AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTION V(K) OF THE ZONING ORDINANCE OF
THE VILLAGE OF OAK BROOK, ORDINANCE G-60, AS AMENDED,
RELATIVE TO STRUCTURE HEIGHT
(1300 Forest Gate Road)
WHEREAS, an application has been filed requesting a variation from the
provisions of Section V(K) of the Oak Brook Zoning Ordinance, Ordinance G-60,
as amended; and
WHEREAS, a public hearing on such application was conducted by the
Zoning Board of Appeals of the Village on July 5, 1994, pursuant to due and
appropriate legal notice; and
WHEREAS, a recommendation has been made by the said Zoning Board of
Appeals that the variation requested be grapted; and
WHEREAS, the said Zoning Board of Appeals made explicit findings that
the variation requested meets the applicable standards set forth in Section
XIII(G) of the Oak Brook Zoning Ordinance; and
WHEREAS, the President and Board of Trustees of the Village of Oak Brook
concur with the recommendation and adopt the findings made by the said Zoning
Board of Appeals as set forth in the Zoning Board's minutes dated July 5,
1994;
NOW, THEREFORE, BE IT ORDAINED By THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1:_ That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section V(K) of the Zoning Ordinance of the Village of Oak Brook so as to
allow the erection of 64'6" lighting poles to illuminate Nos. 2 and 3 baseball
fields in substantial conformance with the plans drawn by Barclay &
Associates, Oak Park, IL, dated 5/3/94 and herein included by reference.
Section 3: That this Ordinance is limited and restricted to the
property located at 1300 Forest Gate Road, Oak Brook, Illinois, which property
is legally described on Exhibit "A" attached hereto and hereby made a part
hereof.
Section 4: The variation granted in Section 2 of this ordinance is
conditioned upon the following:
1. That the lights atop the poles shall be turned off not later than
10:00 p.m. every day.

2. That use of the lights atop the poles shall be limited to
the period from April 1 to October 31 of each year. In the
event that usage in October causes verifiable detrimental
impact on neighbors, the usage period shall be shortened to
April 1 to September 30 in subsequent years.
If the property owner fails to comply with these conditions, said variation
shall automatically terminate and be of no further force or effect.
Section 5: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.

AN ORDINANCE AMENDING ORDINANCE G-342
RELATIVE TO A SPECIAL USE PERMIT
OAK BROOK PARK DISTRICT
(1300-1500 Forest Gate Road)
WHEREAS, on February 14, 1984, the Board of Trustees of the Village of
Oak Brook passed Ordinance G-342, which rezoned certain property and granted
the following special use in Section 5 of the ordinance:
Section 5: That a special use is hereby granted to the Oak
Brook Park District, a unit of local government, under the
provisions of Section VIA(2) (d) of Ordinance No. G-60, the
Zoning Ordinance of the Village of Oak Brook, to permit the
use of Parcel No. 3 (Central Park) legally described in
Section 1(C) above, as a governmental service facility; and
WHEREAS, the Oak Brook Park District filed an application requesting an
amendment to the foregoing special use to permit construction of a Family
Recreation/Administration Center in Central Park; and
WHEREAS, at its meeting of October 17, 1994, the Plan Commission
unanimously recommended to the Village Board that the requested amendment to
the special use be granted, subject to certain conditions; and
WHEREAS, the Zoning Board of Appeals, at its meeting of November 1, 1994,
unanimously recommended to the Village Board that the requested amendment to
the special use be granted, subject to certain conditions and restrictions,
and made certain findings of fact in support thereof as set forth in the
Chairman of the Zoning Board's letter to the President and Board of Trustees
dated November 16, 1994, all pursuant to due and appropriate legal notice;

Trustee Bartecki announced that he could not attend the scheduled
December 10, 1994 Budget Workshop. Board members requested his
attendance of the Workshop as the finance liaison trustee and asked to
reschedule the Workshop. The majority of Board members agreed upon
rescheduling to December 3, 1994 with the exception of Trustee
McInerney who was unavailable for that date.
Motion by Trustee Payovich, seconded by Trustee Shumate, to cancel the
Budget Workshop of December 10, 1994; reschedule the Budget
Workshop to December 3, 1994 from 8:00 a.m. to 12:00 p.m.; cancel the
December 13, 1994 Public Hearing and Village Board meeting and
reschedule the Public Hearing to 7:00 p.m., December 19, 1994 and the

