screened porch at 200 Forest Trail Drive, reducing the required side yard from
10 feet to approximately 5.5 feet and the required rear yard from 30 feet to
approximately 27 feet; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals of the Village of Oak Brook on March 9, 1994, pursuant
to due and appropriate legal notice; and
WHEREAS, the said Zoning Board of Appeals made explicit findings in its
minutes dated April 5, 1994 that the variations requested meet the applicable
standards set forth in Section XIII(G) (4) of the said Oak Brook Zoning
ordinance; and
WHEREAS, a recommendation has been made by said Zoning Board of Appeals
that the variations requested be granted;
WHEREAS, the President and Board of Trustees of the Village concur with
the recommendations and findings made by the Zoning Board of Appeals;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:

are hereby adopted as though fully set forth herein.

Environmental Concerns & Engineering: Trustee Payovich - As a
representative of the Intergovernmental Relations Committee for the
DuPage Mayors and Managers Conference, stated the committee is
requesting municipalities to support the continuation of the Edward Byrne
Grant Program. President Clinton's administration plans to reduce the
funding of said program which aids funding of anti-drug and violent crime
programs. It would be a reduction of 105 officers from said task forces. It
was a consensus of the Village Board to contact our legislators requesting
the continuation of said program and task force officers.
Finance/Purchasing: Trustee Bartecki - No report was given.
Library & Hotel, Convention and Visitors Committee: Trustee McInerney -
He announced Joe Kruvi, Chairman of the Hotel Committee has accepted a
new position with Hyatt in Israel and will be leaving the Committee in
August. Keith Sennstrom, Hotel Committee representative from the Drake
Hotel, has been transferred and his replacement, Adrienne Beck, will be
recommended at the Hotel Committee's May 12th meeting.
Village Librarian Martin will have policy recommendations in June for
handling procedures to increase accessibility of the Library and is
researching computer capabilities for the Library.
Personnel & Public Safety: Trustee Kenny - The Fire Department is
addressing a space utilization study at Station 1 and facility renovation
study at Station 2.
Planning & Zoning: Trustee Skinner - Both recommending bodies will be

SUBJECT: Juang Variation - 200 Forest Trail Drive - Side and Rear Yard Encroachments
RECOMMENDATION: For approval - for the purpose of allowing enclosure of an existing
screened porch per the plat of survey drawn by Intech Consultants,
dated December 16, 1991. Reduce the required side yard to 5 feet
and the required rear yard to 26.5 feet.
The Juang's petition requests side and rear yard variations to allow enclosing an existing non-
conforming screened in porch. The original home is approximately 40 years old and the porch
was in existence at the time of annexation of this area in 1973.
There have been no objections from any of the neighbors nor from the Timber Trails
Homeowners Association. The Zoning Board of Appeals, by a vote of 5 to 0 recommended
approval of this request.
Over the past couple of years, the Juang's have made a major investment in the renovation and
expansion of their home. The proposed porch enclosure will be done in a manner consistent with
the style and architecture of the home.
The difference between the above recommended yards and the dimensions shown on the plat is
to allow for the approximately one foot eave overhang.
If it is your wish to approve this request, it would be appropriate to authorize the Village
Attorney to draft the necessary ordinance for your action at your meeting of May 10, 1994.

Dear Madam President and Board of Trustees:
The Zoning Board of Appeals, at their regular meeting of April 5, 1994 and pursuant to proper
legal notice, held the required public hearing for the Juang Variation request.
The Juang home is approximately 40 years old and has an existing screened in porch that
encroaches into the required side and rear yards and which they would like to enclose. The
Juang's, per their testimony, have expended $600,000 on a major remodeling and enhancement
of their home over the past couple of years. Enclosure of the porch will allow completion of this
work and will not alter the character of the neighborhood..
The Zoning Board of Appeals voted 5 to 0, to recommend approval of this request. See the
attached draft copy of the meeting minutes for motion details.

