b) Procedure To Be Followed by the Plan Commission in
Making Recommendations Concerning Special Use Permits:
Upon receiving an application for a special use permit, the
plan commission shall, prior to making a recommendation
thereon:
(1) Require the applicants to furnish three (3) copies of
such of the following information, prepared by a
professional engineer or land surveyor, registered as
such in the State of Illinois, as is deemed necessary by

the plan commission for determining the suitability of
the particular site for the proposed use:
(i) Plans drawn to a readable scale showing location,
nature, dimensions and elevation of the lot,
existing or proposed structures, fill, storage of
materials, floodproofing measures, and the rela-
tionship of the above to the location of the
channel, floodway and the flood protection eleva-
tion.
(ii) Typical valley cross-section(s) drawn to a scale of
one (1) inch to one hundred (100) feet and a
vertical scale of one (1) inch to ten (10) feet
showing the channel of the stream, elevation of
land areas adjoining each side of the channel,
cross-sectional areas to be occupied by the
proposed development, and high water elevation.
Cross-section intervals shall not exceed one
hundred (100) feet.
(iii) Plans (surface view) showing elevations or con-
tours of the ground; pertinent structure, fill or
storage elevations; size, location and spatial
arrangement of all proposed and existing struc-
tures on the site; location and elevations of
streets, water supply, sanitary facilities; soil
types; and other pertinent information. Contours
shall be shown at one-foot intervals.
(iv) Photographs showing existing land uses and
vegetation upstream and downstream.
(v) A profile showing the slope of the bottom of the
channel or the flow line of the stream.
(vi) Specifications for filling, grading, dredging, chan-
nel improvements, storage of materials, water
supply and sanitary facilities.
(2) Transmit one copy of the information described in
subsection (b)(1) to the village engineer for technical
assistance, where necessary, in evaluating the pro-
posed project in relation to flood heights and

velocities; the seriousness of flood damage to the use;
the adequacy of the plans for protection; and other
technical matters.
(3) Based upon the technical evaluation of the village
engineer, determine the specific flood hazard at the
site and evaluate the suitability of the proposed use in
relation to the flood hazard.
(c) Factors Upon Which the Recommendations of the
Zoning Board of Appeals and the Plan Commission Shall
Be Based: In malting recommendations upon applications
for special use permits, the zoning board of appeals and the
plan commission shall consider all relevant factors specified
in other sections of this article, including but not limited to
the following:
(1) The danger to life and property due to increased flood
heights or velocities caused by encroachments;
(2) The danger that materials may be swept onto other
lands, or cross-stream, upstream or downstream to the
injury of others;
(3) The proposed water supply and sanitation systems
and the ability of these systems to prevent disease,
contamination and unsanitary conditions;
(4) The susceptibility of the proposed facility and its
contents to flood damage and the effect of such
damage on the individual owners;
(5) The importance of the services provided by the
proposed facility to the community.
(6) The requirements of the facility for a waterfront
location;
(7) The compatibility of the proposed use with existing
development and development anticipated in the
foreseeable future;
(8) The relationship of the proposed use to the compre-
hensive plan and floodplain management program for
the area;

(9) The safety of access to the property in times of flood
for ordinary and emergency vehicles;
(10) The expected heights, velocity, duration, rate of rise
and sediment transport of the floodwaters expected at
the site; and
(11) Such other factors which are relevant to the purposes
of this article.
(d) Conditions Attached to Special Use Permits: Upon
consideration of the zoning board of appeals and the plan
commission recommendations, the factors listed above, and
the purpose of this article, the .president and board of
trustees may by ordinance grant, deny or attach such
conditions to the granting of special use permits as they
deem necessary to further the purposes of this article.
Among such conditions, without limitation because of
specific enumeration, may be included:
(1) Modification of waste disposal and water-supply
facilities;
(2) Limitations on periods of use and operation;
(3) Imposition on operational controls, deposit of surety
bonds and deed restrictions;
(4) Requirements for construction of channel modifica-
tions, dikes, levees and other protective measures; and
(5) Floodproofing measures designed to be consistent with
the flood protection elevation for the particular area,
flood velocities, durations, rate of rise, hydrostatic and
hydrodynamic forces, and other factors associated
with the 100-year flood. In this event, the president
and board of trustees shall require that the applicant
submit a plan or document certified by a registered
structural engineer that the floodproofing measures
are consistent with the flood protection elevation and
associated flood factors for the particular area and
shall be provided in accordance with the standards for
completely floodproofed structures contained within
the United States Army Corps of Engineers publica-

