NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1: The recitals above are hereby incorporated into and made a part of this ordinance. Section 2: The Petitioner is hereby granted a special use for the development of additional youth soccer fields and related improvements at 1315 and 1425 Kensington Road, Oak Brook, Illinois, subject to the following conditions: 1. The development shall be in substantial conformance with the plans as submitted and revised. 2. The amended conditions of the special use to include the following: a. The hours of operation are expanded to allow the soccer fields to be used Monday through Friday from 10:00 a.m. to 8:30 p.m., Saturday from 8: 00 a.m. to 8:30 p.m. and on Sunday from 8:00 a.m. to 7:00 p.m. b. The locations of the soccer fields shall be revised in accordance with Page V of the case file (as prepared by Hussey Architects Ltd., Hinsdale, Illinois dated July 10, 2007. Five (5) additional properly shielded light standards shall be installed in conformance with the Village Code and applicable standards. All existing and proposed lights shall be properly shielded, not to exceed .5-foot candles and are to have an automatic shut off installed to comply with the approved hours of operation. d. The construction of a shelter/garage shall be in substantial conformance with the plans submitted and to comply with all Village Building Codes and permit requirements. e. The addition of a drinking fountain shall comply with all Village Codes. f. The Petitioner is authorized to construct a wood rebound wall. g. The Petitioner is authorized to construct a five-foot (5') by six-foot (6') ground sign to be located near the corner of Kensington and Jorie Boulevard. Flowers and landscaping are to be added around the sign. h. The Petitioner is authorized to construct a second gravel parking lot located on the west side of the property approximately 75 feet by 300 feet with a 50-foot driveway, subject to the approval of the requested variations and stormwater management permit. i. The Petitioner shall use its best efforts to improve the landscaping with funds that are available. 3. Final engineering approval. 4. All other provisions of Special Use Ordinance S-1050 are to remain in full force and effect. Kallien, Jr., AICP, Community Development Director /Vtlo� BUDGET SOURCE/BUDGET IMPACT: N/A RECOMMENDED MOTIONS: I move to concur with the recommendation from the Zoning Board of Appeals and approve the requested variations necessary to construct a second gravel parking lot on the property located at 1315 and 1425 Kensington Road subject to the following conditions: 1. The Hawks Soccer Club will comply with all Village requirements for storm water management; 2. The Village Trustees concur with the placement of the new parking lot on the unimproved Village right of way that is located west of the Kensington Road cul-de- sac; and 3. In the event that the Village needs access to its right-of-way, the Hawks Soccer Club will not hinder access under any circumstances; and Authorize the Village Attorney to prepare the necessary ordinance for final consideration at the December 11, 2007 Board of Trustees meeting. Backeround/History: At the September 25, 2007 meeting, the Village Board concurred with the petitioners request to continue the final action on its variation requests in order to reconcile issues relative to stormwater management. In particular, the petitioner is seeking approval of the following variations to the Zoning Ordinance: 1. Section 13-12-4A to permit a new gravel parking lot instead of the required a hard surface parking lot. 2. Section 13-12-3C to eliminate the requirement to depict parking lot stall dimensions. Subsequently, the Master Plan submitted and approved with Ordinance 2007-ZO- SU-S-1211 dated October 9,2007 included as requested by Dale's item#2.b.shown as page V depicted the proposed parking lot on the V'.illagc Right of Way. The Ordinance's#2.h.authorized us to construct the lot subject to the approval of the requested variations and storm water management permit. We ask for this lot to be reconsidered at this time. This lot will actually improve this area of the property and it has been Putted by vehicles and has stone already visible on the proposed parking area. Detention for the property will be created by construction of detention areas as shown by the attached drawings prepared by ERA Consultants and submitted for review on 11/7/07 electronically. These plans have been approved by McDonald's Corp. The approximate dimensions of parking lot would be 300' East to West by 75' North to South,with a 50' drive way. These dimensions would make the lot approximately 23,000 sq ft. Based on a 10' wide stall, this would allow for approximately 60 autos. Estimated completion date summer 2008.Under Special Use factors,we are requesting variances for Zoning Ordinance and rational for the request: a. 13-124A Hard Surface Parking lots. b. 13-12-3C Parking lot stall dimensions. c. 13-12-4B,C,&D Parking lot landscaping and screening d. 13-124G Curbing of access drives and parking lots e. 13-124H Parking lot stripping The Hawks ask for these parking lot variances to promote player safety by avoiding player drop off and pick up on Kensington and further reduce our use of adjacent parking lots,. The lot will be built similar in nature to our current gravel parking lot located on Kensington. To date there have been no complaints about our existing Kensington parking lot from its appearance to retention. As a not for profit,to build a parking lot in accordance with current ordinances would cost approximately$15 per square foot or in excess of$300,000 and cost prohibitive to the club. Additionally,by building it as"soft parking" in the form of crushed limestone and unmarked spaces would keep the lot"easily removable"and temporary in nature and assist natural drainage. As our license agreement with Mc.Donald's in on a rolling two basis to build a permanent lot would not make economic sense and with out the variances the would be unable to complete this project. We intend to relocate approximately 4"of top soil and use such soil to help build detention areas. We will place gravel as the surface of-the parking lot and compress stone to approximately 6"deep. Grass Bio Swales will be used for the detention areas. As a not for profit,the Hawks respectfully ask that"all"fees for permits or plan review be waived or reduced to help Jeep the cost of this project as low as possible and allow us to improve the facility for the benefit of children in our community. As part of this special use request,the petitioner is seeking approval to: 1. Expand hours of operation. The County representatives confirmed my interpretation that, once a development exceeds 25,000 square feet on the development site, stormwater detention is required per the Ordinance. They also confirmed that, even though the McDonald's Subdivision site consists of two lots, the development is considered one parcel for development and the 25,000 square feet governs for the entire 34 acre site. The County representatives stated that this site did not seem unique in relation to other areas in the