I. CALL TO ORDER
The meeting was called to order at 7:36 p.m.

II. APPROVAL OF MINUTES
Member Shah moved, seconded by Member Hasen, to waive the reading of the minutes and to
approve them as written.
VOICE VOTE: All in favor. Motion passed.
III. JUANG VARIATION - 200 FOREST TRAIL - SIDE and REAR YARD VARIATION
Chairman Davis asked the audience if there was anyone in support of or in opposition to this
petition. There was no one. The petitioner, Chih-Shun Juana was then sworn in by Chairman
Davis.
Juana stated that his house is 40 years old and that he and his wife purchased it 5 years ago.
They started renovations two years ago. At that time they did not do any work on the existing
roofed screened porch. Several months ago they decided to enclose the porch. When they went
to obtain a building permit they were told that the porch was legal non-conforming and would
have to apply for a variation to enclose it. There is a little encroachment as shown in the survey.
The areas of the encroachments are two small triangular areas.

Chairman Davis questioned whether or not the neighbors had been notified of the proceedings.
Juana, stated that a letter of approval from the next door neighbor facing north was included in
the file. The neighbor facing south is living with her daughter and he has been unable to contact
her. However, she was very supportive while they were doing the prior renovations. (It should
be noted that the Village sent letters to all neighbors advising them of these proceedings and the
action requested.) The east side of the porch faces the'street and west side is a wooded area by
Salt Creek.
Chairman Davis questioned Hawk as to clarification of the screened in porch as a legal non-
conforming use. Hawk stated that screened in roofed porches are not permitted to encroach into
required yards. If this were an open deck without a roof, it could encroach into the rear yard.
Since it was an existing screened porch, this makes it existing non-conforming. Under our
ordinances you cannot expand an existing non-conforming use. By enclosing the porch it would
be expanding the habitable area into these yards. Davis asked that the fact that the porch has a
roof and is screened does not make it considered habitable. Hawk stated that it could continue
the use as a screened in porch indefinitely. There is no provision in the Ordinance to change
this.
Davis asked Juana what he intended to enclose the area with. Juana stated that because it is on
the north side of the house it would be too cold in the winter to enclose it with glass as they had
originally intended. They now plan to make it compatible with the existing house, enclosing it
with brick and cedar siding as the rest of the house. There is no expanding of the existing
structure footprint at all.
Member Aldini asked if any neighbors have enclosed porches. Juana stated that a house east by
the lake is enclosed but he is unaware of how long it has been there. Member Hasen stated that
after reviewing the photographs, enclosing the porch would make it look better. Several
members agreed with that statement.
Chairman Davis asked for a motion for approval and to include findings. Member Hasen moved,
seconded by Member Aldini to recommend approval of the Juana variation as requested. The
motion is based on the these findings:
1. The plight of the owner is due to unique circumstances.
2. The variation will not alter the essential character of the locality.
3. The lot size, shape and topography constitutes a hardship in adhering got the
reaulations.
4. The conditions upon which this request is based are unique and not generally
applicable to other properties.
5. The granting of this variation will not be detrimental to the public welfare or to
other properties in the area.
6. Adequate light, ventilation, air, and fire separation are maintained.
7. Property values of nearby properties will not be diminished
8. The purpose of this addition is not based exclusively upon the desire to make
more money from the property.
9. The difficulties and hardships alleged were not created by the present property
owners.

reported on the next two months agendas. He also stated that IBLP has withdrawn their petition

