S-896 - 04/14/1998 - SPECIAL USE - Ordinances 98-ZO-SU-S-896 AN ORDINANCE GRANTING A SPECIAL USE FOR OUTDOOR DINING AREAS ADJACENT TO RESTAURANTS (Clubhouse International-Oakbrook L.L.C., 298 Oakbrook Center) WHEREAS, an application has heretofore been filed by the tenant of a part of a building in the Oakbrook Center, which is located at 298 Oakbrook Center, for approval of the issuance of a Special Use Permit to authorize an outdoor dining area adjacent to a restaurant on said property which is located in the B-2 Regional Shopping Center District, and the beneficial owner of said property has approved said application; and WHEREAS, Section VIII(D)(2)(f) of the Oak Brook Zoning Ordinance permits outdoor dining areas adjacent to restaurants as a special use in the B-2 Regional Shopping Center District; and WHEREAS, a public hearing on such application has been conducted by the Plan Commission of the Village of Oak Brook on February 16, 1998, and said Commission has submitted its report on the subject application to the Zoning Board of Appeals and the President and Board of Trustees and has recommended approval of the issuance of such special use permit, subject to certain conditions; and WHEREAS, a public hearing on such application has been conducted by the Zoning Board of Appeals of the Village of Oak Brook on March 3, 1998, pursuant to due and appropriate legal notice, and said Board has submitted its report on the subject application to President and Board of Trustees and has recommended the approval of the issuance of such Special Use Permit, subject to certain conditions; and WHEREAS, the President and Board of Trustees have reviewed these recommendations and concur with the recommendations and deem the passage of this ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a Special Use Permit pursuant to the provisions of Section VIII(D)(2)(f) be and is hereby granted for the use of an outdoor dining area adjacent to a restaurant at 2980akbrook Center, which Center is legally described as follows: Lots 1, 2, 3, 4, 5, 6, 7 and 9 in Oakbrook Terrace, a subdivision of part of Section 23, Township 39 North, Range 11 East of the Third Principal Meridian, excepting from said Lots 3 and 9 those parts thereof dedicated for highway purposes by instruments recorded on September 8, 1961 as Document R61-21444 and on November 20, 1961 as Document R61-30843; and excepting from said Lots 5 and 7 those parts thereof dedicated for highway purposes by said instrument recorded as Document R61-30843, and excepting from said Lot 9 that part thereof included within the First Federal Resubdivision, a resubdivision recorded May 3, 1978 as Document R78-38235, in DuPage County, Illinois, containing 5,695,107 square feet (130.7417 acres), more or less. The dining area will be in substantial accordance to the floor plan as submitted as part of the Special Use petition documents and not included herein. 2. The perimeter planter/barrier will be constructed in accordance with the plans submitted as part of the Special Use petition documents and not included herein. 3. The dining area will be operated in accordance with the rules of operations submitted as follows: a. The dining area may be set up between April 1 and April 15, and shall be removed on or before October 15 of each year. b. No more than 40 seats may be provided. C. The barrier system will be of custom made copper and iron planter boxes that will be similar in design to the interior metal work and railings. They will meet or exceed the barricade standards approved by Village ordinance. d. The emergency egress gate shall open out only and be three (3) feet wide. e. No signage or banners will be placed in the outdoor dining area. f. In October, all equipment, including the railing, will be removed and the sidewalk area will be restored to its original condition including patching or plugging any holes. g. The restaurant will be responsible for maintaining and cleaning the outdoor area and shall comply with all applicable requirements of the DuPage County Health Department.. h. A minimum six foot wide sidewalk adjacent to the outdoor dining area will be maintained at all times. i. There will be no live music, dancing or other entertainment in the area. j. Access to the outdoor dining area shall be through the restaurant only. k. A waiter station, similar in design to the barrier planter boxes, will be installed with self contained water and electricity to facilitate service to the outdoor tables. This station will be covered and locked during non-use. I. The up lights in the sidewalk will be deactivated for the season and covered with metal plates in place of the glass lenses. No additional lighting, except for table candles, will be provided. M. The planters will be watertight with internal drainage to allow for live greenery and seasonal flowers. Trustee Savino noted in the March 24, 1998 minutes under Agenda Item 9.A., "Recommendation - Clubhouse International (298 Oakbrook Center) - Special Use - Outdoor Dining", that the second paragraph indicates the ballast is not included in the planting barriers. It was clarified by Village Manager Veitch that this is an error in the minutes. Motion carried. 