County such as golf courses, park districts, and forest preserve areas. Those other sites throughout the County have provided detention when they developed. Duke Tomei, President Hawks Soccer Club said that in August of 2003, Hawks Soccer Club was granted a special use permit. At that time, the Hawks had approximately 300 players and as of this coming fall they will have approximately 600 players. It is a not-for-profit Soccer Club; this is their 10th anniversary. Ninety percent of the players of the Hawks Soccer Club are from the communities, consisting of Oak Brook, Hinsdale, Clarendon Hills and surrounding communities. They are not a recruiting club they are community based. They are a not-for-profit 5016 corporation that is run by the parents of the club. They are on a two-year rolling license agreement with McDonald's. After the discussions this year, they sat down with McDonald's and thought it important to clarify and come to a long-term vision of what they would like to do with the property and to confirm that they are in good standing with the Village and the agreement that the Club had grown out of 1. Hours of Operation: In 2005, on Saturday mornings, they started loaning soccer fields on Saturday mornings to AYSO American Youth Soccer Organization, which is not a traveling club, but a community soccer organization that is an extension of the Park District, which ran out of soccer fields. They allowed them to use the fields at no charge to keep more kids playing in the community. In addition, they have had some tournaments and fund raising events and wanted to put their hours of use in compliance. In 2003, the original special use allowed them to use the fields on Saturday morning from 10:00 a.m. to 8:00 p.m. On Saturday, AYSO starts using the fields on Saturday at 8:30 a.m. and are off by noon. This is the reason for the request to modify their hours to accommodate them and tournament events to start earlier on Saturday and Sunday. 2. Number of Fields in Use: The property is approximately 34 acres and its circumference is 1.1 miles. During the last 4 years, they raised enough funds to build out 14 soccer fields. Due to the topography they have had to be shifted because they could not move the dirt, all they did was to fix the potholes. When they prepare a field,they set out the goals and then clear out all the rocks to make it safe for the kids. The original special use called for seven(7) soccer fields. VILLAGE OF OAK BROOK Zoning Board of Appeals Minutes Page 2 of 21 September 4, 2007 �S. 3. Field Lights In August of 2006, for security reasons, they added lights around the parking lot. In the fall months, when the time changes it starts getting dark at 4:30, so in October/November when the kids are there it is a safe environment. When they built the lights last year, it illuminated the grassy area on the outer ring of the parking lot. The work was done with the appropriate permits. They are seeking to locate five additional light poles on the east of the lot, which is farther away for the residences opposite Route 83. The lights would be properly shielded in accordance with the building codes. The furthest they would illuminate to the west is 1100 feet from Route 83. Due to the size of the property there is a lot of darkness and the lights will allow the kids to keep playing a little later due to the time change in the fall. 4. Shelter/Garage It would be an approximate 1200-foot slab, but under roof would be less than 1000 feet. In the winter, they would pack up the equipment for storage and in the summer months, it would be empty so that if there are storms they could bring the children in under shelter. The current plan is to go to the Post Office or the Park District. It would be a one-story frame structure that would look like a garage. They have worked with the Building and Fire Departments and have amended their plans to put in exit signs and skylights, so that if a storm came in they could get the kids under shelter. 5. Drinking Fountain In 2005, water was brought into the facility to run a sprinkler system. They would like to work with the village to approve a drinking fountain and would be subject to Village plumbing codes, so that the kids would have potable water at the fields. 6. Rebound Wall In the middle of the property they would construct a wooden rebound wall to allow the kids to use as a training tool. It would be approximately 7 feet high and 18 feet long. 7. Sign on Corner of Kensington and Jorie It would be similar in nature with the one at the property entrance. It would be a two-way wood sign, that would appear to look like the Park District sign to help people recognize and locate the field when they drive by. 8. West Side Gravel Parking Lot This would be located immediately west of the Kensington cul de sac that would allow for west side parking. They do not allow the kids to be dropped off or picked up on Kensington, they would be able to pull into the parking lot, instead of walking across the street. The parking lot would allow for approximately 60 parking spaces and would be in similar nature to what they have on the existing parking lot. They will exceed the 25,000 square foot limitations and they are going to try to work with the County VILLAGE OF OAK BROOK Zoning Board of Appeals Minutes Page 3 of 21 September 4, 2007 ��4 • • for a special exception, based upon the size of the property. With the parking lot and the building, they would be using less than 3% of the footprint of the entire property. There would be 1/8 of a mile between the current parking lot and the proposed lot. 9. At the Plan Commission meeting, one of the Commissioners asked that the red garbage cans be changed and painted green. They would prefer not to do that because it would incur a cost to the club. If it is the request of the Village, they would do it. Ace Hardware would replace all of the cans if they wait until the price drops $4.00 a can in October for a total cost of approximately$1200 to replace them. They would not paint them,because it would look messier and not as professional. They do like the red cans,because people notice them and put the trash where it belongs. 