Re: Application for Setback Zoning Variation
Rapids-Standard Property - Cermak Road
Dear Madam:
I
We are herewith requesting a zoning variation in respect to the j
front building setback line along the south side of Cermak Road, and
immediately to the west of the Blue Spruce (Andy's Restaurant) property,
and running for a distance of 386 feet. The change of setback being
requested is a variance of front yard required of from 100 feet to 40 feet.
During our negotiations with the Rapids-Standard Company, the
area south of Cermak Road and between the Blue Spruce and Meyers Road
was visualized as an industrial park for small plants with sites ranging
in size from a little under one acre to two acres. At that time we
planned a well and water reservoir with a 100-foot-frontage along Cermak,
a 66-foot street right-of-way and a 200-foot wide site for a small
industry. We have been negotiating with the Rapids-Standard Company for
this latter site.
Since then, our inquiries for such small industrial sites have
stopped, and all of our activity has been with companies requiring
five to ten acre sites. We propose, if possible, to retain our good
relationship with the Rapids-Standard Company, so that they can retain
the site in question, to relocate the proposed well and reservoir, and
to plat an "L"-shaped industrial site just east of the Rapids-Standard
property.
Before the Oak Brook Zoning Ordinance and Subdivision Regulations
were adopted, a verbal agreement was entered into between the Butler
Company and the Rapids-Standard Company for sale of the proposed site,
having a 200-foot frontage on Cermak Road. In the Initial planning
stages of the overall industrial park :,. . and before the new zoning
ordinance was prepared . . . a 40-foot building setback from Cermak Road
was contemplated. The thought at the time was to increase the
right-of-way to 200 feet so that the buildings would be set back at
least 140 feet from the pavement center-line. However, after further
study and following the public hearings on the proposed zoning ordinance,
the front-yard setback line in the M Districts was established at 100 feet.

This more restrictive regulation has created practical difficulties
and particular hardship to the Rapids-Standard Company, and for the
intervening 186 feet of land between the Blue Spruce and the Rapids-
Standard site. In view of the progress already made for the improve-
ment of the Rapids-Standard parcel, and since we feel that there
should be uniformity of setback requirements for the entire 386 feet
at the 40-foot building setback line, we request that a variation in
setback be granted as stated above.
