AN ORDINANCE GRANTING A FLOOD PLAIN SPECIAL USE PERMIT
PURSUANT TO SECTION 10-34 OF THE CODE OF ORDINANCES OF
THE VILLAGE OF OAK BROOK, ILLINOIS
(2924 Oak Brook Drive, Oak Brook, IL 60521)
WHEREAS, the owner of certain property described herein has petitioned
the corporate authorities of the Village of Oak Brook, DuPage and Cook
Counties, Illinois, for a Flood Plain Special Use Permit under Section 10-34
of the Code of Ordinances of the Village of Oak Brook, relating to flood plain
and wetland regulations; and
WHEREAS, a public hearing on such petition has been conducted by the
Zoning Board of Appeals of the Village on March 4, 1997, pursuant to due and
appropriate legal notice; and
WHEREAS, the Plan Commission of the Village of Oak Brook has submitted
its recommendation to the President and Board of Trustees; and
WHEREAS, both the Plan Commission and Zoning Board of Appeals have
recommended approval of the petition, because the proposed use satisfies the
requirements of and is consistent with each of the factors set forth in
Section 10-34(c) of the Code of Ordinances of the Village of Oak Brook; and
WHEREAS, the corporate authorities of the Village of Oak Brook deem the
passage of this ordinance to be in the best interest and in furtherance of the
general welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: Pursuant to Section 10-34 of the Code of Ordinances of the
Village of Oak Brook, Illinois, a Flood Plain Special Use Permit is hereby
granted to allow reconfiguration of the flood plain as part of the grading
plan for a new house in substantial conformity with the Site Plan prepared by
Ennis Engineering, Ltd. dated December, 1996 and last revised January 15,
1997, which property is legally described as:
Lot 2 in Twarog's Resubdivision of Lot 2 in Rossman's
Resubdivision of Lot 3 and the North 47.0 feet of Lot 2 in
Dewitt's Assessment Plat of the South 12 acres of the East 462.0
feet of the East half of the Southwest Quarter of Section 28,
Township 39 North, Range 11, East of the Third Principal Meridian
in DuPage County, Illinois. Permanent Parcel No. 06-28-307-013.
Section 3: That the Special Use Permit granted pursuant to Section 2 of
this ordinance is expressly subject to the following conditions:

1. Final engineering approval by the Village Engineer.
2. The petitioner apply for and receive a Letter of Map Revision
(LOMB) from FEMA.
3. The existing flood plain easement be revised in accordance with
the approved plan.
Section 4: That the special use permit herein granted in Section 2 of
this ordinance be further expressly subject to the condition that the
regrading of the subject property be completed on or before March 31, 2001 in
substantial conformity with the aforementioned Site Plan. If the property
owner fails to meet the conditions of this section, this special use permit
shall automatically terminate and be of no further force or effect. The
foregoing completion date may be extended without public hearings by the
President and Board of Trustees upon a showing of necessity by the property
owner.
Section 5: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.

The property is a flag lot southwest of 2914 Oal:Brook Drive. There �2924 Oak Brook

was a house on the site, however, it was demolished after a fire last
year. The property is not contiguous to Gin�er Creek. However,the
Creek's flood plain does extend on to it. The proposed new home for
the property requires the reconfiguration of the flood plain. Based on
the testimony of Village En�ineer Durfey and the reports from the
Village's consultant, RUST, the technical requirements of this
proposal can be accomplished in accordance with all statutory
� requirements. The applicant was in attendance at the meeting.
Both the Plan Commission and Zoning Board of Appeals have
recommended approval of the requested Flood Plain Special Use to
allow reconfiguration of ihe flood plain as part of the gradin� plan for
a new home based on the following conditions:
1. Final Engineering approval by the Villa�e Enoineer;
2. The petitioner apply for a Letter of Map Revision (LOMR) from
the Federal Emergency Management Agency (FEMA); and
3. A sunset provision of four (4) years for implementation of the
grading plan.

Dear President Bushy and Board of Trustees:
At it's March 4, 1997 meeting, the Zoning Board of Appeals, held a public hearing for the
Chmura request for a Flood Plain Special Use approval to allow the reconfiguration of the flood
plain as part of a new home grading plan.
The Board was in receipt of the Plan Commission recommendation for approval. There was no
public t�:stimony either in favor of or in opposition to this proposal.
The Bo�rd by a vote of 6 to 0 passed a motion recommending approval subject to certain
conditions. This action was based on concurrence with the petitioners statements regarding the
impact factors as specified by the ordinance. The conditions recommended were as follows:

Hawk informed the Members that this morning, the DuPage County Stormwater Management

Tom Ennis., President, Ennis Engineering reviewed the site plan and requested flood plain special
use. An existing home on the property had been damaged by fire in 1996 and subsequently
demolished. They are seeking approval to allow reconfiguration of the flood plain as part of the
grading pla� to build a new home on the site. Compensatory storage will be provided at the required
ratio of 1.5 to 1. He addressed the applicable factors (see petition file pages E-E2) as required by