President Bushy noted that the action by the Village Board is not an
endorsement of the project or an approval of the Oak Brook Park District
programs, but a land use question of the Village Zoning Ordinance.
Village Attorney Martens requested a clarification of parking for their
activities.
Both the Plan Commission, at their regular meeting of October 17, 1994,
on a vote of 6 to 0; and the Zoning Board of Appeals, at their regular
meeting of November 1, 1994,on a vote of 5 to 0, recommended
approval of the requested Special Use Amendment Site Plan revision to
include the Family Recreation/Administration Center at 1300 Forest Gate
Road subject to the following conditions:
1. The Recreation/Administrative Center shall be developed in
substantial accordance with the submitted site, floor, and
elevation plans;
2. The development will be in accordance with all other applicable
local, state, and federal regulations i.e., building codes and
stormwater management regulations; and
3. Property owner commitment to provide necessary parking at all
times for all activities.

Trustee Shumate thanked Assistant to Village Manager Long for his letter to CABLE TV
Continental Cablevision regarding CLTV. He further noted Village Manager
Veitch's memorandum of the Comprehensive Plan and that the Graue Mill COMPREHENSIVE
property was not included in the scope of the services from Lohan Associates. PLAN UPDATE
He requested the B-3 property be included in the study. Trustee Kenny
concurred with his recommendation. President Bushy explained the scope of
services from Lohan Associates would need to be adjusted for this.
Motion by Trustee Shumate, seconded by Trustee Payovich, to direct staff to
receive a quote from Lohan Associates for inclusion in their study of the Village

The proposal is consistent with the original Special Use approval and the new facilities will be
constructed in accordance with bulk regulations of the CR Zoning District.
The parking provided will accommodate normal operational needs adequately and the Park
District has committed to providing for parking needs for high volume uses such as occasional
assembly use of the gymnasium spaces.
If it is your wish to proceed with approval of this proposal it would be appropriate to direct

On November 1, 1994, at their regular meeting and pursuant to proper legal notice,the Zoning Board
of Appeals held the required public hearing for the Oak Brook Park District request for Special Use

There was no public testimony for or against this proposed Special Use Amendment.
The Zoning Board of Appeals by a vote of 5 to 0, approved a motion recommending approval
subject to the following conditions:

IV. OAK BROOK PARK DISTRICT - 1300 FOREST GATE ROAD - SPECIAL USE
AMENDMENT
Harlan Spiroff introduced himself as the attorney representing the Oak Brook Park District. He
said that experts and officials were present, but formal testimony will not be given.
Spiroff identified the experts, and park officials. Spiroff gave a brief history on the background
of the Special Use and the Site Plan that was originally granted in 1984 by Ordinance G-342.
He identified the location, zoning, and surrounding property zoning. He explained that they are
not seeking a Special Use, just an amendment to the Site Plan to allow for the construction of
the recreational center and the needed administrative office space. The use of the property stays
the same. They are before the board to modify the site plan. There are no changes to the Special
Use that had been previously granted. The square footage of the building is 57,300 square feet.
Phase One will be modified to add one additional building. Phase Two will include a swimming
pool as a possible use and additional parking. The additional parking is shown on the site plan
should the need for it become necessary. They will comply with all bulk requirements, setbacks
and floor area ratios. All stormwater detention requirements, Village and County, will be
complied with. The proposed structures will be compatible with those existing at the park.
Member Martis questioned the proposed time frame. Jon Sommer explained that they anticipate
construction to begin in the spring of 1995 with completion expected between spring and summer
of 1996. Martis questioned the possible need of a sunset provision. Further discussion deemed
that such a provision would not be needed
Member Vescovi questioned whether the staffing costs will be covered by the usage fees, and
what portion of those fees will sustain staffing wages? Sommer said that they anticipate 20%
of the staffing expenses will be sustained by usage fees; wages for personnel is anticipated to be
approximately $160,000. Sommer added that the facility will be in operation between 12 and
16 hours per day, 7 days per week. Vescovi questioned him regarding his concerns that these
costs will create a need for an increase in the tax base. Sommer answered that there would be
no increase to the taxpayers. He said that the costs are within the current tax base.
Chairman Davis questioned whether the proposed facility was necessary for public convenience.
Sommer stated that all of the surveys done in recent years have supported the need for this
facility. He said that the 1989 Park District referendum was defeated and the plans were shelved

are limited in the activities they can offer and how many can participate.

