AN ORDINANCE ESTABLISHING THE POLICY OF THE VILLAGE OF OAR BROOK
WITH RESPECT TO MAINTENANCE AND IMPROVEMENT
OF EXISTING PUBLIC STREETS AND ROADS IN THE VILLAGE
WHEREAS, on March 23, 1993, the Village President and Board of Trustees of
the Village of Oak Brook (the "Board" ) approved, in concept, an " Infrastructure
Management Plan" which established certain general goals and policies pertaining
to the maintenance of public streets owned by the Village and to the allocation
of resources for such purposes, and
WHEREAS, the Village has since instituted a continuing and comprehensive
program of financial planning in all funds, encompassing both operating and
capital needs, which results each year in a Five-Year Financial Plan, and
WHEREAS, it is necessary and desirable to develop multi-year plans,
schedules and cost projections for roadway maintenance activities as a basis for
the Five-Year Financial Plan and annual Municipal Budget and in order to inform
citizens of the Village' s future plans, in general, and
WHEREAS, the Board has determined that it is necessary and appropriate to
reiterate certain goals and policies expressed in the Infrastructure Management
Plan and to state certain other policies related to maintenance and improvement
of public streets in the Village;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That it is the policy of the Village to maintain, at its cost,
all Village-owned roadways in accordance with a multi-year Roadway Maintenance
Plan, which shall be prepared annually in advance of the Five-Year Financial Plan
and annual Municipal Budget.
Section 3: That the goal of the Village' s roadway maintenance program is
to provide high quality roadways at the lowest possible long-term cost through
selection of cost-effective maintenance strategies with an emphasis on preventive
maintenance procedures.
Section 4: That the Village will not normally fund improvements to
existing roadways which constitute an upgrade in roadway profile. For the
purposes of this section, an upgrade in roadway profile means a change from a
rural section to an urban section or significant widening not justified by
existing or projected traffic volumes or by public safety considerations.
Section 5: That upgrades in construction materials which are not purely
cosmetic in nature, or minor widening of pavement, is not considered to be an

upgrade in roadway profile where the Board finds, after considering a
recommendation from the Village Manager, that such upgrade or widening is in the
best interests of the Village with respect to minimizing long term maintenance
costs or with respect to public safety.
Section 6: That it is the policy of the Village to require participation
by benefiting property owners or owners' associations in the cost of improvements
to existing roadways which do constitute upgrades in roadway profile, and in the
costs of roadway maintenance procedures which are requested by said owners or
associations to be completed earlier than scheduled in the current multi-year
Roadway Maintenance Plan. The amount and means of such financial participation
will be negotiated between the Village and the benefiting owners and associations
in each case, but may include direct cash contributions to project costs, direct
reimbursement to the Village over a period of time or reimbursement by means of
a special service area tax.
Section 7: That the validity of any action otherwise taken by the Board
in accordance with applicable State law shall not be invalidated, impaired or
otherwise affected by noncompliance with any part of the procedures or policy set
forth in this ordinance.
Section 8: That all ordinances or resolutions or parts of ordinances and
resolutions in conflict with this ordinance are hereby repealed.
Section 9: That this ordinance shall be in full force and effect from and
after passage and approval pursuant to law.
