AN ORDINANCE GRANTING VARIATIONS FROM THE PROVISIONS OF
THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
RELATIVE TO LOADING BERTHS
(SE Route 83 & 16th Street)
WHEREAS, an application has been filed requesting certain variations for
property located at the southeast corner of Route 83 and 16th Street,
Oak Brook, IL relating to loading berth requirements of the Oak Brook Zoning
Ordinance; and
WHEREAS, said Zoning Board of Appeals, pursuant to due and appropriate
legal notice conducted a public hearing thereon on April 4, 1995 and has
recommended the granting of the variations; and
WHEREAS, the said Zoning Board of Appeals made explicit findings that
the variations requested meet the applicable standards of Section XIII(G)(4)
of the Oak Brook Zoning Ordinance, including a genuine hardship resulting
from: 1) the unique configuration of this triangular shaped parcel; 2) the
existence on the property of the Spring Road branch of Salt Creek and its
floodway and flood plain; and 3) the large setbacks imposed in a B-2 district;
and
WHEREAS, the corporate authorities concur with the recommendations and
findings of the Zoning Board of Appeals;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That the variations granted herein pursuant to this
ordinance are limited to the property located at the SE corner of Route 83 and
16th Street, Oak Brook, IL, which property is legally described as follows:
Lot 7 (except that part of Lot 9 dedicated for highway purposes by
instrument recorded as Document R61-30843) in Oakbrook Terrace, a
subdivision of part of section 23, Township 39 North, Range 11
East of the Third Principal Meridian, in DuPage County, IL.
Permanent Parcel No. 06 -23 -300 -022. -
Section 3: That the following variations are hereby granted from the
provisions of the Oak Brook Zoning Ordinance of the Village of Oak Brook,
Ordinance G-60, as amended.
A. A variation from the requirements of Section XI(D)(7)(b) to permit
one loading berth instead/ of two berths as required; and

enclosed loading berth at the front of a building instead of at
the rear of the building as required.
Section 4: That the variations herein granted are explicitly subject to
the condition that the property is developed in substantial accordance with
the Site Plan submitted by Nelson, Ostrom, Baskin, Berman & Associates dated,
as last revised, February 24, 1995.
Section 5: That this ordinance shall be in full force and effect from
and after 'passage and approval pursuant to law.

WHEREAS, the owner of certain property described herein has petitioned
the corporate authorities of the Village of Oak Brook, DuPage and Cook
Counties, Illinois, for a Flood Plain Special Use Permit under Sections 10-34
and 10-35 of the Code of Ordinances of the Village of Oak Brook, relating to
flood plain and wetland regulations; and
WHEREAS, a public hearing on such petition was conducted by the Zoning
Board of Appeals of the Village on April 4, 1995, pursuant to due and
appropriate legal notice; and
WHEREAS, the Plan Commission of the Village of Oak Brook considered the
petition and has submitted its recommendation to the President and Board of
Trustees; and
WHEREAS, both the Plan Commission and Zoning Board of Appeals have
recommended approval of the petition because it satisfies the requirements of

ISSUANCE OF A $152,249-80 REFUNDING NOTE OF THE VILLAGE OF ISSUANCE OF
OAK BROOK, DU PAGE AND COOK COUNTIES IL: $152,249.80
The proposed ordinance authorizes the issuance of a Sports Core P.EFtIN?DITJG NOTE
Refunding Note in the amount of $152,249.80 with Oak Brook Bank. The
original borrowing of $522,000.00 commenced in 1989 and provided for
the purchase of equipment and the maintenance building at the Sports
Core. The financing has been accomplished by means of a series of 1-
year notes due on May 12 each year, with the remaining principal balance
being refinanced for an additional one year term. The interest rate on the
note is 6.85% and the monthly payment on this obligation is $6,802.00.
These are the same terms as those in effect when the note was originally
issued. The monthly payments have been budgeted for in the Golf
Course Maintenance Program (8304).

Engineer, gave a brief presentation to the Village Board of the project. 16th St. & Rt.�
President Bushy inquired into the maintenance area being cleared of
debris. Mr. Howlett suggested the area will be landscaped and cleaned.
Sears wishes to develop the northwest corner of their property in Oakbrook
Center with a free standing retail furniture store. Because of the
encroachment into the floodway and flood plain, the petitioner is seeking
approval of a Flood Plain Special Use and because of the site constraints
Sears is seeking a reduction in loading berths from two (2) to one (1) and
the loading berth to be located in the front of the building facing Route 83.
The loading berth will be fully enclosed.
Flood Plain Special Use
Both the Plan Commission and the Zoning Board of Appeals have
recommended approval. Staff and the Village's consultant, Rust
Engineering, have indicated that the engineering design is feasible and
should be able to satisfy the technical requirements of a Flood Plain
Special Use. Both bodies included the same set of conditions in their
recommendations.

reduce the number of loading berths from two (2) to one (1) and to allow
the location of a loading berth to not be at the rear of a building.
The members concurred with the petitioner that the shape of the property,

a unique circumstance and a hardship on the property owner.

SUBJECT. Sears, Roebuck& Co. -Sears Homelife Store - Southeast Corner of 16th Street and Route
83- Flood Plain Special Use and Zoning Ordinance Variation
Sears wishes to develop the northwest corner of their property in Oakbrook Center with a free standing retail
furniture store. The property is currently vacant and is bounded by Route 83 on the west, 16th Street on the
north, and the Spring Road branch of Salt Creek and Oakbrook Center on the southeast.

Because of the encroachment into the floodway and flood plain, the petitioner is seeking approval of a Flood
Plain Special Use and because of the site constraints they are seeking a reduction in loading berths from two
to one and the loading berth to be located in the front of the building facing Route 83. The loading berth will
be fully enclosed.
Flood Plain Special Use
Both the Plan Commission and the Zoning Board of Appeals have recommended approval. Staff and our
consultant, Rust Engineering, have indicated that the engineering design is feasible and should be able to
satisfy the technical requirements of a Flood Plain Special Use. Both bodies included the same set of
conditions in their recommendations.
Loadina Berth Variations
The Zoning Board of Appeals recommended approval of the variations to reduce the number of loading berths
from two to one and to allow the location of a loading berth to not be at the rear of a building.

