AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTION V(G) (3) (h) (1)
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
RELATIVE TO FRONT YARD REQUIREMENTS
(1211 and 1301 22nd Street, Oak Brook, IL)
WHEREAS, an application has been filed requesting a variation from the
provisions of Section V(G) (3) (h) (1) of the Zoning Ordinance of the Village of
Oak Brook to permit construction of entryway canopies extending 912" into the
required front yard at the properties commonly known as 1211 and 1301 22nd
Street, Oak Brook; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals of Oak Brook on July 7, 1992 pursuant to due and
appropriate legal notice; and
WHEREAS, a recommendation has been made by said Zoning Board of Appeals
that the variation requested be granted and made explicit findings that the
variation requested meets the applicable standards set forth in Section
XIII(G) (4) of the said Oak Brook Zoning Ordinance; and
WHEREAS, the Village President and Board of Trustees concur with the
recommendations and findings made by the Zoning Board of Appeals;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section V(G) (3) (h) (1) of the Zoning Ordinance of the Village of Oak Brook so
as to permit construction of entryway canopies extending 912" into the
required front yard at the properties commonly known as 1211 and 1301 22nd
Street, Oak Brook.
Section 3: That this Ordinance is limited and restricted to the
properties located at 1211 and 1301 22nd Street. Said properties are legally
described on the attached Exhibit "A" and made a part hereof.
Section 5: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.

President Bushy questioned the increase of response time to fire
department calls. Fire Chief Nielsen stated mutual aid calls out of the
Village's jurisdiction increases response time to Interstate 88 and
surrounding communities.
Trustee Shumate inquired if the closure of the I-88 ramp would affect
response time to emergency calls. Chief Nielsen stated Fire Station II
has access to an I-88 ramp in either direction by the station house.
Police Chief Fleming stated per the Village Board's direction of July
14, 1992, Sheriff Doria was notified that the Village of Oak Brook would
supply a police officer to the B.A.T.T.L.E. unit providing three (3)
other DuPage communities also supplied a police officer to the unit.
Sheriff Doria contacted Chief Fleming that Bloomingdale, Naperville and
Woodridge would be supplying police officers. At this time, Chief
Fleming committed a police officer to the Unit commencing operations on
August 3, 1992.

Manulife, the owner of 1211 and 1301 22nd St. , has requested
variations or text amendments to allow construction of entryway
canopies extending 912" into the required front yard.
Both the Plan Commission and Zoning Board of Appeals have recommended
approval of this variation and further that a petition be prepared to
amend the ordinance to al-low canopies in required yards of commercial
properties.
The proposed canopies are relatively small and granting this variation
should have no negative impacts on the public welfare or any other
property owner.
The recommendation to amend the ordinance to allow canopies does
appear reasonable to me. We all have seen the advantages canopies can
have in bad weather conditions and they can be even more beneficial to
the elderly, the sick, and the handicapped.

On July 7, 1992, the Zoning Board of appeals held the necessary public
hearing regarding the Manulife request for 1211 and 1301 22nd Street.
The request is for a variation to permit entryway canopies to encroach
9P into the required front yard instead of the 3 feet permitted; to
amend the zoning ordinance to permit 10 ft. canopies in required front
yards.
The Zoning Board of Appeals, by a vote of 5 to 0, makes the following
recommendations:
1. To grant the variation as requested
2. To instruct staff to prepare a petition to amend the
Zoning Ordinance to allow larger canopies in required yards
based on building size.
The board felt that granting of the variation was justified and in
accordance with the necessary findings and further that the ordinance
itself was unnecessarily restrictive and should be revised.

III. APPROVAL OF MINUTES
Member Davis moved, seconded by Member Aldini, to waive the reading of the

IV. MANULIFE - 1211 and 1301 22nd STREET - VARIATION AND/OR ADMENDMENT.
Mr. Jeff Jarvis, who represents the petitioner, was sworn in. Mr. Jarvis
distributed a sketch of the proposed entryway canopy and passed around
several photos of the buildings. A brief restatement of the petitioner's
request was made by Mr. Jarvis and he answered the questions of the members.
The recommendation of the Plan Commission was discussed.
There was no testimony from the public regarding this request.
Mr. Jarvis described the following elements of hardship that are the basis
for their request:
1. The buildings are amongst the oldest buildings in the Village and
are to some extent architecturally-:out of date.
2. The buildings do not have discernible main entrances.
3. The 3 foot permitted canopies are not functional.
4. The overall result of the above is that the buildings' marketability
is reduced.
Member Davis moved, seconded by Member White, to recommend the approval of the
variation as requested and also that staff prepare an amendment to the Zoning
Ordinance which will allow larger canopies in required yards based on building
size. This motion was based on the following findings:

