AN ORDINANCE GRANTING A SPECIAL USE
FOR A RADIO AND TELEVISION STATION AND PRODUCTION STUDIOS
(2000 York Road)
WHEREAS, an application has heretofore been filed by the beneficial owner
of the property located at 2000 York Road for the approval of the issuance of
a special use permit to authorize a radio and television station and
production studios to be located on said property; and
WHEREAS, pursuant to Ordinance G- 487, the Village President and Board of
Trustees of the Village of Oak Brook have amended the Zoning Ordinance of the
Village of Oak Brook by adding radio and television stations and production
studios as a special use in the ORA-1 zoning district; and
WHEREAS, the Plan Commission of the Village of Oak Brook has submitted
its report on the subject application to the Zoning Board of Appeals and the
President and Board of Trustees and has recommended the approval of the
issuance of such special use permit, subject to certain conditions; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals of the Village on April 7, 1992, pursuant to due and
appropriate legal notice; and
WHEREAS, the Zoning Board of Appeals has also recommended the issuance of
such special use permit, subject to certain conditions; and
WHEREAS, the President and Board of Trustees have reviewed these
recommendations and concur with the recommendations and deem the passage of
this ordinance to be in the best interest and in furtherance of the general
welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That a Special Use Permit pursuant to the provisions of
Section X(B) (2) (i) be and is hereby granted for the use of a radio and
television station and production studios at property ("Subject Property")
located at 2000 York Road, which property is legally described as follows:
Parcel 1: Lot 1 in Reuben H. Donnelley Corporation Resubdivision,
being a resubdivision of Lot 1 in Reuben H. Donnelley Corporation
Subdivision of part of the Southwest 1/4 of Section 24, Township 39
North, Range 11, East of the Third Principal Meridian, according to
the Plat of said Resubdivision, recorded April 16, 1973 as Document
R73-20784, in DuPage County, Illinois.

Parcel 2: That part of Lot 1 described as follows: Commencing at
the most Northerly corner of said Lot 1; thence South 120, 431 , 24"
East along an Easterly line of Lot 1, aforesaid; 144.77 feet to the
point of beginning of land herein described; thence
continuing South 12°, 431 , 24" East along said Easterly line 20.28
feet to a corner of said Lot 1; thence North 890, 371 , 56" East
along a North line of Lot 1, aforesaid 105.99 feet to a Northeast
corner of said Lot 1; thence South 0°, 221 , 04" East along another
East line of Lot 1, aforesaid, 56.181 ; thence North 830, 021 , 28"
West 108.78 feet; thence North 2°, 361 , 53" West 62.17 feet to the
point of beginning of Official Airlines Guides Subdivision, a
subdivision in the Southwest 1/4 of Section 24, Township 39 North,
Range 11, East of the Third Principal Meridian, according to the
plat thereof recorded January 16, 1980, as Document R80-04175 in
DuPage County, Illinois. Permanent Parcel No. 06-24-307-016.
Section 3: That the Special Use Permit herein be granted specifically
subject to the following conditions:
1. That a license be obtained from the Federal Communications
Commission by the proposed operator prior to placing the
transmitter in service and that a copy thereof be submitted to the
Village prior to placing the transmitter in service.
2. That up to three microwave transmitting antennas may be placed on
the proposed tower to be substantially located on the Subject
Property at the sites depicted on the Landscape Plan dated May 5,
1992, as prepared by Architect John C. Voosen, which is
incorporated herein by this reference, provided that at all times
they are aimed at a receiving antenna placed on top of the Hancock
Building located at 875 N. Michigan Avenue or the Sears Tower
located at 233 S. Wacker Drive. No other microwave transmitting
antennas are permitted on the Subject Property.
3. That the operator of the transmitter facilities shall provide for
parking and traffic control with the approval of the Village's
building official, for aggregate live audiences of more than 50
people.
4. That all construction and landscaping be done in substantial
conformity with said Landscape Plan and the plans and
specifications attached hereto as Exhibits "A" and "B" provided
that neither said transmitting antennas nor said tower shall exceed
an elevation of 721 feet above mean sea level and further that
neither of the satellite receiving antennas or dishes shall have a
diameter materially in excess of 7.2 meters.

If the property owner fails to meet the conditions of this section, this
special use permit shall automatically terminate and be of no further force
and effect.
Section 5: That this Ordinance is limited and restricted to the property
located at 2000 York Road, Oak Brook, Illinois.
Section 6: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.