The members concurred with the petitioner that the shape of the property, the creek floodway and flood
plain;and the large B-2 setbacks, constituted a unique circumstance and a hardship on the property owner.
Conclusion:
If it is your wish to proceed with approval of these requests,it would be appropriate to approve a voice motion
authorizing Attorney Martens to draft the necessary ordinance for action at your May 9, 1995 meeting.
This motion should include the following conditional elements:
1. The property is to be developed in substantial accordance with the plans submitted.
2. Final approval by the Village Engineer.
3. Compliance with all other applicable regulations, local, county, IDOT, FEMA, Army Corp of
Engineers, etc.

Dear Madam President and Board of Trustees:
The Zoning Board of Appeals, at their regular meeting of April 4, 1995, held the necessary public hearing
regarding the Sears Homelife Store proposal.
These requests are prompted by site constraints which include a creek floodway, flood plain,and a triangular land
area configuration.
There was no public testimony either for or against the proposals.
Flood Plain Special Use
Staff reported that the preliminary review indicated the feasibility of satisfying the technical requirements for a
floodwayiflood plain encroachment and the petitioner presented their position with response to the Flood Plain
Special Use standards.
By a vote of 5 to 0, a motion was passed recommending approval of the Flood Plain Special Use subject to
certain conditions including final engineering approval.
Loading Berth Variations
The petitioner described the site constraints which they believe constitute unique circumstances and hardship
which justify Zoning Ordinance relief. These include the following:
1. The property has an irregular triangular shape.

2. The existence on the property of the Spring Road branch of Salt Creek and its floodway and
flood plain.
3. The large setbacks imposed in a B-2 district.
4. Due to the fact that the location at 16th and Route 83 and being part of Oakbrook Center, the
site effectively does not have a rear side.
The Zoning Board of Appeals members concurred with the petitioner's petition and by a vote of 5 to 0 passed a
motion recommending approval of the variations requested.

a. the petitioner and staff are to develop improved language for the text
amendment to clarify what the yard setback requirements that will be used in
the event of future redevelopment of lots generated by resubdivision using the
revised Zoning Ordinance text.

PLAIN SPECIAL USE AND ZONING ORDINANCE VARIATIONS
John Howlett, introduced himself as the attorney representing Sears, Roebuck & Co. in this petition
request. He introduced Linda Sanders, Construction Project Manager, Larry Wakley, Sears Homelife
Marketing, Steve Stahlings, Sears Homelife Marketing, and Mark Siegel, Engineer with Nelson, Ostrom,
Baskin, Berman & Associates.
Chairman Davis swore in all persons giving testimony.
Wakley described the operation of the store and that based on a consumer purchase study their target
consumer is the female customer. Sears Homelife is a full-line general furniture retail store and the
merchandise is in the middle to upper-middle price ranges. They project the sales to be between six
and ten million dollars in this location; and the payroll would be between five hundred and eight
hundred thousand dollars. They have a number of other free standing stores across the nation that
have done very well.

Linda Sanders briefly discussed the construction of the store. She passed out a booklet of pictures
to help give the members a visual idea of the structure and design, both inside and out. It is a two-
story steel frame building. They anticipate there will not more than thirty and fifty customers in the
store at any one given time. They anticipate employees to be between eleven and twelve. This will not
be a high impact traffic site. The colors are light and well blend in well with the Oakbrook Center
colors. The area will be heavily landscaped that will fit in with existing landscaping. There will be only
one or two truck deliveries per week, so there will not be heavy truck traffic. The store is a display
store only. Merchandise is not delivered from this store. Everything comes from a central distribution
point. They do have accessory furniture pickup, but nothing is delivered from the truck dock.
Mark Siegel said that with the exception of the variations they are meeting every other requirement of
the Zoning Ordinance, including the 300-foot and 80-foot setback requirements. Those constraints have
reduced the area and the size of the store that is allowable. The contour of the lot has imposed
restraints where the loading dock is concerned. A full-size truck will not fit into what would be the rear
area of the building. The loading dock is totally enclosed. The dock is accessed from the Route 83
side of the building with an overhead door designed to blend in with the structure.
Howlett reviewed that factors required to seek a variation.
1. To meet the setback requirements and to put in a second loading dock would substantially take
away from the merchandise space of the store. This would clearly impact the store. The
second loading berth is not needed.
2. The configuration of the lot creates a hardship and unique circumstance trying to meet the
zoning requirements relative to the lot configuration.
3. It will not alter the essential character of the locality. The property is lower than the roads and
will fit into the patterns of the existing shopping center.

4. The petition basis is not generally applicable to other property within the same zoning
classification.
5. The granting of the variance will not be detrimental to public welfare or injurious to other
properties in the neighborhood, because they are clearly in a regional shopping center and is
surrounded by retail development.
6. The proposed variation will not impair adequate supply of light or air to adjacent properties and
they are meeting all standards relative to space, setbacks, parking, etc.
7. Sears is one of the original owners since the inception of the Oakbrook Center and are seeking
a favorable recommendation.
No one in the audience spoke in favor of or in opposition to the proposal.
Shumate discussed the on-site water retention and the possibility of another bridge. Siegel said that
they have maximized the compensatory storage for the culvert.

Hawk said that testimony was given at the Plan Commission meeting and Dale Durfey testified that of
the engineering that has been reviewed and it appears that the proposal is feasible. What remains is
primarily the working out the details with respect to the technical requirements of the flood plain special
use.
Siegel stated that they have made application to IDOT, FEMA, EPA, and the Army Corp of Engineers.
Davis said that the Plan Commission did recommend approval of the request subject to special
conditions set forth on petition page 11 b.
Member Vescovi moved, seconded by Member Shah to recommend for approval the Flood Plain Special
Use subject to certain conditions as stipulated by the Plan Commission on page 11 b of this file.
ROLL CALL VOTE: Ayes: 5 - Aldini, Dosedlo, Shah, Vescovi, and Davis.
Nays: 0 - None.
Absent: 0 - Hasen. Motion carried.
Davis said that there has been testimony given,establishing the unique circumstances and the unusual
configuration of the building. The requests are reasonable under those circumstances.
Member Aldini moved, seconded by Member Dosedlo to recommend for approval the requested
variations to allow a single loading berth and to allow its placement to be at the front rather than the
rear of the building.
ROLL CALL VOTE: Ayes: 5 - Aldini, Dosedlo, Shah, Vescovi, and Davis.

