AN ORDINANCE REZONING CERTAIN PARCELS TO THE
B-1 LOCAL SHOPPING CENTER DISTRICT
JBC ERNIE PYLE ASSOCIATES
(Northeast Corner of Castle Drive & 16th Street)
WHEREAS, on January 15, 1993, an application was filed requesting that
certain property in the area of 16th Street and Castle Drive in the Village of
Oak Brook, Illinois, presently zoned B-2 be rezoned to B-1, Local Shopping
Center District; and
WHEREAS, at its meeting of March 4, 1993, the Plan Commission unanimously
recommended to the Village Board that the requested rezoning be granted,
subject to certain conditions suggested by this applicant; and
WHEREAS, the Zoning Board of Appeals, at its meeting of April 6,1993,
unanimously recommended to the Village Board that the requested rezoning be
granted, subject to certain conditions, and made certain findings of fact in
support thereof as set forth in the Chairman of the Zoning Board's letter to
the President and Board of Trustees dated April 15, 1993, all pursuant to due
and appropriate legal notice; and
WHEREAS, the Village President and Board of Trustees deem it in the best
interest of the Village of Oak Brook that the property described herein be
rezoned to B-1 Local Shopping Center District, subject to the terms and
conditions set forth herein; and
WHEREAS, the corporate authorities of the Village of Oak Brook have
considered the recommendations of the said Zoning Board of Appeals and the
Oak Brook Plan Commission concerning said rezoning; and
WHEREAS, the Village President and Board of Trustees deem it in the best
interest of the Village of Oak Brook that the subject property be rezoned from
B-2 to B-1 Local Shopping Center District, subject to the conditions and
restrictions set forth herein, as said zoning represents the most appropriate
zoning consistent with the highest and best use of the said property.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That the hereinafter described property is hereby rezoned
from B-2 to B-1 Local Shopping Center District. Said property is located at

the northeast corner of Castle Drive and 16th Street, and is legally described
as follows:
Lots 1 and 2 in Buck/Ernie Pyle Second Resubdivision, being a
subdivision of part of the Northwest Quarter of Section 23, Township
39 North, Range 11, East of the Third Principal Meridian, according
to the plat thereof recorded May 19, 1989, as Document No.
R89-58905, in DuPage County, IL. Permanent Parcel Nos.
06-23-102-023, 06-23-102-027, and 06-23-102-028,
Section 3: That the Village Clerk is hereby directed to amend the
official map of zoning districts of the Village of Oak Brook in accordance
with the provisions of Section 2 of this ordinance.
Section 4: That all ordinances in conflict with the provisions of this
ordinance are hereby repealed to the extent of such conflict, but only as they
apply to the specific property hereinabove described.
Section 5: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.
