to the Safety Pathway Committee, as the signed papers for this SAFETY PATHWAY
appointment were not received by the deadline for the printing of the COMMITTEE
agenda. Mr. Ronald Cullum, Trinity Lakes, has served on the Oak
Brook Civic Association Board and is a senior managing partner with
Arthur Anderson Consulting.
Motion by Trustee Kenny, seconded by Trustee Savino, to concur
with the recommendation of President Bushy and appoint Ronald li
Cullum to a three-year term to the Oak Brook Safety Pathway I'
Committee (southwest quadrant); term to expire June 30, 2001.

The ordinance adopting the 1999 Budget includes a revenue exhibit, BUDGET FOR 1999
an expenditure exhibit, and a fund summary. The figures are as
presented in the proposed budget document reviewed by the Board at
the Budget Workshop on December 5, 1998.
President Bushy noted that the Village provides free police service to
the Oak Brook Park District, and if a time comes where our police
officers have difficulty completing all of their duties with this
additional burden, this service could be withdrawn by the Village.
The Park District, under Illinois State Statute, has the right to tax the
residents for their own police department.
Motion by Trustee McInerney, seconded by Trustee Kenny, to pass

ORDINANCE S-729
AN ORDINANCE AMENDING ORDINANCE S-583
AND GRANTING AN AMENDED SPECIAL USE PERMIT
(CHRIST CHURCH - 501 OAK BROOK ROAD)
WHEREAS, on August 10, 1971 the corporate authorities of the Village of
Oak Brook passed Ordinance S-237, which approved a special use for the
property hereinafter described for construction of a church sanctuary and
steeple; and
WHEREAS, on October 28, 1975 and October 25, 1983, the corporate
authorities of the Village of Oak Brook passed Ordinances S-346 and S-511,
respectively, which amended the aforementioned special use by permitting
additional parking; and
WHEREAS, on April 22, 1986, the corporate authorities of the Village of
Oak Brook passed Ordinance S-583, granting a special use to permit the
construction of two additions to the church, 136 additional parking space and
various roadway and grading modifications; and
WHEREAS, the owners of said property have applied to the Village for an
amendment to said special use to permit construction of a choir rehearsal room
and additional classrooms; and
WHEREAS, the Plan Commission on January 20, 1992, recommended approval
of the requested amendments to the special use; and
WHEREAS, a public hearing thereon was conducted by the Zoning Board of
Appeals of the Village of Oak Brook on February 4, 1992, pursuant to due and
appropriate legal notice; and
WHEREAS, a recommendation has been made by both the said Zoning Board of
Appeals and Plan Commission that the amendment to special use be granted; and
WHEREAS, the President and Board of Trustees concur with the
recommendations of the Zoning Board of Appeals and Plan Commission and deem
the passage of this ordinance to be in the best interest and in furtherance of
the general welfare of the Village of Oak Brook, subject to the conditions set
forth below;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That the special use granted pursuant to Ordinances S-237,
S-346, S-511 and S-583 be and are hereby further amended to permit the
construction of a choir rehearsal room and additional classrooms to the
church.

Section 3: That the amendment to the special use permit herein granted
pursuant to Section 2 of this ordinance is expressly subject to the condition
that said additions be done in substantial conformity with the site plan dated
December 16, 1991 as drawn by Ware Associates, incorporated herein by
reference. If the property owner fails to meet the conditions of this
section, this special use permit shall automatically terminate and be of no
further force and effect.
Section 4: That this ordinance is limited to property located at 501
Oak Brook Road and 3202 York Road, Oak Brook, Illinois, which property is
legally described as:
The North 660 feet of the East 880 feet of the
Northwest Quarter of Section 36, Township 39 North,
Range 11, East of the Third Principal Meridian, in
DuPage County, Illinois. Permanent Parcel No. 06-36-
107-002.
Section 5: That except as amended hereby, the special use granted
pursuant to Ordinances S-237, S-346, S-511 and S-583 be and the same is hereby
ratified and confirmed in all respects.
Section 6: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.

Bushy in the Samuel E. Dean Board Room of the Village Commons at 7:32 p.m.

President Bushy announced the first issue of the Village newsletter was
received by residents and thanked Assistant to Village Manager Long, Executive
Secretary Margaret Rimbo and Staff for their fine presentation.
President Bushy announced on April 12th a fundraiser is being held at Drury Lane
to benefit the Center for Abused Children. This facility is under the guidance of
the DuPage County Government. President Bushy stated normally we do not announce
charity events, but this facility is used by the Oak Brook Police Department and
the Village contributes to the Center.
No one spoke for Open Forum.