Dear Mr. Durfey:
Review comments for the proposed Sears Homelife Store floodplain special use request of
February 27, 1995 are provided in this letter. These comments were transmitted to you verbally
on March 20, 1995. In general, the proposed floodplain and floodway construction including the
culvert crossing appears to be feasible, and has the potential to comply with the countywide
stormwater and floodplain ordinance. A detailed review will be performed at the time of final
engineering as only preliminary calculations were provided at this time.
1. Final approval of the proposed culverts and channel modifications will require
modification of the regulatory floodway and floodplain. An IDOT-DWR permit and a
CLOMR from FEMA will be required for redelineation of the regulatory floodway
(Article 10, Section 15-132 of the ordinance).
2. While the development may cause a 0.1 foot increase according to IDOT-DWR
requirements, according to the countywide ordinance, Article 10, Section 155-133, the
proposed culverts and channel modifications may not increase flood elevations, flows, or
floodway velocity. A computer model and all supporting calculations should be
provided.
3. Article 9, Section 15-115 requires special consideration be given to impacts to riparian
areas, including identification and mitigation. Vegetation and riparian benefits lost in the
regulatory riparian area should be replaced.
4. No filling, grading, dredging, or excavating which changes the base flood elevation, base
flood flow rate or the floodway boundary should take place prior to obtaining a CLOMR
from FE
MA. No building construction should take place until a LOMR Is obtained
(Article 10, Section 15-132).
5. The proposed buildings and low water entry elevations should be elevated 3 foot above
the base flood elevation.
Quality through teamwork ��
6. Proposed contours along the channel in the grading plan should be consistent with the
channel cross-sections.
7. Excessive side slopes, such as 1:1 currently shown in cross-section D.6, should be
avoided. A minimum of 3:1 to 4:1 side slopes are recommended.
8. Excessive side slopes, such as 2:1 currently shown for the detention basin proposed at the
northeast corner of the site, should be avoided. A minimum of 3:1 to 4:1 side slopes are
recommended.
9. Other items discussed in our February 10, 1995 meeting with Mark Siegel and discussed
in his February 14 memorandum should be incorporated in the final engineering plans.
10. A Corps of Engineers permit and an IEPA water quality certification will also be required
through the joint permit application process.

Dear Tom,
Per your request we are submitting our responses of Monday nights' Plan Commission meeting
to the "Factors Upon which the Recommendations of the Zoning Board of Appeals and the Plan
Commission Shall Be Based" in writing.
1. The danger to life and property due to increased flood heights or velocities will not be
an issue. Our calculations and computer model show that the high water level upstream
of the proposed culvert will actually drop due to the amount of compensatory storage
being provided.
2. There will be no danger that materials may be swept onto other lands, or cross-stream,
upstream or downstream to the injury of others. As stated in our submittal booklet,
construction practices will be controlled by a specification for the protection of the
waterway. Tire contractoi:will alls;.-,be sub;Cct to the restrictions of the federal regulations
governing the Corps of Engineers' Permit Program, Section 404. We will also be
providing erosion control measures and construction sequencing to be followed by the
contractor as well as continuing maintenance program.
3. The proposed water supply and sanitation systems will be tied directly to the respective
services already located on, or adjacent to, the property in a lawful and proper manner
as prescribed by the plumbing codes. These systems will not impact on the waterway.
4. The ground floor of the proposed structure will be located above the high water level
of the floodplain and the building I will not encroach anywhere into the floodplain or
floodway. Therefore, the facility will not be susceptible to 100 year flood damage.

5. The property is currently zoned B2 and is part of the Oakbrook Center. Most existing
development in the Center is dedicated almost exclusively to community services of a
similar type, namely retail sales. Therefore, we feel the question of the importance of the
retail sales services to be provided by the proposed a,-�;lity is iioi applicable.
6. A waterfront location is not required for the proposed facility. However, the
Spring Road tributary is an integral part of the site which must be crossed in order to gain
access to the property because site topography will not allow access from the street.
7. As stated in item 5 above the property is a part of the Oakbrook Center and, as such,
would be completely compatible with the existing development.
8. The proposed use of the facility is for retail sales which is compatible with the current
B2 zoning of the property. Buildings and other site improvements are being designed or
situated to comply with the floodplain management requirements of the 1991 DuPage
County Stormwater and Flood Plain Ordinance and, additionally, with applicable
additional requirements of other governmental agencies having floodplain jurisdiction,
including: IDOT, Illinois EPA, & Corp of Engineers. Application to these other agencies
has been made.
9. Safe access will always be available as the paved surface of the access road will have
a freeboard of 3 feet above high water elevation, as required by Village Ordinance. In

(within 90 feet) to the building structure from 16th Street to the north, Mall entry drive
to the west, and the mall parking lot to the south.
10. The expected heights, velocity, duration and rate-of-rise of the floodwaters expected
at the site is the subject of a HEC-2 computer hydrology modeling simulation of 5 thru
500 year storm events done under request from IDOT. The HEC-2 study was completed
subsequent to the submission deadline for the 3-20-95 Plan Commission Meeting but is
now available for review. The modeling is used to compare flood dynamics of the
existing site to that of the proposed developed site. The simulation shows that the
previously mentioned parameters will not be negatively impacted by the proposed
development. Floodwater heights after development will be equal to or less than the pre-
development heights owing to the combined effects of additional compensatory storage,

flow streamlining, and detention of storm runoff water. Floodwater heights off-site will
be unaffected by the proposed development. The site development will not contribute
to sediment deposition in the stream as all site runoff water will be directed into a new
on-site stormwater detention basin.

