S-919 - 12/08/1998 - ZONING-SPECIAL USE - Ordinances ORDINANCE 98-ZO-SU-S-919 AN ORDINANCE AMENDING ORDINANCE S-729 AND GRANTING AN AMENDED SPECIAL USE PERMIT (Christ Church of Oak Brook, 501 Oak Brook Road, Oak Brook, IL 60523) WHEREAS, Christ Church has applied to the Village for a special use amendment to Ordinance S-729, which approved a special use for the property hereinafter described for construction of a church sanctuary and steeple; and WHEREAS, the Plan Commission on October 19, 1998, recommended approval of the requested amendments to the special use; and WHEREAS, a public hearing thereon was conducted by the Zoning Board of Appeals of the Village of Oak Brook on November 3, 1998, pursuant to due and appropriate legal notice; and WHEREAS, a recommendation has been made by both the said Zoning Board of Appeals and Plan Commission that the amendment to special use be granted; and WHEREAS, the President and Board of Trustees concur with the recommendations of the Zoning Board of Appeals and Plan Commission and deem the passage of this ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook, subject to the conditions set forth below; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That the special use granted pursuant to Ordinance S-729 is hereby further amended to include the property at 3212 York Road, said property to act as a temporary office. Section 3: That the amendment to the special use to allow the use of the existing building on the 3212 York Road property as a temporary office is expressly limited to a period of five (5)years or until substantial completion of a planned addition to the existing church building, whichever occurs first. Section 4: That use of the volleyball courts is limited to no later than 10:00 p.m. Section 5: That all volleyball court lighting shall be installed in such a manner as to avoid light spillage onto neighboring properties. Section 6: That this ordinance is limited to property located at 501 Oak Brook Road, 3202 and 3212 York Road, Oak Brook, Illinois, which property is legally described as: Lot 1 in the Christ Church Resubdivision of part of the Northwest Quarter of Section 36, Township 39 North, Range 11, East of the Third Principal Meridian, in DuPage County, Illinois, recorded on the 9th day of September, 1986 as Document No. R86-107588. and Ordinance 98-ZO-SU-S-919 Amending S-729, Granting an Amended Special Use Permit, Christ Church, 505 Oak Brook Road, Page 2 Plat of Survey of Lot"B" (except the North 250 feet thereof measured along the East line) according to the survey of part of the West half of Section 36, Township 39 North, Range 11, East of the Third Principal Meridian, recorded November 16, 1897 as Document 65421 in DuPage County, Illinois. Permanent Parcel Nos. 06-36-107-002, 06-36-107-001 and 06-36-100-004. Section 7: That except as amended hereby, the special use granted pursuant to Ordinances S- 237, S-346, S-382, S-511, S-583 and S-729 be and the same is hereby ratified and confirmed in all respects. Section 8: That this ordinance shall be in full force and effect from and after passage and approval pursuant to law. PASSED THIS 8th day of December, 1998.
