AN ORDINANCE VACATING SURREY DRIVE
AND CERTAIN EASEMENTS
IN THE VILLAGE OF OAK BROOK, DU PAGE COUNTY, ILLINOIS
WHEREAS, application has been made by David and Daniel Callaghan, developers of the
Forest Gate Subdivision, to the Village of Oak Brook for the vacation of Surrey Drive; and
WHEREAS, pursuant to notice, a hearing was held before the Village Board on March 9,
1999 on this application; and
WHEREAS, the Village Board finds:
1) That Surrey Drive was dedicated to the Village of Oak Brook upon the
recordation of the Plat of Subdivision of the Oak Brook Village Green
Subdivision in 1971;
2) That on September 22, 1998 the Village Board approved an amended Preliminary
Plat know as Forest Gate which included the land originally dedicated for Surrey
Drive;
3) That Surrey Drive improvements have never been installed or maintained;
4) That as shown on the original Village Green Plat of Subdivision, Surrey Drive is
located about 800 feet west of Jorie Boulevard and runs in a general north/south
direction between Forest Gate Road and Oak Brook Road;
5) That no cost has been incurred by the Village as a result of the Surrey Drive
dedication;
6) That the developers, the Callaghans, have offered to convey Lot 82 in the Forest
Gate Subdivision to the Village at no cost upon the filing of the Final Plat of that
Subdivision; and
7) That Lot 82 is adjacent to the Village owned parcel in the northwest corner of 318`
Street and Jorie Boulevard and provides the only access to this parcel off of 318`
Street;
8) That vacating Surrey Drive will relieve the Village of installing and maintaining this
street; and

9) That no replacement costs will be incurred by the Village, as the Forest Gate
Subdivision will be serviced by a private road system, initially paid for by the
developer and maintained by the Homeowner's Association, with easements to the
Village for storm water, emergency service and water service;
10) That the developer owns the property on both sides of Surrey Drive;
11) That given the above findings, it is in the best interest of the Village that Surrey
Drive and certain easements set forth on the attached Plat of Vacation be vacated
at no monetary cost to the adjoining landowners(the developers), provided that
the developers convey Lot 82 to the Village within 30 days of the date of
recordation of the Final Plat of the Forest Gate Subdivision; and
WHEREAS, the President and Board of Trustees of the Village of Oak Brook find that
the nature and extent of the public use and public interest to be served is such as to warrant the
vacation of Surrey Drive and certain easements;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES,
ILLINOIS, as follows:
Section 1: That Surrey Drive in the Village of Oak Brook, as described on the Plat of
Vacation thereof, attached hereto labelled Exhibit"A' and hereby made a part hereof, be and the
same is hereby vacated. Surrey Drive hereby vacated is legally described as:
That part of the Southwest Quarter of Section 26, Township 39 North, Range 11
East of the Third Principal Meridian, designated as Surrey Drive on the Plat of
Subdivision of Oak Brook Village Green Subdivision, being a subdivision of part
of said Southwest Quarter, according to the plat thereof recorded August 30, 1971
as Document No. R71-43495 in DuPage County, IL.
Section 2: That the easements marked"Hereby Vacated" on the Plat of Vacation
(attached as Exhibit A) are hereby vacated.
Section 3: That this ordinance shall be in full force and effect from and after its passage
and approval according to law.
Section 4: That the Village Clerk is hereby authorized and directed to file with the
Recorder of Deeds of DuPage County a certified copy of this ordinance, together with the Plat of
Vacation, attached hereto, labelled Exhibit"A" and incorporated herein.