V. SEARS, ROEBUCK & CO. - SOUTHEAST CORNER OF 16TH STREET AND ROUTE 83 -
FLOOD PLAIN SPECIAL USE AND ZONING ORDINANCE VARIATIONS
Mark Siegel introduced himself as an Architect and Project Manager with Nelson, Ostrom, Baskin,
Berman & Associates as agent for Sears, Roebuck & Co. along with Steve Thompson, Chief In-
House Engineer.
Siegel said they are requesting a Special Use permit, because the limitations of the site make it
necessary to access the property over the existing Spring Road Tributary through the existing
Oakbrook Center parking lot. Due to the setbacks in the B-2 District, basically they are limited
where they can put the building. Sears owns the property and have finally decided to develop it.
They have been dealing with staff and also with IDOT and the Corp. of Engineers for permitting to
put in the culvert. They will be providing compensatory storage upstream of the culvert at the ratio
of 1.5 to 1.
Savino questioned how the building itself will blend in with Oakbrook Center. Siegel said the
building itself will follow color wise the prototype design by Sears. Anything they do has to be
agreed upon by both JMB and Marshall Fields. Sears has submitted letters of their approval in the
file.

Hawk said the request is not for any variation or deviation from any of the underlying zoning
ordinance requirements. They are requesting flood plain special use to allow for encroachment into
the flood plain and floodway with the culvert. They are asking for two variations that pertain to
loading berths in the building itself. The petitioner is not asking for any other relief. The rest of
the plan is to be in accordance with all applicable building codes.
Siegel responded to the factors to be considered by the commission with respect to the flood plain
special use request:
1. No damage will be done to life or property. Flood levels will not be raised, they will
be lowered. The hydraulic calcs have been submitted to IDOT.
2. They will take whatever measures necessary to assure no erosion into the creek due
to planting materials, disturbing the soils, etc. There will be a soil erosion control
plan in effect when they start construction.
3. Is not applicable.
4. Detention storage will be in full compliance with DuPage Stormwater Management
Ordinance.
5. The property is already zoned B-2.
6. The water is already there and it is a situation they have to deal with.
7. It is already part of the existing shopping center.
8. Same.
9. Culvert is being designed with a three foot freeboard above high water elevations.,
so they will be able to maintain access to the property.
10. The rates of rise, etc., are part of the HEC-2 study. It does show that the levels are
maintained at or below current levels and they will be improving the sediment
control. It will be much better than it is now. This study is now being reviewed
by the State and IDOT.
11. Same.
Members discussed parking lot capacity, traffic impacts, fire and emergency vehicles, the
construction time-frame that they desire to be opened by the end of the year.
Siegel said being a furniture store and they do not have a lot of traffic that goes into a furniture
store on a given day.
Hawk said there will be better emergency access to this store than many of the other stores in the
Oakbrook Center and the building will be fully sprinklered.
Durfey said that they have done the preliminary review and everything appears to be feasible.
There are some details to be worked out, but they should not be a problem.
Hawk said the petitioner is committed to compliance with the balance of the Ordinance on the rest
of the site. The only issue is the Flood Plain Special Use, and if the submitted plan satisfies the
technical requirements for flood plain management under our current ordinances.

Dear Mr. Hawk:
We are adamantly against anymore construction on 16th street.
We live on the corner of the Oak Brook Club and have noticed the continual
increase in the congestion and noise on both 16th St. and Spring Road from
heavy truck traffic and speeding cars. Adding further construction requiring
special flood plain requirements, along with the congestion that is already at the
SE corner of 16th St. and Rte. 83, is going to increase the density of the activity
and make for an intolerable situation. It also will be setting a precedent for
further building East along 16th Street. In the end we will have a downtown
Chicago, just exactly what we moved out here to leave behind.
I shall be out of town on Monday March 20th during the day, but if I get back in
time for the meeting I will certainly be there. I shall definitely be at the mooning
Board of Appeals meeting April 5th.

SUBJECT Sears Homelife - Southeast Corner of 16th Street and Route 83 -
Flood Plain Special Use - Loading Berth Variations
This proposal is for the property located at the southeast corner of 16th Street and Route 83. It is part of the
Oakbrook Center and is on the lot where Sears is located. Sears, Roebuck and Co. is the property owner.
The area involved is triangular in shape and approximately 4.9 acres in size. It is separated from the
Oakbrook Center by the Spring Road tributary of Salt Creek. The property has approximately 630 foot
frontage on 16th Street. Access will not be permitted from either 16th Street or Route 83 and access to the
property must be provided from the Oakbrook Center parking area proper.
Since a flood plain and floodway for the Spring Road tributary exist on the property and both of these
elements must be disturbed to accomplish this development, a Flood Plain Special Use is required. The
necessary technical information has been provided to the Engineering Department and we hope to have
preliminary comment from our consultant engineer(RUS7)by the March 20, 1995 Plan Commission meeting.
The petitioner is also asking for two variations that pertain to the loading berths that they are required to
provide. The ordinance requires two loading berths fora building of this size and they are to be completely
enclosed and located at the rear of the building.
The petitioner has indicated that the actual use as a furniture showroom with limited warehousing needs will
generate very little delivery and shipping activity. They have proposed to provide a single loading berth, fully
enclosed and accessed from the front of the building. In the event the loading berth needs in the future
warrant a second berth, it has been planned into the floor plan and can be constructed upon demand of the
Village.
Also, the ordinance does require that all B-2 loading berths constructed within 500 feet of a boundary street
are to be completely enclosed and located at the rear of the building. The petitioner believes that the
irregular lot shape and required setbacks in conjunction with the tributary creek location constitute a unique
circumstance and hardship that justify a variation regarding the loading berth location.
The Plan Commissions'interest in this petition is the Flood Plain Special Use.
The Zoning Board of Appeals is the public hearing body for both the Flood Plain Special Use and the loading
berth variations.
The petitioner is limited to the requested Flood Plain Special Use and the loading berth variations. All other
elements of the submitted plans are to be per the ordinance and will be verified prior to the issuance of
building permits.
If recommendations for approval are made, please consider the following in making these motions:

(3) Based upon the technical evaluation of the village
engineer, determine the specific flood hazard at the
site and evaluate the suitability of the proposed use in
relation to the flood hazard.
(c) Factors Upon Which the Recommendations of the
Zoning Board of Appeals and the Plan Commission Shall
Be Based: In making recommendations upon applications
for special use permits, the zoning board of appeals and the
plan commission shall consider all relevant factors specified
in other sections of this article, including but not limited to
the following:
(1) The danger to life and property due to increased flood
heights or velocities caused by encroachments;
(2) The danger that materials may be swept onto other
lands, or cross-stream, upstream or downstream to the
injury of others;
(3) The proposed water supply and sanitation systems
and the ability of these systems to prevent disease,
contamination and unsanitary conditions;
(4) The susceptibility of the proposed facility and its
contents to flood damage and the effect of such
damage on the individual owners;
(5) The importance of the services provided by the
proposed facility to the community.
(6) The requirements of the facility for a waterfront
location;
(7) The compatibility of the proposed use with existing
development and development anticipated in the
foreseeable future;
(8) The relationship of the proposed use to the compre-
hensive plan and floodplain management program for
the area;

