ORDINANCE S- 730
AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTION VII(E) (8) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK,
ORDINANCE G-60, AS AMENDED, RELATIVE TO FRONT AND SIDE YARD REQUIREMENTS
IN AN R-2 SINGLE-FAMILY DETACHED RESIDENCE DISTRICT
(408 Luthin Road)
WHEREAS, an application has been filed requesting a variation from the
provisions of Section VII(E) (8) of the Oak Brook Zoning Ordinance, Ordinance
G-60, as amended; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals on December 3, 1991, pursuant to due and appropriate
legal notice, and was tabled for further discussion on February 4, 1992; and
WHEREAS, the said Zoning Board of Appeals made explicit findings of fact
that the variations requested conform to the standards set forth in Section
VII(E) (8) of the Oak Brook Zoning Ordinance; and
WHEREAS, the Village President and Board of Trustees concur with the
recommendation of the Zoning Board of Appeals to grant said variations;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section VII(E) (8) of the Zoning Ordinance of the Village of Oak Brook so as to
allow the construction of (1) a room addition to the side yard of the
residence, reducing the existing side yard to 15 feet instead of the 18 feet
required and (2) a garage addition to the front and side yards, thereby
reducing the side yard from the required 18 feet to 10 feet and the front yard
from the required 40 feet to 38 feet, provided that said variations are
constructed in substantial conformity with the Site Plan dated October 15,
1991 submitted with the application, a copy of which is attached hereto,
labelled "Exhibit A", and hereby made a part hereof.
Section 3: That this Ordinance is limited and restricted to the
property located at 408 Luthin Road, which property is legally described as
follows:
Lot 6 in Luthin Subdivision of a part of the South half of Section
36, Township 39 North, Range 11 East of the Third Principal
Meridian, according to the plat thereof recorded February 17, 1949
as Document No. 563041, in DuPage County, IL. Permanent Parcel
No. 06-36-303-010.

Section 4: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.