Hawk said that the Special Use continues as previously approved, only the site plan is changed.
The use of the structure is consistent with Park District uses.
No one in the audience spoke in favor of or in opposition to the request.
Chairman Davis said that the need appears to be necessary; that the public health, safety and
welfare will be protected and enhanced; that there is no indication there will be substantial injury
to the cost or value of property in the neighborhood; and there is no opposition to the request.
Member Davis moved, seconded by Member Dosedlo to recommend approval of the requested
amended site plan based on the revised site plan (Petition Index page 8), pages numbered 2 and
3 of the Design study (as drawn by Smith & Stephens Architects, revision date 9/9/94), and
including the following conditions:
1. The Recreation/Administrative Center shall be developed in
substantial accordance with the submitted site, floor, and elevation
plans.
2. The development will be in accordance with all other applicable
local, state, and federal regulations, i.e., building codes and
stormwater management regulations.
3. Property owner commitment to provide necessary parking at all
times for all activities.

There was discussion at the Plan Commission meeting of October
17, 1994 regarding the necessary parking requirements for the Park
District's Family Recreation/Administration Center.
Let this letter serve as an assurance and a Park District
commitment to always provide what ever parking requirements that
would be necessary, at all times, to meet the needs of this
facility and its functions, as well as, for the residents of Oak
Brook.
It is the Park District's belief, based upon the current and
future population demographics of Oak Brook, that the current 200
space parking facility will more than adequately meet the
facilities anticipated normal program usage needs, both now and in
the immediate future. Though not anticipated, the District does
have however, on the Central Park site, additional improved parking
via: racquet club, baseball, soccer, shelter, etc. , that could
always be utilized, temporarily, if ever there was an isolated
special program activity overflow that warranted more than the
current 200 spaces for the Family Center. However, when the future
need does arise for additional permanent parking spaces, in
relationship to the Family Center, the District would indeed
construct whatever additional parking spaces necessary. As per
your request, the enclosed revised site plan illustrates the
anticipated location of those designated areas as future parking
if ever needed.

Dear Mr. Sommer:
Per your request, Gewalt-Hamilton Associates, Inc. has conducted a traffic planning as-
sessment of the Family Recreation/Administrative Center. The following summarizes our
findings and provides various recommendations for consideration.
I. INTRODUCTION
The Oak Brook Park District will be adding a Family Recreation Center to Central Park
utilizing Forest Gate Road for access. The location is illustrated in Exhibit 1.
The purpose of this analysis is to: 1) review the traffic, circulation and parking, 2) deter-
mine its impact, if any, upon the adjacent roadway and to 3) determine if any modifications
to either the proposed use or the existing roadway system are required.
II. EXISTING CONDITIONS
Central Park is currently he most active ark within the District. The administrative of-
fices are already within the park in the racquet club and will be relocated to the Family
Recreation Center. The portion of Central Park proposed for the Family Recreation
Center is currently vacant.

The following area roadways service the subject property:
Forest Gate Road
This is a wide three-lane local collector roadway with parking currently servicing only Park
District uses. Its intersection with Jorie Boulevard is signalized.
Jorie Boulevard
Jorie Blvd. is the primary north-south roadway for the employment district between 31st
Street and 22nd Street. It carries two lanes in each direction with a planted barrier median,
widening at signalized intersections to provide a left turn bay. Signalized intersections
include 31st Street, Forest Gate, Kensington, and 22nd Street.
22nd Street
This multi-lane east-west regional route serves the Oak Brook commercial district and has
a direct connection to I-294. (To/from the north).
31st Street
This DuPage County highway will provide primary access to the site via Jorie Blvd. 31st
Street has its western terminus at Highland Avenue and extends through the eastern
suburbs.
III. PROPOSED CONDITIONS
The Family Recreation Center will contain approximately 57,300 square feet and will
include a variety of commum recreational uses such as a gymnasium, programming
spaces, meeting rooms, cardio7fitness area, and Park District offices. The offices will be
relocated from the existing racquet club site. Various operational components are dis-
cussed below.
1. Programs
The traffic generated by a center of this nature, can vary significantly from season to
season and from community to community. The population served by the Oak
Brook Park District appears to be extremely active and will generate a fairly higgh
level of use in relation to its size. In any case, use of the Center is anticipated to be
more active in the colder portions of the year as well as during the school year.