(9) The safety of access to the property in times of flood
for ordinary and emergency vehicles:
(10) The expected heights, velocity, duration, rate of rise
and sediment transport of the floodwaters expected at
the site; and
(11) Such other factors which are relevant to the purposes
of this article.
(d) Conditions Attached to Special Use Permits: Upon
consideration of the zoning board of appeals and the plan
commission recommendations, the factors listed above, and
the purpose of this article, the president and board of
trustees may by ordinance grant, deny or attach such
conditions to the granting of special use permits as they
deem necessary to further the purposes of this article.
Among such conditions, without limitation because of
specific enumeration, may be included:
(1) Modification of waste disposal and water-supply
facilities;
(2) Limitations on periods of use and operation;
(3) Imposition on operational controls, deposit of surety
bonds and deed restrictions;
(4) Requirements for construction of channel modifica-
tions, dikes, levees and other protective measures; and
(5) Floodproofing measures designed to be consistent with
the flood protection elevation for the particular area,
flood velocities, durations, rate of rise, hydrostatic and
hydrodynamic forces, and other factors associated
with the 100-year flood. In this event, the president
and board of trustees shall require that the applicant
submit a plan or document certified by a registered
structural engineer that the floodproofing measures
are consistent with the flood protection elevation and
associated flood factors for the particular area and
shall be provided in accordance with the standards for
completely floodproofed structures contained within
the United States Army Corps of Engineers publica-

Concerning this application, I offer the following comments:
1. Anwer Ahmed of RUST Environment and Infrastructure has received a copy of
this application and is in the process of reviewing it for compliance with
the Countywide Stormwater Ordinance. I expect to receive preliminary
comments from him by this Friday or Monday. I should be able, therefore, to
inform the Plan Commission of Anwer's preliminary comments during their
meeting of March 20, 1995.
2. The original submittal which I received on February 27, 1995 was revised by
the applicant and I received revised drawings on March 8, 1995. Mr. Ahmed
also has these revised drawings.
3. This property is currently vacant and lies within the southeast corner of
Illinois Route 83/16th Street and northwesterly of the existing stream. This
stream is noted as the Spring Road Tributary and is a mapped flood plain with
• mapped floodway. Any work within the confines of the flood plain requires
• Village of Oak Brook permit and any work within the floodway also requires
an IDOT permit.
4. The Engineering Department is also reviewing the requested 1.5:1 side slopes
on certain portions of the property. This review is taking place in
accordance with this Flood Plain Special Use application since the proposed
grading may change if the steep slopes are not permitted.

USES; VARIANCES
Sec. 10-31. Occupation and use of floodways.
(a) [Generally:] In floodways only those uses will be
permitted which will not:
(1) Affect the rate of flow or quantity of floodwaters
flowing into, over or off of the subject property;
(2) Affect the available detention area of the floodplain;
or
(3) Result in an increase in the risk of blockages forming
in a floodway during a flood.
(b) Permitted Uses: The following uses, when permitted by
the Oak Brook Zoning Ordinance, Ordinance No. G-60
[Appendix A of this Code], as amended, of the Village of
Oak Brook, are found to have a low flood damage potential
and are specifically permitted if they will not obstruct flood
flows, provided that no structure, fill or storage of materials
or equipment is required:
(1) General agricultural or horticultural;
(2) Private and public recreational;
(3) Residential use as lawns, gardens or play areas.
(c) Special Uses: Uses not listed above which are
permitted or special uses under the Oak Brook Zoning
Ordinance for the subject property may be allowed upon
issuance of a special use permit as set forth below. (Ord. No. '

Sec. 10-33. Occupation and use of wetlands.
(a) [Generally:] In wetlands only those uses will be
permitted which will not affect adversely the quantity or
quality of the public water supply, drainage, storm water
runoff or detention, or the health and safety of the village
and its environs.
(b) Permitted Uses: The uses listed in section 10-31(b) and
any other uses permitted by the applicable provisions of the
Oak Brook Zoning Ordinance which, in the opinion of the
building commissioner, will not adversely affect the public
water supply or the public health and sanitation.
(c) Special Uses: Uses not listed above which are
permitted or special uses under the Oak Brook Zoning
Ordinance for the subject property may be allowed upon
issuance of a special use permit as set forth below. (Ord. No.

Sec. 10-34. Special use permits.
(a) Required. Any use listed in this article as requiring a spe-
cial use permit may be allowed only upon application to and
issuance of a special use permit by the village.
(1) Authority: Special uses shall be authorized or denied by
the village board in accordance with the statutes of the
State of Illinois applicable to amendments of a zoning or-
dinance, and the regulations and conditions set forth in
this division for special uses. No application for a special
use shall be acted upon by the village board until after:
(i) A written report is prepared and forwarded to the
zoning board of appeals and the village board by the
plan commission in the manner prescribed in the zon-
ing ordinance for amendments to said ordinance; and

(ii) A public hearing has been held by the zoning board of
appeals, after due notice by publication as provided by
the applicable statutes of the State of Illinois for amend-
ments to a zoning ordinance and upon a report of the
plan commission to the board of trustees, if such a
report is made.
The concurring vote of four (4) members of the plan com-
mission and/or the zoning board of appeals shall be neces-
sary to recommend in favor of any application which is
brought before the respective hearing body pursuant to
this article.
(2) Initiation: An application for a special use may be
made by any person, firm or corporation or by any
office, department, board, bureau or commission
requesting or intended to request a zoning certificate
for property within a floodplain, as defined in this
article.