10. They will also work to improve some of the landscaping by the front entrance and around the proposed sign. 11.No Parking Signs They ask people not to park along Kensington as a safety rule and there are only about 2-3 standing no parking signs, and would be prepared to pay for the signs and would like to put them on all of the posts so that parents would see them on every light post. Chairman Davis questioned the Plan Commissions determination. Mr. Tomei responded that they approved all items subject to engineering approval and complying with all Village Building Codes and Ordinances. They have had several meetings with the Village and the most difficult is the parking lot and the waivers being sought for paving, curbs, and landscape. Their intention is to keep it very clean,but as a park-like setting. Chairman Davis questioned the stormwater management issues. Village Engineer Durfey responded that they have scheduled a meeting with the County to discuss interpretations of the Code, which relates to the need for stormwater detention. Under one interpretation, if they do anything they are required to provide detention for the entire area. Another interpretation is that they would not be required to provide detention when they provide additional parking and the shelter. Mr. Tomei said that they would like to move forward subject to the engineering approval of the stormwater requirements. The Village Board could vote and they would not have to go to the County. Their argument is that the property is so huge that maybe a normal commercial development of 3-5 acres would have a 25,000 square foot limitation, but on 34 acres, they are using less than 3 VILLAGE OF OAK BROOK Zoning Board of Appeals Minutes Page 4 of 21 September 4, 2007 • percent of the footprint. They are trying to do what is acceptable to the Village to follow up with the County specifically. They are seeking approval subject to Engineering approval. Member Krietsch said that if subject to engineering approval, the permits could not be issued,without engineering approval. Director of Community Development Kallien said that the major issue is reconciling the stormwater management because that would allow the west side parking lot and the shelter. If the issues cannot be reconciled, the Hawks Soccer would not be allowed to put in the parking or the shelter without providing the detention. The variations then become moot, because they would not be allowed to do that. Technically the garage could be placed upon the existing parking lot. Village Engineer Durfey said that the original application the calculation was only based upon the one parking lot and did not exceed the 25,000 square foot threshold for detention. Member Young asked if any kind of traffic study had been undertaken. Mr. Tomei responded that since most of their games are held on Saturday and the majority on Sunday, when the businesses are closed and to date there is no traffic or parking issues in the area. They try to start their programs when the businesses are closed. On Sunday, they have the Oak Brook Police on the field to make sure that the kids are kept safe and they have been told that it goes very smoothly, even better than at the Sports Core because everything is closed when they are there. Member Young questioned how the lighting will be controlled. Mr. Tomei said that the box itself is locked and the device is hardwired into the system controlling the number of hours that it can operate. Someone would have to reset the system and it was set that way to ensure that the lights would not be left on. Currently it is set so that the system shuts itself off at 8:30 p.m. Member Nimry questioned the proposed sign details. Mr. Tomei responded that the sign would be a two-sided 5x6 foot 2-sided sign similar in nature to the Park District sign. Director of Community Development Kallien said that the property is in the VILLAGE OF OAK BROOK Zoning Board of Appeals Minutes Page 5 of 21 September 4, 2007 ORA-1 District, is very large and fronts on two streets. The sign that they are proposing request is not out of character for the size of the property, which would be a 30 square foot sign at the corner. They would ensure that it would not violate the height or lighting codes along with landscape around it. If approval is granted, they are still required to comply with all permit requirements and codes. Chairman Davis said that the no parking sign request is not part of the special use,but is something being requested of the Village. Mr. Tomei said that they do not want people parking there, or picking up and dropping off the kids on Kensington. If the kids are dropped off across the street,there is a clear view for them. Special Use Standards 1. Is of the type described in subsection Al of this Section, is deemed necessary for the public convenience at that location. RESPONSE: The Hawks Soccer Club is a not-for-profit organization for children usually aged 8 to 19. The organization has grown since its original special approval was granted in 2003. They intend to keep a need and tidy soccer field for the use of the children. 2. Is so designed, located and proposed to be operated that the public health, safety and welfare will be protected; RESPONSE: Over the past four years they have shown themselves to be very capable to run a clean, tidy and safe operation. The actual property has been well maintained and gives the appearance of an extension of the Oak Brook Park District. It shows an active support for the children of the community. 3. Would not cause substantial injury to the value of other property in the neighborhood in which it is located. RESPONSE: They are surrounded by businesses on 2 sides, Route 83 to the west and the Park District is to the south. Compared to the vacant land that was there before them, they are very proud that it has turned into a very nice facility. Better than most park district and public parks. They keep it clean, watered, and mowed. Chairman Davis noted that all of the improvements could be removed. Mr. Tomei said that if McDonald's decided not to renew their license, there VILLAGE OF OAK BROOK Zoning Board of Appeals Minutes Page 6 of 21 September 4, 2007 would be light poles and a wood frame garage, and a gravel parking lot would be left. Chairman Davis noted that the Plan Commission recommended unanimous approval, subject to several conditions. He noted that one of the recommendations was to paint the garbage cans green. Mr. Tomei responded that the existing garbage cans are very nice red, weighted and strapped, and if blown over the garbage does not escape. They prefer not to change them, but would do so if required by the Village. If so, he would like additional time. Ace Hardware had already given them 100 cans and they have an additional 30 left in storage. Chairman Davis said that he did not feel strongly about the color of the cans. Member Nimry commented that he believed the red cans would be safer around the children than the green cans would be,because they can see them. No one spoke in opposition to the request. Chairman Davis said that the standards were provided by the applicant on page E of the case file. With the exception of the condition to paint the garbage cans green the Zoning Board agreed with the Plan Commissions recommended conditions for special use approval. They are requesting that they be permitted to install a gravel parking lot rather than an asphalt parking lot due to several factors. If asphalt they would be required to curb it, which would create more detention issues. It would be cost prohibitive to the club; one estimate was for $300,000. Normally, they are out of the area by 8:30 and some of the issues do not apply. They are requesting relief to including the asphalt surface, curbing, landscaping, screening and striping. The property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations governing the district in which it is located. RESPONSE: They op erate under a two-year license agreement.eement. Not knowing how long they will be there as a not-for-profit would be cost prohibitive to build it. 1.b. The plight of the owner is due to unique