Trustee Payovich requested Village Engineer Durfey to clarify the removal
of the west side guard rail. Village Engineer Durfey stated he met with the
State and the removal of the guard rail was due to the railing not meeting
present standards. The revised standards state the slope of the ground is
safer than the guard rail. Trustee Payovich requested a motion from the
floor, as she felt the removal of the railing was a hazard to residents and
would vote against the proposed transfer.

Trustee Krafthefer moved that the Oak Brook Park District, a governmental
unit, be rebated the utility tax charge retroactive to its passage.
Motion failed due to lack of a second.
Trustee Shumate moved to direct the Village Attorney to confer with the
Oak Brook Park District Attorney on the legality of a rebate to the Park
District or legality of the concept of a monetary gift. Seconded by

V. ROOD DUDEK FLOOD PLAIN .AL USE _ 15 YORKSHIRE WOODS _ PUBLIC HEARI�' T
Mr. Bernie Dudek and Dr. William Bauer were sworn in and made a presentation regarding the proposal to
flood protect this home and part of the adjacent property. The following points were covered:
a) The flooding experience of the property.
b) The concrete wall and earth berm design.
c) A portion of the front yard is protected to allow vehicular access.
d) Compensatory storage is provided at a 1 to 1 ratio.
e) The IDOT/DWR permit has been issued.
f) The proposed Elmhurst quarry will lower flood elevations; however, the petitioner does not want to rely
on this since it may never be built and in any case this flood proofing system will provide additional
protection.
g) The factors relating to Flood Plain Special Use were reviewed. All findings were positive.
The Plan Commission recommended approval with waiver of full compensatory storage requirments at their
meeting of January 20, 1992. Compensatory storage at a 1 to 1 ratio is now included in the revised plan.
Dale Durfey reported that most of his concerns were minor design details or housekeeping items except for
the following:
a) The revised compensatory storage plan still has to be analyzed.
b) The flood proofing protects considerably more property than just the home.
There was no comment from the public.

a) Final engineering approval by "engineering.
b) Permits from any other required regulatory agencies be obtained.

A presentation describing the proposed plans was made.
Director of Code Enforcement, Tom Hawk, reported that the request is in accordance with the requirements of
the Zoning Ordinance and consistent with the Special Use standards.

VII. OAK BROOK EARLY WARNING SIREN SYSTEM _ PUBLIC HEARING
The proposal was presented by Director of Code Enforcement, Tom Hawk, and Assistant E.S.D.A. Coordinator,
Mark Fleishman, and cover the following:
1) The siren system will consist of four pole mounted rotating directional sirens.
2) The four Locations were selected based on engineering specifications to attain coverage of the entire
community.
3) The signal activation procedures.
4) The principal use will be for storm warning however, the system can be adapted for other types of
warnings.

5) The necessary text amendments, variations, and Special uses that the petition proposes.
6) Examiniation of the standards and findings pertaining to the Variation and Special Use requirements of
the ordinance.
7) The Plan Commission recommended approval at their January 20, 1992 meeting.

The Zoning Board of Appeals at their meeting of February 4 , 1992 ,
has made recommendations as follows:
Cladek Variation - 408 Luthin Road
The Cladek ' s are undertaking a major renovation to their home.
In order to do this as planned, they have requested variations as
follows:
For the room addition. at the northeast corner;
a side yard variation to permit a side yard of 15 feet
instead of the required 18 feet.
For the garage third car addition:
a) a side yard variation to permit a side yard of 10 feet
instead of the required 18 feet
b) a front yard variation to permit the eave to encroach
2 feet into the 40 feet required front yard
This property is legal non-conforming as follows:
a) the -lot is 132 feet wide where the R-2 minimum is 150 feet
b) the east side yard where the encroachments are proposed
is presently 15 feet
After reviewing the proposal at length, examining several alter-
natives, and analyzing the unique circumstances and hardships of
this proposal, the Zoning Board of Appeals voted by a margin of 5
to 0 to recommend approval of this request as described above.
McDonald ' s L Oak Brook Park District Flood Plain Special Use

McDonald' s, with the cooperation of the oak Brook Park District,
has petitioned for a Flood Plain Special Use to allow for recon-
figuration of the flood plain on this property.