(3) Processing: An application for a special use, in such
form and accompanied by such information as shall
be established from time to time by the Village of Oak
Brook, shall be filed with the village clerk and
thereafter processed in the manner prescribed thereto-
fore for applications for amendments.
(4) Decisions: The village board, upon report of the
zoning board of appeals and the plan commission, and
without further hearing, may authorize or deny an
application for a special use in accordance with the
statutes of the State of Illinois applicable to amend-
ments, or may refer it back to the zoning board of
appeals and the plan commission for further consider-
ation. No special use shall be authorized by the village
board unless the special use:
(i) Is so designed, located and proposed to be
operated that the public health, safety and welfare
will be protected; and
(ii) Would not cause substantial injury to the value of
other property in the neighborhood in which it is
located.
(5) Conditions: The plan commission and zoning board of
appeals may recommend, and the village board may
provide, such conditions and restrictions upon the
construction, location and operation of a special use,
as may be deemed necessary to promote the general
objectives of this article and to minimize the danger
of flood damage resulting therefrom. }}
(b) Procedure To Be Followed by the Plan Commission in 1
Making Recommendations Concerning Special Use Permits:
Upon receiving an application for a special use permit, the
plan commission shall, prior to making a recommendation
thereon:
(1) Require the applicants to furnish three (3) copies of
such of the following information, prepared by a
professional engineer or land surveyor, registered as
such in the State of Illinois, as is deemed necessary by

the plan commission for determining the suitability of
the particular site for the proposed use:
(i) Plans drawn to a readable scale showing location,
nature, dimensions and elevation of the lot,
existing or proposed structures, fill, storage of
materials, floodproofing measures, and the rela-
tionship of the above to the location of the
channel, floodway and the flood protection eleva-
--tion.
(ii) Typical valley cross-section(s) drawn to a scale of
one (1) inch to one hundred (100) feet and a
vertical scale of one (1) inch to ten (10) feet
showing the channel of the stream, elevation of
land areas adjoining each side of the channel,
cross-sectional areas to be occupied by the
proposed development, and high water elevation.
Cross-section intervals shall not exceed one
hundred (100) feet.
(iii) Plans (surface view) showing elevations or con-
tours of the ground; pertinent structure, fill or .
storage elevations; size, location and spatial
arrangement of all proposed and existing struc-
tures on the site; location and elevations of
streets, water supply, sanitary facilities; soil
types; and other pertinent information. Contours
shall be shown at one-foot intervals.
(iv) Photographs showing existing land uses and '
vegetation upstream and downstream.
(v) A profile showing the slope of the bottom of the

channel or the flow line of the stream.
(vi) Specifications for filling, grading, dredging, Chan-
nel improvements, storage of materials, water
supply and sanitary facilities.
(2) Transmit one copy of the information described in
subsection (b)(1) to the village engineer for technical
assistance, where necessary, in evaluating the pro-
posed project in relation to flood heights and

velocities; the seriousness of flood damage to the use;
the adequacy of the plans for protection; and other
technical matters.
(3) Based upon the technical evaluation of the village
engineer, determine the specific flood hazard at the
site and evaluate the suitability of the proposed use in
relation to the flood hazard.
(c) Factors Upon Which the Recommendations of the
Zoning Board of Appeals and the Plan Commission Shall
Be Based: In making recommendations upon applications
for special use permits, the zoning board of appeals and the
plan commission shall consider all relevant factors specified
in other sections of this article, including but not limited to
the following:
(1) The danger to life and property due to increased flood
heights or velocities caused by encroachments;
(2) The danger that materials may be swept onto other
lands, or cross-stream, upstream or downstream to the
injury of others;
(3) The proposed water supply and sanitation systems
and the ability of these systems to prevent disease,
contamination and unsanitary conditions;
(4) The susceptibility of the proposed facility and its
contents to flood damage and the effect of such
damage on the individual owners;
(5) The importance of the services provided by the !
proposed facility to the community.
(6) The requirements of the facility for a waterfront j
location; i
(7) The compatibility of the proposed use with existing
development and development anticipated in the
foreseeable future;
(8) The relationship of the proposed use to the compre-
hensive plan and floodplain management program for
the area;

(9) The safety of access to the property in times of flood
for ordinary and emergency vehicles;
(10) The expected heights, velocity, duration, rate of rise
and sediment transport of the floodwaters expected at
the site; and
(11) Such other factors which are relevant to the purposes
of this article.
(d) CondLtions Attached to Special Use Permits: Upon
consideration of the zoning board of appeals and the plan
commission recommendations, the factors listed above, and
the purpose of this article, the president and board of
trustees may by ordinance grant, deny or attach such
conditions to the granting of special use permits as they
deem necessary to further the purposes of this article.
Among such conditions, without limitation because of
specific enumeration, may be included:
(1) Modification of waste disposal and water-supply
facilities;
(2) Limitations on periods of use and operation;
(3) Imposition on operational controls, deposit of surety
bonds and deed restrictions;
(4) Requirements for construction of channel modifica-
tions, dikes, levees and other protective measures; and
(5) Floodproofing measures designed to be consistent with
the flood protection elevation for the particular area,
flood velocities, durations, rate of rise, hydrostatic and
hydrodynamic forces, and other factors associated
with the 100-year flood. In this event, the president
and board of trustees shall require that the applicant I
submit a plan or document certified by a registered
structural engineer that the floodproofing measures
are consistent with the flood protection elevation and
associated flood factors for the particular area and
shall be provided in accordance with the standards for
completely floodproofed structures contained within
the United States Army Corps of Engineers publica-

tion, "Flood-Proofing Regulations," June, 1972, GPO:
1973 0-005-026 edition, or any subsequent edition
thereof. (Ord. No. G-217, § 2, 9-27-77; Ord. No. G-364, § 2,