circumstances. RESPONSE: They are not the owner they are a 5016 not-for-profit organization with use of the fields and the cost would be prohibitive and impossible for them to do. 1. c. The variation, if granted, will not alter the essential character of the locality. RESPONSE: It will be similar to the one that currently exists and the property would be maintained as it has been now. Member Young questioned whether any other conditions should be attached to this request. Village Engineer Durfey responded there were not. In regards to the detention issue, if the County determines that detention is required, they will need to either build the required detention or seek a variation to that portion of the Village Code. The Zoning Board of Appeals acts as the Oversight Committee would review the application and make a recommendation to the Village Board. Notices are sent out to every municipality along Salt Creek and in DuPage County for their comments before the Zoning Board of Appeals hear it. They are going to the County for their interpretation and for them to determine if the detention would be required. Mr. Tomei noted that if detention were required, the engineering studies alone would make it cost prohibitive. Mr. Tomei requested that if the County denies it,he would like the action to go forward to the other communities. Village Engineer Durfey responded that a normal variation to Title 9 starts from the beginning. Chairman Davis clarified that if the County denies it, the parking lot could not be built because they would not comply with other sections of the Village Code. They are looking to expand that presence and are trying to market more and to get their name out into the market place. Part of the marketing they believe would be in more prominent signage. When they came to the village to ask for that it was determined that they needed to have a permissible use for their location. They want to be in compliance with the village and they are also seeking approval to raise their sign. Chairman Davis clarified that the past use was in compliance because it was primarily an office use for the headquarters with limited personal service use. Director of Community Development Kallien said that within the two office towers, there are a number of financial advisors that operate there, such as Fidelity Investments. In 2003, the Hawks Soccer Club and McDonald's worked out an agreement that the Autumn Oaks property located at Kensington and Jorie Blvd could be used as a soccer field with related improvements on a temporary basis. The soccer program has been very successful and Hawks made a request to McDonald's to modify their plan. They agreed and now they are seeking approval to amend their existing special use for the property. Duke Tomei, President Hawks Soccer Club said that in August of 2003, Hawks Soccer Club was granted a special use permit. The lease agreement with McDonald's is a two-year rolling agreement. In 2003 they had approximately 300 players and as of this coming fall they will have approximately 600 players. Ninety percent of the players of the Hawks Soccer Club are from the communities, consisting of Oak Brook, Hinsdale, Clarendon Hills and surrounding communities. They are a not-for-profit 5016 corporation that is run by the parents of the club. Over the last few months as they have expanded, they sat down with McDonald's and thought it important to clarify and come to a long-term vision of what they would like to do with the property and to confirm that they are in good standing with the Village. 1. Hours of Operation: In 2005, they started loaning soccer fields on Saturday mornings to AYSO American Youth Soccer Organization, which is not a traveling club, but a community soccer that is like the park district. On Saturday mornings, they allowed them to use the fields at no charge to keep more kids playing in the community. In 2003, the original special use allowed them to use the fields on Saturday morning from 10:00 a.m. to 8:00 p.m. On Saturday, AYSO starts using the fields on Saturday at 8:30 a.m. and are off by noon. This is the reason for the request to modify their hours to accommodate them and tournament events. The kids are there from April to June/July and then come back in the fall from Labor Day until November. They may have summer camps,but would be during the day. 2. Number of Fields in Use: They put seven fields into use and there currently are 14 fields being used. The original special use talked about Lot 1 and Lot 2, but at the time, they only had enough funds to get 7 fields into operation. Over the last 4 years, they have now built out 14 game fields that talk about the west side of fields closer to Route 83. They had to switch fields a bit due to the topography. Field Lights In August of 2006, for security reasons, they added lights around the parking lot. In the fall months, when the time changes it starts getting dark at 4:30, so in October/November when the kids are there it is a safe environment. When they built the lights last year, it illuminated the grassy area on the outer ring of the parking lot. The entire area is 34 acres, and the outer circumference of the property is 1.1 miles. 4. Drinking Fountain In 2005, they brought in water to run a sprinkler system. They would work with the village to approve a drinking fountain, subject to Village plumbing codes, so that the kids would have potable water at the fields. 5. Rebound Wall It would be a wood wall for the kids to use as a training tool. 6. Sign on Corner of Kensington and Jorie It would help identify the site when people drive by to locate the field. 7. Shelter/Garage In the summer months, it would be empty so that if there are storms they could bring the children in. In the winter, they would pack up the equipment for storage. The shelter would be over an approximate 1200-foot slab. The shelter would be less than a 1000 foot, one-story frame structure that would look like a garage. They worked with the Fire Department and exit signs would be installed for safety. If a storm came in they could get the kids under shelter. 