ORDINANCE S-731
AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTIONS VI-A(6) AND X(A)(4) (a)
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK,
ORDINANCE G-60, AS AMENDED, RELATIVE TO STRUCTURE HEIGHT
(Emergency Warning Siren System)
WHEREAS, an application has been filed requesting a variation from the
provisions of Section VI-A(6) and Section X(A) (4) (a) of the Zoning Ordinance
of the Village of Oak Brook, Ordinance G-60, as amended; and
WHEREAS, a public hearing on such application was conducted by the
Zoning Board of Appeals of the Village on February 4, 1992, pursuant to due
and appropriate legal notice; and
WHEREAS, a recommendation has been made by the said Zoning Board of
Appeals that the variation requested be granted; and
WHEREAS, the said Zoning Board of Appeals made explicit findings that
the variations requested meet the applicable standards set forth in Section
XIII(G) (4) of the Oak Brook Zoning Ordinance; and
WHEREAS, the President and Board of Trustees of the Village of Oak Brook
concur with the recommendation and adopt the findings made by the said Zoning
Board of Appeals as set forth in the Zoning Board's minutes dated February 4,
1992;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section VI-A(6) of the Zoning Ordinance of the Village of Oak Brook so as to
allow a structure height of fifty (50) feet from the special use maximum of
forty (40) feet.
Section 3: That a variation is hereby granted from the provisions of
Section X(A) (4) (a) of the Zoning Ordinance of the Village of Oak Brook so as
to allow a maximum sound level of 133 decibels in the 600 to 1,200 cycles per
second range, from the 46 db in residential districts and the 51 db in
business and ORA districts.
Section 4: That this ordinance is limited and restricted to the real
estate described as:
(1) Adjacent to the pump house at 1915 York Road; Permanent Index No.
06-24-402-002.

(2) Within the 22nd Street right-of-way at the Southwest corner of
Route 83 and 22nd Street; Permanent Index No. 06-26-100-010.
(3) On the Fullersburg Woods Forest Preserve property adjacent to
Spring Road approximately 100 feet East of Madison and across the
street from 3502 Spring Road; Permanent Index No. 06-36-101-002.
(4) In the Oak Brook Road (31st Street) right-of-way on the North side
of Oak Brook Road at the Southwest corner of the Butterfield
Country Club approximately 600 feet East of Oak Brook Hills Road.
The above locations are legally described on Exhibit A and are depicted
on the map submitted with the variation and incorporated herein by reference.
Section 5: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.

of the intersection of York Road and Cermak Road (22nd Street) and is a part of
Tract-2A of the Butler Company-Illinois Tollway Assessment Plat No. 3, being a part
of the south half of Section 24 and the Southeast Quarter of Section 23, all in
Township 39 North, Range 11 East of the Third Principal Meridian in the Village of
Oak Brook, DuPage County, Illinois, according to the Assessment Plat thereof recorded
on November 25, 1964 as Document No. R64-44568 in the Recorders Office of DuPage
County, Illinois.

a part of the North Half of Sections 26, 27 and 28 all in Township 39 North, Range 11
East of the Third Principal Meridian in the Village of Oak Brook, DuPage County,
Illinois, according to the Assessment Plat thereof recorded December 27, 1960 as
Document Number 991695 in the Recorders Office of DuPage County, Illinois.
Commonly known as a portion of the southeast corner of 22nd Street & Route 83.

PARCEL 3:

On the north side of Spring Road on Forest Preserve District of DuPage County
property which is approximately 300 feet southeasterly of the intersection of Madison
Street with Spring Road. Said site is on Lot 4 of the F.O. Butlers Plat, being a
part of Section 36, Township 39 North, Range 11 East of the Third Principal Meridian
in the Village of Oak Brook, DuPage County, Illinois, according to the plat thereof
recorded on October 8, 1921 as Document No. 151374 in the Recorder's Office of DuPage
County, Illinois.
Commonly known as a portion of DuPage County Forest Preserve Property.
Permanent Index Number 06-36-101-002.
PARCEL 4:
Emergency Siren shall be located:
Within the northerly right-of-way of Oak Brook Road (31st Street) approximately 2650
feet east of the intersection of Oak Brook Road and Meyers Road. Said site is
approximately 27 feet east of the east line of the west half of the southeast quarter
of Section 28 and approximately 27 feet north of the south line of the southeast
quarter of Section 28 all in Township 39 north, Range 11 East of the third Principal
Meridian in the Village of Oak Brook, DuPage County, Illinois.
