ORDINANCE 95-ZO-V-DU-SWM+FP-S-833
AN ORDINANCE GRANTING A VARIANCE FROM THE
DU PAGE COUNTY COUNTYWIDE STORMWATER AND FLOOD PLAIN ORDINANCE
(3601 ADAMS ROAD)
WHEREAS, as a result of the flooding that occurred in DuPage County
during the mid to late 19801s, DuPage County and all DuPage municipalities
created the DuPage County Countywide Stormwater and Flood Plain Ordinance (the
"Ordinance") ; and
WHEREAS, the Ordinance was adopted by DuPage County in 1991 and
subsequently by the Village of Oak Brook, as a full waiver community; and
WHEREAS, as a full waiver community, the Village has the responsibility
for administration of the Ordinance within its corporate limits; and
WHEREAS, an application has been filed requesting a variance from the
provisions of Article 9 of the DuPage County Countywide Stormwater and Flood
Plain Ordinance, to exempt the applicant's property from the requirements for
stormwater detention; and
WHEREAS, a public hearing on such application has been conducted on
August 1, 1995 by the Zoning Board of Appeals of the Village sitting as the
Village's Oversight Committee to oversee the implementation and enforcement of
the Ordinance, pursuant to due and appropriate legal notice; and
WHEREAS, in its report dated August 3, 1995, the Zoning Board of Appeals
made its findings and recommendation to approve the petition; the applicant's
professional engineer testified that in his opinion, the omission of detention
on this property would not increase flood risk for downstream properties to
any appreciable extent; rather the abundance of trees on the property provides
natural storage through absorption rather than run off; and
WHEREAS, the requested variance allows the preservation of the forested
character of the subject property and strict enforcement of the DuPage
Ordinance will create an undue hardship on the owner and would, according to
the applicant's professional engineer, require the destruction of 1.4 acres of
trees as required by the Ordinance; and
WHEREAS, the subject property is unique, as it is steeply sloped, highly
wooded, and lies near Salt Creek, with a tributary of the creek running
through it. Stormwater runoff into the tributary occurs rapidly, long before
the peak period of flooding. If detention were to be provided, it would
release runoff gradually and actually increase the runoff at the peak flow
period; and
WHEREAS, the corporate authorities of the Village of Oak Brook deem the
passage of this Ordinance to be in the best interest and in furtherance of the
general welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:

Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variance is hereby granted from the provisions of
Article 9 of the DuPage County Countywide Stormwater and Flood Plain Ordinance
to exempt the property at 3601 Adams Road, in the Mitchell Subdivision, which
property is legally described as follows:
The North 347.45 feet, as measured on the East line and on the
West line of the following described tract of land to wit: that
part of the Southeast Quarter of Section 35, Township 39 North,
Range 11 East of the Third Principal Meridian, described by
commencing at the quarter section post in the East line of said
Section 35, and running thence South 1056.0 feet to the Southeast
corner of land formerly owned by D. Tallmadge; thence West 825.0
feet to the Northwest corner of land owned by Greenup H. Butler
for a place of beginning; thence West 495.0 feet to the division
line of said quarter, thence North along said division line 615.78
feet to land formerly owned by R. Reed and now owned by Edward
Opler; thence East along said Reed (now Opler) South line 706.86
feet to the Northwest corner of land formerly owned by W. Burbank;
thence South along said Burbank West line 615.78 feet to the
Butlers North line; thence West 211.86 feet to the place of
beginning; also the North 347.45 feet as measured on the East line
and on the West line of the West 283.14 feet of the East 613.14
feet of the South 615.78 feet of the North 1056.0 feet of the
Northeast Quarter of the Southeast Quarter of Section 35, Township
39 North, Range 11 East of the Third Principal Meridian in DuPage
County, IL. PIN 06-35-401-002.
Section 3: That the variance herein granted in Section 2 of this
Ordinance is expressly subject to the following conditions:
(1) That the property be developed as a two-lot single-family detached
subdivision.
(2) That the wooded character of both newly created lots be protected
by covenants running with the land.
(3) That the impervious area of each lot be not more than 33% or one
acre, whichever is less.
(4) That the owner provide an impact statement from a professional
engineering firm which finds that the subdivision will have no
undue, adverse impact on surrounding property.
Section 4: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.
