AN ORDINANCE RATIFYING AND CONFIRMING
THE GRANT OF A VARIATION FROM THE PROVISIONS OF
SECTION VII(E)(8)(a) OF THE ZONING ORDINANCE
OF THE VILLAGE OF OAK BROOK
RELATIVE TO REQUIRED FRONT YARDS
(51 Windsor Drive, Oak Brook, IL 60521)
WHEREAS, an application has been filed requesting a variation from the
provisions of Section VII(E) (8) (a) to permit construction of an addition,
reducing the setback from 40 feet to 35 feet to allow construction of a 4' 2"
eave projecting into a portion of the front yard; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals of the Village of Oak Brook on October 1, 1996,
pursuant to due and appropriate legal notice; and
WHEREAS, a recommendation has been made by said Zoning Board of Appeals
that the variation requested be granted conditionally; and
WHEREAS, the Village President and Board of Trustees concur with the
recommendations made by the Zoning Board of Appeals;
WHEREAS, on October 22, 1996, the Board did grant by motion the
requested variation as conditioned below;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That this Board does ratify and confirm the grant of a
variation from the provisions of Section VII(E) (8) (a) so as to permit
construction of a building eave that will project approximately 4' 2" into the
required 40' setback. The construction of the proposed eave shall conform to
plans submitted to the Village as part of the hearing process.
Section 3: That this variation is limited and restricted to the
property commonly known as 51 Windsor Drive, Oak Brook, IL 60521, which
property is legally described as:
Lot 120 in York Woods, a subdivision in the Northeast Quarter of
Section 25, Township 39 North, Range 11, East of the Third
Principal Meridian, in DuPage County, IL.

WHEREAS, an application has been filed requesting a variation from the

The Beckers have requested the Village to sell a portion of a vacated Lincoln)
street to allow them access to their home at 3025 Lincoln. The
Village vacated this adjacent alley in 1984, at the request of the then
owner of 3025 Lincoln, by bisecting it from "edge to edge" rather
than along the "center line". As a result, the Beckers must "trespass"
over the Village "half' of the vacated alley to gain entrance to their
property.
State statute requires that the Board declare this parcel as "surplus
property" and obtain a written appraisal before offering the property
for sale. The Village has obtained a MAI appraisal, paid for by the
Beckers, which indicates the subject property has a market value of
$5,500.00. The alleys in the Westchester Park Subdivision were not

home currently on the site. It is presently divided into two lots and
this petition seeks to reconfigure the property into three lots. One of
the lots fronts on Adams and the other two lots are flag lots. The area
is zoned R-1 (2-acre lots).
The property is bisected across the rear half by the Bronswood
tributary of Salt Creek and since the proposal is seeking to place the
stormwater detention in an onstream facility, a flood plain special use
is required. The onstream design for the detention facility is
consistent with several other similar facilities in this watershed, and it
has the advantage of allowing most of the existing trees on the site to
be saved.
The Plan Commission has recommended approval of the
Resubdivision Plat and both the Plan Commission and Zoning Board
of Appeals have recommended approval of the flood plain special use.
Final engineering approval and waiver of the requirements for curb
and gutter, streets, sidewalks, street lights, and parkway trees were
stipulated as conditions of these approvals.
Motion by Trustee Shumate, seconded by Trustee Savino, to direct the
Village Attorney to draft the necessary resolution and ordinance for
action at the Regular meeting of November 12, 1996. VOICE VOTE:
Motion carried.
RECOMMENDATION - AMATO (51 WINDSOR DRIVEL - ArcATO - VARIATION
C.0 VARIATION - FRONT YARD SETBACK: FRONT YARD
SETBACK
The applicant is requesting a reduction in the front yard from forty
(40') feet to thirty-five (35') feet to allow construction of a four-foot
two-inch (4'2") roof eave that will encroach into the front yard. Plans
for the kitchen room addition has been approved by the York Woods
Homeowners Association architectural review committee. The
applicant, when applying for his building permit, found out that the
proposed building eave encroached into the front yard and the eave
was'subsequently eliminated in order to comply with the Zoning
Ordinance.
The permit was issued and construction was started. As the
construction progressed, the York Woods Homeowners Association
questioned the appearance as being significantly different from what
they approved. They have decided that the plan, as modified, is in
violation of their subdivision covenants. As a solution to this
problem, they encouraged the applicant to apply for a variation to
allow this relatively small encroachment and are actively supporting

its approval. At the public hearing, there was no public testimony in
opposition and the neighbors and the York Woods Homeowners
Association testified in support.
The Zoning Board of Appeals, by a vote of 5 to 0, recommended
approval of the requested variation.
Motion by Trustee Shumate, seconded by Trustee McInerney, to
direct the Village Attorney to draft the necessary ordinance for a
variation to reduce the front yard setback from forty (40') feet to
thirty-five (35') feet to be effective October 22, 1996, for action at the
Regular meeting of November 12, 1996. VOICE VOTE: Motion
carried.