2) ORDINANCE 98-PP-S-897 AN ORDINANCE AUTHORIZING ORD. 98-PP-S-897 THE SALE BY PUBLIC AUCTION OF PERSONAL SALE BY PUBLIC PROPERTY OWNED BY THE VILLAGE OF OAK BROOK: AUCTION OF PERSONAL PROPERTY The ordinance declares eleven vehicles as surplus and authorizes their sale at the DuPage Mayors and Managers Conference surplus vehicle and equipment auction. Included are seven squad cars, one administrative car; and three dump trucks. If replacements for some of these vehicles have not been received by the date of the auction, those surplus vehicles will be pulled from the June auction and sold at the Conference's second 1998 auction on August 29`h. The Conference charges a 15% administrative fee, which will be subtracted from the gross receipts. The auction is scheduled for Saturday, June 20, 1998 at the College of DuPage, with bidding beginning at 10:00 a.m. As in past years, the Village is required to supply one staff person (usually a Police Officer) to assist the Conference with the auction. AWARD OF CONTRACTS: 1) 1998 PAVEMENT F.JUVE.NATIO PROD T: 1998 PAVEMENT REJUVENATION The Village Board, at its Regular meeting=of January 27, 1998, PROJECT waived bidding due to sole source, and authorized staff to negotiate a contract with Boecker Road Maintenance to perform the 1998 Pavement Rejuvenation Project. RECOMMENDATION - CLUBHOUSE INTERNATIONAL (298 CLUBHOUSE OAKBROOK CENTER) - SPECIAL USE - OUTDOOR DINING: INTERNATIONAL - SPECIAL USE - Keith Olsen, architect for Clubhouse International, spoke to the OUTDOOR DINING construction of planters for the proposed outdoor dining area of the (298 Oakbrook restaurant. He stated the planters would be metal structures anchored Center) in concrete. President Bushy emphasized the serious stand the Village takes with regard to the consumption of alcohol at such establishments. This request is much like the requests previously approved for several other restaurants in Oakbrook Center. The conditions the petitioner has agreed to operate within are the same. The perimeter planting/barrier is different in design in that it is constructed of welded steel tubing,and it does include the same ballast to increase its mass. In the designer's opinion, this design is structurally equivalent with the previously approved design. The Plan Commission by a vote of 5 to 0, at their February 16, 1998 meeting, and the Zoning Board of Appeals by a vote of 6 to 0, at their March 3, 1998 meeting, have recommended approval of Clubhouse International's request for Special Use approval for an"outdoor dining area adjacent to a restaurant"subject to the following conditions: 1. POLICY ORDINANCE - M IDENTIAL SPECIAL SERVICE RESIDENTIAL ARE SPECIAL SERVI, AREA Based on the Committee-of-the-Whole discussion on February 23, Village Manager Veitch has revised the proposed policy ordinance on residential Special Service Areas (SSA's). The changes are as follows: As suggested by the Board, the minimum showing of interest for a resident-initiated application has been increased from 40 percent to 60 percent of the proposed area(Section 3). A new section(Section 4) has been added to require the staff to prepare a report, including appropriate estimates of costs, to assist the Board in its consideration of an application (and provide information for affected property owners should the application proceed to the ordinance stage). Although it has determined that advance definition of the geographic limits of SSA's in the Village would be inconsistent with the statute (and probably not very practical), language has been added to Section 5 to make it clear that the legal description of an SSA will be determined solely by the Board, whether or not it happens to be the same as the area proposed initially. A new section (Section 6) has been added to indicate that the Board may set a limit on the costs that the Village will incur prior to the end of the objection period, the point at which an SSA becomes a legal reality. Motion by Trustee Caleel, seconded by Trustee Bartecki, to place the Policy Ordinance- Residential Special Service Area revisions on the April 28, 1998 Village Board agenda for discussion and direct the Village Manager to forward a copy of the proposed policy ordinance to the Homeowners' Association Presidents for their comments. If it is your wish to move toward approval of this request, it would be appropriate to pass by voice vote a motion authorizing Attorney Martens to draft the necessary ordinance including the conditions as appropriate (see conditions restated below). The ordinance will be brought to you for final action at your meeting on April 14, 1998. 1. The dining area will be in substantial accordance to the floor plan as submitted. 