SECTION VIII. BUSINESS DISTRICTS
(A) Preamble.
The Business Districts provide for groupings of business
and other nonresidential establishments in accordance with
their compatibility, functions and scope of service. The
regulations of the various Business Districts are designed to
govern developments ranging from the local shopping areas
serving primarily residents of the Village to. those which
serve the region.
(B) Business District Provisions.
(1) Minimum Lot Area-2 or more uses on a lot: Wherever
2 or more permitted uses or Special Uses, each
requiring a minimum lot area, are located in the same
building or on the same lot the required minimum lot
area shall be the sum of the areas required for each
use individually. When one or more use has a required
--� minimum lot area, the total lot area shall equal the
sum of the required lot areas plus an adc=tional area
equivalent to that devoted to the use which does not
have a required minimum lot area.
(2) Scope: All business establishments shall be retail
trade or service establishments dealing directly with
consumers and all goods produced on the premises
shall be sold on the premises where produced, and all a = .
business, service, storage, merchandise, display, and
' where permitted, repair and processing shall be

give due notice thereof to parties and shall decide
the appeal within reasonable time. The Board may
reverse or affirm, wholly or.partly, or may modify
the order, requirement or decision or determine
- tion as in its opinion ought to be made on the
premises and to that end has all the powers of the
official from whom the appeal is taken.
(4) Decisions: All decisions, after hearing of the Zoning
Board of Appeals on appeals from an administrative
order, requirement, decision, or determination of the
Building Inspector or other authorized official of the
Village of Oak Brook, shall, in all instances, be final
administrative determinations and shall be subject to
judicial review only in accordance with applicable
Statutes of the State of Illinois.
(G) Variations.
(1) Authority. The Board of Trustees shall decide all
applications for variations of the provisions of this
ordinance after a public hearing held before the .
Zoning Board of Appeals on such notice as shall be
required by the Illinois Statutes. The Zoning Board of
Appeals shall hold public hearings upon all applica-
tions for variations and shall report its recommenda-
tions to the Board of Trustees as to whether a
requested variation would be in harmony with its gen-
eral purpose and intent, and shall recommend a varia-
tion only where it shall have made a finding of fact
specifying the reason or reasons for recommending the
variations. Such findings shall be based upon the stand-
ards prescribed in Section XIII G-4 of this ordinance.
No variation shall be granted by the Board of Trustees
without such findings of fact. In the case of a
variation where the Zoning Board of Appeals fails to
recommend the variation, it can only be adopted by an
ordinance with the favorable vote of two-thirds of the
Trustees.
(2) Initiation: An application for a variation shall be in
triplicate and may be made by any governmental

office, department, board, bureau or commission, or by
any person, firm or corporation having a freehold
interest, a possessory interest entitled to exclusive
possession, a contractual interest which may become a
freehold interest, or any exclusive possessory interest
applicable to the land or land and improvements
described in the application for a variation.
(3) Processing: An application for a variation shall be
filed with the Village Clerk who shall forward one
copy of such application to the Zoning Board of
Appeals for processing in accordance with applicable
Statutes of the State of Illinois and one copy to the
Board of Trustees. '
_ (4) Standards:
(a) The Zoning Board of Appeals shall not recom-
mend a variation of the provisions of this
ordinance as authorized in this section unless it
shall have made findings of fact based upon the
evidence presented to it on the following specific
issues that:
(1) The property in question cannot yield a
reasonable return if permitted to be used only
under the conditions allowed by the regula-
tions governing the district in which it is
located.
I (2) The plight of the owner is due to unique
circumstances.
(3) The variation, if granted, will not alter the
essential character of the locality.
(b) For the purpose of supplementing the above
standards, the Zoning Board of Appeals, in
making the determination whether there are
practical difficulties or particular hardships, shall
also take into consideration the extent to which
the following facts, favorable to the applicant,
have been established by the evidence that:

(1) The

or topographical conditions of the specific
property involved would bring a particular
hardship upon the owner as distinguished
from a mere inconvenience if the strict letter '
of the regulation were to be carried out.
(2) The condition upon which the petition for
variation is based would not be applicable
generally to the other property within the
same zoning classification.
(3) The granting of the variation will not be
detrimental to the public welfare or injurious
_ to other 'property or improvements in the
neighborhood in which the property is lo-
cated.
(4) The proposed variation will not impair an
adequate supply of light and air to adjacent
property, or substantially increase the danger
of fire, or otherwise endanger the public safety
.or substantially diminish or impair property
values within the neighborhood.
(5) That the purpose of the variation is not based
exclusively upon a desire to make more money
out of the property.
(6) That the alleged difficulty or hardship as
not been created by any person
having an interest in the property.
(c) The Zoning Board of Appeals may recommend
and the Board of Trustees may require such r
conditions and restrictions upon the premises j
benefited by a variation as may be necessary to
comply with the standards set forth in this section
to reduce or minimize the injurious effect of such
variation upon other property in the neighbor-
hood, and to implement the general purpose and
intent of this ordinance.
(5) Unauthorized Variations: The variation procedure
shall in no case be used to accomplish a result which

could otherwise be achieved by a rezoning of the
property involved, such as, but not limited to,
establishment or expansion of a use not permitted in a
residence district; authorizing the construction of
residences in other than residence districts; nor
authorizing other than single-family detached res-
idences in the R1, R2, R3 and R4 Districts.
(6) Re-applications: Any person, firm, or corporation
having been denied a variation to the Zoning
Ordinance respecting a specific parcel of property may
not re-apply for a like variation on said real property
until the period one (1) year has elapsed since the
denial of the application for variation by the
President and Board of Trustees. (Ord. No. G-137,
9-14-71)
(I) Plan Commission.
Jurisdiction. _
The Plan Commission of the Village, which has been duly
established with functions as prescribed by the Illinois
Statutes, is the Plan Commission referred to in this
ordinance, and shall have the following duties under this
ordinance:
(1) Receive from the Village Clerk copies of applications
for proposed amendments and thereafter may submit
I its recommendations thereon to the Zoning Board of
Appeals and Board of Trustees.
(2) Receive from the Building Inspector copies of applica-
tions for proposed Special Uses and thereafter submit
its recommendations thereon to the Building Inspector
and Board of Trustees.
(3) Act on all other matters which are referred to it as
required by the provisions of this ordinance.
(4) Review, from time to time, the provisions of this

LETTER OF EXPLANATION
TO VILLAGE OF OAK BROOK:
To support my petition for variation, the following list of findings
is presented for your consideration:
1 . That the proposed area is a legal non-confirming structure.
2 . That the proposed area faces the public street and is readily
visible from the street. Therefore, its appearance and compatibility
with the rest of the house is of vital importance in valuation of
the property and the general outlook of the neighborhood. This
particular area had not been maintained when we bought the house
five years ago and is in dire need of repair. Left in its present
state of openness will render it incompatible with the house and
will only prolong the negative impact, on the neighborhood.
3 . That the current appraised value of the property is way below the
cost of the extensive rehabilitation of the house that was completed
in the last two years . Therefore, by completing the proposed project
I am merely seeking to remedy the situation mentioned above and not
any profit. However, if the situation can- not be improved it will
certainly affect the marketability of the property in the future .
4 . That the proposed area, with its matching roofline, is an existing
integral part of the house . Therefore, by enclosing and not
expanding or relocating the structure, it will not alter the
essential character of the locality.
5 . That the rehabilitation and addition that was done is one of the few
recent improvements in a neighborhood of older houses and has been
well received by the neighbors . By granting the variation and make
the property more complete and the appearance improved will not be
detrimental to the public welfare or injurious to other property or
improvement in the neighborhood in which the property is located.
6 . That the proposed area is outside the flood plan and situated to the
back and away from the neighboring house . There is more than adequate
distance (more than 36 feet ) between the proposed area and the
nearest structure which is the garage of the neighboring house.
Therefore , the proposed variation will not impair an adequate supply
of light and air to adjacent property, or substantially increase
the danger of fire, or otherwise endanger the public safety or
substantially diminish or impair property values within the
neighborhood .
7 . That the proposed project has been reviewed and is supported by the
the Timber Trail/Merry Lane Home Owner Association and by the neighbor
whose house is adjacent to the proposed area.