2. Target Market
The Oak Brook Park District targets resident use, providing limited availability of
programs at increased cost for non-residents. This is anticipated to continue with
the Family Recreation Center.
3. Access
The Family Recreation Center will have access to Forest Gate Road and then to
Jorie Blvd. via its existing alignment. No changes in Forest Gate or Jorie are antici-
pated.
4. Parking
Based upon our experience at other centers of this nature, approximately 4 parking
spaces per 1000 gross square feet of building area are required to serve the majority
of peak demands at a facility such as is proposed. At this rate, a total of approxi-
mately 230 spaces would be required, includingg staff and ADA (handicapped) stalls.
The site plan currently proposes 200 spaces. It would be our recommendation that
the additional space to meet this criteria plus additional space to support a future
possible natatorium expansion should be designated and land-banked.
A key consideration in parking volume determination is the impact of any
excess/overflow. In this case, it could be relocated-to other parking lots within
Central Park,as well as along adjacent roadways on an infrequent basis. Due to the
distance from the Family Recreation Center, no impact upon Jorie Blvd. is antici-
pated..In.this situation, the District does have the ability to allow the use to develop
and then to respond with additional parking if needed. Overflow situations will
impact the users rather than adjacent residents,,employers, or through traffic.
W. FAMILY RECREATION/ADMINISTRATIVE CENTER
TRAVEL CHARACTERISTICS
TRIP GENERATION
We have studied a number of other center's of this nature within the metropolitan area
with fairly similar uses. Those facilities, which were of the size proposed for Oak Brook,
were generally supported by a much larger population base. Utilizing that information
under a"most intense"scenario, we anticipate about 190 weekday and 100 Saturday peak
hour trips. Exhibit 2 lists the estimated monthly variations in the peak hour traffic genera-
tions.

The volumes listed in Exhibit 1 were measured at a similar facility serving a resident
Eapproximately four times as large as Oak Brook's. Given the character of Oak
Brook, we can expect a fairly high usage rate from its residents, both residential and corpo-
rate and possibly some non-resident use. Also, given the intent to maintain certain resident
usage fee rates at a very inexpensive level, if any, average use may be high per resident.
Based on the above, the generation rates noted clearly represent the very high end of the
probable range, even including the future natatorium. The generations listed also repre-
sent activities both in the administrative section as well as in the recreational, program-
ming, and competitive aspects of the Family Recreation Center. As the Administrative
offices relocate out of the racquet club, some infill and reuse of this space will occur.
TRIP DISTRIBUTION
The Family Recreation Center is quite central to the service area within the Oak Brook
Park District. However, we believe that access to/from the Family Recreation Center will
primarily be via 31st Street rather than north to 22nd Street (see Exhibit 3). As can be
seen in Exhibit 2, about 70 percent of the Family Recreation Center trips will be oriented
along 31st Street.
VI. TRAFFIC IMPACT
ROADWAY PEAK HOURS
Exhibit 4, illustrates the existing traffic at the intersection of Forest Gate and Jorie Blvd.
for the evening peak hour. This time was selected because is coincides with busy site and
background traffic activity. Since the majority of use of the Family Recreation Center
occurs at off-peak periods, this project and.its traffic load will not significantly impact your
corporate neighbors, such as the McDonald's Corporation, immediately to the east.
Movements during the morning peak hour are quite minor and are often employees on
their trip from home to work stoppin g off at the Family Recreation Center. Evening peak
period tends to flow in the opposite direction of the primary on-street flow in that employ-
ees and their families will be traveling toward the Family Recreation Center, the opposite
direction from the primary Jorie Blvd. movement.
Site traffic was assigned to the Jorie/Forest Gate intersection based on the travel charac-
teristics and combined with background volumes. Exhibits 5 and 6 illustrate the site and
total traffic assignments.
Ca acity analyses conducted at the Jorie/Forest Gate intersection indicate that operations
will remain at the "design" level of service (LOS) C. Exhibits 7 and 8 list the intersection
analyses parameters and results.

DAILY AC'T'IVITY
A facility such as the Family Recreation/Administrative Center will generate a fair volume
of traffic due to the continuous activity level at the center. These are primarily short trips
by residents and tend to be spread out throughout the day rather than being concentrated
in a single peak. The majority of these movements take place outside the on-street rush
hour periods. The majority of the users are adults or transported by adults, reducing busi-
ness day traffic significantly.
In this corridor, the weekend movement is particularly advantageous due to the limited
traffic generated by the corridor office uses.
VII. ON-SITE PLANNING
The parking lot with 200 parking spaces and the drop-off lanes provides efficient on-site
operations.
Potential locations for land-bank parking, may be located either immediately to the north
of the proposed parking lot or, south of the Family Recreation Center in the area of the
future natatorium.
As we understand it, Forest Gate Road is a ppublic street which happens to have the Park
District as its only current tributary user. We would recommend that both Central Park
Drive and the Family Recreation Center roadway operate under stop sign control. Forest
Gate Road could operate as a through movement, entering both driveways.
VIII. RECOMMENDATIONS
Based upon our analysis of the proposed development and existing operations, the follow-
ing recommendations are offered:
1. Parking Facilities
Our typical experience indicates the need for approximately 230 parking spaces,
while the site plan proposes approximately 200 spaces. We recommend that the
additional spaces be designated on-site but that they be land-banked rather than
constructed.