2. The perimeter planter/barrier will be constructed in accordance with the plans submitted. 3. The dining area will be operated in accordance with the rules of operations submitted, as follows: a. The dining area may be set up between April 1 and April 15, and may be ^r -x removed between October 1 and October 15 of each year. b. No more than 40 seats may be provided. c. The barrier system will be of custom made copper and iron planter boxes (see sketches on pages 13-13d of the petition file) that will be similar in design to the interior metal work and railings. The emergency egress gate shall open out only and be 3 feet wide. e. No signage or banners will be placed in the outdoor dining area. f. In October, all equipment, including the railing, will be removed and the sidewalk area will be restored to its original condition including patching or plugging any holes. g. The restaurant will be responsible for maintaining and cleaning the outdoor area and shall comply with all applicable requirements of the DuPage County Health Department. h. A minimum six foot wide sidewalk adjacent to the outdoor dining area will be maintained at all times. L There will be no live music, dancing or other entertainment in the area. j. Access to the outdoor dining area shall be through the restaurant only. k. A waiter station, similar in design to the barrier planter boxes, will be installed with self contained water and electricity to facilitate service to the outdoor tables. This station will be covered and locked during non-use. I. The up lights in the sidewalk will be deactivated for the season and covered with metal plates in place of the glass lenses. No additional lighting, except for table candles, will be provided. m. The planters will be water tight with internal drainage to allow for live greenery and seasonal flowers. Background This request is much like the requests you have approved for several other restaurants in Oakbrook Center. The conditions the petitioner has agreed to operate within are the same. The perimeter planting/barrier is different in design in that it is constructed of welded steel tubing, but it does not include the same ballast to increase its mass. In the designers opinion, this design is structurally equivalent with the previously approved design. I concur. The petitioner has agreed to the rules of operation that are the same as the "outdoor dining areas" previously approved. In addition, design drawings were submitted for the dining area perimeter barrier that will be constructed of steel tubing and with sand filled sections beneath the planter boxes. The petitioner indicated it was their intention to provide a barrier that is equivalent to the sand filled wood barrier previously approved. The Oakbrook Center management has approved the entire submittal There was no public testimony in opposition to or in support of this request. The Zoning Board of Appeals, by a vote of 6 to 0, passed a motion recommending approval of the Clubhouse International's request for"outdoor dining area adjacent to a restaurant" Special Use subject to the following conditions: 1. The dining area will be in substantial accordance to the floor plan as submitted. 2. The dining area will be operated in accordance with the rules of operation as submitted. 3. The perimeter planter/barrier will be constructed in accordance with the plans submitted. The motion was based on the members' consensus that this request satisfies the variation standards of the Zoning Ordinance. He described the details of the outdoor seating plan that have been approved by Chuck Fleming of Oakbrook Center. He also reviewed the planter and rail design along with the anchoring details shown on pages 13 through 13-d of the petition file. Hawk had requested the details be submitted for review at this meeting. Chairman Davis asked what changes were made to the barriers. Sax responded that the depth of the planters was increased. The planters are five feet wide by two feet deep. No one in the audience spoke in favor or in opposition to the request. Chairman Davis said that the Special Use as requested will protect the health safety and welfare of the public as stated on page E of the file, and the method of operation will be as stated in the plans on pages 9 and 9-a of the petition file. The petitioner has committed to operate this area under essentially the same rules as those used for the other outdoor dining areas we have approved. He will also be providing more complete design documents for the railing/planter structure that will surround the outdoor dining area. There was no public testimony in support or in opposition to this proposal. The Plan Commission by a vote of 5 to 0 passed a motion recommending approval of the proposed outdoor area at Clubhouse International. The berm does not have an adverse impact upon drainage issues. Member Mueller questioned, if approving this request would be precedent setting. Chairman Aktipis noted that it did not . The petitioner