The reconfiguration is in conformity with the previously approved
site development plan.
The proposal was found to be in compliance with the Village
Codes . Engineer Durfey has approved the plans and there are no
outside regulatory agency permits required.
The Zoning Board of Appeals, by a vote of 6 to 0 , recommends
approval of this request.
Rood (Dudek) Flood Plain Special Use - 15 Yorkshire Woods
The petitioner has requested a Flood Plain Special Use to allow
for flood protection of the home and part of the front yard.
This property has suffered severe damage due to flooding.
The flood protection will be accomplished by a combination of a
concrete wall and an earthen berm. By flood proofing part of the
front yard, vehicular access to the home will be maintained even
during storm events .
Compensatory sorage at a ratio of 1 to 1 is provided, however the
engineering details have not been approved by Engineer Durfey.
IDOT-DWR has issued the required permit for the proposed work.
The Zoning Board of Appeals , by a vote of 6 to 0 , recommends
approval of this request subject to the following conditions:
a) all other outside regulatory agency permits to be obtained
b final approval of the engineering by the Village engineer

Village of Oak Brook Early Warning Siren System
This petition was presented on behalf of the Village by Director
of Code Enforcement, Tom Hawk, and Assistant E. S . D.A. Coordina-
tor, Mark Fleishman. The request covers the following:
1) Text amendment to establish a siren warning system as a
governmental Special Use activity.
2) The necessary variation pertaining to structure height and
the performance standards regarding noise levels.
3) The Special Use status needed for each of the four proposed
locations.

Engineer Durfey went over his memo of January 14, 1992. Most of the problems listed are design details
which Mr. Bauer indicated could be resolved. The one serious deficiency was the compensatory storage. The
plans submitted do not show any compensatory storage. Mr. Bauer indicated he would supply revised plans.
It was stated that even with the potential protection provided by the proposed Elmhurst quarry project, the
petitioner still wanted to pursue this proposal.
A general discussion ensued and several questions by neighbors were answered.
Mr. Bauer went over the 11 factors of Section 10-34c of the regulations and responded positively to all of
them.
There was no testimony by the public in opposition to this proposal.

any proposed amendment in accordance with applica-
ble Illinois Statutes, or may refer it back to the Boards
for further consideration.
(5) Re-Applications: Any person, firm, or corporation
having been denied an amendment to the Zoning
Ordinance respecting a specific parcel of property may
not re-apply for a like amendment on said real
property until the period of one (1) year has elapsed
since the denial of the application for amendment by
the President and Board of Trustees. (Ord. No. G-137,

O Special Uses.
(1) Purpose: The development and execution of the zoning
ordinance is based upon the division of the Village
into districts, within any one of which the use of land
and buildings and the bulk and location of buildings i
or structures, as related to the land, are essentially
uniform. It is recognized, however, that there are
special uses which, because of their unique character,
cannot be properly permitted in particular districts
without consideration, in each case, of the impact of
those uses upon neighboring lands and upon public
need for the particular use or the particular location.
Such special uses fall into two categories:
(a) Uses operated by public agency or publicly-regu-
lated utilities, or uses traditionally affected with a

public interest.
(b) Uses entirely private in character, but of such a
nature that the operation may give rise to unique
problems with respect to their impact upon
neighboring property or public facilities such as,
but not limited to, single-family attached and
semi-detached dwellings, horizontal condomini-
ums and other residential developments. (Ord. No.

Sec. XIII OAK BROOK CODE
(2) Authority: Special uses shall be authorized or denied
by the Village Board in accordance with the Statutes
of the State of Illinois applicable to amendments of
this ordinance, and the regulations and conditions set
forth in this ordinance for special uses.
No application for a special use shall be acted upon by
the Village Board until after:
(a) A written report is prepared and forwarded to the
Board of Appeals and the Village Board by the
Plan Commission in a manner prescribed herein
for amendments to this ordinance; and
(b) A public hearing has been held by the Zoning
Board of Appeals, after due notice by publication
as provided by the applicable Statutes of the State
of Illinois for amendments and upon a report of
the Plan Commission to the Board of Trustees, if
such a report is made.
(3) Initiation: An application for a special use may be
made by any person, firm or corporation or by any
office, department, board, bureau or commission
requesting or intended to request a zoning certificate.
(4) Processing. An application for a special use, in such
form and accompanied by such information as shall
be established from time to time by the Plan
Commission, shall be filed with the Village Clerk and
thereafter processed in the manner prescribed thereto-
fore for applications and amendments. Special use
applications may be processed simultaneously with
requests for amendment of this ordinance. (Ord. No.
6-66, 12-19-66)
(5) Decisions: The Village Board, upon report of the
Zoning Board of Appeals and the Plan Commission,
and without further hearing, may authorize or deny
an application for a special use in accordance with the
Statutes of the State of Illinois applicable to amend-
ments, or may refer it back to the Board of Appeals
and the Plan Commission for further consideration.

