Pursuant to your direction. I have drafted the following: Ij

(1) An Ordinance Amending The Zoning Map Of The Village Of Oak Brook wherein the northerly parcel of
3824 York Road is rezoned from R-3 to B-1 Please mote that the southerly parcel at this address is
already zoned B-3. I draw your at"-ntnon to the third and fourth'WHEREAS"clauses regarding the
Circuit Court and the Appellate Court's characterization of tha northerly parcel.
(2) Ordinance Approving Development Plan And Authorizing Issuance Of Certificate Of
Appropriateness,subject to the conditions set forth in Section 3,including the January 31, 1999
(Rocca`s purchase of the property)and December 31 2000(substantial completion of the
Improvements)sunset dates.
(3) An Ordinance Granting A Special Use For A Drive-in Banking Facility,subject to the conditions set
forth in Section 3,including the January 31,1999 and December 31,2000 sunset dates.
(4) An Ordinance Granting A Flood Plain Special Use Permit Pursuant To Section 10-34 Of The Code Of
Ordinances Of The Village Of Oak Brook,subject to the conditions set forth in Section 3,including the
January 31, 1999 and December 31,2000 sunset dates.
(5) An Ordinance Granting Variations From The Provisions Of The Zoning Ordinance Relative To Yards,
Ground Signs, Fences And Loading Berths,subject to the conditions set forth in Section 3,including
both sunset dates.

the Circuit Court and the Appellate Court's characterization of the i
northerly parcel which read as follows: �
"WHEREAS, in 1972 in a case entitled Cities Service Oil Company
v. Village of Oak Brook, 71-1443-G, the Circuit Court found that
with respect to the northerly parcel,"the zoning of the Village of Oak
Brook for residential use is not compatible with the character of the
neighborhood and existing uses therein,and has no tendency to
promote the health,safety,morals,convenience and general welfare
of the citizens of the Village of Oat:Brook,"and further found that I'
the"general character of the neighborhood is business", and
WHEREAS,the Circuit Court's decision was affirmed in Cities
Service Oil Company V. Village of Oak Brook 15 I1I.App. 3d 424,
304 N.E.2d 460(2"d Dist_, 1973),wherein the Appellate Court found
that with respect to the northerly parcel the existing uses of the area
were basically commercial with considerable public use for forest
preserve purposes, including the historic Oraue Mill site,and with
comparatively few residential uses and went on to state: "The area
cannot be characterized as solidly residential,but rather is developing
commercial;and any damage to the property of the surrounding area
has already been done by existing commercial use," 15 II1.A_pp. 3d at
430; and„