had testified that it was an oversight and to force the homeowner a tremendous expense to dig up the berm when there have been no complaints, it is aesthetically pleasing and the work was encouraged by Midwest Club Architectural Review Committee. Member Goel noted that they have met the standards to allow for the recommendation of approval of the requested variance. It was not intentional, it does not cause any drainage problems, it is not detrimental to the public health and is not injurious to other neighboring properties. Member Goel moved, seconded by Member Tappin, to recommend for approval the petitioners request for variation to the berm location as requested. He said that they have followed the guidelines of previous outdoor dining requests. The plan has been reviewed and approved by Chuck Fleming of the Oakbrook Center. Member Tappin questioned the anchoring of the planters to the concrete and was also assured that the planter would be weighted with sand. Hawk noted that the planters will be attached to the railing system. Olsen said that it is a combination planter/rail system. Hawk requested that Clubhouse International provided detailed plans showing the anchoring details prior to the Zoning Board of Appeals meeting. He also said that in the past there has been concerns raised by the Board of Trustees that the planters should also be looked at as a potential barrier. No one in the audience spoke in support or in opposition to the request. Member Tappin moved, seconded by Member Girgis, to recommend for approval the Special Use - Outdoor Dining as requested by the Petitioner. Clubhouse International is located along the southeast perimeter of the Center in the area southwest of Neiman Marcus. The proposal is similar in nature and scope to the previously approved "Outdoor Dining Area" for Maggiano's and Papagus Restaurants. The list of conditions submitted by the petitioner (see Page E of this file) is based on the conditions developed for the previously approved Outdoor Dining Special Uses. This category of Special Use was established in 1993 and the Village has approved five restaurants for its use - Maggiano's, Zarrosta's - J. Alexander's - Stir Crazy and Papagus. We have not had any problems with these outdoor dining areas. If it is your wish to recommend approval of this request, please include in your motion the conditions to be imposed and your findings with respect to the Special Use Standards in the Zoning Ordinance (see page 2b of this file). Special uses shall be authorized or denied by the Village Board in accordance with the Statutes of the State of Illinois applicable to amendments of this ordinance, and the regulations and conditions set forth in this ordinance for special uses. No application for a special use shall be acted upon by the Village Board until after: (a) A written report is prepared and forwarded to the Board of Appeals and the Village Board by the Plan Commission in a manner prescribed herein for amendments to this ordinance; and (b) A public hearing has been held by the Zoning Board of Appeals, after due notice by publication as provided by the applicable Statutes of the State of Illinois for amendments and upon a report of the Plan Commission to the Board of Trustees, if such a report is made. (3) Initiation: An application for a special use may be made by any person, firm or corporation or by any office, department, board, bureau or commission requesting or intended to request a zoning certificate. (4) Processing: An application for a special use, in such form and accompanied by such information as shall be established from time to time by the Plan Commission, shall be filed with the Village Clerk and thereafter processed in the manner prescribed thereto- fore for applications and amendments. THE PLANS ATTACHED, BY OLSEN & ASSOCIATES, SK 0113.01 & .02, SHOW THE PROPOSED SEATING PLAN WHICH WE WISH TO USE AS FOLLOWS: 1 . THE DINING AREA MAY BE SET UP BETWEEN APRIL 1 AND APRIL 15 AND MAY BE REMOVED BETWEEN OCTOBER 1 AND OCTOBER 15 EACH YEAR. 2. NO MORE THAN 40 SEATS WILL BE PROVIDED. 3. THE BARRIER SYSTEM WILL BE OF CUSTOM MADE COPPER AND IRON PLANTER BOXES THAT WILL BE SIMILAR IN DESIGN TO OUR INTERIOR METAL WORK AND RAILINGS. THEY WILL MEET OR EXCEED THE BARRICADE STANDARDS APPROVED BY VILLAGE ORDINANCE. 4. THE EMERGENCY EGRESS GATE SHALL OPEN OUT ONLY AND BE 3 FEET WIDE. 5. NO SIGNAGE OR BANNERS WILL BE PLACED IN THE OUTDOOR DINING AREA. 6. IN OCTOBER, ALL EQUIPMENT, INCLUDING THE RAILING, WILL BE REMOVED, AND THE SIDEWALK AREA WILL BE RESTORED TO ORIGINAL CONDITION INCLUDING PATCHING OR PLUGGING ANY HOLES. 7. THE RESTAURANT WILL BE RESPONSIBLE FOR MAINTAINING AND CLEANING THE OUTDOOR AREA AND SHALL COMPLY WITH ALL APPLICABLE REQUIREMENTS OF THE DUPAGE COUNTY HEALTH DEPARTMENT. 8. A MINIMUM SIX FOOT WIDE SIDEWALK ADJACENT TO THE OUTDOOR DINING AREA WILL BE MAINTAINED AT ALL TIMES. 9. THERE WILL BE NO LIVE MUSIC, DANCING OR OTHER ENTERTAINMENT IN THIS AREA. 10.