1. The age and architecture of the buildings will benefit from the
proposed canopies.
2. The three foot permitted canopies are not functional and do not pro-
vide desirable protection from the elements, espically for the aged
and the handicapped.

have no detrimental effects on neighboring properties.
4. The request is in accord with the purpose and intent of the Ordinance.
ROLL CALL VOTE: All in favor - motion passed.
Mr. Jarvis was advised that his petition would be placed on the Board of Trustees
agenda of July 28, 1992.
V. OTHER AGENDA ITEMS
Member Martis moved, seconded by Member Aldini, to table the Shannon and Hsu
petitions until the next meeting.

V. SHANNON/SANCTUARY - 1801 OAK BROOK ROAD -
PRELIMINARY PLAT OF SUBDIVISION WITH AMENDMENT AND
SPECIAL USE
Chairman Savino introduced Mr. Gene Ognibene, President of the
District 53 School Board, who addressed what impact the Sanctuary
would have on the elementary schools . At present time, Brook
Forest School is , at capacity. Butler School has two rooms that
could be utilized for additional pupils . However, Mr. Ognibene
noted that it is impossible to predict the ages of incoming
students and therefore, could not determine where new students
would be attending. Mr. Ognibene submitted an enrollment break-
down and a data sheet from the Capital Development Board.
Park District Commissioner, Mr. Howard Trier, then outlined the
Park District involvement in the Franciscan property and noted
that the Park District did not see how the land could be utilized
for sports and other recreation programs due to the irregular
topography. While the Park District would gain revenue if the
property is developed, Commissioner Trier stated that the Park
District board favored keeping the area in its natural state.
Following Commissioner Trier ' s comments, Chairman Savino returned
to item 5 on the agenda .

ON VARIATION
Mr . Jeff Jarvis from Lucien Lagrange and Associates spoke on
behalf of Manulife . He explained that extensive renovation was
underway on these two buildings and Manulife was requesting
relief from the Zoning Ordinance to allow cantilever canopies to
be constructed 10 feet into the required front yard instead of
the 3 feet that is permitted . The request was made both for
the purpose of visibility and to make the building more accessi-
ble as required by the Americans with Disabilities Act.
Discussion ensued as to whether relief should be sought through
means of a text amendment or a variation. Following discussion,
Member Haglund moved seconded b Member Sandstedt the motion to

recommend to the Village Board that a variation be granted allow-
ing Manulife to erect canopies at 1211 and 1301 22nd Street
approximately 912 " into the front yard , as the standards set
forth in Section XIII (G) (4) had been satisfied.

Member Doyle moved , seconded by Member Mueller , a motion to
recommend to the Village Staff that a text amendment to the
Zoning Ordinance be made to take into account the relation of a
building height to the size of the canopy allowed.

the appeal within reasonable time. The Board may
reverse or affirm, wholly or partly, or may modify
the order, requirement or decision or determina-
tion as in its opinion ought to be made on the
premises and to that end has all the powers of the
official from whom the appeal is taken.
(4) Decisions: All decisions, after hearing of the Zoning
Board of Appeals on appeals from an administrative
order, requirement, decision, or determination of the
Building Inspector or other authorized official of the
Village of Oak Brook, shall, in all instances, be final
administrative determinations and shall be subject to
judicial review only in accordance with applicable
Statutes of the State of Illinois.
(G) Variations.
(1) Authority: The Board of Trustees shall decide all
applications for variations of the provisions of this
ordinance after a public hearing held before the
Zoning Board of Appeals on such notice as shall be
required by the Illinois Statutes. The Zoning Board of
Appeals shall hold public hearings upon all applica-
tions for variations and shall report its recommenda-
tions to the Board of Trustees as to whether a
requested variation would be in harmony with its gen-
eral purpose and intent, and shall recommend a varia-
tion only where it shall have made a finding of fact
specifying the reason or reasons for recommending the
variations. Such findings shall be based upon the stand-
ards prescribed in Section XIII G-4 of this ordinance.
No variation shall be granted by the Board of Trustees
without such findings of fact. In the case of a
variation where the Zoning Board of Appeals fails to
recommend the variation, it can only be adopted by an
ordinance with the favorable vote of two-thirds of the
Trustees.
(2) Initiation: An application for a variation shall be in
triplicate and may be made by any governmental

