AN ORDINANCE REZONING A CERTAIN PARCEL TO THE
B-3 GENERAL BUSINESS DISTRICT
(SE 22ND STREET & MIDWEST ROAD)
WHEREAS, on January 5, 1995, ORIX TMK Oak Brook Venture, as agent for
the Illinois State Toll Highway Authority, filed an application requesting
that certain property in the area of the southeast corner of 22nd Street and
Midwest Road in the Village of Oak Brook, Illinois, presently zoned ORA-1,
Office Research Assembly District be rezoned to B-3, General Business
District; and
WHEREAS, at its meeting of February 20, 1995, the Plan Commission found
that the factors pertaining to zoning amendments were satisfied and
unanimously recommended to the Village Board that the requested rezoning be
granted, with certain conditions; and
WHEREAS, the Zoning Board of Appeals, at its meeting of April 4, 1995,
unanimously recommended to the Village Board that the requested rezoning be
granted, with certain conditions, and made certain findings of fact in support
thereof as set forth in the Chairman of the Zoning Board's letter to the
President and Board of Trustees dated April 18, 1995, all pursuant to due and
appropriate legal notice; and
WHEREAS, the Village President and Board of Trustees find that the
factors pertaining to zoning amendments are satisfied and deem it in the best
interest of the Village of Oak Brook that the property described herein be
rezoned to B-3, General Business District as conditioned below;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: The property legally described on Exhibit "A", (Subject
Property) attached hereto and incorporated herein by reference, is hereby
rezoned and reclassified from ORA-1 Office Research Assembly to B-3, General
Business District zoning classification pursuant to the Zoning Ordinance of
the Village of Oak Brook, IL, subject to the following conditions:
a. That the Subject Property shall be developed in substantial
conformity with the plans submitted by Chipman Adams, Ltd. ; SDI
Consultants, Ltd. ; and Douglas Hills Associates, Inc. dated
January 12, 1995 (the "Plans"). This approval does not suggest
any approval of variations to the Zoning Ordinance or to any
other applicable requirement of the Village Code.

b. That the Subject Property shall be developed in compliance
with all other applicable local, county, state or federal
requirements such as storm water management, wetlands, and
traffic regulations.
C. That the Subject Property shall be landscaped in
substantial conformity with the Plans; all landscaping
shall be permanently maintained and replaced promptly if
die off occurs.
d. That the evergreen tree plantings along the south
perimeter of the site as shown in the Plans shall be
increased by 50%.
e. That construction and development of the Subject Property
shall commence no later than May 1, 1997 and shall be
completed on or before May 1, 1998.
Section 3: That the Village Clerk is hereby authorized and directed to
modify and amend the Zoning Map of the Village of Oak Brook and all other
pertinent documents and records to reflect the rezoning and reclassification
of the property hereinbefore described, all in accordance with the provisions
of this Ordinance and as otherwise provided by law.
Section 4: All ordinances, rules and regulations of the Village of
Oak Brook which are in conflict with the provisions of this ordinance are
hereby repealed solely to the extent of the conflict, and only as they apply
to the property hereinbefore described.
Section 5: If any section, subsection, sentence, clause, or phrase of
this ordinance is for any reason held to be invalid, such determination shall
not affect the validity of any remaining portion of this ordinance.
Section 6: That in the event that one or more of the conditions set
forth in Section 2 are not met, the Subject Property shall automatically
revert to ORA-1, Office Research Assembly District, without further notice or
hearing.
Section 7: That this ordinance shall be in full force and effect upon
receipt by the Village Clerk of written proof satisfactory to the Village
Attorney that title to the Subject Property has been recorded in the name of
ORIX TMK Oak Brook Venture, an Illinois partnership, or its nominee, provided,
however, that if such proof has not been filed on or before January 9, 1996,
this ordinance shall be of no force or effect.
Section 8: That the Village Clerk is hereby authorized and directed to
publish this ordinance in pamphlet form in the manner provided by law.