8. West Side Gravel Parking Lot This would be located immediately west of the Kensington cul de sac that would allow for west side parking. The kids are not allowed to be dropped off or picked up on Kensington. They would be able to pull into the new parking lot, instead of the kids walking across the street. The parking lot would allow for approximately 60 parking spaces and would be in similar nature to what they have on the existing lot. The construction of the parking lot requires requests for variations, because it is a gravel parking lot versus a permanent asphalt parking lot. The license agreement is renewable every 2 years so they try to look at economical sense as to what they are going to make an investment in. They are a not-for-profit organization so they try their best to keep their fees as low as possible. To build the west side parking lot and meeting all the building requirements would be cost prohibitive and they would not be able to do it. The club is run by the parents and when they build out a soccer field costs about $4,000-5,000 in equipment and another $4,000-5,000 to make the grounds safe; so each field runs about $10,000 to just open. They have estimates to do the west side parking lot correctly and it is about $300,000, so they could not do it. 9. No Parking Signs They ask people not to park along Kensington as a safety rule and there are only about 2-3 standing no parking signs, and would be prepared to pay for the signs and would like to put them on all of the posts so that parents would see them on every light post. VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 3 of 13 August 20, 2007 William Lindeman, resident of Oak Brook, said that the activity and usage has increased over the years. His question is to McDonald's who has made these activities possible. The land is taxed and assessed as open space,which means that a large parcel of property incurs less taxes than he pays on his home. He is also disappointed that McDonald's ignores the aesthetics of such a large parcel of property. All the property in use by their business is top class. Their campus along Jorie, the medians along Jorie, their facility along 22°a Street are above what a village would expect to see. Driving past the property on Kensington, he saw that it has basically been ignored by McDonald's. It puzzled him how the village is able to condone an unpaved parking lot and condone the lack of any kind of landscaping. He does not believe that a single tree has been planted on the property while it has been under the ownership of McDonald's. McDonald's acquired that property from the Park District and conditioned that the property be rezoned to permit a multi-story office building development. It was approved and as a result, the value of the property increased tremendously. The assessed value is approximately 30 million dollars. To allow it to exist in its present condition, given the development across the street and the aesthetics of the properties across the street he did not think it was fair for the Village or McDonald's to continue to not make an effort to improve the appearance. It looks like an amateur operation, which it probably is, because it is a not-for-profit organization doing the best that it can. He could appreciate the current 600 kids that make use of it,but thinks at this time,with the Village spending money to improve the appearance of 31St Street, 22 d Street, Jorie Blvd., now is the time for the Village to reassess its attitude towards these types of operations. The Sports Core facilities are being used and they have adequate paved parking and is better maintained landscape. Now is the time for the Village to reconsider what it should expect from a corporate citizen, such as McDonald's as far as maintenance on a 30- acre parcel of property. Mr. Tomei responded that as part of their license agreement the Hawks maintains the facility. Their annual field budget is $60,000. They have fertilizer on the grounds at least 6 times per year; at $2,000 apiece. With the exception of this week (due to rain), it is mowed weekly. Unlike the Sports Core, they have 60+ garbage cans on the ground, so with the exception of the wind, they have less trash than the Sports Core. They work very diligently at manicuring the land, because it affects their appearance and that of McDonald's. It is being maintained to the fullest extent and he believes that over the last 4 years there has been a dramatic improvement from the field grass that existed before. They continue to keep it up and have put flowers and have landscaped around the sign that was put up on the main entrance. Over the last year, McDonald's improved and put up a wood barrier around the parking lot that is very nice and adds clean lines. There have been quite a bit of improvements to the land including the sprinkler system, so they can water the fields as needed. In the pre-August 2003, we were in a drought and it would just dry up and nothing would be done to it; it was kept raw. Now, it is as good as any park district facility for soccer around and they are proud of that. Many families they know have kids who love the game and the Hawks is making the difference between the kids being involved in athletics or not involved. There were a couple of other local teams that were turned into regional teams, so a lot of the kids that really want to be involved in sports are not given the opportunity anymore. The Hawks are affording many children the opportunity to do so (from grammar school through high school). They are an excellent organization. They have been involved in other soccer clubs, but the Hawks are the local team for Oak Brook and the surrounding community. It is an excellent opportunity for Oak Brook to show its generosity and allowing the Hawks to use the field for soccer. He would encourage everyone to do anything as a Village to help the children of the area. Member Sharma said that she was a little concerned about the garbage cans that are spread out over the field. Aesthetically they do not look that great. They are all red in color and there are so many, which are spread out every few feet. They are nothing like the ones that the Park District has, which are green and blend in with the landscape. She asked if anything could be done about them. Mr. Tomei responded that on every field and every mid-field there are at least 2 garbage cans because they did not want anyone to go very far without a garbage can, so they have been strategically situated. Ace Hardware donated the cans for the Hawks use. If the Village would require that they change them, they would do everything that they could to accommodate it. However, the nice thing about them, is that they are all weighted, strapped, so that if they blow over in a storm, there is not garbage everywhere. Since they are bright red, people see them at put the trash in. The tough part is that they did not want to blend them in. They wanted it to be dominant so that people would use them; which is why there are so many strategically placed. They do not want the kids to walk too far, to where there is a garbage can. Chairwoman Payovich asked when the season closed. Mr. Tomei responded that there are two seasons. The spring season games are from April and usually end in mid-June. They go into summer and have some summer camps during the day. Fall season begins just after Labor Day and ends in mid- November. They can trade games and try to move them up so that the kids do not have to play in November. The littlest kids are usually out of there by November 1" By the end of November, they pack up all the equipment and garbage cans and are out. For about 5 months, the site is completely vacant. Mr. Tomei responded that they have addressed all of the Engineers issues to the best of their ability, with the exception of the interpretation of the parcel. The land is 34 acres. In the current codes, there is a 25,000 square foot limitation of any development. A development could be a parking lot or a building. They have scheduled a meeting with the County to discuss building the west side parking lot because its construction would put them over the 25,000 square foot threshold. The Village's Board could vote and they