Attached is a Notice dovering the variations on three
parcels of Eastman Kodak property, namely Parcel C. B and
A.
Parcel C - We would like a variation of between 0' and
10' , not more than 10' .
Parcel B - we would like a variation of 20' to 40' on
the set-back, 20" if possible.
You will note on these two parcels a line in red pencil
which is the extension of the Tollway and Route 83
inter-change with 22nd St. This extension virtually
wipes out all existing set-backs and for your confidential
thought we would like the set-back as close to the road as
possible so that when we are approached by the State on the
acquisition of this property, we will be in a better bar-
gaining position with more valuable land, should this be
granted.
Parcel A - we would like a set-back of nox:e.more than
40' as on the Parcel immediately west of A we were granted
a variation of not less than 601 .

WHEREAS, a public hearing was held on this application by this
Zoning Board of Appeals at a meeting held on June 6, 1961, pursuant to
due public notice by publication in Suburban Life , a newspaper with a
general circulation within the Village, 7and also served upon the owners
of the properties located adjacent to the above described premises; and
WHEREAS, the Zoning Board of Appeals is authorized by statute
and ordinance to determine and approve variations of the provisions of
the zoning ordinance in harmony with its general purposes and intent when
based on findings of fact where there are practical difficulties or particular
hardship in the way of carrying out the strict letter of the zoning ordinance
relating to the depth of the front yards; and
WHEREAS, the Zoning Board of Appeals, having fully heard the
testimony and arguments before it and being fully advised in the premises,
finds that the premises are located in an M Limited Manufacturing District,
that the zoning ordinance as applied to these premises requires a front
yard of not less than 100 feet in depth, side yards of not less than 30 feet
in width, and a rear yard of not less than 40 feet in depth; that these prem-
ises are 496. 74 feet in depth along the West line thereof and 506. 07 feet
in depth along the East line thereof; that the premises are presently vacant;
that the yard requirements reduce the usable space of these premises to
such an extent that the premises are unsuitable for almost all appropriate
uses permitted in an M Limited Manufacturing District; that due to the
unique topography of the premises the cost of erecting a suitable building
on the premises under the zoning ordinance yard requirements would
impose an undue hardship; that the yard restrictions make it impractical
to construct a building or other structure on these premises; that the
unique circumstances created by the depth of these premises and the yard
restrictions produce a particular hardship upon the owner and not a mere
inconvenience; that the premises cannot yield a reasonable return to the
owner under the present restrictions; that the purpose of the variation is
not simply to make money but to put the premises to a suitable use rather
than have the premises continue to be vacant; that the failure to grant the
variation would amount to practically a confiscation of the property; that

structure which will be beneficial to the public welfare and will increase
property values within the neighborhood and will not impair an adequate
supply of light and air to adjacent property, or substantially increase

NOW THEREFORE BE IT RESOLVED, that the Zoning Board
of Appeals by virtue of the authority conferred upon it does hereby
CONCLUDE that the variation requested is in harmony with the general
purpose and intent of the zoning ordinance and that there are practical
difficulties as well as particular hardship in carrying out the strict
letter of the zoning ordinance and does hereby GRANT the variation as
applied for, permitting a front yard of not less than 40 feet in depth
with a provision that no loading docks may be located in the front of the

feet in depth, side yards of not less than 30 feet in width, and a rear yard-
of not less than 40 feet in depth; that these premises have a front lot line
of 250 feet abutting 22nd Street, are 506 feet deep and have a rear lot
line of only 113 feet; that the rear 174 feet of the parcel is only 113 feet
wide; that the premises are presently vacant; that the shape of the lot
and the yard requirements reduce the buildable area of the premises to
approximately 112 acre so that the premises are unsuitable for almost
all uses appropriate for an M Limited Manufacturing District; that due
to the unique topography of the premises the cost of erecting a suitable
building on the premises under the zoning ordinance yard requirements
would impose an undue hardship; that the yard restrictions make it