tion, "Flood-Proofing Regulations," June, 1972, GPO:
1973 0-005-026 edition, or any subsequent edition
thereof. (Ord. No. G-217, § 2, 9-27-77; Ord. No. G-364, § 2,
9-10-85)
Sec. 10-35. Variations.
(a) (President and Board of Trustees May Grant:)
Variations to the provisions of this article may be granted
by the president and board of trustees upon recommendation
by the zoning board of appeals.
(b) Authority: The board of trustees shall decide all applica-
tions for variations of the provisions of this division after a public
hearing held before the zoning board of appeals on such notice as
shall be required by the Illinois Statutes for zoning variations.
The zoning board of appeals shall hold public hearing upon all
applications for variations and shall report its recommendations
to the board of trustees as to whether a requested variation
would be in harmony with its general purpose and intent, and
shall recommend a variation only where it shall have made a
finding of fact specifying the reason or reasons for recommending
the variation. Such findings shall be based upon the standards
prescribed in subsection(e)below. No variation shall be granted
by the board of trustees without such findings of fact. The con-
curring vote of four (4) members of the zoning board of appeals
shall be necessary to recommend in favor of the requested varia-
tion. In the case of a variation where the zoning board of appeals
fails to recommend the variation, it can only be adopted by an
ordinance with the favorable vote of two-thirds of the trustees.
(c) Initiation: An application for a variation shall be in
triplicate and may be made by any governmental office,
department, board, bureau or commission, or by any person,
firm or corporation having a freehold interest, a possessory
interest entitled to exclusive possession, a contractual
interest which may become a freehold interest, or any
exclusive possessory interest applicable to the land or land
and improvements described in the application for a
variation.
(d) Processing: An application for a variation shall be
filed with the village clerk who shall forward one copy of

Dear Mr.Kapff:
As you are aware, the Oak Brook Park District petition for zoning relief will be first
heard at a public hearing before the Plan Commission the evening of September 17,
1990. In support of this request,which includes down-zoning the property from a R-
4 to a CR district, granting of a special use with a text amendment to construct the
Community Center building, and the granting of a special use to modify the
floodplain limits, I offer the following comments for the Village's consideration:
Change in Zoning District and Granting of a Special Use to Construct Community Center
Building
The down-zoning of the Oak Brook Park District site on Kensington
Road from R-4 to CR, as requested by the Village, will enhance the
character of the immediate neighborhood by providing a facility which
will compliment the adjacent office development to the north (zoning
district ORA-1) and the existing opens ace to the south and east, that
being Central Park (zoning district CR�and the Butler National Golf
Club (zoning district R-1), respectively. The residential R-4 uses to the
west are essentially isolated from any impact by this project by the
visual and access separation imposed by Route 83.
As proposed, this project will further enhance the property values and
the quality of life within Oak Brook by providing an excellent facility
that will enhance the Park District's ability to provide outstanding
programs and recreational opportunities to the residents of Oak
Brook.

,Hoodplain Special Use
The Oak Brook Park District has determined, in the best interests of
its proposed Community Center, that a minor amount of regrading
within the aexisting floodplain of Ginger Creek will be necessary to
elevate the proposed building and parking lot above the 100-year flood
level. This regrading will be accomplished in accordance with the
requirements of the Village of Oak Brook, and will not require
approval by the Illinois Department of Transportation/Division of
Water Resources (IDOTrD:VR) since no work will be performed
within the floodway of Ginger Creek.
This modification of the Ginger Creek floodplain boundary will
require the release of a floodplain easement previously granted to the
Village of Oak Brook in 1985, and the granting of another floodplain
easement to the Village of Oak Brook over the reconfigured
floodplain limits. In addition, an application to the Federal Emergency
Management Agency (FEMA) requesting a Letter of Map Revision to
modify the floodplain boundary has been submitted and is expected to
be approved in early October.
Lastly, the Park District's response to the 10 factors which are to be
considered in the granting of this requested floodplain special use are
enclosed for the Village's consideraton.
I trust this information will be helpful to the Villages' deliberations regarding the
requested zoning relief.