would not have to go to the County. Their argument is that the property is so huge that maybe a normal commercial development of 3-5 acres would have a 25,000 square foot limitation, but on 34 acres, they are using less than 3 percent of the footprint. They are trying to do what is acceptable to the Village to follow up with the County specifically. They are seeking approval subject to Engineering approval. Member Iyer questioned Village Engineer Durfey. Village Engineer Durfey said that in his memorandum there is nothing major, except for the possible detention problem, which will be discussed with the County on September 5, 2007. Member Lalmalani asked what happens with their agreement with McDonald's in 2 years. Mr. Tomei responded that they meet with McDonald's every two years, approximately 6 months in advance of the lease expiration to review any open items. There is a notice clause that allows them to renew the lease for another 2 years, which was just renewed in August. They are very happy and appreciative that McDonald's lets the Hawks use the land and are not comfortable in a contract that was longer than 2 years. Director of Community Development Kallien said that the major issue is reconciling the stormwater management because that would allow the west side parking lot and the shelter. The rest of the items, really are enhancements to what had been previously approved. The Zoning Board of Appeals is the Oversight Committee and they are going to the Zoning Board because they need to seek variations to requirements related to the parking lot. Village Engineer Durfey said that in the past the Plan Commission has typically conditionally approved things. He would not encourage the Village to override the County approval on the stormwater issues and that the requirements would have to be met. He did think that Mr. Lindeman raised a good point about beautification of the area. He appreciated the fact that it is a temporary arrangement and the organization has limited funds. He would not want to make it mandatory for anyone to spend a lot of money on this site, but maybe the garbage cans could be painted green and would look a lot better than the red. It would be nice if additional flowers could be planted around the sign especially at the corner area. Signs are always an emotional subject in the Village, so anything that could be done to beautify it and make it as nice as possible. He certainly would not want McDonald's to spend a lot of money on vegetation for this site, especially since they don't know what they are going to do with it. Perhaps some trees could be planted along Jorie or Kensington with the thought that later, as they mature, they would add to the value of the property. It may or may not be practical and would not demand that McDonald's spend a lot of money on the site. Anything that could be done to beautify the site would help. Perhaps the Village as part of its beautification could look at it. Director of Community Development Kallien said that it could be a point that the Beautification Committee could discuss because there are a number of areas they would like to target and this could be one. Member Sharma said that she although 5 additional lights were requested, they were all for the east side parking lot and raised concerns over the lack of lighting over the proposed west side parking lot. Mr. Tomei responded that it is a good point, but that the west side parking lot is meant to alleviate congestion during the day. If it starts getting used a lot in the fall, they may have to add lighting. They want to keep their trash and facilities all in the middle, because then it could be managed. If it is far on the west side, it can get away from them a little more. Member Sharma said that she was concerned for the safety of the kids using the lot because it is quite a distance from the east parking lot, especially since the number of kids is doubling. Mr. Tomei said that where the lights are, covers 1,000 feet of ground to the west, and to the east where the lights will cover 400 feet. When it is dark, they will not be out there anyway. They will actually move the kids to the middle where the light is because they will not be able to illuminate the fields. They compress to the middle, so that when it is dark, they are less likely to go that far west. They would probably have to come back and raise the money for the west side. So far, they have not needed it. Four nights a week, they go to Veck in Hinsdale, which is lit. They have made an arrangement and are working through to use the baseball diamonds over at VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 7 of 13 August 20, 2007 the Park District for the kids to play. The new light posts will more than solve the problem today,but of they grow to 700-800 kids then they will need to come back to the Village. Director of Community Development Kallien said that if there is additional lighting contemplated they would require .5 candlelight at the property line, they would have to be shielded and would require an automatic shut off. Mr. Tomei said that the existing system is hardwired, so that they already shut off automatically. The current lights are only 25 feet high, and may reduce it to 20 feet. Unlike the Park District lights that are 40-50 feet, these are closer to the ground and with property glare protection, and when they shut off, they have to be manually turned back on. They are off the fields by 8:00-8:30. It is a club, these are their kids, and they want them out of there and home before 9:00. Mr. Tomei asked that the Plan Commission to allow them to keep going to work on improvements by the end of the season and they will be working on the stormwater. Village Engineer Durfey noted that nothing depends upon the County. Oak Brook is a full waiver community and issues its own permits. They are meeting with the County to get a proper interpretation of Code so that the Village does not do something wrong, so that they would remove the full waiver status. Motion by Member Lalmalani, seconded by Member Iyer that the applicant has addressed and satisfied the requirements for a special use to recommend approval of the requested site improvements as requested subject to the following conditions: 1. The development shall be in substantial conformance with the plans as submitted and revised. 