Sec. 10-35. Variations.
(a) [President and Board of Trustees May Grant:]
Variations to the provisions of this article may be granted
by the president and board of trustees upon recommendation
by the zoning board of appeals.
(b) Authority: The board of trustees shall decide all applica-
tions for variations of the provisions of this division after a public
hearing held before the zoning board of appeals on such notice as
shall be required by the Illinois Statutes for zoning variations.
The zoning board of appeals shall hold public hearing upon all
applications for variations and shall report its recommendations
to the board of trustees as to whether a requested variation
would be in harmony with its general purpose and intent, and
shall recommend a variation only where it shall have made a
finding of fact specifying the reason or reasons for recommending
the variation. Such findings shall be based upon the standards
prescribed in subsection (e)below. No variation shall be granted
by the board of trustees without such findings of fact. The con-
curring vote of four (4) members of the zoning board of appeals
shall be necessary to recommend in favor of the requested varia-
tion. In the case of a variation where the zoning board of appeals
fails to recommend the variation, it can only be adopted by an
ordinance with the favorable vote of two-thirds of the trustees.
(c) Initiation: An application for a variation shall be in
triplicate and may be made by any governmental office,
department, board, bureau or commission, or by any person, j
firm or corporation having a freehold interest, a possessory li
interest entitled to exclusive possession, a contractual
interest which may become a freehold interest, or any !
exclusive possessory interest applicable to the land or land !
and improvements described in the application for a
variation.
(d) Processing: An application for a variation shall be
filed with the village clerk who shall forward one copy of

such application to the zoning board of appeals for
processing in accordance with applicable statutes of the
State of Illinois and one copy to the board of trustees.
(e) Standards: The recommendation of the zoning board
of appeals and the decision of the president and board of
trustees on an application for a variation to the provisions
of this article shall be based on the following standards, the
burden of showing to be borne by the applicant:
(1) A showing of good and sufficient cause;
(2) A determination that failure to grant the variation
would result in exceptional hardship to the applicant;
and
(3) A determination that the variation will not result in
increased flood heights, additional threats to public
safety, extraordinary public expense, create nui-
sances, cause fraud on or victimization of the public,
conflict with other existing ordinances, or conflict with
the intent of this article.
(f) [Conditions and Restrictions:] The zoning board of
appeals may recommend and the board of trustees may t
require such conditions and restrictions upon the premises
benefited by a variation as may be necessary to comply with }
the standards set forth in this section to reduce or minimize
the injurious effect of such variation upon other property in
the neighborhood, and to implement the general purpose
and intent of this article.

(g) [Insurance rates:] The village shall inform applicants i
for variations that should a variation be granted to build a
structure with its lowest floor below the base flood
elevation, it could result in flood insurance premiums as
high as twenty-five dollars ($25.00) per one hundred dollars i
($100.00) of insurance coverage. (Ord. No. G-217, § 2,

give due notice thereof to parties and shall decide
the appeal within reasonable time. The Board may
reverse or affirm, wholly or partly, or may modify
the order, requirement or decision or determina-
tion as in its opinion ought to be made on the
premises and to that end has all the powers of the
official from whom the appeal is taken.
(4) Decisions: All decisions, after hearing of the Zoning
Board of Appeals on appeals from an administrative
order, requirement, decision, or determination of the
Building Inspector or other authorized official of the
Village of Oak Brook, shall, in all instances, be final
_ administrative determinations and shall be subject to
judicial review only in accordance with applicable
Statutes of the State of Illinois.
(G) ariations.
(1) Authority: The Board of Trustees shall decide all
applications for variations of the provisions of this
ordinance after a public hearing held before the
Zoning Board of Appeals on such notice as shall be
required by the Illinois Statutes. The Zoning Board of
Appeals shall hold public hearings upon all applica-

(1) The property in question cannot yield a
reasonable return if permitted to be used only
under the conditions allowed by the regula-
tions governing the district in which it is
located.
(2) The plight of the owner is due to unique
circumstances.
(3) The variation, if granted, will not alter the
essential character of the locality.
(b) For the purpose of supplementing the above
standards, the Zoning Board of Appeals, in
making the determination whether there are
practical difficulties or particular hardships, shall
also take into consideration the extent to which
the following facts, favorable to the applicant,
have been established by the evidence that:

(1) The particular physical surroundings, shape,
or topographical conditions of the specific
property involved would bring a particular
hardship upon the owner as distinguished
from a mere inconvenience if the strict letter
of the regulation were to be carried out.
(2) The condition upon which the petition for
variation is based would not be applicable
generally to the other property within the
same zoning classification.
(3) The granting of the variation will not be
detrimental to the public welfare or injurious
_ to other property or improvements in the
neighborhood in which the property is lo-
cated.
(4) The proposed variation will not impair an
adequate supply of light and air to adjacent
property, or substantially increase the danger
of fire, or otherwise endanger the public safety
or substantially diminish or impair property
values within the neighborhood.
(5) That the purpose of the variation is not based
exclusively upon a desire to make more money
out of the property.
(6) That the alleged difficulty or hardship has
not been created by any person presently
having an interest in the property.
(c) The Zoning Board of Appeals may recommend
and the Board of Trustees may require such
conditions and restrictions upon the premises
benefited by a variation as may be necessary to
comply with the standards set forth in this section
to reduce or minimize the injurious effect of such
variation upon other property in the neighbor-
hood, and to implement the general purpose and
intent of this ordinance.
(5) Unauthorized Variations: The variation procedure
shall in no case be used to accomplish a result which

could otherwise be achieved by a rezoning of the
property involved, such as, but not limited to,
establishment or expansion of a use not permitted in a
residence district; authorizing the construction of
residences in other than residence districts; nor
authorizing other than single-family detached res-
idences in the Rl, R?, R3 and R4 Districts.
(6) Re-applications: Any person, firm, or corporation
having been denied a variation to the Zoning
Ordinance respecting a specific parcel of property may
not re-apply for a like variation on said real property
until the period one (1) year has elapsed since the
denial of the application for variation by the
—President and Board of Trustees. (Ord. No. G137,

(H) Plan Commission.
Jurisdiction.
The Plan Commission of the Village, which has been duly
established with functions as prescribed by the Illinois
Statutes, is the Plan Commission referred to in this
ordinance, and shall have the following duties under this
ordinance:
( (1) Receive from the Village Clerk copies of applications
for proposed amendments and thereafter may submit
its recommendations thereon to the Zoning Board of
Appeals and Board of Trustees.
(2) Receive from the Building Inspector copies of applica-
tions for proposed Special Uses and thereafter submit
its recommendations thereon to the Building Inspector
and Board of Trustees.
(3) Act on all other matters which are referred to it as
required by the provisions of this ordinance.
(4) Review, from time to time, the provisions of this
ordinance and to make reports of its recommendations
with respect to proposed amendments to the Board of
Trustees.