On the basis of the above, land-bank parking for additional parking as required
should be planned and provided for on the site plan.
2. Access
Access to this site will be quite efficient via the existing roadway system of Forest
Gate Road to Jorie Blvd. No modifications to either roadway are anticipated and
both roadways and their intersection will continue to operate efficiently.
3. Roadways
The Village Engineer, Mr. Dale Dursey suggested that we contact the DuPage
County Highway Department regarding a proposed modification to the intersection
of Jorie Blvd. and 31st Street. He suggested that the existing "rumble" median
between the southbound to westbound lane and westbound 31st Street be made a
"barrier" divider, preventing premature merging, which is a current problem. The
need for this modification was detected at the Jorie/Forest Gate intersection. The
southbound right turn lane was congested occasionally, as traffic failed to efficiently
execute the merge onto westbound 31st Street. We have contacted Mr. Mark Avery
of the DuPage County Highway Department and he is reviewing the issue.
PLEASE NOTE THAT THE POSSIBLE NEED FOR THIS IMPROVEMENT IS
NOT ASSOCIATED WITH THE FAMILY RECREATION CENTER.
VIII. CONCLUSIONS
1. The traffic generated by this site will be primarily community residents traveling to a
community facility and will primarily occur during non-peak hours.
2. The operation of this facility will not interfere with the current operations of the
employee/business community along Jorie Blvd. or 31st Street since these move-
ments will be effectively opposite in direction.
3. The vast majority of trips to this site will occur during non-peak hours when both
Jorie Blvd. and 31st Street have a high volume of available capacity.
In summary, the Family Recreation Center/Administrative Center will provide a very
positive community amenity for the residents of the Oak Brook Park District and will do so
without any deleterious traffic impact upon area roadways, area businesses, area residents,
or any other existing users of adjacent facilities. In addition to not impacting any of the
above, the site selection is quite central to the service population and, as a result, will
provide maximum benefit to the potential users.

Chairman Savino questioned the use of Lot 15 and was informed that Lot 15 is a separate lot and
will continue to exist the way it currently is.
Hawk said that in most other cases the requested change could have been accomplished without
the hearing process. However, this particular case involves two lots in two different subdivisions
on two different streets. There will be no physical change in the rear yard because it is in the
lake. The only lot that could be affected would be the Baroni lot, and Mrs. Baroni does not view
it as having a detrimental effect. They will gain 20+ feet of buildable area.
Durfey said that once the lots are combined, 506 Wennes will become a flood plain lot. Member
Mueller moved, seconded by Member Pequet to recommend approval of the Girgis' Assessment
Plat to combine the two lots subject to engineering approval and the conditions set forth in

AMENDMENT
Harlan Spiroff introduced himself as the attorney representing Oak Brook Park District in this
petition and introduced William Greeve, traffic engineer and Mike Hughes. Spiroff said that they
t. . are seeking an amendment to the Site Plan that was granted in 1984 by Ordinance G-342.
Spiroff said that the recreational center is intended to provide gymnasium meeting room space
and additional administrative office space. The Park District programming has increased and so
has the need for additional offices. The need for the recreational center has been determined by
years of surveys of program participants and interest in the programs. Some of these needs
include child care so that parents can participate in various programs. It will be located in
Central Park on a 60-acre site surrounded on the west and south by residential and on the north
and east by office research. The building is proposed to consist of 54,000 square feet,
containing, a gymnasium, various meeting and activity rooms, and administrative offices. There
is a proposed Phase H shown on the plan with a proposed swimming pool. The building will
be built compatibly to existing buildings, will meet all building code requirements, and all the
stormwater requirements of both the Village and County Stormwater Ordinance.
Mr. Greeve identified access and discussed the traffic impacts. By analyzing the intersection
of Jorie and Forest Gate it was determined that the recreation center can be constructed while still
maintaining the existing operation at that key intersection. The intersection at Jorie and 31st is
stacked during rush hour. When 31st Street was reconstructed several years ago the optimization
was to have the right turn move almost like a merge lane. The design is not quite consistent with
that. The County Highway Department has been contacted and they are going to be taking a
look at the area to see if some sort of remedial measure can take place to assist that traffic.
Accessibility will be excellent in and out of the building. The site plan provides for 200 parking
spaces which is believed to be more than adequate, except for an occasional event.