2. The amended conditions of the special use to include the following: a. Expand the hours of operation to allow the soccer fields to be used Monday through Friday from 10:00 a.m. to 8:30 p.m., Saturday from 8:00 a.m. to 8:30 p.m., and on Sunday from 8:00 a.m. to 7:00 p.m. b. Addition of five properly shielded light standards to conform to village standards at time of building permit and provide details with respect to illumination and glare. We concluded our meeting agreeing to meet with DuPage County staff to review this unique development and interpretation of the stormwater code issues. This kind of project is a first in Oak Brook and maybe the County has some experience elsewhere that can shed light on how to interpret the code. This morning I called and set up a meeting for 9:00 a.m. Tuesday, September 5, 2007. i Regarding the additional documentation, I note the following: 1. The documents make several references to the gravel parking lot as being porous and allowing for natural drainage. That is incorrect. The existing gravel parking lot has become extremely hard and is not much different from an asphalt or concrete parking lot. As an example, if one were to take a wood stake and hammer, one could pound the stake into the grass (a porous surface) adjacent to the parking lot. The pounding of the wooden stake into the compacted gravel parking lot would be much more difficult if it could be done at all. 2. The area of the fields and parking is treated as one development parcel. Regarding the detention issue, the code states that improvements shall be counted cumulatively. Again, this will be reviewed with the County when we meet. 3. The permanent or temporary nature of the garage/shelter and the lighting system would be a Community Development decision, not an Engineering one. Section 13-124A requires an all weather hard surface pavement in accordance with the Village of Oak Brook Public Works Construction Standards. B. Section 13-124B requires screening and landscaping in front yard, side yard, and rear yard areas adjacent to parking areas. C. Section 13-12-4D requires a complete detailed landscaping plan. D. Section 13-124H requires that parking spaces be delineated by a single white or yellow line. It appears that they do not need a Zoning Ordinance Variation for Sections 13-12-3C nor 13-12-4C. 5. A Stormwater Management Permit will be required since the development involves filling with stone of more than 16 cubic yards and the development disturbs more than 2,500 square feet of ground cover. It must be prepared, signed, and sealed by a professional engineer. 6. It is my understanding that no dirt would be moved and the ground elevations would remain as they are regarding the proposed soccer fields and their layout. 7. There is a question as to whether the proposed parking area will have the gravel placed on the grass or have the topsoil removed. Mr. Tomei will check on this. The existing parking area did remove topsoil and create a berm to the west. 8. Exhibit 6, the shelter/garage, does not have a foundation or footings. This would be regulated by Community Development. Since complete site plan drawings were not submitted, there may be other issues that will surface when a building permit is applied for and a full and complete review is accomplished. If any submitted drawings are used as exhibits to ordinances, a note should be added within the ordinance to the effect that: Notwithstanding the attached exhibits, the applicant shall meet all Village Ordinance requirements at the time of building permit application except as specifically varied or waived. With the new parking area, it is over the 25,000 square foot threshold; therefore, detention is required for both the existing and new parking areas and the shelter/garage (even without the new parking area, the shelter/garage, at 1,200 square feet, would also put it over the threshold) and any other area of development as defined within Title 9. 3. On the"Proposed Master Plan 2007", we note the following: A. It should be revised to depict the lot lines (easily drawn with the subdivision plat that was attached). The current plan is unclear that all improvements are not on Village right-of-way. B. The new parking area states 9' parking stalls while the narrative says 10'. 4. There is floodplain on the property. The existing subdivision plat that was attached depicts the floodplain easement. 5. As I understand it, the original concept was to install non-permanent soccer facilities on the McDonald's property. The marked soccer field and the gravel parking lot basically accomplish that. However, the existing street light system is permanent in that it has permanent concrete bases with underground conduit. This is counter to the stated 3`d Special Use Factor (the concrete bases are not easily disassembled). The proposed shelter/garage is also a building and is more permanent and not easily disassembled. 6. Section 13-12-3.0 states that non-office parking spaces shall be 9 feet by 18 feet. If the Village approves of a gravel parking area, the stated 10' wide spaces is appropriate (9 foot wide gravel non-striped parking stalls probably would not work). If the Village approves of the new gravel parking area, the following Code sections will need a variation: A. Section 13-124A requires an all weather hard surface pavement in accordance with the Village of Oak Brook Public Works Construction Standards. B. Section 13-12-413 requires screening and landscaping in front yard, side yard, and rear yard areas adjacent to parking areas. C. Section 13-12-41) requires a complete detailed landscaping plan. D. Section 13-12-4G requires continuous permanent concrete curbing adjacent to all driveway, loading and parking pavements associated with non-residential uses. E. Section 13-12-4H requires that parking spaces be delineated by a single white or yellow line. 8. A Stormwater Management Permit will be required since the development involves filling with stone of more than 16 cubic yards and the development disturbs more than 2,500 square feet of ground cover. It must be prepared, signed, and sealed by a professional engineer. 9. It is my understanding that no dirt would be moved and the ground elevations would remain as they are regarding the proposed soccer fields and their layout. 10. Exhibit 6, the shelter/garage, does not have a foundation or footings. The major item is that detention will be required for both the existing parking area (and mound of earth that was moved to the west of the parking area), the new parking area, the shelter/garage, and any other area of development. Since complete site plan drawings were not submitted, there may be other issues that will surface when a building permit is applied for and a full and complete review is accomplished. B. Screening And Landscaping: The following landscaped and planted areas shall be provided and maintained for all parking areas: 1. Front Yards: Permanent screening at least four feet (4') high shall be installed in front yard areas adjacent to parking areas. This screening may consist of a planted earth berm, densely planted shrubs or trees, or a combination of both. 2. Side And Rear Yards: Permanent peripheral screening at least five feet(5) high shall be installed in side and rear yards adjacent to parking areas. This screening may consist of a planted earth berm, densely planted shrubs or trees, or a combination of both. In side and rear yards, the screening shall be so located and constructed as not to interfere or conflict with the use of any utility easements or utility installations existing or planned to be installed in these easement areas. C. Interior Parking Lot Landscaping: Landscaped areas shall occupy not less than ten percent (10%) of the total lot area excluding: 1. The building footprint or footprint of other structures, 2. All required front yard or street setback areas, and 3. Any required landscape areas along rear lot lines. In parking areas which are