A Variation is a zoning adjustment which permits minor changes of district requirements where individual properties are both harshly
and uniquely burdened by the strict application of the law. The power to vary is restricted and the degree of Variation is limited to
the minimum change necessary to overcome the inequality inherent in the property.
1. A Variation recognizes that the some district requirements do not affect all properties equally. Variations permit minor
changes to allow hardship properties to enjoy equal opportunities with properties similarly zoned. You must prove that your land is
affected by special circumstances or unusual conditions. These must result in uncommon hardship and unequal treatment under the

Sears Roebuck and Company has been involved with the ownership of Oakbrook Center
for about 35 years. They are in current partnership with JMB Properties and Marshall
Field and Company.
The p ro proposed project is located in the northwest corner of the Center which is bounded
p p roj
by Robert Kingery Road (Rt 83) on the west, 16th Street on the north, Spring Road on
the east and Cermak Road (Rt. 22) on the south and is zoned B2, Regional Shopping
District.
Physical Constraints of the Property
Per the Village Zoning Ordinance, the required building setbacks are three hundred feet
�j (300) from the property line paralleling Kingery and eighty feet (80') from the property line
paralleling 16th Street. Due to these parameters, and the existing Hinsdale Sanitary
District easement and Spring Road tributary across the southeast corner of the site, the
proposed building can only be placed in one (1) triangular piece of the property. Also,
due to the existing topography, which slopes severely from both Kingery and 16th Street,
access to the property can only be achieved by crossing the Spring Road tributary off of
the existing parking lot.
With Oakbrook Center on the opposite side of the tributary, the proposed building has,
in effect, two (2) fronts, one facing Kingery and one facing the existing Center. There is
no true "rear" of the building in which to place our off-street loading berth.

The pertinent sections of the Village of Oak Brook Zoning Ordinance for which a variance
is being requested are as follows:
Sections XI(D)(1) and XI(D)(7)(b), pages 939 and 941 - Off-Street Loading
In addition, application is being made for a Floodplain Special Use permit.
Floodplain Special Use Permit
A Floodplain Special Use permit is hereby being requested for the purpose of gaining
access to the property from the existing shopping center parking lot. Application is
concurrently being made to the Illinois Department of Transportation (IDOT), Division of
Water Resources.
Requested Variance
iSections XI(D)(1) and XI(D)(7)(b), pages 939 and 941 - Off-Street Loading
A variance is being requested to reduce the number of required off-street loading berths
to one (1) which will be located on the side of the building.
Per the previous discussion there is no "rear" of the building at which to locate the truck
dock. With no rear available to us the most logical location to place the truck dock is the
side of the building, in this case along 16th Street. Per the zoning ordinance requirement,
the truck dock would be totally enclosed and would not detract from the character of the
Center or adjacent properties, which are also zoned for commercial use. In fact, the
proposed truck dock location would be less noticeable than the open air truck dock at the
Stouffer Hotel which is visible from Spring Road.
Sears HomeLife is not your typical furniture store. While some deliveries will be made
directly from the store, Sears HomeLife is basically a showroom. The prevailing policy
is to ship most items from a central warehouse instead of from the store itself. For this
reason a multitude of stock is not maintained on the premises. One truck dock is more
than sufficient for the anticipated low volume of one (1) or two (2) trucks deliveries per
week.
We realize, however, that there could be some concern over what would happen if Sears
HomeLife were to close down (which is obviously not anticipated) and a different user
type were to move in, one that would require the second off-street loading berth. For this
reason, the plans will be developed to include the capability to construct a second truck
dock in the future, should it be necessary.

Outlet Control'
Culverts flowing with outlet control can flow with the culvert barrel
full or part full for part of the barrel length or for all of it.
Figures 14-19c, 14-19d, 14-19e, and 14-19f show the various types of
outlet control flow. The equation and graphs for solving the equation
give accurate results for the first three conditions. For the fourth
' condition shown in Figure 14-19f, the accuracy decreases as the head
decreases. The head H, Figure 14-19c and 14-19d, or the energy required
to pass a given discharge through the culvert flowing in outlet control
with the barrel flowing full throughout its length consists of three
major parts: 1) velocity head Hv, 2) entrance loss He, and 3) friction
loss Hf, all expressed in feet. From Figure 14-21a:

IDOT has jurisdiction over the floodway, the Village of Oak Brook has jurisdiction over

the floodfringe. The combination of the floodway and the floodfringe constitutes the
floodplain.
The maximum increase of flood water level upstream of any new structure within the
floodway is 0.1' (one tenth of a foot).
3. The floodway is not as wide as the contours would suggest based on high water levels
for a 100 year flood. The actual floodway width allows for a certain percentage of the
adjacent grade to be filled in without raising the high water level more than 0.1'. The
width of the floodway along the tributary is to be scaled from the flood boundary and

SAMPLE SPECIFICATION
FOR
PROTECTION OF WATERWAYS
Construction adjacent to waterways, lakes and reservoirs shall be performed in such
a

manner as to avoid washing, sloughing or placing materials into waters in a way that
causes undue contamination, pollution or siltation. The contractor shall not dispose of
bituminous materials, oil or other petroleum-based materials, or any other waste materials
within the right-of way or contiguous to any lake, stream or waterway.
Any material excavated or otherwise removed from project waterways will not be wasted
or used as embankment in or near the waterway, but shall be incorporated into a self
rcontained area or embankment core where it will not readily be eroded and discharged
into the waterway.
i ' Fording of waterways shall not be permitted unless the contractor's plan for such an
operation meets with the approval of the engineer and provides for minimizing siltation
of the waterway. Unless otherwise approved by the engineer, mechanized equipment
I , shall not be operated in waterways except as may be required to construct channel
changes and temporary or permanent structures.
Concrete work forms shall be constructed and placed securely enough to prevent
seepage of wet concrete under or around them. In no case shall any concrete be poured
or disposed of in the water.
The contractor shall be responsible for the removal of any concrete or debris that enters
the waterway because of his construction operations.
Separate work areas from the waterways by a dike or other barrier to keep sediment from
entering the main waterway. Care shall be taken during the construction and removal of
such barriers to minimize the siltation of the waterway.
The contractor and work under this contract is subject to restrictions of the federal
regulations governing the Corps of Engineers' Permit Program, Section 404.
