AN ORDINANCE AMENDING ORDINANCE S-255 (Exlhibit F
RELATIVE TO FLOOR P.R.EA RATIO
(2901, 2905, 2907 Butterfield Road)
WHEREAS, on July 25, 1972, the Village Board of Trustees passed
Ordinance No. S-255 which provided that as to Lot 1 in Oak Brook International
Office Center Subdivision, the maximum floor area for building improvements to
be constructed on the lot be increased to 215,500 gross square feet pursuant
to the petitioner's variation request; and
WHEREAS, on January 16, 1905, applications were filed with the Village
of Oak Brook requesting approval of a Final Plat of Resubdivision,
resubdividing said Lot 1 into new Lots 1, 2 and 3; requesting a text amendment
to Section X(B) (5) of the Zoning Ordinance; and requesting an amendment to
Ordinance S-255, wherein the 215,500 gross square feet would be apportioned
among the new Lots 1, 2 and 3; and
WHEREAS, on January 24, 1995, the corporate authorities referred the
application to the Plan Commission for public hearing on the Plat of
Resubdivision and text amendment and to the Zoning Board of Appeals for public
hearing on the variation request and text amendment; and
WHEREAS, at the conclusion of its public hearing on March 20, the Plan
Commission recommended to the Village Board approval of the Plat of
Resubdivision as more fully detailed in Resolution 95-SD-R- 647 ; and
WHEREAS, the Plan Commission and Zoning Board's favorable
recommendations regarding the proposed text amendment are detailed in an
Ordinance Amending Section X(B) (5) of the Zoning Ordinance of the Village of
Oak Brook, Ordinance 95-ZO-TA-G- 554 , and
WHEREAS, at the conclusion of its public hearing pursuant to notice on
April 4, 1995, the Zoning Board of Appeals recommended to the Village Board
the approval of the applicant' s proposed amendment to Ordinance S-255 wherein
the 215,500 gross square feet would be apportioned among the new Lots 1, 2 and
3; and
WHEREAS, the corporate authorities have considered the recommendation
of the Zoning Board of Appeals and deem the foregoing requested amendment to
Ordinance S-255 to be consistent with the spirit and intent of the Oak Brook
Zoning Ordinance; and
WHEREAS, the variation which the corporate authorities granted pursuant
to S-255 passed on July 25, 1972, providing a maximum floor area for building
improvements to be constructed on Lot 1 to be 215,500 gross square feet is
amended as set forth below.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That Section 1 of Ordinance 5-255 is hereby amended to state
as follows:
Section 1. That the applicable rules and regulations of
"The Zoning Ordinance of the Village of Oak Brook; Illinois,
of 1966", as amended, contained in Section X, paragraph (B) ,
sub-paragraph (3) , are hereby varied to permit an increase
in floor area from 194,256 square feet to 215,500 square
feet which maximum floor area shall be apportioned as
follows among the three new lots into which said Lot 1 in
Oak Brook International Office Center Subdivision has been
approved to be subdivided by Plat of Resubdivision dated, as
last revised, May 4, 1995, approved by the Village Board on
May 9, 1995:
New Lot 1, 2901 Butterfield Rd - 110,540 gross sq.ft. (51.3%)
New Lot 2, 2905 Butterfield Rd - 52,525 gross sq.ft. (24.4%)
New Lot 3, 2907 Butterfield Rd - 52,435 gross sq.ft. (24.3%)
Total 215,500 gross sq.ft. (100.0%)
provided, that, if the applicable maximum Floor Area Ratio
specified in said sub-paragraph (3) shall be increased to
authorize a total floor area of more than 215,500 gross square
feet, the total permitted floor area for the said three lots shall
without further action by the Village Board be apportioned among
the said three lot=_ on the percentage basis set forth above.
Section 3: That all other provisions of Ordinance S-255 not in conflict
with this ordinance shall remain in full force and effect.
Section 4: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.