REQUEST FOR SPECIAL USE TO OCCUPY FLOODPLAIN
Oak Brook Park District/Community Center
Oak Brook, Illinois
Response to factors listed in the Village of Oak Brook Municipal Code upon which the
recommendations of the Zoning Board of Appeals and the Plan Commission shall be based:
1. The danger to life and property due to increased flood heights or velocities caused by
encroachments.
Response: The submitted plan indicates that any floodplain volume filled by the
development of the subject property will be offset by a volume to be excavated
along Ginger Creek in excess of the volume of fill to be placed within the property.
2. The danger that materials may be swept onto other lands or cross stream, upstream, or
downstream to the injury of others.
Response: This park district property is ultimately to be used for a community
recreational center with no unusual storage of hazardous material; therefore,
there is no unusual risk of injury to others due to materials being swept onto the
property of others.
3. The proposed water supply and sanitation systems and the ability of these systems to prevent
disease,contamination,and unsanitary conditions.
Response: This building will be served by water supplied by the Village of Oak Brook
water system and sanitary service supplied by the Hinsdale Sanitary District. These
systems will be installed in accordance with the codes of the Village of Oak Brook,
Hinsdale Sanitary District and the State of Illinois Environmental Protection Agency, all
of which are intended to prevent the transmission of disease, contamination, and
unsanitary conditions.
4. The susceptibility of the proposed facility and its contents to flood damage, and the effect of
such damage on the individual owners.
Response: The proposed plan indicates its lowest opening to the building (floor
elevation) to be 3.5 feet above the 100-year flood elevation which will protect the
building and its contents from flood damage.
5. The importance of services provided by the proposed facility to the community.
Response: The facility will provide the residents of Oak Brook with one of the
finest recreational facilities of its kind and will be a valuable asset to both the Oak
Brook Park District and the Village of Oak Brook.

6. The requirements of the facility for a waterfront location.
Response: The use of this property is not dependent upon a waterfront location;
however, the asset of having Ginger Creek flowing through the Park District
property enhances the setting of the building and also the views available from
inside the building and the proposed patio area located on the south side of the
building. 11.
7. The compatibility of the proposed use with existing development and development
anticipated in the foreseeable future.
Response: The building is located across Ginger Creek from the existing park
district meeting house. The intended recreational use not only is compatible with
existing park district activity, but is also compatible with the office uses on the
north side of Kensington Road.
8. The relationship of the proposed use to the comprehensive plan and floodplain management
program for the area.
Response: The ultimate development of this property will be consistent with the
comprehensive plan, zoning ordinances, and floodplain management regulations
of the Village of Oak Brook.
9. The safety of access to the property in time of flood for ordinary and emergency vehicles.
Response: The access to the property will be Kensington Road, which is not
subject to flooding and will remain open to ordinary and emergency vehicles at all
times.
10. The expected heights, velocity, duration, rate of rise, and sediment transport of the flood
waters expected at the site.
Response: No change in these parameters will result from the site development
proposed. An excess of storage will be provided to compensate for any filling in
the floodplain.

MEMO TO: Bruce F. Kapff, Assistant to Village Manager
SUBJECT: Oak Brook Park District
You provided me with the first and second floor space and room legend
concerning the proposed "Community Center" constructed by the Park District.
The question concerned the conformance of this with the CR zoning. This
assumes, of course, that the property would be rezoned to CR consistent with
the balance of property presently owned by the Park District at its Central
Park location.
It does not appear that the building and uses therein is a permitted use in
the CR District. Although parks and playgrounds and accessory uses and
structures are permitted uses in that district, the intent of the CR District
was to make structures and buildings as special uses. The special use uses
most closely fitting the proposed use include government service facilities
and tennis and swimming clubs.
Based upon the uses proposed, it would be appropriate to consider rezoning of
the property to CR as well as the grant of a special use for the uses
intended. It might be most appropriate to design a new additional special use
labelled such as "Community Center" and defined to incorporate the types of
uses contained in the Park District proposal.

A Variation is a zoning adjustment which permits minor changes of district requirements
where individual properties are both harshly and uniquely burdened by the strict
application of the law. The power to vary is restricted and the degree of Variation is
limited to the minimum change necessary to overcome the inequality inherent in the
property.
1. A Variation recognizes that the same district requirements do not affect all
' properties equally; it was invented to permit minor changes to allow hardship properties
to enjoy equal opportunities with properties similarly zoned. You must prove that your
land is affected by special circumstances or unusual conditions. These must result in
j uncommon hardship and unequal treatment under the strict application of the Zoning
Ordinance. Where hardship conditions extend to other properties, a Variation cannot be
granted. The remedy for general hardship is a change of the map or the text of the
Zoning'-Ordinance.
2. You must prove that the combination of the Zoning Ordinance and the uncommon
conditions of .your property prevents you from making any reasonable use of your land' as
{ permitted by your present zoning district. Since zoning regulates land and not people,
the .following conditions cannot be considered pertinent to the application for a
Variation: (1) proof that :a Variation would increase the financial return from the