Dave Gooder introduced himself as attorney for the petitioner. He reviewed the revised text for the
requested identification announcement signs (page 13 of the petition file). He explained the reason
for the req�aest and noted that they are trying to reduce the setback from fifty feet to ten feet to
improve th� visibility. Pursuant to the Ordinance the sign will not exceed 16 square feet.
Robert Sat►atino, Superintendent , was sworn in and provided testimony regarding the purpose of
announcerrient sign as a way to inform parents and passer-bys of upcoming events and recognition
of students accomplishments. The drive is one-way, so the position of the sign facing south allows
for maximum readability for those turning into the driveway and for northbound traffic on York Road.
Hawk explained that the original proposal included religious institutions, but the Plan Commission felt
that the ne�d is for schools and was not requested by any religious institution. The revised text limits
the effects of the change to educational institutions. It was noted that the proposed sign location only
has significant effect for the Butler School where the present requirement would place the sign fifty
feet from th� front lot line.

The Members questioned and addressed several concerns regarding the site and Fire
Department access to the property.

than that everything else appears to be in order.
Ennis said that the property is fifty feet from the waters edge, it is well graded, all mowed and
there ar�e no obvious wetland conditions.

Members questioned whether the sign was double-sided, illuminated, and how the letters would
be accessed to prevent any inappropriate messages. The sign will be single sided and the
announc.ement board area will be internally illuminated. They also questioned the need to
include "religious uses" in the requested text amendment.
Member Mueller moved, seconded by Member Allen, to recommend approval of the Zoning
Ordinanc;e Text Amendment as requested by the Petitioner, including the following
considerations:
1. T'he text amendment should be limited to educational uses and not include religious
uses.
2. T'he text amendment wording should be redrafted to eliminate the potential confusion of
the multiple exceptions.

Flood Plain Special Use
This petition is seeking a Flood Plain Special Use approval to allow a reconfiguration of the
flood pl�in as part of the grading plan for the construction of a new home. The property backs
up onto the Ginger Creek ponds and is affected by their flood plain. There was a home on the
site, hovvever it was demolished after a fire a year or so ago.
The pro�osed grading plan and compensatory storage calculations are being reviewed by
Village E=ngineer DurFey and RUST, our engineering consultant. Compensatory storage at a
ratio of 1.5 to 1 is required.
If our er�gineering review of the proposal indicates compliance with the Village's Flood Plain
Regulations and the DuPage County Countywide Stormwater and Flood Plain Ordinance,
approval is warranted.
There are no zoning ordinance issues involved in this petition. Final engineering approval and
your recommendation regarding a sunset provision (four years suggested) should be included if
your action is to recommend approval.

I have reviewed the submitted documents and offer the following comments:
1. 'This application proposes to fill a portion of lot 2 to provide a larger building pad and

2. 'The attached letter from Mike Morgan of RUST lists several issues that were reviewed at
;a meeting yesterday with Tom Ennis, the applicant's engineer. The following comments
�pply:
� ,a) Wetlands and Riparian Areas
i) A wetland specialist will view the site and determine if any wetlands exist.
ii) The ordinance defines riparian areas as within 50 feet of a lake shore.
None of this property lies that close to the Ginger Creek lakes; therefore,
no riparian areas exist on-site. In any event, the current vegetation is
mowed grass which will be maintained with the proposed home.
b) Flood Plain and Floodway Requirements
i) As we looked at the Floodway Map, no floodway exists on this site; it is
closer to the shoreline.
ii) The only structure is a retaining wall that will be resistant to flood
damage.

3. One additional item that Mr. Ennis will supply is a calculation of the proposed
compensatory storage at the same incremental flood frequency elevation as the flood

4. Several minor drafting revisions need to be made to the engineering plan.

�or and receive a LOMR from FEMA and that the existing flood plain easement be

We have received a petition from William J. Chmura, 1627 S. Scoville, Berwyn, IL 60402 for
Flood F'lain Special Use for the property at 2924 Oak Brook Drive. The petition seeks to allow
reconfiguration of the flood plain as part of the grading plan for a new home.
Please refer this proposal to the Plan Commission for review and recommendation at their
meetiny on February 17, 1997, and to the Zoning Board of Appeals for public hearing and

