AN ORDINANCE GRANTING A
SPECIAL USE PERMIT FOR A HELIPORT
McDonald's Corporation
2915 Jorie Boulevard, Oak Brook, IL
WHEREAS, McDonald's Corporation has petitioned the Village of Oak Brook
seeking special use approval to construct and operate a heliport facility on
the northeast corner of McDonald's South Campus, commonly known as 2915 Jorie
Boulevard; and
WHEREAS, the Plan Commission of the Village of Oak Brook has submitted
its report on the subject petition to the Zoning Board of Appeals and the
President and Board of Trustees and recommended approval of the Special Use
for the heliport subject to certain conditions; and
WHEREAS, a public hearing on the application has been conducted on May
6, 1997 by the Zoning Board of Appeals of the Village of Oak Brook pursuant to
due and appropriate legal notice; and
WHEREAS, a recommendation was made by the said Zoning Board of Appeals
that the Special Use requested be granted subject to certain conditions; and
WHEREAS, the President and Board of Trustees have reviewed these
recommendations and concur with the recommendation of the Zoning Board of
Appeals and deem the passage of this Ordinance to be in the best interest and
in furtherance of the general welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a Special Use permit is hereby granted for the property
described in Section 4 hereof to permit a heliport pursuant to Section
X(D) (3) (c) of the Zoning Ordinance of the Village of Oak Brook.
Section 3: That the Special Use permit herein granted pursuant to
Section 2 of this Ordinance is expressly subject to compliance with the
following conditions:
A. That operations at the heliport by McDonald's and its
invitees shall be limited to an average of four (4)
operations per week, averaged over the course of a year
(with each "year" for the purpose of this Ordinance to be
measured from the date and year of the first helicopter
operation) , and with the maximum number of operations in any
given year not to exceed two hundred eight (208) , and with
the number of operations in any given calendar month not to
exceed thirty (30) . An "operation" is defined as a landing

and a take-off by McDonald's and its invitees.
B. That approach routes shall conform to those depicted in the
attached Exhibit "A" dated April 14, 1997. Pilots will be
instructed to fly the center line of the paths as much as
reasonably possible and to follow the best procedures for
minimizing sound which are available under the circumstances.
C. That helicopters utilizing this heliport shall fly at the maximum
safe level prior to entering the approach pattern to the heliport.
D. That in addition to use by McDonald's and its invitees, use of the
heliport shall be made available to the Village of Oak Brook or
its designees in the event of emergencies.
E. That the location of the heliport shall be limited to that area as
depicted on the attached Exhibit "B". The heliport will be
constructed in substantial accordance with plans submitted by
McDonald's.
F. That except for the provisions of subparagraph D, only helicopters
owned, leased or chartered by McDonald's Corporation and its
invitees may utilize the heliport, and only so long as McDonald's
Corporation is occupying the property.
G. That McDonald's Corporation shall maintain appropriate and
sufficient insurance coverage relative to the installation and use
of said heliport insuring against any property damage or personal
injury arising therefrom with policy limits of not less than
$20,000,000.
H. That only helicopters with a maximum weight of less than or equal
to 12,000 pounds and a maximum number of occupants not in excess
of those permitted by the F.A.A. may utilize the heliport.
I. That a log of usage shall be submitted to the Village on a monthly
basis during the first twelve (12) months of operation;
thereafter, the log may be submitted annually at the conclusion of
each year.
J. That operation of the heliport shall at all times be in
conformance with the provisions of Section X(B) (2) (a) - of the
Zoning Ordinance of the Village of Oak Brook.
K. That McDonald's Corporation shall place two (2) signs along paths
and drives in the vicinity of the heliport indicating that
helicopter operations may occur from time to time. If experience
indicates the need for additional warning devices, McDonald' s will
supplement these signs with warning lights.

L. That McDonald's Corporation shall advise helicopter pilots which
plan to use the heliport that the heliport is in a wooded location
and encourage them to utilize the flight maneuverability of the
helicopter and to utilize due care to avoid wildlife in the
vicinity.
M. That upon final passage of this Ordinance and construction of the
heliport described herein, McDonald's will be deemed to have
released and terminated its previous heliport approval obtained
from the Village of Oak Brook respecting the heliport at 2111
McDonald's Drive, Oak Brook, Illinois.
If McDonald's Corporation or its agents fail to meet any of the conditions of
this section, then if such condition or conditions are not met within ten (10)
days after said notice, the Village Manager or his/her designee may bring
further enforcement action. Any such notices to McDonald's shall be sent to:

Section 4: This Ordinance is limited and restricted to the property
located at 2915 Jorie Boulevard, Oak Brook, Illinois, as legally described as
follows:
Lot 1 in Butler GHQ Subdivision, being a part of Section 26,
Township 39 North, Range 11, East of the Third Principal Meridian
in the Village of Oak Brook, according to the Plat thereof
recorded as Document No. R80-44966, in DuPage County, Illinois.
Permanent Index Nos. 06-26-401-008, 06-26-401-009 and
06-26-401-010.
Section 5: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.