Dr. Amato was sworn and described the situation, including the following:
1. The need for additional kitchen space
2. The elimination of the originally planned eave to satisfy the zoning yard requirements.
3. The objections by the York Woods Homeowners Association to the elimination of the
eave.
4. His present position of agreement with the York Woods Homeowners Association that
the eave is important to the overall appearance of the house.
Ralph DeLuca, architect, was sworn and confirmed Dr. Amato's description of the situation. He
described in detail the proposed eave and his judgment of the impact of the yard encroachment as
follows:
1. Due to the curvature of Sheffield Lane and the positioning of the home to the east,
the proposed encroachment will not be discernible.
2. There are no detrimental effects to neighboring properties in the areas of light,
ventilation, or fire separation.
3. There are no detrimental effects to the general public welfare.
4. The proposal has the support of the Yorkshire Woods Homeowners Association.
John Winters, a past president of the Yorkshire Woods Homeowners Association, was sworn and
testified that York Woods has been consistent in their efforts to maintain the aesthetic and economic
values of the subdivision by requiring consistency of architectural style, roof line, eaves, and building
materials. The Homeowners Association encouraged the application for this variation and strongly
supports approval.
There was no public testimony in opposition to the request.
Chairman Davis stated his views on this request including the following:
1. The variation, if granted, will have no detrimental effects. In fact, if not granted, the
neighbors perceive certain detrimental effects will result.
2. The property as is, can satisfy the zoning ordinance, however, the neighboring
property owners see the need for the variation and have encouraged the petitioning
for this relief. The hardship is therefore not of the owners making.
3. The above constitutes acceptable unique circumstances and hardship to warrant the
requested zoning relief.
Member Ascher moved, seconded by Member Dosedlo, to recommend approval of a variation to
reduce the front yard setback from forty feet to thirty-five feet to allow construction of building eaves
in substantial conformance with the plans submitted. The motion is based on concurrence with
Chairman Davis' evaluation of the circumstances and hardship.

eave encroachment will have no detrimental effects for the neighboring properties, will not be
readily discernible by observation due to the curved street configuration, and since the
variation is prompted by the neighbors and not by the applicant, the hardship is not of the

This petition was prompted by the York Woods Homeowners Association and has their support
along with that of the neighbors. There was no testimony in opposition to the request.
The Zoning Board of Appeals by a vote of 5 to 0, passed a motion recommending approval of
the request with the condition that the eave be constructed in substantial conformance with the
plans as submitted.

testified that York Woods has been consistent in their efforts to maintain the aesthetic and economic
values of the subdivision by requiring consistency of architectural style, roof line, eaves, and building
materials. The Homeowners Association encouraged the application for this variation and strongly _
supports approval.
There was no public testimony in opposition to the request.
Chairman Davis stated his views on this request including the following:
1. The variation, if granted, will have no detrimental effects. In fact, if not granted, the
neighbors perceive certain detrimental effects will result.
2. The property as is, can satisfy the zoning ordinance, however, the neighboring
property owners see the need for the variation and have encouraged the petitioning
for this relief. The hardship is therefore not of the owners making.
3. The above constitutes acceptable unique circumstances and hardship to warrant the
requested zoning relief.
Member Ascher moved, seconded by Member Dosedlo, to recommend approval of a variation to
reduce the front yard setback from forty feet to thirty-five feet to allow construction of building eaves
in substantial conformance with the plans submitted. The motion is based on concurrence with
Chairman Davis' evaluation of the circumstances and hardship.