Hawk said that a written report was never received Mueller questioned the need for additional
parking when the future expansion is built. Spiroff said that when it is constructed additional
spaces may be required. Hawk said that should be included into the site plan if the future
expansion of the building is provided for, so should the parking.
Doyle asked if this precludes the development of a separate club type of facility that had been
voted on and rejected. Sommer answered yes, as far as he was aware.
Durfey had no comment regarding the plan. Hawk said that he would like to see the written
evaluation their traffic engineers put together. He asked that they add the future parking onto
the site plan so that it can be covered by the Ordinance. The Ordinance is not equipped to deal
with parking at this type of facility.
Savino said that the Commission's recommendation is for site plan approval only, not special use.
Resident Bruce Trevil of 152 Timber Trail Drive stated that he was not for or against the
proposal, but questioned the comparison of the proposed 50,000 square foot building to a large
department store. Based on this does not believe the amount of parking will be enough. Hawk
said that a large portion of this building is the gymnasium, which is equal to three full basketball
courts.
Mueller asked about tournaments and spectators for those events. Greeve said that it should
comfortably accommodate the event. However, there may be an instance where there will be an
overflow.
No one in the audience spoke in favor of or in opposition to the petition.
Hawk said that they must comply with all zoning ordinance bulk regulations and the stormwater
elements must be reviewed and be approved.
Member Doyle moved, seconded by Member Aktipis to recommend approval of the Special Use
Amendment subject to the conditions set forth in Hawks memo dated October 14, 1994 and are
as follows:
1. The Recreation/Administrative Center shall be developed in
substantial accordance with the submitted site, floor, and elevation
plans.
2. The development will be in accordance with all other applicable
local, state, and federal regulations, i.e., building codes and
stormwater management regulations.

The Oak Brook Park District is moving forward with their plans to construct a Community
Recreation Center on their property in Central Park at 1300 Forest Gate Road.
This property was zoned CR- Conservation/Recreation District by Ordinance G-342 on February
14, 1984. This ordinance also granted the Oak Brook Park District a Special use as a
"governmental service facility." A copy of this ordinance is included in this file (see pages D
to D-5).
The proposed Recreation/Administrative Center will house uses and activities that are normal
functions for a park district. The proposed structure and accessory parking area are consistent
with the Zoning Ordinance bulk requirements of setbacks (100 feet for the building, 40 feet for
parking spaces), structure height (40 feet maximum permitted- 32 feet proposed), and floor area
ratio (.15 maximum permitted - less than .05 proposed).
The petitioner will be commenting on parking and traffic during the hearing process. Parking
needs for these types of land uses are difficult to regulate. The Oak Brook Park District is
providing parking based on their estimates of actual need. An approval ordinance should include
a commitment by the property owner to provide for all parking needs to avoid overflow onto
neighboring properties and/or public rights-of-way.

any proposed amendment in accordance with applica-
ble Illinois Statutes, or may refer it back to the Boards
for further consideration.
(5) Be-Applications: Any person, firm, or corporation
having been denied an amendment to the Zoning
Ordinance respecting a specific parcel of property may
not re-apply for a like amendment on said real
property until the period of one (1) year has elapsed
since the denial of the application for amendment by
the President and Board of Trustees. (Ord. No. G137,

(J) Special Uses.
(1) Purpose. The development and execution of the zoning
ordinance is based upon the division of the Village
into districts, within any one of which the use of land
and buildings and the bulk and location of buildings
or structures, as related to the land, are essentially
uniform. It is recognized, however, that there are
special uses which, because of their unique character,
cannot be properly permitted in particular districts
without consideration, in each case, of the impact of
those uses upon neighboring lands and upon public
need for the particular use or the pa~ticular location.
Such special uses fall into two categories:..
(a) Uses operated by public agency or publicly-regu-
lated utilities, or uses traditionally affected with a
public interest.
(b) Uses entirely private in character, but of such a
nature that the operation may give rise to unique
problems with respect to their impact upon
neighboring property or public facilities such as,
but not limited to, single-family attached and
semi-detached dwellings, horizontal condomini-
ums and other residential developments. (Ord. No.
G-66, 12-19-66)