NOTICE TO APPLICANTS
A Variation is a zoning adjustment which permits minor changes of district requirements where individual properties are both harshly
and uniquely burdened by the strict applicadon of the law. The power to vary is restricted and the degree of Variation is limited to
the minimum change necessary to overcome the inequality inherent in the property. '
1. A Variation recognizes that the some district requirements do not affect all properties ec�ually. Variadons permit minor
changes to allow hardship properties to enjoy equal opportunities with properties similarly zoned. You must prove that your land is
affected by special circumstances or unusual conditions. These must result in uncommon hazdship and unequal treatment under the
strict application of the Zoning Ordinance. Where hardship condidons extend to other properties,in general, a variation cannot be
granted. The remedy for general hardship is a change of the map or the text of the Zoning Ordinance.
2. You must prove that the combination of the Zoning Ordinance and the uncommon conditions of your property prevents
you from making reasonable use of your land as permitted by your zoning district. Since zoning regulates land and not people, the
following conditions cannot be considered pertinent to the application for a Variation:
(a)proof that a Variation would increase the financial return from the land,
(b) personal hardship,
(c) self-imposed hardship.
3. No Variation may be granted which would adversely affect surrounding property or the general neighborhood. All
Variations must be in harmony with the intent and purposes of the Zoning Ordinance.

Dear 1�1r. Hawk,
This letter is in response to ren�irements set forth by the Village of Oak Brook Ordinance
regarding special use permits. According to the Village of Oak Brook Ordinance, several factors
are considered by the Village of Oak Brook zoning board of appeals and plan commission in
making; recommendations upon applications for special use permits. These factors were
addressed in the site design of the property at 2924 Oak Brook Dr. The response to each
applicable item is listed below.
1) The ��'anger to life and property due to increased flood heights or velocities caused by
encroachments;
Flooci heights and velocities will decrease with the construction of the proposed residence.
1.5 times the amount of fill placed will be cut from the property in an area that is currently
abov�� the floodplain. This will provide compensatory storage which will decrease flood
heiglits and velocities below their current levels.
2) The danger that materials may be swept onto other lands, or cross-stream, upstream or
do�,vnstream to the injury of others;
There will be no danger of any materials being swept onto other lands, or cross stream,
upstrf,am or downstream to the injury of others. No portion of the residence, driveway,
ga.rage or any other:naterial �,�i?1 rPs:�e belo�v the 100 ye�r base flood el,:vation
3) The proposed water supply and sanitation systems and the abiliry of these systems to prevent
disease, contamination and unsanitary conditions;
The proposed water supply system for the residence will involve the use of an existing
residf�ntial well on the property. Thus, the well will not affect the water supply of
neigh.boring properties. The proposed sanitation system will involve connecting a
sanitary sewer from the residence to the Hinsdale Sanitary District. The sanitary sewer will
elimi�nate the need for a septic system and will eliminate any contamination problems
associated with septic systems.

4) The susceptibility of the proposed facility and its contents to flood damage and the effect of
suclz damage on the individual owners;
The proposed residence and contents will not be subject to damage resulting from a 100 year
flood event since the base of the foundation of all portions of the residence and garage will
reside 3 ft above the 100 year base flood elevation and all fill will extend at least 10 feet
beyond the foundation before the grade slopes below the 100 yr. flood elevation.
5) The importance of the services provided by the proposed facility to the communiry.

6) The requirements of the facility for a waterfront location;
Not applicable
7) The c°ompatibility of the proposed use with existing development and development
anticipated in the foreseeable future;
The Xiroposed single family residence is compatible with existing and anticipated
development in the area. The residence is a replacement of a previous residence on the site
which was destroyed by fire in 1996.
8) The relationship of the proposed use to the comprehensive plan and floodplain management
prog;�am for the area;
The proposed residence is compatible with the comprehensive plan and floodplain
management plan for the area. The proposed layout of the residence, garage and driveway
was ciesigned accor�iing the standards set by the Village of Oak Bro�k Ordinance �nd the
DuPage County Stormwater and Flood Plain Ordinance. As required by the ordinance, the
100 year base flood elevation of 700 ft. and the delineation of the floodplain were taken from
a Federal Emergency Management Agency Flood Insurance Rate Map far the Village of Oak
Brooik. The placement of the residence 3 ft above the base flood elevation to an elevation of
703 ft., and the extension of fill 10 feet from the foundation is in response to the DuPage
County Ordinance. Also, as required by the DuPage County Ordinance, 1.5 times the volume
of placed fill will be cut from the area of the property currently above the floodplain in order
to provide compensatory flood plain starage.

The s,�fety of access to the property in times of flood for ordinary and emergency vehicles will
not be a concern since, as stated previously, all portions of the driveway and garage will be
placed at least 3 ft. above the flood plain, thereby providing no hindrance of access during a
flood.
10) The expected heights, velocity, duration, rate of rise and sediment transport of the
floo,dwaters expected at the site;
The post-development height, velocity, duration, rate of rise and sediment transport of the
floociwaters will actually decrease slightly since compensatory storage will be provided at
1.5 t:imes the fill volume. Sediment transport from the site will be minimal since the fill area
in th��flood plain will be protected with an erosion blanket and vegetation immediately
following fill placement.