This proposal is for a variation to reduce the front yard setback requirement from forty-feet to
thirty-five-feet to allow an encroachment of a four-foot two-inch building eave on an addition
into the front yard.
The property is in an R-3 zoning district. It is a corner lot with the zoning front yard along
Sheffield Lane and the corner lot side yard along Windsor Drive.
The proposed building eave is to be on a small building addition (approximately ten-foot by
thirty-two feet) at the south end (Sheffield Lane) of the pre-existing structure. The addition is
90% complete at this time. The depth of the proposed encroachment is four-foot two-inches
and the area of the encroachment is approximately eighty square feet in a front yard with an
area of approximately fifty-two hundred square feet.
I do not perceive any significant impacts on neighboring property owners and due to the
Sheffield Lane curved configuration in this area, the encroachment will not be readily apparent.
There are some precedents for approval. Several front yard variations have been granted for
needed additions to existing homes; although the Amato situation is somewhat unique in
the circumstances that have caused the need for a variation (see Dr. Amato's letter of
explanation).
A motion to recommend either approval or denial should include findings with respect to the
standards specified in the Variation section of the Zoning Ordinance. If a recommendation for
approval is your action, it should be limited to an addition constructed in substantial conformity
with the plans submitted.

Community Association, I ask you to grant the zoning variance
requested by Dr. Joseph Amato in his letter to the Board dated
August 20th, 1996 .
Over the years, our Architectural Review Committee has always
insisted that any exterior renovation maintain the existing roof
pitch and eave depth of the original design. We feel the present
kitchen addition to the Amato property lacks architectural
integrity and creates a hardship for our community. We strongly
feel if the exterior is left as is, our property values would not
yield a reasonable return because it has altered the appearance of
our neighborhood. Granting the variance would preserve the
character of York Woods we desire and promote through the
enforcement of our Protective Covenants .

reverse or affirm, wholly or partly, or may modify
_ the order, requirement or decision or determina-
tion as in its opinion ought to be made on the
premises and to that end has all the powers of the
official from whom the appeal is taken.
(4) Decisions: All decisions, after hearing of the Zoning
Board of Appeals on appeals from an administrative
order, requirement, decision, or determination of the
Building Inspector or other authorized official of the
Village of Oak Brook, shall, in all instances, be final
administrative determinations and shall be subject to
judicial review only in accordance with applicable
tatutes of the State of Illinois.
( ariations.
(1) Authority. The Board of Trustees shall decide all
applications for variations of the provisions of this
ordinance after a public hearing held before the
Zoning Board of Appeals on such notice as shall be
required by the Illinois Statutes. The Zoning Board of
Appeals shall hold public hearings upon all applica-
tions for variations and shall report its recommenda-
tions to the Board of Trustees as to whether a
requested variation would be in harmony with its gen-
eral purpose and intent, and shall recommend a varia-
tion only where it shall have made a finding of fact
specifying the reason or reasons for recommending the
variations. Such findings shall be based upon the stand-
ards prescribed in Section XIII G4 of this ordinance.
No variation shall be granted by the Board of Trustees
without such findings of fact. In the case of a
variation where the Zoning Board of Appeals fails to
recommend the variation, it can only be adopted by an
ordinance with the favorable vote of two-thirds of the
Trustees.
(2) Initiation: An application for a variation shall be.in
triplicate and may be made by any governmental

office, department, board, bureau or commission, or by
any person, firm or corporation having a freehold
interest, a possessory interest entitled to exclusive
possession, a contractual interest which may become a
freehold interest, or any exclusive possessory interest
applicable to the land or land and improvements
described in the application for a variation.
(3) Processing: An application for a variation shall be
filed with the Village Clerk who shall forward one
copy of such application to the Zoning Board of
Appeals for processing in accordance with applicable
Statutes of the State of Illinois and one copy to the
Board of Trustees.
(4) Standards:
(a) The Zoning Board of Appeals shall not recom-
mend a variation of the provisions of this
ordinance as authorized in this section unless it
shall have made findings of fact based upon the .
evidence presented to it on the following specific
issues that:
(1) The property in question cannot yield a
reasonable return if permitted to be used only
under the conditions allowed by the regula-
tions governing the district in which it is
located.
(2) The plight of the owner is due to unique
circumstances.
(3) The variation, if granted, will not alter the
essential character of the locality.
(b) For the purpose of supplementing the above
standards, the Zoning Board of Appeals, in
making the determination whether there are
practical difficulties or particular hardships, shall
also take into consideration the extent to which
the following facts, favorable to the applicant,
have been established by the evidence that:

(1) The particular physical surroundings, shape,
or topographical conditions of the specific
property involved would bring a particular
hardship upon the owner as distinguished
from a mere inconvenience if the strict letter
of the regulationwere to be carried out.
(2) The condition upon which the petition for
variation is based would not be applicable
generally to the other property within the
same zoning classification.
(3) The granting of the variation will not be
detrimental to the public welfare or injurious
- to other property or improvements in the
neighborhood in which the property is lo-
cated.
(4) The proposed variation will not impair. an
adequate supply of light and air to adjacent
property, or substantially increase the danger
of fire, or otherwise endanger the public safety
or substantially diminish or impair property
values within the neighborhood.
(5) That the purpose of the variation is not based
exclusively upon a desire to make more money
out of the property.
(6) That the alleged difficulty or hardship has
not been created by any person presently
having an interest in the property.
(c) The Zoning Board of Appeals may recommend
and the Board of Trustees may require such
conditions and restrictions upon the premises
benefited by a variation as may be necessary to
comply with the standards set forth in this section
to reduce or minimize the injurious effect of such
variation upon other property in the neighbor-
hood, and to implement the general purpose and
intent of this ordinance.
(5) Unauthorized Variations: The variation procedure
shall in no case be used to accomplish a result which

/ could otherwise be achieved by a rezoning of the
property involved, such as, but not limited to,
establishment or expansion of a use not permitted in a
residence district; authorizing the construction of
residences in other than residence districts; nor
authorizing other than single-family detached res-
idences in the R1, R2, R3 and R4 Districts.
(6) Re-applications: Any person, firm, or corporation
having been denied a variation to the Zoning
Ordinance respecting a specific parcel of property may
not re-apply for a like variation on said real property
until the period one (1) year has elapsed since the
denial of the application for variation by the
President and Board of Trustees. (Ord. No. G137,
9-14-71)
(I� Plan Commission.
Jurisdiction.
The Plan Commission of the Village, which has been duly
established with functions as prescribed by the Illinois
Statutes, is the Plan Commission referred to in this
ordinance, and shall have the following duties under this
ordinance:
. (1) Receive from the Village Clerk copies of applications
for proposed amendments and thereafter may submit
its recommendations thereon to the Zoning Board of
Appeals and Board of Trustees.
(2) Receive from the Building Inspector copies of applica-
tions for proposed Special Uses and thereafter submit
its recommendations thereon to the Building Inspector
and Board of Trustees.
(3) Act on all other matters which are referred to it as
required by the provisions of this ordinance.
(4) Review, from time to time, the provisions of this
ordinance and to make reports of its recommendations
with respect to proposed amendments to the Board of
Trustees.

Additional to the issues noted on our letter of request, the following items are presented to
supplement the request.
1. The aesthetic design of the residence could have been accomplished if the curvature of
Sheffield Avenue was not as drastic. The planned addition would not be feasible if the
room size was reduced by the amount required to achieve the indicated cave projection.
2. This request is specific to this residence due to the location of the existing residence, the
feasibility of a 10'-0" addition and the curvature of an adjoining road. This variance request
is site specific.
3. This variance, if granted, would not be detrimental to public welfare nor injurious to other
properties or owners. Additionally, the York Woods Homeowner's Association has
evidenced support for this variance request.
4. This variance, if granted, will not impact natural ventilation or light supplies to the adjacent
Properties nor will it endanger public safety. The essence of this request is to allow the
eaves of the residence to project into the building setback-line off the adjacent roadway.
This has no effect on the property directly to the east.
5. The basis for this request is to simply enhance the aesthetic of the residence. There is no
financial benefit or gain associated with the variance. Additionally, there are costs
associated with this improvement which the owner will burden.
6. The hardship is created by the overall layout of the existing residence, which includes the
public areas of the residence being located proximal to the Sheffield.Avenue setback. The
goal of the owner is to enhance the public area;specifically the kitchen, to provide better
accommodations for food preparation. The feasibility of such an addition is continent on
an expansion which supports the function of the proposed space. The 10'-0"room
addition supports the functionality, however, does not address provisions for the
overhanging eaves. Hence, the purpose of this variance request.

The request is based solely on the perceived aesthetic of the residence and its effect on the
surrounding property owners. The owner desires to complete this project so that he may
then become a member, in good standing, of his Homeowner's Association and the Village of
Oak Brook.