Sec.XIII OAK BROOK CODE
(2) Authority: Special uses shall be authorized or denied
by the Village Board in accordance with the Statutes
of the State of Illinois applicable to amendments of
this ordinance, and the regulations and conditions set
forth in this ordinance for special uses.
No application for a special use shall be acted upon by
the Village Board until after:
(a) A written report is prepared and forwarded to the
Board of Appeals and the Village Board by the
Plan Commission in a manner prescribed herein
for amendments to this ordinance; and
(b) A public hearing has been held by the Zoning
Board of Appeals, after due notice by publication
as provided by the applicable Statutes of the State
of Illinois for amendments and upon a report of
the Plan Commission to the Board of Trustees, if
such a report is made.
(3) Initiation: An application for a special use may be
made by any person, firm or corporation or by any
office, department, board, bureau or commission
requesting or intended to request a zoning certificate.
(4) Processing. An application for a special use, in such
form and accompanied by such information as shall
be established from time to time by the Plan
Commission, shall be filed with the Village Clerk and
thereafter processed in the manner prescribed thereto-
fore for applications and amendments. Special use
applications may be processed simultaneously with
requests for amendment of this ordinance. (Ord. No.
6-66, 12-19-66)
(5) Decisions: The Village Board, upon report of the
Zoning Board of Appeals and the Plan Commission,
and without further hearing, may authorize or deny
an application for a special use in accordance with the
Statutes of the State of Illinois applicable to amend-
ments, or may refer it back to the Board of Appeals
and the Plan Commission for further consideration.

No special use shall be authorized by the Village
Board unless the special use:
(a) Is of the type described in Section XIII J-1 (a) is
deemed necessary for the public convenience at
that location. (Ord. No. G-66, 12-19-66);
(b) Is so designed, located and proposed to be
operated that the public health, safety and welfare
will be protected; and
(c) Would not cause substantial injury to the value of
other property in the neighborhood in which it is
located.
(6) Conditions: The Plan Commission and Zoning Board
of Appeals may recommend, and the Village Board
may provide, such conditions and restrictions upon
the construction, location and operation of a special
use, including, but not limited to, provisions for
off-street parking and loading as may be deemed
necessary to promote the general objectives of this
ordnance and to minimize the injury to the value of
the property in the neighborhood.
(K) Fees.
Fees for any relief under this ordinance shall be as
otherwise established by separate ordinance. (Ord. No.
G-132, 5-25-71; Ord. No. G-289, § 2, 3-24-81)
(L) Violation, Penalty and Enforcement.
(1) Any person, firm or corporation who violates,
disobeys, omits, neglects, refuses to comply with or
who resists enforcement of any of the provisions of
this ordnance shall, upon conviction, be fined not less
than $25.00 nor more than $500.00 for each offense.
Each day that a violation is permitted to eAst shall
constitute a separate offense.
(2) The Building Inspector is hereby designated and
authorized to enforce this ordnance. However, it shall
also be the duty of all officers, citizens and employees
of the Village, particularly of all members of the police

Any additions to the incorporated area of the Village resulting
from disconnection by the County or otherwise shall be automat-
ically classified as in the R1 Single-family Residence Districts
unless otherwise classified by amendment to the ordinance.
SECTION VI-A.CONSERVATION/RECREATION DISTRICT
The Conservation/Recreation District is designed to encourage
the development of land for open space recreational activities
and/or preserve natural resources. This district is characterized
by open uses of land, for example, golf courses and agricultural
uses.The only structures and improvements permitted are those
which supplement and are incidental to the principal open use.
This district is not intended to encourage commercial or residen-
tial operations.
(1) Permitted uses:
(a) Agricultural,including incidental agricultural structures.
(b) Forest preserves, wildlife reservations, ecological sanc-
tuaries and arboretums.
(c) Parks and playgrounds.
(d) Golf courses,and similar open field recreational activities.
(e) Accessory uses and structures, incidental to and on
the same zoning lot as a principal use.
(2) Special uses:
(a) Botanical gardens.
(b) Zoological gardens.
(c) Educational facilities.
(d) Governmental service facilities, including municipal
civic centers, police and fire stations and similar uses.
(e) Tennis and swimming clubs.
(f) Cultural facilities, including libraries, museums, and
similar cultural institutions.

flagpoles, roadways, and other similar structures in-
tended to be accessory and incidental to the primary
use.of a principal building on the lot shall be permit-
ted without regard to the setbacks established herein.
(8) Off-street loading and off-street parking shall be as set
forth in section XI of this Ordinance.
(9) Any use established in a conservationlrecreation district
shall be operated in compliance with the performance stand-
ards set forth in section X(AW of this ordinance.

