R-962 - 01/23/2007 - SUBDIVISION - ResolutionsRESOLUTION 2007- SD -PP -R -962 A RESOLUTION APPROVING THE PRELIMINARY PLAT FOR A FIVE -LOT SUBDIVISION FOR DEERPATH WOODS (Approximately 12 acres of vacant land located on the west side of Adams Road, south and east of Breakenridge Farm and north of Ogden Avenue, Oak Brook, Illinois 60523) PIN 06 -35- 405 -003 WHEREAS, the Village of Oak Brook has heretofore adopted an ordinance setting forth the Subdivision Regulations for the Village of Oak Brook in Title 14 of the Village Code (the "Subdivision Regulations "), and WHEREAS, Deerpath Woods, LLC, the owner of the proposed five (5) -lot Deerpath Woods Subdivision, which is a parcel of approximately 12 acres of vacant land located on the west side of Adams Road, south and east of Breakenridge Farm and north of Ogden Avenue, Oak Brook, Illinois 60523 (the "Subject Property'), has submitted a petition for approval of a preliminary plat of subdivision, and WHEREAS, the Subject Property is legally described as follows* THAT PART OF LOT 6 IN BREAKENRIDGE FARM UNIT 1, BEING A SUBDIVISION OF THAT PART OF THE SOUTHEAST QUARTER OF SECTION 35, TOWNSHIP 39 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED NOVEMBER 27, 1984 AS DOCUMENT NUMBER R84- 95116, LYING NORTH OF A LINE PARALLEL TO AND 390.0 FEET NORTH OF THE SOUTH LINE OF SAID LOT 6 IN DUPAGE COUNTY, ILLINOIS PIN 06 -35- 405 -003 and, WHEREAS, the Plan Commission of the Village of Oak Brook reviewed the proposed preliminary plat for the five (5) -lot Deerpath Woods Subdivision on the Subject Property at its meeting on November 21, 2006, and recommended approval of the such preliminary plat subject to certain conditions, and WHEREAS, the Village President and Board of Trustees have considered the recommendations and findings of the Plan Commission and concur with same NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows Section 1 That the Preliminary Plat of Subdivision known as the five (5) -lot Deerpath Woods Subdivision, prepared by Engineering Resource Associates, Inc, and last revised November 14, 2006, be and is hereby approved, subject to the following conditions. a Access to the subdivision will be from Adams Road to Deerpath Woods Court, which will be a private cul -de -sac designed to Village Standards, b Engineering approval is required for the road design, which includes the water and sewer lines and addresses the safety issues on Adams Road c The developer shall move the gate farther in from Adams Road so that it is not too obtrusive from the road d Engineering approval is required Resolution 2007- SD -PP -R -962 Approving Preliminary Plat Deerpath Woods Subdivision (west side of Adams Road, south and east of Breakenridge Farm and north of Ogden Avenue) PIN 06 -35- 405 -003 Page 2 of 2 Section 2 That all requirements, conditions and standards of the Subdivision Regulations shall be applicable to the subdivision and development of said Deerpath Woods Subdivision Section 3.