wider than one bay of double parking, interior shade trees shall be planted with a maximum spacing of forty feet (40'), provided that at least one tree is located in the area occupied by every fifteen (15) interior parking spaces. Landscaped dividers with a minimum width of six feet (6) shall be provided between every three (3) parking bays. Individual permanent planter areas (minimum size of 8 feet 6 inches by 17 feet) are required for interior trees with a minimum caliper of three inches (3"), which shall be of a variety which do not drop a messy fruit (see village of Oak Brook public works construction standards for list of appropriate trees). A Copy of this permit is marked Exhibit 1. At the time the permit was issued,the Hawks had approximately 300 players participating. For the fall 2007 season the Hawks will now have nearly 600 players participating. We wish to amend the permit to show these existing lights and request that we be allowed to add five more 25' light poles with a 2' base on the east side of the property. Starting with a single travel soccer team in the fall of 1997,the Hawks have expanded to a to over forty boys and girls teams for the 2007-2008 seasons. As a result,there are approximately 600 players and their families currently involved with the Hawks Soccer Club. Welcoming children from all communities, 90% of our players come from Oak Brook,Burr Ridge, Clarendon Hills,Hinsdale, and Westmont. Hawks Soccer Club, Inc. is an Illinois not-for-profit,IRS designated 501c (3)charity created for the purpose of encouraging and supporting the expansion of soccer opportunities for girls and boys in the West Suburban area. With the recent take over of other soccer clubs in town by a Libertyville based for- profit company; the Hawks remain the only non for profit travel soccer club remaining in the community. In September 2003,the Hawks were granted a license in Oak Brook, Illinois from McDonald's Corporation to develop 34 acres of raw land into soccer fields for the children. Starting with seven soccer fields,the club currently has fourteen game fields in operation. Since 2005, the Hawks have provided to American Youth Soccer Organization(AYSO), at no charge, game fields for use on many Saturdays to promote the game through out our community. The Hawks are extremely grateful for the generosity of the McDonald's Corporation and for those individuals who have developed the many projects that are the result of their support. The Hawks Soccer Club philosophy is to focus on the individual child and the development of that child as both a skilled soccer player and a good team player.While competing in a strong league soccer program and striving to win, we also want to create positive life-long attitudes and values among our team players.The Board encourages our players to get involved with the community and their school teams. Because the club is guided by the parents,the Hawks have a unique ability to look out for the interests of our competitive players as well as provide top athletes with opportunities to compete at high levels. This reaffirms our message that all of our players are important! Hawk teams are coached by parents for the Competitive level teams and by professional trainers for our Highly Competitive and College Prep teams. All Hawk players receive the benefits of weekly instruction from qualified professional trainers. All of our coaches and trainers are certified/licensed by the United States Soccer Association(USSF) or the National Soccer Coaches Association of America(NSCAA). Currently one third of Hawks teams are playing in upper division leagues. The Hawk's Board is made up of Mostafa Edders who serves as Hawk's Director of Soccer Operations and twelve parent members. Edders, a former professional player,Moroccan National team member, and USSF"A"licensed coach,was named 2004 Girls Coach of the Year by Illinois Youth Soccer Association. In 2005 Mostafa also had the privilege of leading a group of U-16 Olympic Development players to the Regional and National Olympic Development Championship. The lot will be built similar in nature to our current gravel parking lot located on Kensington. To date there have been no complaints about our existing Kensington parking lot from its appearance to retention. As a not for profit,to build a parking lot in accordance with current ordinances would cost approximately$15 per square foot or in excess of$300,000 and cost prohibitive to the club. Additionally,by building it as"soft parking"in the form of crushed limestone and unmarked spaces would keep the lot"easily removable"and temporary in nature and allow for natural drainage. As our license agreement with McDonald's in on a rolling two basis to build a permanent lot does not make economic sense and with out the variances we would be unable to complete. The property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations governing the district in which it is located. RESPONSE: The property in question is being used for soccer fields under a two year licensing agreement. To build a parking lot in accordance with Oak Brook specifications would cost in excess of$300,000. Due to its cost and the temporary nature of our use agreement, such expenditure is not economically feasible. 1. b. The plight of the owner is due to unique circumstances. RESPONSE: The Hawks Soccer Club is a 501(c) 3 not for profit created for the benefit of children in the community and surrounding area. As a not for profit we are doing all we can to keep the club affordable for the children. The cost of a permanent lot would be unbearable to the club. 1. c. The variation, if granted, will not alter the essential character of the locality. RESPONSE: Changes to the landscaping by adding this parking lot would enhance the value of the surrounding property by approving its appearance. The development of the property would give the appearance of a greater park district facility due to its locations adjacent to the Oak Brook Park District Facilities. Given the scarcity of playing fields in the western suburbs of Chicago, the proposed master plan provides continued relief from the over use of park district facilities while providing for improved green space in Oak Brook. 2. a. The particular physical surroundings shape or topographical conditions of the specific property involved would bring a particular hardship upon the owner as distinguished from a mere inconvenience if the strict letter of the regulation were to be carried out. RESPONSE: The area where the west parking lot would be located is relatively flat and would not require an unreasonable amount of dirt to be displaced. Excess dirt would be transformed into a natural burin landscaped with mulch and or grass. a . 2. b. The condition upon which the petition for variation is based would not be applicable generally to the other property within the same zoning classification. RESPONSE: As the area is going to be used for soccer fields its use is unique and not generally applicable to other property within the same zoning classification. 2. c. The granting of the variation will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located.