office, department, board, bureau or commission, or by
any person, firm or corporation having a freehold
interest, a possessory interest entitled to exclusive
possession, a contractual interest which may become a
freehold interest, or any exclusive possessory interest
applicable to the land or land and improvements
described in the application for a variation.
(3) Processing: An application for a variation shall be
filed with the Village Clerk who shall forward one
copy of such application to the Zoning Board of
Appeals for processing in accordance with applicable
Statutes of the State of Illinois and one copy to the
Board of Trustees.
(4) Standards:
(a) The Zoning Board of Appeals shall not recom-
mend a variation of the provisions of this
ordinance as authorized in this section unless it
shall have made findings of fact based upon the
evidence presented to it on the following specific
issues that:
(1) The property in question cannot yield a
reasonable return if permitted to be used only
under the conditions allowed by the regula-
tions governing the district .in which it is
located.
(2) The plight of the owner is due to unique
circumstances.
(3) The variation, if granted, will not alter the
essential character of the locality.
(b) For the purpose of supplementing the above
standards, the Zoning Board of Appeals, in
making the determination whether there are
practical difficulties or particular hardships, shall
also take into consideration the extent to which
the following facts, favorable to the applicant,
have been established by the evidence that:

(1) The particular physical surroundings, shape,
or topographical conditions of the specific
property involved would bring a particular
hardship upon the owner as distinguished
from a mere inconvenience if the strict letter
of the regulation were to be carried out.
(2) The condition upon which the petition for
variation is based would not be applicable
generally to the other property within the
same zoning classification.
(3) The granting of the variation will not be
detrimental to the public welfare or injurious
to other property or improvements in the
neighborhood in which the property is lo-
cated.
(4) The proposed variation will not impair an
adequate supply of light and air to adjacent
property, or substantially increase the danger
of fire, or otherwise endanger the public safety
or substantially diminish or impair property
values within the neighborhood.
(5) That the purpose of the variation is not based
exclusively upon a desire to make more money
out of the property.
(6) That the alleged difficulty or hardship has
not been created by any person presently
having an interest in the property.
(c) The Zoning Board of Appeals may recommend
and the Board of Trustees may require such
conditions and restrictions upon the premises
benefited by a variation as may be necessary to
comply with the standards set forth in this section
to reduce or minimize the injurious effect of such
variation upon other property in the neighbor-
hood, and to implement the general purpose and
intent of this ordinance.
(5) Unauthorized Variations: The variation procedure
shall in no case be used to accomplish a result which

could otherwise be achieved by a rezoning of the
property involved, such as, but not limited to,
establishment or expansion of a use not permitted in a
residence district; authorizing the construction of
residences in other than residence districts; nor
authorizing other than single-family detached res-
idences in the R1, R2, R3 and R4 Districts.
(6) Re-applications: Any person, firm, or corporation
having been denied a variation to the Zoning
Ordinance respecting a specific parcel of property may
not re-apply for a like variation on said real property
until the period one (1) year has elapsed since the
denial of the application for variation by the
President and Board of Trustees. (Ord. No. G-137,
9-14-71)
(H) Plan Commission.
Jurisdiction.
The Plan Commission of the Village, which has been duly
established with functions as prescribed by the Illinois
Statutes, is the Plan Commission referred to in this
ordinance, and shall have the following duties under this
ordinance:
(1) Receive from the Village Clerk copies of applications
for proposed amendments and thereafter may submit
its recommendations thereon to the Zoning Board of
Appeals and Board of Trustees.
(2) Receive from the Building Inspector copies of applica-
tions for proposed Special Uses and thereafter submit
its recommendations thereon to the Building Inspector
and Board of Trustees.
(3) Act on all other matters which are referred to it as
required by the provisions of this ordinance.
(4) Review, from time to time, the provisions of this
ordinance and to make reports of its recommendations
with respect to proposed amendments to the Board of
Trustees.