The facility, both exterior (the building envelope to be of
face brick to match existing Park District buildings, ie: racquet
club, shelter, gazebo, with "bands" of precast concrete in a color
to blend) and interior will be of a contemporary design using
durable, high quality, proven materials in such a way as to insure
that the external appearance will be compatible and comfortable
with its surroundings and that the interior spaces will be
inviting, user friendly, exciting and above all - functional for
our community's residents.
The Park District is planning on breaking ground for this
exciting community project in the Spring of 1995.
The Park District would also respectfully request from the
Village, the waiving of any fees, ie: Special Use Amendment, etc.
in connection with this project.
The enclosed materials will satisfy, as per your instructions
and direction, in meeting the necessary time-lines for the various

AN ORDINANCE REZONING CERTAIN PARCELS TO CONSERVATION/RECREATION
ZONING DISTRICT AND GRANTING CERTAIN SPECIAL USE PERMITS IN SAID DISTRICT
WHEREAS, on September 14, 1982, the Village of Oak Brook, a municipal
corporation, filed an application with the Village Clerk of the Village of Oak
Brook requesting that seven parcels be rezoned to a newly created zoning
classification called the Conservation/Recreation (CR) District and that special
use permits be granted for the continued operation of a tennis and swimming
facility at 800 Oak Brook Road and for various governmental and cultural
facilities at the Village Commons; and
WHEREAS, the parcels which are the subject of this application for
rezoning are commonly known as: 1) York Park; 2) Sports Core, inclu;ing Village
owned properties in the Westchester Park Subdivision; 3) Park District property
at Central Park; 4) Lot 2 of the Butler GHQ; 5) Fullersburg Forest Preserve;
6) Village Commons; and 7) Butler National Golf Club; and
WHEREAS, on September 28, 1982 the corporate authorities referred the
application to the Plan Commission and the Zoning Board of Appeals for public
hearings; and
WHEREAS, on December 14, 1982 the applicant modified its application by
deleting the Butler National Golf Club parcel from its rezoning request; and
WHEREAS, at its meeting on December 20, 1982, the Plan Commission
recommended to the Village Board that the proposed CR Zoning District be created
subject to a revision in the proposed text precluding the rezoning of any
privately owned property, that all of the. parcels in the modified application be
rezoned with the exception of Lot 2 of the Butler GHQ, and that special use
permits be granted for the continutd'd operation of the Bath and Tennis Club,
Municipal Civic Center, Police Station, Fire Station, Public Works Building and
Library; and
WHEREAS, on April 5, 1983 a majority of the Zoning Board of Appeals
recommended to the Village Board that the CR Zoning District be created, subject
to certain revisions in the proposed text; and
WHEREAS, on July 5, 1983 a majority of the Zoning Board of Appeals
recommended to the Village Board that all of the parcels in the modified
application be rezoned to the proposed CR Zoning District with the exception of
Lot 2 of the Butler GHQ and that special use permits be granted for the continued
operation of the Bath and Tennis Club in the Sports Core and for various
governmental activities as contained in the Village Commons; and
WHEREAS, on November 22, 1983 the applicant modified its application by
deleting the Village Coirmons parcel from its application; and
WHEREAS, the Comprehensive Community Development Plan as set forth in
Chapter 6 of the Comprehensive Plan for the Village of Oak Brook as amended May,
1978 states in part on page 93 as follows:

WHEREAS, on January 23, 1984 the corporate authorities passed Ordinance
No. G-341 entitled "An Ordinance Establishing Conservation/Recreation Zoning
District In The Village Of Oak Brook Zoning Ordinance", which states the purposes
of the CR District is as follows:
The Conservation/Recreation
District is designed to encourage
the development of land for open
space recreational activities
and/or preserve natural resources.
This district is characterized by
open uses of lard, for example,
golf courses and agricultural uses.
The only structures and
improvements permitted are those
which supplement and are
incidental to the principal open
use. This district is not
intended to encourage commercial
or residential operations; and
WHEREAS, the President and Board of Trustees concur with the
recommendations of the Zoning Board of Appeals and Plan Commission except as
modified herein and deem it in the best interest of the Village of Oak Brook that
certain parcels be rezoned to the Conservation/Recreation Zoning District and
that the certain special uses be granted, all as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