Re: Midwest Road Access into The Shops at Oakbrook Place
Dear Ms. Manofsky:
As a result of your call to Village Manager Veitch, I have looked into the matter regarding the
Midwest Road access provided to The Shops at Oakbrook Place and offer the following
response.
The approved plan for this development does not limit the access off of Midwest Road.
However, the development prohibits access out onto Midwest Road. Signage has been installed
in the southwest corner of their parking lot prohibiting this movement.
As to the issue of traffic movements from Midwest Road into the Shops at Oakbrook Place, there
are no posted access or turning movement limitations. Village Engineer Dale Durfey has
contacted the DuPage County Transportation Department who has jurisdiction over Midwest
Road to determine their regulations. The County has indicated that they have not limited access
into the development from Midwest Road. With the existing taper for the left-turn lane onto I-88
beginning at this location, the County does not object to left-turns into the development from
Midwest Road.

Section 1: That the assessment plat consisting of two sheets and
entitled "Oak Brook Retail Center Assessment Plat" prepared by SDI Consultants
Ltd. dated, as last revised, December 8, 1995, and herein incorporated by

22nd Street-Assessment Plat
We have received a request for approval of an Assessment Plat for the ORIXITMK property that was part of a
larger land tract owned by the Illinois State Toll Highway Authority and which contained the Authority`s
Headquarters facility until recently. Due to an oversight, this property has never been individually platted.
Zoning
Earlier this year, the property was rezoned from ORA-1 to B-3 by your action In a B-3 District there are no
minimum lot bulk requirements. The lot dimensions are approximately 460 degrees x 1380 feet and the area is
in excess of 13 acres.
The Zoning Ordinance is satisfied.
Subdivision
There are no public infrastructure requirements. The stormwater management requirements will be accomplished
with the site development The plat document has several minor errors and omissions as determined by Dale
Durfey's review and a corrected document will be approved prior to recordation.
Conclusion
Attached is a copy of a revised plat based on our review of the original submittal.
In order to avoid the likelihood of delay to the site development, there is some urgency in getting the property
platted. We have prepared the necessary resolution(copy attached)to approve the plat This resolution contains
the stipulation requiring approval by the Village Engineer.
If it is your wish to approve the Resolution, it may be done by roll call motion.

Assessment Plat
Dear Mr. Hawk:
The attached assessment plat is being submitted to satisfy the Village of Oak Brook's
subdivision ordinance in lieu of a plat of subdivision at your direction. It is my understanding per
our telephone conversation today, that this plat shall not be used for assessment purposes, but
shall serve only as a recorded instrument that shall delineate the parcel division for public
records.
As you already know, a P.I.N. number for the subject parcel was assigned when the deed was
recorded at the County.
Additionally, because the underlying property was originally tax exempt, county records
supporting the existing P.I.N. number information in the area to be platted is sketchy.
The plat submitted today for your review conforms with the format of existing assessment plats
on record at the county recorders office.

SIGNAGE CONCEPT
Signage for The Shops at Oak Brook Place will consist of two ground mounted monument
signs along 22nd Street and building mounted tenant signage. All signage will comply with
signage requirements of the Village of Oak Brook Zoning Ordinance. A consistent overall
theme will be adhered to so as to result in a package of signage that responds to the
architecture of the building.
One sign will be installed at each of the two site entries along 22nd Street within the
landscape buffer. Tenant sign panels will appear on both sides. All panels and letters will
be internally lit and consistent in color, either bronze or black on a white field. The signs
will be approximately 10' wide, 25' high and 2!4' thick and will use forms sympathetic with
the building. See the (next page) detail sketch for sign appearance.
Building mounted signage will occur for each tenant on both the north and south elevations. �
Tenants with frontage on Midwest Road will be given the option of signage on the west
elevation. Tenants will be given the option of internally lit, white letters or front-lit black
or bronze-letters. No colors will be permitted. Letter size will be based on tenant size but
will not exceed 5'-0" in height with a maximum cumulative size of 2% of that tenant's floor
area. Notwithstanding the foregoing, all signs on the south elevation shall be
uniform, illuminated with silhouette non-channel lighting and shall not exceed
410° in height.