No special use shall be authorized by the Village
Board unless the special use:
(a) Is of the type described in Section XIII J-1 (a) is
deemed necessary for the public convenience at
that location. (Ord. No. G-66, 12-19-66);
(b) Is so designed, located and proposed to be
operated that the public health, safety and welfare
will be protected; and
(c) Would not cause substantial injury to the value of
other property in the neighborhood in which it is
located.
(6) Conditions: The Plan Commission and Zoning Board
of Appeals may recommend, and the Village Board
may provide, such conditions and restrictions upon
the construction, location and operation of a special
use, including, but not limited to, provisions for
off-street parking and loading as may be deemed
necessary to promote the general objectives of this
ordinance and to minimize the injury to the value of
the property in the neighborhood.
(K) Fees.
Fees for any relief under this ordinance shall be as
otherwise established by separate ordinance. (Ord. No.
G-132, 5-25-71; Ord. No. G-289, § 2, 3-24-$1)
(L) Violation, Penalty and Enforcement.
(1) Any person, firm or corporation who violates,
disobeys, omits, neglects, refuses to comply with or
i who resists enforcement of any of the provisions of
this ordinance shall, upon conviction, be fined not less
than $25.00 nor more than $500.00 for each offense.
Each day that a violation is permitted to exist shall
constitute a separate offense.
(2) The Building Inspector is hereby designated and
authorized to enforce this ordinance. However, it shall
also be the duty of all officers, citizens and employees
of the Village, particularly of all members of the police

We are processing the following petitions:
1. James L. Rood (Dudek) , 15 Yorkshire Woods petition for Flood Plain
Special Use to allow construction of a flood protection system
consisting of a concrete wall and berm.
2. Christ Church of Oak Brook, 501 Oak Brook Road, petition to amend
their Special Use to allow construction of a choir rehearsal room
and additional classroom facilities. Christ Church is requesting
waiver of petition fees and permit fees. A copy of their request
and the Ordinances pertaining to such requests are attached.
Historically, the Board has waived petition, application fees and
building permit fees for Christ Church.
Please refer all three of these requests to the Plan Commission meeting of

Christ Church of Oak Brook' began its ministry at the Paul
U Butler School in 1965. In 1969 construction began on a
i� first unit of a long-range plan, consisting of 29,230 square
feet of area on six acres of land on the southwest corner of
York Road and Thirty-first Street. At that time a Special
Use Permit was granted by the Village of Oak Brook.
To meet ever-growing needs of the ministry to the community,
subsequent increments of the long-range plan were
implemented. Each time, the Special Use Permit was amended
}� and current code, zoning, parking, and landscape conditions
met. These were as follows:
1970 Fellowship unit, 16,000 S.F. ; two acres
of land added.
1975 Education, office, and narthex, 27,200
S.F. ; automatic fire protection system
added; increased parking; four acres of
land added.
1984 Canopy added.
1986 Fellowship Hall, youth lounge, and
27,200 S.F. educational areas increased;
site increased by six acres, bringing
total to 18 acres. At the request of
the Village, the land was replatted into
a single parcel. On-site parking was
increased to accommodate 943 cars. This

Storm water retention was increased to
meet the current needs, plus future
additions to the building and parking
lot area.
Once again, Christ Church of Oak Brook is responding to the
needs of the church and is requesting an amendment to the
Special Use Permit to permit the construction of a below.,
grade choir rehearsal room, consisting of 5,031 S.F. and an
8,389 S.F. addition to the classroom facility. The total
increase in area is 13,420 S.F. The increase in ground area
is 4,195 S.F.

As requested by Mr. C. Edward Ware, Ware Associates, I am submitting
O the following church procedures for controlling traffic on Sunday
morning and special occasions.
Every Sunday morning we have 3 services, at 8, 9:30 and 11 :15, which
last for 1 hour each. We engage 4 policemen from the DuPage County
U Sheriff's Department coordinated by Lt. David Leeburg. Their hours
are:
2 men from 9:45 to 11 :15 A.M.
2 men from 10:30 A.M. to 12:45 P.M.
Since our largest services are 9:30 and 11 :15, our heaviest concentration
of traffic is between 10:30 and 11 :15. Therefore we have 4 men on duty
at that time.
+� Their duties are:
1 man directing traffic on York Road at our east entrance.
L1 man directing traffic at our crosswalk at the southwest.
corner of the canopy.
2 men directing traffic on 31st Street at our 31st Street
entrance.
Since wi.dening 31st Street to 4 lanes we found we need 2 men to
provide safety of exit.
Special services such as Easter, Thanksgiving and Christmas Eve we have
additional men on duty and provide flares to ensure maximum safety.
I am very strict with parking and organizing the duties of the policemen
and we have excellent cooperation from the DuPage County Sheriff's Dept.