Sec. XIII OAK BROOK CODE
(I) Amendments.
(1) Authority: This ordinance may be amended from time
to time by ordinance in accordance with applicable
Illinois Statutes. No vote shall be taken upon the
adoption of a proposed amendment by the Board of
Trustees until after a public hearing before the Zoning
Board of Appeals and a report of its findings and
recommendations has been submitted to the Board of
Trustees along with the recommendation of the Plan
Commission.
(2) Initiation of Amendment: Amendments may be
proposed by the Board of Trustees, Plan Commission
or Zoning Board of Appeals, and by any person, firm
or corporation having a freehold interest, a possessory
interest entitled to exclusive possession, a contractual
interest which may become a freehold interest or any
exclusive possessory interest which is specifically
enforceable on the land which is described in the
proposal for an amendment.
(3) Processing.
(a) A proposal for an amendment shall be filed with
the Village Clerk and thereafter entered into the
records of the first meeting thereafter of the Board
of Trustees.
(b) A copy of such proposal shall be forwarded by the
Village Clerk to the Zoning Board of Appeals with
a request to hold a public hearing and submit to
the Board of Trustees a report of its findings and
recommendations. Such public hearing shall be
held upon notice as required by Illinois Statutes.
(c) The Village Clerk shall also transmit a copy of
such proposal to the Plan Commission. The Plan
Commission shall submit an opinion report
relative to such proposed amendment to the
Zoning Board of Appeals and Board of Trustees.
(4) Decisions: The Board of Trustees, upon report of the
Plan Commission, if such report is made, and the

report of the Zoning Board of Appeals, and without
further public hearing, may vote upon the adoption of
any proposed amendment in accordance with applica-
ble Illinois Statutes, or may refer it back to the Boards
for further consideration.
(5) Re-Applications: Any person, firm, or corporation
having been denied an amendment to the Zoning
Ordinance respecting a specific parcel of property may
not re-apply for a like amendment on said real
property until the period of one (1) year has elapsed
since the denial of the application for amendment by
the President and Board of Trustees. (Ord. No. G-137,
9-14-71)
(J) Special Uses.
(1) Purpose: The development and execution of the zoning
ordinance is based upon the division of the Village
into districts, within any one of which the use of land
and buildings and the bulk and location of buildings
or structures, as related to the land, are essentially
uniform. It is recognized, however, that there are
special uses which, because of their unique character,
cannot be properly permitted in particular districts
without consideration, in each case, of the impact of
those uses upon neighboring lands and upon public
need for the particular use or the particular location.
Such special uses fall into two categories:
(a) Uses operated by public agency or publicly-regu-
lated utilities, or uses traditionally affected with a
public interest.
(b) Uses entirely private in character, but of such a
nature that the operation may give rise to unique
problems with respect to their impact upon
neighboring property or public facilities such as,
but not limited to, single-family attached and
semi-detached dwellings, horizontal condomini- •
ums and other residential developments. (Ord. No.

APPLICATION FOR PUBLIC HEARING
OAK BROOK EXECUTIVE PLAZA
April 16, 1992
It is the intention of the Owner, Manulife Real Estate, to construct a new canopy
to each of the two Oakbrook Executive Plaza office tower north (front) entrances.
Current zoning allows for the construction of up to a three-foot deep canopy as an
accessory structure per Section V, Paragraph G.31, Page 880 of the Village of Oak
Brook Zoning Ordinance Pamphlet.
Manulife Real Estate is requesting a variance to this item as shown on the enclosed
ASK 041692 for a 9'-2" deep canopy or an amendment to the zoning ordinance to allow
up to a ten foot canopy for the following reasons:
1. 22nd Street is an important and high profile thoroughfare for the
village. As originally constructed, the orientation of the
Oakbrook Executive Plaza buildings' main entrances are not visible
and actually give the appearance of a back door, not a front door.
A new canopy will assist in providing direction to the main
entrances and emphasize the "front door" on 22nd Street.
2. A three-foot deep canopy, if constructed, would not be funcional.
Construction of a 9'-2" canopy would create a protected covering
for passenger drop off access. With the current emphasis placed
upon handicapped accessibility, such a canopy would provide a
more safe path of travel with overhead protection to the elements.
3. The proposed canopy will not have supports extending to grade,
but in fact will be cantilevered. This will keep to a minimum
the mass of the structure.
